WHEREAS; Texas Election Code Section 216.003 provides as follows: "Sec. 216.003. INITIATING AUTOMATIC RECOUNT. Section 4. Due to the tie vote in the Recount, the two tied candidates, Bianca Valerio and Bruce Leamon, cast lots to determine the winner, pursuant to Texas Election Code, Section 2.028. The casting of lots was held on June 30, 2025 during the Special City Council Meeting and was supervised by the Mayor as presiding officer pursuant to Texas Election Code, Section 2.028. The casting of lots determined that the following person is declared qualified and elected to the office of Councilmember for District B in the City of Pasadena, Texas: Councimember = District B: Seccion 4. If any provision, section, subsection, sentence, clause, or phrase of this Resolution, or the application of same to any person or set of circumstances, is for any reason held to be unconstitutional, void, invalid, or unenforceable, neither the remaining portions of this Resolution nor their application to other persons or sets of circumstances shall be affected thereby, it being the intent of the City Council in adopting this Resolution that no portion hereof or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, voidness, invalidity or unenforceability of any other portion hereof, and all provisions of this Resolution are declared to be severable for that purpose. Section 6. The City Council officially determines that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. DISTRICT B CANDIDATES AGREEMENT Casting of Lots to Determine Winner of Runoff Election District B Race Background Summary Candidates Bianca Valerio and Bruce Leamon each received 272 votes in the June 7, 2025 Runoff Election for District B Councimember. Under Texas Election Code, Sections 2.028 and 216, there shall be an automatic recount to resolve the tie. The Recount was conducted on June 18, 2025 and the tie was not resolved; therefore, pursuant to Texas Election Code, Section 2.028, the candidates shall cast lots to determine the winner. Candidates have been advised that the casting of lots will take place during the Special Council Meeting scheduled at 11:00 a.m. on June 30, 2025 in City Council Chambers at Pasadena City Hall. Further, candidates agree to the following procedures for the casting of lots to determine the winner: Procedures for the Casting of Lots to Determine Winner A coin toss using a quarter that will be selected randomly by the mayor from a roll of quarters contained in a coin wrapper. The quarter will be tossed in the air, in a spinning motion, landing on one of its two sides facing up after landing on the floor or a flat surface. Candidate Leamon has agreed that Candidate Valerio will call the toss, heads or tails, before the coin is tossed. The winner will be the candidate who wins the coin toss.
