Jarvies called the meeting to order at 9:00 am Mitchell Jarvies - Chairperson - Present Carlos Garcia - Vice Chair - Present Joseph Baroz - Vice Chair Present Present: Tressesa Martinez-County Administrator Nathan Ruybal-Clerk and Recorder - Connie Ricci - HR Manager - Nick Sarmiento - County Attorney Not Present: NONE Pledge of Allegiance: Comm. Jarvies led everyone on the Pledge of Allegiance. Opening Prayer: Comm. Garcia gave the opening prayer. Approval of Agenda: Add ADA Compliance discussion. Add WWII Veteran present with plaque discussion. Add Tyler discussion. Comm. Garcia makes motion to approve agenda as amended. Comm. Baroz seconded that motion. Motion carried 3-0 Approval of Minutes: October Sth Regular Meeting. Comm. Baroz makes a motion to approve minutes as presented. Comm. Garcia seconded that motion. Motion carried 3-0 October 11th Special Meeting Comm. Garcia makes motion to approve as presented. Comm. Baroz seconded that motion. Motion Carries 3-0 Public Comment: NO PUBLIC COMMENT 1 Administrative Correspondence - Tressesa Martinez: Naomi Keys discusses how Proposition HH if passed will affect Residential property by $50,000 on private property assessments however no change for commercial properties, it will also push back certification dates for counties and municipalities. Discussion continues regarding Mill Levies, public hearings, and resolution for all entities. RAA Architecture engagement letter, Comm Jarvies reads out loud the letter to RAA firm regarding the engineering design for the new Conejos County Ambulance headquarters. Comm. Baroz makes motion to approve letter of engagement. Comm. Garcia seconded that motion. Motion Carries 3-0 Re-Tac agreement was presented with direction to appoint Sarah Gilleland to Re-Tac board. Comm. Garcia makes motion to approve appoint of Mrs. Gilleland to Re-Tac board. Comm. Baroz seconded that motion. Motion Carries 3-0 Guadalupe Water Project Atencio Engineering has agreed to work on the project, Conejos County enters agreement with Guadalupe Town Site to partner together to complete project. Comm. Baroz makes motion to approve agreement between Guadalupe and Conejos County. Comm. Garcia seconded that motion. Motion Carries 3-0 GoCo Lobatos Bridge MOU Joint effort with Costilla, Conejos, and the GoCO to create an educational historical dedication area for the area and bridge. Attorney Sarmiento reviewed the agreement regarding Conejos and GoCo. Comm. Garcia makes motion to approve agreement as presented. Comm. Baroz seconded that motion. Motion Carries 3-0 Lobatos Bridge Resolution o Tress Martinez reads resolution C-41-23 Comm. Baroz makes motion to approve resolution as presented. Comm. Garcia seconded that motion. Motion Carries 3-0 Wage and Salary Administration Policy Approval. Discussion regarding the new policy. Comm. Garcia makes motion to approve new policy as presented. Comm. Baroz seconded that motion. Motion Carries 3-0 Underfunded Court Grant O Sheriff, Under Sheriff and Scott Lucero applied for a grant to improve front entry doors and general safety improvements to the courthouse. Tyler Update. Process is running forward, and system will improve Conejos County Accounting and payroll practices and procedures. 2 ADA Compliance Discussion - Nathan Ruybal: Clerk Ruybal discusses that recently he had a visit from the Secretary of States office, the visit by Judd Choate reviewed election procedures and policies. The only issues found was that the front ofthe Courthouse did not comply with Federal ADA compliance regulations. Judd asked that we work on getting these issues fixed as soon as possible. Clerk Ruybal did point out to the BOCC that when he took over the office, Clerk Ruybal had mentioned these violations to the BOCC, but nothing had been done. Clerk Ruybal is asking for the BOCC to move from discussion to action and approve the work needed to move Conejos in the direction of full ADA compliance. Comm. Jarvies discusses that we do not need to request an RFP and we can openly discuss project with local contractors to fix the issues we have. WWII Veteran - Comm. Baroz: Comm. Baroz discusses that we have a WWII Veteran that lives at the Rio Grande Nursing home in Conejos County. Comm. Baroz would like to recognize him for his service, present him with a plaque with all three Commissioners there to honor his service. C.G. Betenboux is the name of the veteran that the BOCC would like to recognize. Sheriff's Report - Garth Crowther: Sheriff discusses briefly regarding something about an MOU between other departments. Sheriff quickly transitions to discussing Major OT for his deputies because of working some major cases in Conejos County. Discussion regarding the Town of La Jara wanting the Sheriff to contract to take over Law Enforcement and Patrol. Sheriff also mentions wanting to get hooked up to Town of Antonito water supply, rather than using the well water. Land Use Report - Linda DeHerrera: Asking BOCC for an extension ofthe Moratorium on Minor Sub-Divisions, which has expired on 10/06/2023. Comm. Garcia makes a motion to extend moratorium on Minor Subdivisions as requested until May 2nd, 2024. Comm. Baroz seconded that motion. Motion Carries 3-0 County Attorney - Nick Sarmiento: Attorney Sarmiento mentioned that the BOCC has now held six total public hearings. Discussion leads to rules and regulations outlined in the resolution. Comm. Garcia would like to post Resolution and notice of agenda on the website, but unfortunately the county website is down due to annual maintenance. Comm. Garcia asks about a comment that Attorney Sarmiento had made about some counties rescinding their approved resolution. Comm. Baroz mentions that if approved, terms ofa approval require a annual review of road conditions and traffic accidents and OHV violations. Attorney Sarmiento responds to Comm. Garcia's question, the reason has been noise complaints and road conditions to as why the counties rescinded their approved resolution after the fact. BOCC would like to post resolution and next BOCC meeting on the website as soon as its back up, before deciding on OHV resolution. 3 Comm. Garcia makes a motion to table decision on OHV Resolution until 12/7/2023. Comm. Baroz seconded that motion.
