Call to Order: The meeting was called to order by Chairman Peter McKay. Present were Commissioners Ernest Kuhlman, Scott Fetchenhier, County Attorney Dennis Golbricht and Administrator William Tookey. The meeting was held via Zoom video conferencing. Commissioner Fetchenhier moved to approve the minutes of. July 8, 2020 as submitted. Commissioner Kuhlman seconded the motion. The motion passed unanimous. Planning Director Lisa Adair was present to provide the Commissioners with her report. She informed the Commissioners that she had approved a Poker Run for August 14th - 16th. Public Health Director Becky Joyce, Emergency Manager Jim Donovan and Public Information Officer DeAnne Gallegos were present to provide the Commissioners with an update on the COVID 19 emergency. The Commissioners reviewed a draft written warning for violations to the public health order. Administrator Tookey and Health Director Joyce presented to the Commissioner a spreadsheet breaking down all of the Public Health Grants and which employees would be working on which grants. The COVID 19 Pandemic has placed a huge burden on public health but fortunately there is additional state and federal monies to off set the additional costs. The spreadsheet also reflected payroll increases to reflect the additional workload and demand. It was the consensus oft the Commissioners to approve the payroll increases as presented. Terry Morris was present to update the Commissioners on the CAG. The CAG is sending a letter to the EPA expressing their concerns that they should be involved earlier in the planning process. It was the consensus of the Commissioners to send a letter to the EPA expressing similar conçerns. There was also a consensus oft the Commissioners to send a letter to the BLM expressing concerns ofthe impact grazing sheep may have on remediated sites. The Commissioners discussed county roads. They instructed the County Administrator to notify the Road Department to place a barrier on CR 22A near the Jepson Property line and to post a sign the states no motorized traffic beyond this point-non motorized allowed. Also, to remove the no OHV sign on CR 22A. They asked that the boulders on CR 22 be moved to prevent dirt bikes from driving through them. They also asked that the 35 mph signs be replaced with 20 mph signs. It was also a consensus to not apply any dust control product at this time. James Simino of the San Juan National Forest was present to provide the Commissioners with an update on the Forest Services issues with the Durango and Silverton Narrow Gauge Railroad and the impacts on the backcountry. Silverton Schools Superintendent Kim White was present to explain to the Commissioners her plans for the school this fall. She is planning to have the school opened for in school learning. She also provided an update noting that $100,000 in rent support and 4000 food bags were provided to the community. Ron Mabry was present to provide the Commissioners a proposal for weed control. Ron would become a part time temporary county employee and Ouray County would donate a truck to San Juan County that has the sprayer on it. It was the consensus of the Commissioners to have the attorney, the administrator and Ron meet to work out the details. Having no further business, the meeting adjourned at 9:08 P.M. It is disappointing that although the OHV's are damaging our business and I respectfully requested assistance, not one of the Town Trustees felti it was important enough to respond. Not even a confirmation that my request was received. did receive an email from Trustee Barela defending her posts and frequent comments on Facebook that encouraged people that masks were ineffective and a health risk SO I am assuming responding to this issue is just not worth your time. So I am trying a second time before taking a more confrontational path. Iti is important to know that I will not be bullied by abusive phone calls or the comments made on either David Breeds gossip Facebook Page or the defamatory right-wing page of Sharon Zimmerman, Doolie and Inga McFadden. It only proves my points and cements my resolve. If this is how the town and community treats a person for simply wanting to begin a discussion on the damage OHV's are doing to our town and county, - can see why it is perceived by some that our local officials lack a backbone and are controlled by the loud, 'anything for a buck" bullies. Now is the time to begin a discussion on changes to our OHV policy sO next summer is not another nightmare for my guests and many residents. As you will see in my commentary below, I am requesting the Town Trustees and County Commissioners schedule a joint meeting with the residents of the county to discuss this issue and to contemplate forming a task force to make improvements on traffic, noise, pollution and the damage being done to the environment and other visitors experiences. This gives us 10+ months to get it right. I am not asking for a ban this year or even next. am simply asking that the people who are being paid to solve problems and protect the safety and welfare of ALL residents make a small effort to improve the situation. To ignore a fair and sensible request to make improvements to what can only be considered an irresponsible and chaotic mess shows a disturbing lack of leadership. Heirich Perpetua Management Services LLC The Historic Alma House Commentary Are OHV's a Blessing or a Curse This summer saw an increase in OHV usage in San Juan County and in the town of Silverton proper. As with every summer, complaints