Main Street in the Town of Madison, Virginia it was called to order by Chairman Steve Carpenter at 6:30 PM. Determine Presence of a Quorum & Microphone Reminder Chairman Carpenter determined there was a quorum. As a quorum was established the following members were present, Chairman Steve Carpenter, Vice-Chairman Pete Elliott, Commissioners Nathan Cowan, Zack Whitman, Mike Snider. James Graves III and Jim Smith. Also, present was Allen Nicholis; Zoning Administrator. Chairman Clay Jackson for the Bos was and Vice-Chairman Carty Yowell were present. Hannon Wright, County Attorney, attended remotely by GoToMeeting. Adoption of Agenda Commissioner Cowan moved to adopt the agenda as submitted, seconded by Commissioner Snider. Hearing none, the floor was closed. New Business 1). Adoption of Minutes - May 7, 2025 Commissioner Cowan made a motion to adopt the minutes as presented, seconded by Commissioner Whitman. (Case No. RZ-04-25-01) Madison Wood Preservers - Rezoning Application (Second Workshop) Page 1 of7 Kari Gaviria, on behalf of Madison Wood Preservers, has applied to rezone property identified as 98 Oak Park Rd (Madison County tax map 39-96, 0.936 acres) and 206 Oak Park Rd (Madison County tax map 39-98, 0.701 acres) from R-2 (Residential, General) to M-2 (Industrial, General). The purpose of the rezoning application is to facilitate the expansion of Madison Wood Preservers. Chairman Carpenter read the case. Allen Nicholls stated that the adjacent and adjoining property owner letters were mailed as the state code required. No further updates were provided. Applicant Kari Gaviria stated that she met with neighbors to present their future expansion plans. She stated that the neighbors are generally happy with the plan. Commissioner Elliott offered a comment, stating that one makes good neighbors by allowing them to use land for parking. Commissioner Smith inquired about the deadline for receiving comments from the public regarding this application. Allen Nicholls stated that the upcoming public hearing to the last opportunity for the public to comment. (Case No. SU-04-25-01) Davila/Smith Family Day Home - Special Use Permit (Second Workshop) Kelsa Smith and lan Davila are seeking a special use permit in accordance with Madison County zoning ordinance, article 5-2-5 to operate a day care center. The subject property is identified as 401 Burnt Tree Way and further identified as Madison County tax map 58-70F. The parcel is 3.5 acres (GIS) and is zoned R-1. Commissioner Carpenter read the case. Allen Nicholls provided brief updates about the application. VDOT provided. some written, but also verbal, comments regarding the application. VDOT stated that an appropriate entrance is achievable within the existing 20' right of way. John Winn (VDOT representative) stated that VDOT would make it work without physical changes. Supervisor Yowell stated that VDOT's comments were contrary to what had been previously understood. Allen Nicholls stated while the comments are contrary to what were previously understood, the is the communication we are reçeiving from VDOT. John Winn stated that as long as the sightline are established, VDOT intends to issue a permit. Allen Nicholls stated that an OSE visited the applicant's property in order to evaluate the applicant's property. The applicant, in previous correspondence with Allen Nicholls, stated that the current drainfield is acceptable, but paperwork is not yet available to submit. The paperwork is expected to be available soon. Commissioner Cowan stated that he was missing some pages from his packet. Allen Nicholls asked Commissioner Cowan to elaborate on what he is missing. Commissioner Cowan reiterated that he is missing some pages after having downloaded the packet. Allen Nicholls suggested that Commissioner Cowan utilize the web version oft the packet rather than downloading the. .pdf file. Commissioner Snider made an inaudible comment. Page 2 of7 Appliçant Kelsa Smith was invited to speak but declined. Chairman Carpenter stated that a VDH comment is still required. Allen Nicholls stated that a VDH comment is expected. SUPS may be recommended with the approval being conditioned on the remaining items to be completed. Commissioner Whitman inquired ift the applicant already had customers lined up. Applicant Smith stated that she does not have customers lined up. Commissioner Snider inquired about how big the area that is will be utilized for the day home. The applicant responded that the basement of the home is 861 square feet, most of which is a rec room. A utility room and a bathroom are also in the basement. Chairman Carpenter stated that VDOT's current comments state that they are waiting for an