Jarvies Second Motion Motion Carries 2-0 Approval of Minutes: No Minutes to Approve Administrative Correspondence - Tressesa Martinez: DOLA's $125,000 grant has been awarded to the County for Architect work regarding the Ambulance Headquarters was discussed by BOCC. Advertised bid for the perimeter fence for the jail was published in the Valley Courier. Your Great Outdoors was the only bid submitted to the County for $50,041.69 with $25,000 due up front. Motion made to accept bid from Your Great Outdoors for the amount of$50,041.69 with $25K due upfront for the Conejos County Jail as presented. Comm. Garcia makes first motion. Comm. Motion Carries 2-0 1 County Attorney - Nick Sarmiento: Motion to enter Executive Session 24-6-402 Sub Section B Conference with an Attorney to Discuss Legal Counsel regarding 1041 regulations. Comm. Jarvies - Let the record reflect that we are coming out of Executive Session conference with an Attorney, no decisions were made, and it is 9:35 am. Attorney Sarmiento - It is the opinion of the County Attorney that the discussion had an Executive Session constitute Attorney and Client privilege and therefore no record was kept. Sheriff's Report = Garth Crowther: Five Sheriff deputies have been assaulted while on duty, Sheriff S response is that he must do everything to keep his deputies safe. One female deputy was attacked by a perpetrator with a knife, deputy was able to fight off assault and was able to tazze the assailant. Back up arrived on scene from La Jara, Alamosa, CSP. Subject was tazed again with no effect. Sheriff believes that by having more deputies for back up would help this issue. D/A Ann Kelly visited the deputy in the ER and discussed with the Sheriff that she will seek Attempted Murder on the assailant. Sheriff shares a lighter story of a an on-duty situation, Sheriff fis coming on duty and notices a man near the road and bridge area outside the Courthouse. Sheriff makes contact thinking the man is stealing catalytic converters from the County trucks. Man was actually filling sandbags with the sand put out for citizens to use to protect property from flooding. Sheriff and undersheriff ask how they can help, the man says well there is another shovel in the truck. So at 3am in the morning the Sheriff, Undersheriff and the citizen are all filling sandbags. Sheriff discusses grants received. Sheriff talks about the new vehicles and repairs needed on some of the older trucks. Discussion regarding recruiting potential deputies from the Otero Academy in three months. Sheriff discusses the need for a On Call Doctor for the inmates in the jail per the new bill that passed. Land Use Report - Linda DeHerrera: Linda presents to the BOCC a Resolution of a Moratorium of review or approving Minor Sub- Divisions in unincorporated Conejos County in the State ofColorado, initial request for moratorium was first presented on April 6, 2023. Attorney Sarmiento suggest that Linda and the BOCC has impose resolution Non-Pro Tunc today from the April 6th request date. Resolution number 17 Building and Energy Code discussed, Linda mentions that there are some chapters that Land Use will not adopt. Work session is scheduled for June gth at 2:30 pm to discuss adoption oft building code for Conejos County. 2 Special Use Permit - Wood Molding Shop - Marvin and Ida Mast: CONEJOS COUNTY LAND USE STAFF REPORT SPECIAL USE REVIEW Case No. CCLU 2023-0041 APPLICANT: Marvin & Ida Mast BACKGROUND: An application for a Special Use Permit was filed with the Land Use Office on 03/21/2023. BOARD OF CONEJOS COUNTY COMMISSIONERS = The hearing before the Board of County Commissioners is scheduled for Thursday, June Ist, 2023, at 9:30 AM. Two referral agencies have submitted comments. C-DOT submits that no access permit is required from Hwy 285. Donnie from Road and Bridge mentions that no traffic issues on County Road. Public Comment Portion either for or against was open and subsequently closed with no comments. Comm. Garcia asks question regarding what moldings he would be making and what type of wood he would be using. Mr. Mast answers it depends on what the customer wants but would be sourcing local wood. Comm. Felipe Blea was worried about the safety of renters due to activities of the neighbor to the North. Armando Valdez challenged the zoning for this property. He belleves it should be Community Townsite due to its proximity to the Town of Antonito and voted no because he felt that it did not match the demographic of the neighborhood. Our land use zoning book shows the property Is zoned Rural. BOARD OF CONEJOS ÇOUNTY COMMISSIONERS - The application will be presented to the Board of County Commissioners on 06/1/2023 at 10:15 AM. Michelle from Land Use presents the case to the BOCC, highlighting details of the property and the surrounding area. Comm. Garcia discusses Standards of Approval for Short Term Lodging. Comm. Jarvies opens the public comment portion ofthe hearing and asks Michelle ifthere were any written comments submitted. Two referrals were submitted with No Comment. Surrounding landowners called the Land Use Office regarding the property in question and the neighbors, however no one submitted a written complaint or comment. Comm. Jarvies closes the public comment portion ofthe hearing. Comm. Garcia makes motion to approve the Short-Term Lodging for Greg Dupont as presented. Comm. Jarvies seconds that motion. Motion Carries 2-0 Resolution #19 4 Ambulance Report - Ernest Abeyta: No Financial information for this month's report. Ernest discusses the issues regarding Fire Dept. responding to Ambulance calls, Ernest explains that some oft the Fire Districts receive the same tones (alerts) from dispatch. This situation is typically not an issue, however on one particular call the Fire Dept. called the death of a person involved in a car accident. Ernest explains that none ofthe responding Fire personnel had the training or authority to make the call oft the deceased driver. Ernest will send a letter to the Fire Districts ofC Conejos County to highlight that EMT and not the Fire Districts can declare pass oflife when responding to an Emergency Call. EMT tones will be removed from Fire District personnel. Ernest and the BOCC discuss Special Event Par for EMT's that work those events. BOCC suggest that the County pay more for those events to the participating EMT's. Comm. Garcia makes motion to approve Special Event pay to $20 per hour as presented. Comm.
