CTY OF SARASOA City of Sarasota Board of Adjustment Minutes September 26, 2018 The following are the motion minutes of the Board of Adjustment meeting held on Wednesday, September 26, 2018. The meeting came to order at 1:30 p.m. Roll call was taken. PRESENT: Pandora Seibert, Vice Chair; and members Alan Freedman; Calvin Bryant; Herb Ruderman; and Gretchen M. Schneider, General Manager, Development Services; Angela M. McLeod Wilkins, Administrative Assistant, Development Services. ABSENT: Chair Paul Israelson LEGAL COUNSEL: Mike Connolly, Deputy City Attorney, City Attorney's Office. Mr. Connolly explained the quasi-judicial procedures. The minutes of the. August 29, 2018 meeting were approved as submitted. Ex-parte communications and site visits were announced. Reading oft the Pledge of Conduct. Everyone intending to speak was sworn in. Time Limits were announced. Variance Petition No. 2018-VAR-08: Willard F. Libby, owner, requesting a 6-inch variance from the minimum side yard setback of 6 feet along a proposed east property line in order to split the parcel into two lots. The existing single-family dwelling is setback 5.5 feet from the proposed property line. Address: 1210 Myrtle Street. Zoning Code: Section VI-203. Legal Description: Metes and bounds survey on file in the City's Development Services Department. Zone District: RSF-4 Residential Single Family. Willard F. Libby, owner, The public hearing was opened. Ms. Schneider gave an overview of the variance being requested. Willard Libby, owner, presented the variance being requested. The public hearing was closed. Mr. Bryant made a motion for approval and this was seconded by Mr. Ruderman. The vote was unanimous for approval. Variance Petition No. 2018-VAR-11: Colleen D. and Steven B. Shoemaker, owners, requesting a setback variance to construct a garage. The garage requires a front yard setback of 30 feet along Vista Lane and 14 feet 7 34 inches is proposed; therefore, a variance of 15 feet 4 % inches is requested. Address: 1313 Hillview Drive. Zoning Code: Section VI-203. Legal Description: Lot 175 Harbor Acres Section 2. Zone District: RSFE Residential Single Family Estate. Thomas Shumway, agent for owner. Mr. Connolly called on Robert Keesecker, as he completed a Request for Affected Person Status. Mr. Keesecker was not present and was therefore denied Affected Person Status. The public hearing was opened. Ms. Schneider gave an overview of the requested variance. Ms. Schneider stated that the Board of Adjustment has a policy of denying variance requests for garage setback on properties which once had a fully compliant garage, that was enclosed at the discretion of the property owner. Ms. Schneider noted that the Board of Adjustment has the authority to vote in favor of such a variance should the members see it fit and if the 5 criteria are met. Colleen Shoemaker, owner, and William Dooley presented the variance being requested and stated safety concerns, additional parking space, and property protection as the reasons for the request. The Board questioned the petitioner. Mr. Bryant inquired whether a garage could be constructed on a different space of the property. Mrs. Shoemaker indicated this is where they felt the garage should go SO they did not look elsewhere. Mr. Freedman asked about the placement of the garage on the property and asked for clarification regarding safety concerns noted by the petitioner. Ms. Shoemaker gave a rebuttal. The public hearing was closed. Mr. Freedman made a motion for denial and this was seconded by Mr. Bryant. The vote was unanimous for denial. Administrative Matters Ms. Schneider advised the Board that there may be an October meeting but it was not certain at this time.