came rolling in with the trailers. Some are frivolous but many deal with public safety and the effect the OHVS have on the quality of life of the residents and the surrounding mountains. The main argument that the supporters of OHV use is that the OHV crowd brings in much needed revenue. Without it, they say, they would go out of business. The argument is the same as when they were dependent on the DSNGR yet when circumstances shut down the train, they adapted and refocused, thus bringing in the OHV crowds. While their adaptability is to be admired, the visitors they brought in appears to be the lowest common denominator in the tourist algorithm. Now they say that they are dependent on them and without the roar of machines through the mountains they would go out of business. They know that the damage done to the back country, the pure air, wildlife corridors, tundra and the resident experience is being sacrificed for this revenue. Most will use the unproven argument that it is only 1 or 2% that misbehave but that is just a number they pull from the air. We don't know what damage is being done because the county and the town of Silverton have failed to fund the necessary infrastructure and enforcement tools needed, In simpler terms, Silverton and the County wants the revenue but does not want to pay for the safety and welfare of it's residents and all we are tasked to care for. This is irresponsible and short-sighted. It also hurts property values in the long run. The damage to other demographics is also a long term effect. Not everyone wants to come to Silverton and listen to engines revving and roaring through the pristine environment. These folks will go elsewhere thus further narrowing our demographic pool. Hikers, bikers, photographers, artists, and others will simply go where the people care about the environment and where the residents understand how important it is to care for and protect the natural world that sustains us. We will have created our own destiny and in doing SO will have destroyed all that has made the San Juans the most beautiful mountains in the world. Iti is long term destruction for a quick buck. It is morally wrong and insidiously stupid. It has to be managed. It has to be monitored and adjustments made. It has to be looked at with eyes that are not dependent on just the revenue - blinding all logic and intelligence. It is clear the town board nor the county commissioners are eager to make a decision that will result in the vocal, angry minority attacking them as they did with our county sheriff lately. I get it. Because of this, I am asking the town board to meet with the county commissioners in a public zoom meeting to discuss bringing in a third party. There are dozens of environmental groups who will gladly step in and fill the decision making void. I propose we bring one of them in to evaluate the damage being done to our County by the OHV crowd. Voters often vote with their pocketbooks, not thinking of the other important factors of an issue. To accept and encourage something that is annoying to many others, damages the environment, chases away less impactful visitors and places strains on parking and enforcement (while refusing to even look at how we can manage it more effectively) is what the voters voted for the last time this came up. No increase in enforcement funding, no attempt at better signage, No one knows how much damage is being done up mountain because the town does not want to know. It is easier to just insist that 98% are decent folks who understand the fragile high country. Say it enough, everyone will believe it, Out of sight, out of mind. We are sacrificing these beautiful mountains, the clean air, and the throngs of tourists who will stay away due to the noise of the machines for the quick buck, thus making us even more dependent on a demographic that does not seem to value the reasons many visit the San Juans or show any respect to the local residents. If they refuse to even follow in-town rules, do you really think they are staying on trail when no one is looking? This is not a demographic that likes to be told to what to do and that includes respecting wildlife, others and the world around us. Continuing to market to this demographic is a sure death knell to one of the most beautiful places on the planet. All for another dollar in the till. By sending this to the voters it becomes a political argument. Iti is not. t is about sustainability and looking to the future. Iti is about showcasing our values - responsible stewardship or anything for a buck? There exist compromises and solutions to this dilemma but it takes conviction, empathy and fully understanding the damage that this unregulated demographic has wrought on these mountains. There are better ways to make a buck while keeping our values in check. For me, personally, 1 think OHV's are a mixed blessing at the moment - sacrifice peaceful living, clean air and unmolested wildlife SO some ousinesses do not shut down. understand. But to think this is the best way to survive and grow going forward is just plain wrong. (up Prospect Gulch) Spoke twice with him. He has brought in 3 or 4 loads this summer and has made progress. I let him know a 9-year permit was stretching the limits of our rules (even the old Land Use Code) and we expected him to finish up by end of 2021. Year of Permit 2012--#2217: Hummingbird, Leif Steiner. I had a very specific conversation with the contractor (Paul Hammer) about the progress on this site. I will have an updated oral report on this Wednesday. They