Main Street in the Town of Madison, Virginia it was called to order by Chairman Steve Carpenter at 7:00 PM. Determine Presence of a Quorum & Microphone Reminder Chairman Carpenter determined there was a quorum. As a quorum was established the following members were present, Chairman Steve Carpenter, Vice-Chairman Pete Elliott, Commissioners Nathan Cowan, James Graves, HI, Jim Smith, Mike Snider, and Zachary Whitman. Also, present was Allen Nicholls, Zoning Administrator, Hannon Wright, County Attorney, Jonathan Weakley, County Administrator. Board of Supervisor members present were Chairman Clay. Jackson, Vice-Chairman Carty Yowell, and Supervisors Jud Buchanan, Dustin Dawson, and James Jewett. Adoption of Agenda Snider moved to adopt the agenda as submitted, seconded by Whitman. (Case No. RZ-04-25-01) Madison Wood Preservers - Rezoning Application Kari Gaviria, on behalf of Madison Wood Preservers, has applied to rezone property identified as 98 Oak Park Rd (Madison County tax map 39-96, 0.936 acres) and 206 Oak Park Rd (Madison County tax map 39-98, 0.701 acres) from R-2 (Residential, General) to M-2 (Industrial, General). The purpose of the rezoning application is to facilitate the expansion of Madison Wood Preservers. Nicholls added that there is a letter from one MWP neighbor stating no objections to the rezoning, as MWP has been a good neighbor. There has been no negative feedback provided to the Planning and Zoning office to date. Chairman Carpenter opened the floor for public comment. Hearing none, the floor was closed. (Case No. SU-04-25-01) Davila/Smith Family Day Home = Special Use Permit Kelsa Smith and lan Davila are seeking a special use permit in accordance with Madison County zoning ordinance, article 5-2-5 to operate a day care center. The subject property is identified as 401 Burnt Tree Way and further identified as Madison County tax map 58-70F. The parcel is 3.5 acres (GIS) and is zoned R-1. Draft version of the permit includes the definition of the family day home that is used by the Dept of Education. The VDH and VDOT approvals are still not complete, sO operation cannot begin prior to receipt. Additionally, the permit will not be transferable; it will run with the applicant, not the land. Elliott questioned whether the applicant will be able to handle handicapped children. Ms. Smith feels that more research is necessary before answering definitively. She is not sure if her home meets all of the requirements for accommodating handicapped children, or if the Dept of Education would have additional requirements. Updates regarding VDH or VDOT approval: Ms. Smith stated that the land surveyor visited the property today. She is still waiting for some paperwork regarding the septic. Ms. Smith stated that she has been given preliminary approval to use the road as it is, as long as the daycare stays at a limit of 10 children. The soil engineer's report is still pending. He asked if she had any background in dealing with disabilities and she indicated that she had been an RN. Snider made a motion to submit the application to the BoS for approval with all conditions complied with prior to operation, seconded by Cowan. (Case No. SU-04-25-02) River House at the Swinging Bridge - Special Use Permit Scott (Taki) Sidley is seeking a special use permit in accordance with Madison County zoning ordinance 4-1-1/3-1-22 (reference article 20-160A) to operate more than one short-term lodging unit. The subject property is identified as 36 Meadows Ln and further identified as Madison County tax map 21-40. The parcel is 13.24 acres (GIS) and is zoned A-1. Nicholls, a draft defines what is being permitted. The draft permit expresses that the main house, bungalow 1, and bungalow 2 are suggested for approval, as the maximum capacity of the drain field. Certificate of Occupancy is needed prior to those structures being rented to the public. Use of bungalow 3 and the garage are expressly prohibited as overnight lodging, unless the applicant comes back to modify the special use permit. There was one piece of feedback from a neigh that stated no objections to the project, as he has been aware of Mr. Sidley renting the space previously and has had no issues. Upcoming PC Workshop Items (Case No. ZOA-05-25-01) Al Esh - Zoning Text Amendment (Second Workshop) Al Esh has proposed changes to Article 7 (residential multiple family R-3) in order to facilitate more orderly development of housing projects. Nicholls stated that Mr. Esh would likely be willing to table the discussion so that all board members can have ample time to review any data to make an informed decision. Applicant can table the topic at least once. Application Tabled (Case No. SU-05-25-02) Full Life Journey Farm (First Workshop) Reggie Lipscomb is seeking a special use permit in accordance with Madison County zoning ordinance 14-18 to operate an event venue. The subject property is identified as 4299 W Hoover Rd, and further identified as Madison County tax map 23-88. The parcel is 42.86 acres (GIS) and is zoned A-1. Application Tabled (Case No. SU-05-25-01) Gerald Fuchs = Special Use Permit (First Workshop) Gerald Fuchs is seeking a special use permit, in accordance with Madison County zoning ordinance article 5-2-1, for livestock on a lot less than two acres.
