Nomination of temporary Chair for this meeting a. Miller nominated Boehnke b. Cram Seconded C. Unamimous vote of approval B. 3:00 - Public Hearing: Plat Amendment a. The Planning Commission will review and make a recommendation to the Board of County Commissioners regarding an application by the Jill Dorsey Revocable Trust for approval of a Plat Amendment for Unit 5 and 6 of Pointe Escape Subdivision. The purpose of the Amendment is to combine Unit 5 and Unit 6 into one contiguous parcel, and adjust the build area of that parcel. b. Staff Presentation Staff gave a brief presentation of the application and is recommending that the Planning Commission forward the application to the BOCC with a recommendation of approval, with the following conditions: 1. The applicant shall have a plat prepared by a Colorado Licensed Surveyor and submit the plat for approval within 6 months of approval by the Board of County Commissioners. 2. The following plat note shall be added: "The unit of density associated with Unit 6 is hereby permanently extinguished by this plat and such unit of density is not available for future development. 1 3. Prior to obtaining signatures on the plat, the Applicant shall submit a draft to the Land Use Department, in order for Staff to review for completeness. 4. Prior to signature by the Chair of the BOCC, the Applicant shall ensure that all other signature blocks have been properly signed. 5. All applicable conditions, rules, and regulations within the covenants of the Pointe Escape Common Interest Community, and the Ouray County Land Use Code shall remain in effect. b. Applicant Presentation i. C. Questions from Planning Commission i. Cram asked about whether lots this small would be allowed today. 1. Sampson stated that the LHV density is higher than what is allowed today. Minimum lot size today is 1-acre due to OWTS considerations. ii. Cram asked about what size of home is to be constructed 1. The Applicant stated that she did not plan to build a huge house - possibly 3,000 SF. ii. Cram noted a concern that a house could be built that is much larger than what is allowed on surrounding parcels. 1. Boehnke noted that the size of home is not of the County's concern, SO long as the contruction is located within the build area. 2. Applicant noted that minium size in covenants was 1500SF 3. Cram noted a 4-bedroom limit in Point Escape 4. Applicant noted that LHV architecture review is still required d. Public Comment Open 3:27 i. No public Comment e. Public Comment Closed 3:27 f. Planning Commission Diliberation: i. Cram = read the following comment: I am bothered that PE was originally placed (and still shows in LH plat notes) as "9 cluster units". . I assume the intent was to be able to build "good view" (and expensive) units along the escarpment edge, "clustering" to put them close together. In this case clustering was only motivated by economics, and I don't see any reason that that the "clustering" helps neighbors or other people in LH or PE; thus de-clustering" should be OK (given that the applicant bought 2 separate lots). The word "clustering "is used in the Land Use Code in a different sense than it is used in the LH plat notes. 1. Bothered by potential by this applicant to build a very big house, but appears to be legal. 2. Szwarc - combining lots is a reduction in density. 3. Castrodale - Size of home is not in the Land Use Code and is not part of our purview. Can not be making stuff up. ii. No further concerns were discussed g. Vote i. Motion: Szwarc moved to forward the application to the BOCC with the recommendation of approval, with the following conditions: 1. Second: Miller Seconded the motion iii. Discussion: Cram asked if we should include a plat note regarding the 4-bedroom could be included. 1. Condition #6 was added: All plat notes associated with the original Pointe Escape Common Interest Community plat, reception #207330 shall remain in effect. iv. Vote: The motion passed unanimously Adjourn Public Hearing: Motion: Szwarc moved to adjourn the public hearing and resume with the regular meeting agenda.