stated they were going to take some time off this summer (this was late June). I strongly urged them to reconsider this plan. Three days later Paul contacted me and stated they were on the full summer construction plan. Year of Permit2014-- #2277: Horseshoe Lode, Mace Pemberton. spoke with Mace and have visited the site. There is progress being made. Again, I urged him to please proceed with as much expediency as safely possible. I did suggest keeping the area as cleaned up as possible as it is very visible from CR 10. He, again, assured me he wants to finish this quickly. I am not sure his progress in the last 3 years equates with that statement. Year of permit 2015--#2311: Broadway Lode, Dooley's. (Deer Park) Michelle contacts me regularly. They are from Aztec and are very close to a final inspection. I believe that will happen shortly. Year of Permit 2016--#2349: Animas Lode, George Brown. (Kendall Rd.) Almost complete also. George contacts me often (email Monday 8/3), and we are working out the final details for a CO. Probably done this year. Very close. Year of permit 2017--#2375: Wilcox Lode, Darwin Flaugh. (CR 14, top of Red Mountain pass, Brooklyn Rd. % mile up) Darwin communicates with me as required. We have spoken twice in the last 2 months. His cabin is about 75% complete. He is conscientious about his project and keeps the site cleaned up when he is gone. Year of Permit 2017-#2391: Loren Lew, Foundation only under old mule barn. Virtually complete, just a few small items to finish this part. Year of Permits 2018-#2399: GW Lode, Opus Hut, Bob Kinsley. Continuation of his Land Use Permit. Very short construction season. I have gone to site the last 2 years in early September to inspect. He calls me when he starts and finishes a certain phase. I then inspect. #2410: Ranch Placer, Dennis Stenslien, (Clamping) Dennis calls me when he needs something. He has done some work this summer, but not much. He has been out of country for a while "staying away from the covid thing" I will have an updated oral report on him Wednesday. #2423: Bastille Lode, Ben Cross (old hippie cabin site up top of Minnehaha) The owners/builders are almost done. We talked last month about what was needed to get their CO. Possibly this year. Covid has caused slowdown of there income/funds to finish. It has turned out decent. - 1 will follow up on their Land Use requirements before I issue a final CO. Year of Permit 2019-- #2439: Kruger Lode, Doug and Valerie Coniff (off CR 110, by Irene slide) I visit site often, twice this year. Just completed footing pre-pour inspection. They hope to have complete foundation completed by end of September. #2241: Maggie Gulch cabin redo. Anthony Doctor. Inspected framing this June, he could be done by end of September. It has been a nice upgrade from the original plywood structure. Slowed because of Covid stuff. Year of Permit 2020--#2471: Anvil Mtn. Subdivision, Lot 14, Wade Christenson. Working with Wade to make some significant progress. He hopes to be weathered in by end of October. Post and Beam home package is on the way. "Tiny Home" will have to remain through this winter? I will work with Wade to keep them on task. He is doing his own home with little experience. #2472: Anvil Mtn. Lot 26, Emma & Tyler's home. New home in Subdivision. Should be done and occupied by 9/1. Very nice, efficient, liveable, and well-built new home. I would like to give you guys a tour of it during my final inspection. It is a great example of your goals being accomplished. #2478: Anvil Mtn Lot2, Mark Liessmann. Probably having foundation being dug this week. Should be under construction and weathered in by 10/15. Small customed designed home. We have not had a Permit "pulled" yet for the Hidden Treasure B & B. That could happen yet this year, but probably early next. They might also request a partial Permit for foundation only in 2020 and full Permit for the balance of the structure in 2021. This decision by two of the three county commissioners at their whims and prejudices has created this situation. This is a road that we have biked for years, and now this obstacle has generated a greater risk for us. ATVS still operate on all sections of this road. We encounter them each time we ride. This action has accomplished nothing but to make this a riskier bike ride for those who use it and to have wasted taxpayer funds to put these two barriers in place, This was total foolishness, a waste of our money, a display of selfishness, and a total lack of common sense. was unable to find emails or phone numbers for these two commissioners or I would have directed this message to them. Under the 2019 Interim Record of Decision (IROD), work is beginning at the following source areas: Kohler, Junction and Longfellow, Natalie Occidental, Ben Butler, and Dispersed Campsites (Campground 4 and 7). Red and Bonita Bulkhead Test The Red and Bonita bulkhead test started on July 15, 2020. The pressure behind the Red and Bonita bulkhead was raised 50 feet and pressure will be increased to reach 200 feet, at which point, the pressure will be held. During this time, the bulkhead and surrounding structures will be monitored regularly. Sampling of Cement Creek, nearby draining mines, and seeps and springs along Cement Creek will also be conducted. At the end of the test, the water that has accumulated behind the bulkhead will be drawn down and fully controlled at the bulkhead valve and be treated at the Interim Water Treatment Plan (IWTP). Natalie Occidental Currently, the Natalie/Occidental adit