MINUTES OF THE SPECIAL SARASOTA COMMUNITY REDEVELOPMENT AGENCY MEETING OF OCTOBER 20, 2014 PRESENT: Chair Willie Shaw, presiding, Vice Chair Susan Chapman, Members Suzanne Atwell, Paul Caragiulo, and Shannon Snyder and Executive Director Thomas Barwin, Attorney Robert Fournier, and Secretary Pamela Nadalini ABSENT: None The meeting of the Community Redevelopment Agency (CRA) was called to order by Chair Shaw at 2:38 p.m. 1. APPROVAL RE: MINUTES OF THE SPECIAL COMMUNITY REDEVELOPMENT AGENCY MEETING OF OCTOBER 6, 2014 (AGENDAI ITEM CRA-1) Chair Shaw noted Community Redevelopment Agency Board consensus to approve the minutes of the Special Community Redevelopment Agency meeting of October 6, 2014. 2. APPOINTMENT RE: DOWNTOWN COMMUNITY REDEVELOPMENT AGENCY ADVISORY BOARD (CRA-2) City Attorney Fournier stated that at the October 6, 2014, Special CRAI meeting, the CRA: approved a motion to delay the possible reappointments of Valerie Buchand and Paul Thorpe to the Downtown Community Redevelopment Agency (CRA) Advisory Board until the October 20, 2014, Special Sarasota Community Redevelopment Agency meeting to allow Staff time to conduct research concerning the Resign-to-Run Law and present findings to the Commission. Secretary Nadalini stated that a motion is necessary to remove from the table the possible reappointments of two members to the Downtown CRA Advisory Board which were postponed by unanimous vote at the October 6, 2014, Special CRA meeting to allow the City Attorney's Office to conduct research regarding holding dual office; that Mr. Thorpe is running for one of the vacant Commission District seats; that Ms. Buchand is a candidate for the Charter Review Board of Sarasota County. City Attorney Fournier stated that the Resign-to-Run Law would not be applicable for the two Downtown CRAAdvisory Board members seeking reappointment; that a specific exemption in the Florida State Statute is: This (the Resign-to-Run Law) would not apply to persons serving without salary as members of an appointed Board or Authority. City Attorney Fournier continued that the original Resolution establishing the Downtown CRA Advisory Board was reviewed; that the Downtown CRA Advisory Board has no independent sovereign authority and is advisory only; that the conclusion is the two Downtown CRA Advisory Board members are not subject to the Resign-to-Run Law and are, therefore, eligible for reappointment. A motion was made by Member Atwell, seconded by Member Snyder, and carried by a 5-0 vote to remove from the table the possible reappointments of Valerie Buchand and Paul Thorpe to the Downtown Community Redevelopment Agency (CRA). Advisory Board. Member Atwell nominated Alexandra Chau for appointment to the Downtown CRAAdvisory Board. Ms. Chau reçeived one vote: Atwell, yes. Vice Chair Chapman nominated Valerie Buchand for reappointment to the Downtown CRAAdvisory Board. Ms. Buchand received three votes: Chapman, yes; Shaw, yes; Snyder, yes. Mr. Thorpe received five votes: Atwell, yes; Caragiulo yes; Chapman, yes; Shaw, yes; Snyder, yes. Chair Shaw announced the reappointments Valerie Buchand and Paul Thorpe to the Downtown Community Redevelopment Agency (CRA). Advisory Board.
