The subject property, approximately 1.2 acres in size, is currently occupied by a vacant Hooters restaurant and is situated within Paulding County. The proposed redevelopment includes the construction of a new 2,816-square-foot Whataburger restaurant, along with associated site improvements including a parking area and a dual-lane drive- thru. The eastern portion of the site features a significant slope descending toward an unnamed tributary of Powder Springs Creek, which ultimately flows into the Coosa River. The existing structure already encroaches into the 75-foot impervious surface buffer. Due to the site's topography, irregular trapezoidal shape, and the presence of four easements along the property boundaries, alternative site configurations were deemed infeasible. These constraints, combined with operational requirements such as accommodating 18-wheeler deliveries and a dual- lane drive-thru necessitate the requested buffer encroachment. The two-lane drive-thru has become standard in the quick service restaurant industry due to evolving consumer preferences in the post- Covid environment and provides additional queuing space for vehicles. This increase in drive-thru capacity ensures that customers can be served in a more efficient manner and limits the impact from queued vehicles to the traffic patterns within the site and surrounding access drives. The applicant seeks approval for a limited encroachment of 1,038 square feet into the 75-foot impervious surface buffer to accommodate the drive-thru. Additionally, the grading necessary for the redevelopment will result in the removal of ten existing trees, as detailed in Attachment C - Tree Removal List. No disturbance is proposed within the 25-foot state stream buffer or the 50-foot city no-disturbance buffer.