discharge flows over the existing waste pile, leading to erosion and waste rock migration to Cement Creek. This summer, the adit discharge will be re- routed SO it no longer erodes the waste pile and the portal grate will be cleared to reduce the buildup of mine sediment and debris on the grate allowing adit discharge to freely flow to Cement Creek. Kohler, Junction and Longfellow This summer, crews will be removing sediment buildup within the sediment ponds adjacent to the Koehler and the Junction adits. This sediment will be stored on site until a site-wide repository is built. This will ensure water flows safely from the portals, through the ponds, and out to Mineral Creek without causing migration of additional waste in the sediment. Flat areas which could be used for recreation and contain elevated contaminant levels will be covered to mitigate excess exposure to recreational users. Ben Butler The State of Colorado will be conducting a safety closure at the Ben Butler Mine. Work at the Ben Butler will include waste rock amendments and backfill with this amended waste rock to close open stopes at the site. The closure will be contoured to physically mitigate the risk of stormwater interacting with the waste rock. Dispersed Campsites (Campground 4 and 7) The State of Colorado will be working to characterize high contamination points at Campground 4. After characterization is complete, the state will develop a cleanup design and project construction bids to reclaim the contaminated areas for Campgrounds 4 and 7 during the 2021 construction season. BLM Mayday Mine Repository The Bureau of Land Management's (BLM) contractors are conducting maintenance on the Mayday Mine Repository located on BLM managed land adjacent to County Road 110A within the Cement Creek watershed, from July 7-August 17. Work includes regrading, hauling in borrow material, and installing steel sheet pile using a large crane. The BLM is working closely with San Juan County officials during this work to ensure that traffic is minimally interrupted during construction. (c) The Chairpersons of the NEA and NEH and the Chairman of the ACHP shall establish cross- department initiatives within the NEA, NEH, and ACHP, respectively, to advance the purposes oft the Task Force and this order and to coordinate relevant agency operations with the Task Force. Sec. 3. National Garden of American Heroes. (a) It shall be the policy oft the United States to establish a statuary park named the National Garden of American Heroes (National Garden). (b) Within 60 days of the date of this order, the Task Force shall submit a report to the President through the Assistant to the President for Domestic Policy that proposes options fort the creation of the National Garden, including potential locations for the site. In identifying options, the Task Force shall: (i) strive to open the National Garden expeditiously; (ii) evaluate the feasibility of creating the National Garden through a variety of potential avenues, including existing agency authorities and appropriations; and (lii) consider the availability of authority to encourage and accept the donation or loan of statues by States, localities, civic organizations, businesses, religious organizations, and individuals, for display at the National Garden. (c) In addition to the requirements of subsection 3(b) of this order, the proposed options for the National Garden should adhere to the criteria described in subsections (c)() through (c)(vi) of this section. (i) The National Garden should be composed ofs statues, including statues of John Adams, Susan B. Anthony, Clara Barton, Daniel Boone, Joshua Lawrence Chamberlain, Henry Clay, Davy Crockett, Frederick Douglass, Amelia Earhart, Benjamin Franklin, Billy Graham, Alexander Hamilton, Thomas Jefferson, Martin Luther King, Jr., Abraham Lincoln, Douglas MacArthur, Dolley Madison, James Madison, Christa McAuliffe, Audie Murphy, George S. Patton, Jr., Ronald Reagan, Jackie Robinson, Betsy Ross, Antonin Scalia, Harriet Beecher Stowe, Harriet Tubman, Booker T. Washington, George Washington, and Orville and Wilbur Wright. (ii) The National Garden should be opened for public access prior to the 250th anniversary of the proclamation ofthe Declaration ofl Independence on July 4, 2026. (iti) Statues should depict historically significant Americans, as that term is defined in section 7oft this order, who have contributed positively to America throughout our history. Examples include: the Founding Fathers, those who fought for the abolition of slavery or participated in the underground railroad, heroes of the United States Armed Forces, recipients of the Congressional Medal of Honor or Presidential Medal of Freedom, scientists and inventors, entrepreneurs, civil rights leaders, missionaries and religious leaders, pioneers and explorers, police officers and firefighters killed ori injured in the line of duty, labor leaders, advocates for the poor and disadvantaged, opponents of national socialism or international socialism, former Presidents of the United States and other elected officials, judges and justices, astronauts, authors, intellectuals, artists, and teachers. None will have lived perfect lives, but all will be worth honoring, remembering, and studying. (iv) All statues in the National Garden should be lifelike or realistic representations of the persons they depict, not abstract or modernist representations. (v) The National Garden should be located on a site of natural beauty that enables visitors to enjoy nature, walk among the statues, and