TOWN OF DE BEQUE BOARD OF TRUSTEES PUBLIC MEETING AND PUBLIC HEARING DECEMBER 22, 2020 The Board of Trustees of the Town of De Beque held a Public Hearing and a Public Meeting on Tuesday, December 22, 2020 at 6:00 P.M. by virtual means. Present were the following: Mayor: Zeke Gaudern Trustees: David Jackson Judy Lake Cindy Farris Shanelle Hansen Walter Wood Summer Black Greening Absent: None Staff Present: Care' Mcinnis Bob Dalley Toni Vincenzetti Shirley Nichols Tim Meloveck Also, Present: David McConaughy, Davis Farrar, Ed Sands, Lisa Maestas, Tony Marsh, Max Pollett and 50 + others Ms. Mcinnis introduced Tim Meloveck, the new Public Works Director. Mr. Meloveck is highly qualified and comes to us with all water and wastewater licenses and certifications. Please welcome him aboard. Ms. Mcinnis also explained that we would be having a public hearing and a public meeting of the Board of Trustees this evening. Additionally, there will be a Public Hearing of the Local Liquor Licensing Authority. She explained a change to the wording on page 2 of the Agenda in B-2. MAYOR GAURDERN CALLED THE PUBLIC HEARING TO ORDER AT 6:06 P.M. Town Planner Davis Farrar led discussion and noted that notices had been posted for the hearing. This application is from Leif Erickson Realty, Mr. Max Pollett. The property owners are Mike Schaeffer and Vera Bott. This is a 50-acre parcel that is zoned AGII. The surrounding area is also AG property. They are requesting an Indoor Marijuana Cultivation. It will be a 15,022 square foot greenhouse with administrative offices. They are wanting to do this Phase greenhouse with a Phase II expansion in 2021. This will require a separate building permit. Their plans show 5 future green houses, for a total of 6, built as business allows and with permission for each one. There is a water line % mile away on 45.5 Road. The closest sewer is near the De Beque Fire Station. They are proposing a septic system with a leech field and enclosed system for water used for watering. This water will be disposed in a licensed facility on the Western Slope. Mr. Farrar explained the ownership and lease agreement. If this is approved, they will purchase the property. He also explained that this was a flagpole annexation and that the land or cash in lieu was met by Bluestone Ranch. The new applicant does not have to do this. Davis included comments from the review agencies in his staff report. There are senior water rights that should be dedicated back to the Town. Cash in lieu should only be required if the water rights are not adequate. Maxwell Pollett addressed the Board of Trustees fori the Flower Collective. He stated that he has no objections to the conditions presented. He said he will continue to be in touch with all review agencies. He presented a short slide show. Trustee Black Greening asked how many employees they planned to have. Mr. Pollett said they would have 6 employees in Phase 1 and each block of 3 greenhouses would have 6 more employees. He noted that at harvest times there would be an additional 15 employees. Mr. Pollett said that they have 35 shares of Bluestone Ditch water that will be more than sufficient for their purposes. 1. ADOPTION OF RESOLUTION NO. 2020-27: AI RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF DE BEQUE, COLORADO, APPROVING A RETAIL MARIJUANA CULTIVATION FACILITY LICENSE FOR THE FLOWER COLLECTIVE, LTD AT 1918 45.5 ROAD. APPROVAL OF MINUTES OF NOVEMBER 24, 2020 REGULAR MEETING Motion: Trustee Hansen: with a typo correction. To approve the minutes of the October 20, 2020 Special Meeting Second: Trustee Farris Voice Vote: Trustee Hansentake abstained; all others voted unanimously in favor of the motion. BILLS AND EXPENDITURES: November 2020 Mayor Gaudern explained that if any Trustee feels that they may have a conflict regarding information found in the financial documentation, to identify such information and then abstain from voting on the motion. Trustee Hansen abstained from all bills for the De Beque Country Store. BOARD COMMENTS: There were none. TOWN MANAGER'S REPORT: Ms. Mcinnis informed the Board that there are business grants available through DOLA and also spoke of the Public Works Director. NEW BUSINESS: 1. DISCUSSION AND DIRECTION CONCERNING REGARDING A CONTRACT WITH MESA COUNTY ANIMAL CONTROL. Motion: Trustee Hansen To approve the contract with Mesa County Animal control and giving Town Administrator the ability to negotiate and make changes to the agreement, especially #11.
