CALL TO ORDER The Regular Meeting of the Board of County Commissioners on Tuesday, June 10, 2025, was called to order by Chair, Eric Mamula, at 1:00 p.m. in the County Commissioners' Meeting Room, Summit County Courthouse, 208 Lincoln Avenue, Breckenridge, Colorado. II. APPROVAL OF AGENDA IV. CITIZEN COMMENT V. PROCLAMATIONS & ANNOUNCEMENTS A. Resolution in Honor and Recognition of Lora Behm's Service and Contribution to Summit County, Colorado. Summit County Board of County Commissioners Regular Meeting Minutes of June 10, 2025 Commissioner Pogue read the Proclamation in full and shared her appreciation for and the importance of benefits administrators and their impact on the community. Joanne Sprouse noted that Lora was a beautiful person and a beloved member of the department and community. MOTION: A motion was made by Commissioner Pogue and seconded by Commissioner Waters to approve Resolution 2025-41, in Honor and Recognition of Lora Behm's Service and Contribution to Summit County, Colorado. MOTION PASSED UNANIMOUSLY BY THE BOARD PRESENT VI. CONSENT AGENDA A. Approval of 5/27/2025 Special Meeting Minutes. Approved as Presented; and B. Warrant list 05/16/25-05/31/25. Approved as Presented by the Finance Department; and C. 2025 SCWC Hazardous Fuels Reduction (HFR) and Community Wildfire Protection Plan (CWPP) Grant Program recommendation. Approved as Presented; and MOTION: A motion was made by Commissioner Waters and seconded by Commissioner Pogue to approve the Consent Agenda, items A-C, as presented. MOTION PASSED UNANIMOUSLY BY THE BOARD PRESENT VII. NEW BUSINESS A. Consideration of a Resolution transferring the duties of Countywide Emergency Management from the Sheriffs Office to the County Manager's Office through the creation of the County Emergency Management Department. Commissioner Mamula noted that because the Director of Emergency Management was unavailable for this meeting, they felt it was not appropriate to make a decision at this time. The Board of County Commissioners has a statutory obligation to oversee emergency management in their county. MOTION: A motion was made by Commissioner Pogue and seconded by Commissioner Waters to table Consideration of a Resolution transferring the duties of Countywide Emergency Management from the Sheriff's Office to the County Manager's Office through the creation of the County Emergency Management Department. MOTION PASSED UNANIMOUSLY BY THE BOARD PRESENT VIII. PUBLIC HEARING A. PLN25-019: Appeal of County Engineer denial of Variance ESP25-001, reviewed by the Code Administrator and heard by the BOCC; Lot 2, Block 6, Hamilton Creek Sub #2, zoned Hamilton Creek PUD. Continued from the May 27, 2025 Regular Meeting. Jen Uhler gave a presentation including but not limited to a summary of the staff review, three potential variance designs, and necessity versus design preference. She noted that staff recommends denial of the appeal. Dan Teodoru spoke on behalf of the applicant and shared concerns around the staff report and Summit County Board of County Commissioners' Regular Meeting Minutes of June 10, 2025 the idea that the application is incomplete. He stated that the applicant wishes to minimize disturbance to the lot. He suggested that if this were the first house with a driveway on the road, the driveway could be used as a turnaround, or the road could be widened to the beginning of the driveway. He shared other incidences of driveway variances that have been granted. Zane Levin discussed with the Board the different design options that had been proposed. Susan Lee noted that a driveway could not be added off of the cul-de-sac. She stated that while the applicant's preferred plan shows less disturbance, in reality there would need to be substantial retaining walls. Commissioner Waters noted that going against staff's recommendation is not something that they take lightly. MOTION: A motion was made by Commissioner Waters and seconded by Commissioner Mamula to approve Resolution 2025-43, denying PLN25-019: Appeal of County Engineer denial of Variance ESP25-001, reviewed by the Code Administrator and heard by the BOCC; Lot 2, Block 6, Hamilton Creek Sub #2, zoned Hamilton Creek PUD with 6 findings and zero conditions. MOTION PASSED BY A VOTE OF 2 to 1 BY THE BOARD PRESENT, WITH COMMISSIONER POGUE VOTING NO. IX.