be inspired to learn about great figures of America's! history. The site should be proximate to at least one major population center, and the site should not cause significant disruption to the local community. (vi) As part of its civic education mission, the National Garden should also separately maintain a collection of statues for temporary display at appropriate sites around the United States that are accessible to the general public. Sec. 4. Commissioning of New Statues and Works of Art. (a) The Task Force shall examine the appropriations authority of the agencies represented on iti in light of the purpose and policy of this order. Based on its examination ofrelevant authorities, the Task Force shall make recommendations for the use of these agencies' appropriations. (b) To the extent appropriate and consistent with applicable law and the other provisions of this order, Task Force agencies that are authorized to provide for the commissioning of statues or monuments shall, in expending funds, give priority to projects involving the commissioning of publicly accessible statues of persons meeting the criteria described in section 3(b)(ili) of this order, with particular preference for statues ofthe Founding Fathers, former Presidents of the United States, leading abolitionists, and individuals involved in the discovery of America. (c) To the extent appropriate and consistent with applicable law, these agencies shall prioritize projects that will resulti in the installation of a statue as described in subsection (b) of this section in a community where a statue depicting a historically significant American was removed or destroyed in conjunction with the events described in section 1 of this order. (d) After consulting with the Task Force, the Administrator of General Services shall promptly revise and thereafter operate the General Service Administration's (GSA's) Arti in Architecture (AIA) Policies and Procedures, GSA Acquisition Letter V-10-01, and Part 102-77 oft title 41, Code of Federal Regulations, to prioritize the commission of works of art that portray historically significant Americans or events of American historical significance or illustrate the ideals upon which our Nation was founded. Priority should be given to public-facing monuments to former Presidents of the United States and to individuals and events relating to the discovery of America, the founding of the United States, and the abolition of slavery. Such works of art should be designed to be appreciated by the general public and by those who use and interact with Federal buildings. Priority should be given to this policy above other policies contained in part 102-77 oft title 41, Code of Federal Regulations, and revisions made pursuant to this subsection shall be made to supersede any regulatory provisions of AIA that may conflict with or otherwise impede advancing the purposes ofthis subsection. (e) When a statue or work of art commissioned pursuant to this section is meant to depict a historically significant American, the statue or work of art shall be a lifelike or realistic representation of that person, not an abstract or modernist representation. Sec. 5. Educational Programming. The Chairperson of the NEH shall prioritize the allocation oft funding to programs and projects that educate Americans about the founding documents and founding ideals of the United States, as appropriate and to the extent consistent with applicable law, including section 956 of title 20, United States Code. The founding documents include the Declaration of Independence, the Constitution, and the Federalist Papers. The founding ideals include equality under the law, respect for inalienable individual rights, and representative self-government. Within 90 days of the conclusion of each Fiscal Yeari from 2021 through 2026, the Chairperson shall submit a report to the President through the Assistant to the President for Domestic Policy that identifies funding allocated to programs and projects pursuant to this section. Sec. 6. Protection of National Garden and Statues Commissioned Pursuant to this Order. The Attorney General shall apply section 3 of Executive Order 13933 of June 26, 2020 (Protecting American Monuments, Memorials, and Statues and Combating Recent Criminal Violence), with respect to violations of Federal law regarding the National Garden and all statues commissioned pursuant to this order. Sec. 7. Definition. The term "historically significant American" means an individual who was, or became, an American citizen and was a public figure who made substantive contributions to America's public life or otherwise had a substantive effect on America's history. The phrase also includes public figures such as Christopher Columbus, Junipero Serra, and the Marquis de La Fayette, who lived prior to or during the American Revolution and were not American citizens, but who made substantive historical contributions to the discovery, development, or independence of the future United States. Construction efforts will consist of installing five towers on the mountain and ridgeline above the highway. The monitoring and mitigation help prevent natural avalanches from impacting public travel. When there is a high risk of avalanche danger, CDOT will close highways at the location of the avalanche path in order to conduct avalanche control operations. While the road is safely closed to any traffic, avalanches are triggered. Maintenance crews with heavy equipment then clear the highway of any snow and debris that reached the road.