entrance profile. Has the applicant begun that process? The applicant replied that she has engaged a surveyor to prepare this map, and it may take up to six weeks. Commissioner Cowan inquired if the applicant does, in fact, need to be licensed. The applicant replied that less than four children would not require licensing. Commissioner inquired if the outdoor area would be fenced in thei future. The applicant responded that she is required to have a four-foot-tall fence. Discussion followed regarding Department of Education permitting requirements. Hannon Wright inquired about the applicant's intentions regarding insurance. Discussion followed, with the applicant stating they intend to obtain an appropriate insurance policy. Chairman Carpenter asked the applicant to elaborate on where they are with the department of health. Discussion followed. (Case No. SU-04-25-02) River House at the Swinging Bridge - Special Use Permit (Second Workshop) Scott (Taki) Sidley is seeking a special use permit in accordance with Madison County zoning ordinance 4-1-1/3-1- 22 (reference article 20-160A) to operate more than one short-term lodging unit. The subject property is identified as 36 Meadows Ln and further identified as Madison County tax map 21-40. The parcel is 13.24 acres (GIS) and is zoned A-1. Chairman Carpenter read the case. Allen Nicholls stated that the applicant will be joining by GOTOMeeting, but is not yet present. Allen Nicholls suggested that the next case (ZOA-05-25-01) be heard now, and the Planning Commission return to case SU-04-25- 02 later, once the applicant is attending online. (Case No. ZOA-05-25-01) Al Esh - Zoning Text Amendment (First Workshop) Al Esh has proposed changes to Article 7 residential multiple family R-3) in order to facilitate more orderly development of housing projects. Chairman Carpenter read the case. Applicant Al Esh spoke and explained that he is primarily asking for a change to Article 7-5-1, with the proposal being a minimum lot width of 65 feet. Discussion followed regarding the reasoning for the request, and specific changes requested. Commissioner Smith suggested that the creation of a new R-4 district would be more appropriate than modifying the existing R-3 district. Discussion continued. Supervisor Yowell inquired with the application if his plan is to hook up to public sewer for a future proposed development. The applicant responded "yes". The applicant expresses his wishes to wait for a proposed future expansion of public services to proceed with any major development. Chairman Carpenter expressed a concern that changes to R-3 will have consequences when paired with the eminent implementation of SB974. Discussion followed. Commissioner Snider stated he had trouble understanding the proposed changes with 7-5. The applicant stated that a good example of the way he would like to shape development is a new development made by Ryan Homes near Hwy 15 in Orange. Discussion followed regarding one of the Applicant's future projects. Chairman Carpenter opened the floor for public comment. Hearing none, the floor was closed. Allen Nicholls stated that a copy of the VDH permit for septic was received by the Zoning Department. Mr. Nicholls clarified that the structure with a deck will not be utilized as an overnight accommodation. Applicant Scott Sidley interjected that the. Discussion followed regarding the location of the septic system and other matters regarding the site plan. Commissioner Elliott made comments that were inaudible. Discussion followed regarding access to the property. Chairman Whitman inquired about future plans regarding the structure identified as "bungalow 3" on the site plan. The applicant explained challenges with handling wastewater in that structure. Discussion followed regarding access to the property and parking. Commissioner Cowan inquired about the definition of short-term lodging units in the zoning ordinance. Allen Nicholls read the ordinance and provided context. Commissioner Smith stated that the fact of this case have been fluid. He stated that the deck structure across the road is problematic. Discussion followed. Informational Correspondence Staff is preparing ordinance amendment proposals for both site plan and subdivision ordinances after the signing of SB974. The proposed amendments are scheduled to be presented to the Board of Supervisors on May 27, 2025. Allen Nicholls gave an update on SB974, including a brief overview of proposed ordinance amendments. Commissioner Smith gave updates from the economic development committee. The economic development committee is working on proposed ordinance changes for development impact and fiscal impact ordinances. Discussion followed.
