"Nasar road construction project which is underway, and we are in the process of relocating all utility lines which is required in order to construct a new intersection, new traffic signals, and SO forth. One one part of the project, we advertise for each particular project. The law says you must accept the lowest responsible bidder. So, we got 4 bids to relocate the water line. And I will tell you what the bids were because - am making a ruling on the low bid. The bids were, $68,000, was the low bid. The other ones were $143,070, $149,960 dollars and $183,000. The bid that came in at $68,000, did not meet the requirements of the advertisement, which in and of itself is a basis to reject the bid. The original submission did not include a required bid bond, the original bid submission did not include a separate line item for the construction of a water authority access road. So those in and of themselves are failures to satisfy the requirements and a legal basis to disqualify the bidder, but nonetheless, spoke to the engineers, HRG is a consultant for this project, the engineer is Jim Green. About this bid, he said to me, Greg, have very serious concerns. I do not think it is a responsible bid. The project cannot be done at that price. And SO that leads him to believe we are going to run into problems, the guy is going to want change orders and SO forth and we need to keep this moving. I said to him, I'd like to have something in writing. just SO the commissioners can consider it, and we did discuss it, and he specifically says in his professional opinion that this lowest bid, we should consider rejecting it on the basis that it is not a responsible bid. Therefore, my job as a solicitor is to review this to determine this, and the law is clear that you have to award the lowest responsible bidder. So, am talking about the law and since we are all here, I can read you and I have research on this and did more research because there have been times in my career that we did not take the lowest bid. When this has been challenged, this is from a case, an appellate court case, says the the law provides that the municipal contracts must be awarded the lowest responsible bidder, but the courts have uniformly held that the question of who the lowest responsible bidder is one for the sound discretion of the proper municipal authority. This is the commissioners. It does not necessarily mean the one who is bid on its face is low as the dollars, but then it goes on to list numerous examples. So, our engineer has great concerns that this is not a responsible bid, that it cannot be done at that price. He anticipates problems and their other technical reasons why the bid could be rejected. So, I'm making a ruling on the record and I'm putting this on the record for all the public to hear that in my opinion, we have absolute legal basis to reject the bid because it didn't meet the technical requirements of the submission, number one and number two, we have professional basis and professional opinion that is not a responsible bid. Therefore, it can be rejected legally is my ruling and the commissioners are free to make an award to the next lowest bidder. So, I wanted to put that on the record, SO the public understands all this. Mr. President, which concludes my report." ROAD: Commissioner.
