* * UG ison - Coss Madison, Virginia 22727 Madison County Planning Commission Meeting Minutes May 7th, 2025 The Madison County Planning Commission Workshop meeting was held in the Madison County Administrative Auditorium at 414 N. Main Street in the Town of Madison, Virginia it was called to order by Chairman Steve Carpenter at 7:00 PM. The chairman called for the room to recite the Pledge of Allegiance and observe a moment of silence. Determine Presence of a Quorum & Microphone Reminder Chairman Carpenter determined there was a quorum and the first order of business was to adopt the agenda and approve the minutes from the April 16th Planning Commission Workshop. As a quorum was established the following members were present, Chairman Steve Carpenter, Vice-Chairman Pete Elliott, Commissioners Nathan Cowan, Zack Whitman, Mike Snider. James Graves III and James (Jim) Smith. Also, present was Allen Nicholls; Zoning Administrator. Chairman Clay. Jackson for the BoS was present, Bos Vice-Chairman Carty Yowell was present. Supervisors Jud Buchanan, Dustin Dawson, and James Jewitt were also present. Hannon Wright, County Attorney, and Deputy County Administrator Brian Gordon were also present. Adoption of Agenda Commissioner Nathan Cowan moved to adopt the agenda as submitted and Commissioner Jim Smith seconded. Hearing none, thei floor was closed. New Business 1). Adoption of Minutes April 16nd, 2025 Allen Nicholls informed the Commission of a minor error in the minutes that requires amendment. Commissioner Elliott made a motion to approve the minutes as submitted and Commissioner Whitman seconded. Public Hearings (Case No. RZ-03-25-1) Jonathan Baughn Rezoning Application (Public Hearing) Jonathan Baughn has submitted an application to rezone a portion of his property from A-1 (Agricultural) to B-1(Business, General). The applicant is seeking the partial rezoning of his property SO that he may operate his artificial turf and hardscaping business out of an existing building. The property that is the subject of this application is located at 3351 Oak Park Rd and is further identified as Madison County tax map 40-40. The property contains approximately 27 acres and is currently zoned A-1. Chairman Carpenter read the case. Allen Nicholls gave information regarding the area to be rezoned as illustrated on a plat provided by the applicant. Additionally, Allen Nicholls stated that the applicant is working with VDOT to update the entrance to the property. Chairman Carpenter inquired about the applicant working with VDOT. Allen Nicholls encouraged the Chairman to ask the applicant directly about his involvement with VDOT. Commissioner Snider made a comment suggesting that it may be possible for the rezoning not to go forward but allow the applicant to operate his business under the home occupation ordinance. Commissioner Elliott responded to Commissioner Snider's comment by stating that there are concerns with the entrance. Commissioner Elliott went on to state that he felt, in this case, rezoning is the preferable option. Commissioner Cowan stated that he is not in favor of rezoning this small portion of a property. He went on to state that the use is consistent with other properties in the area. The traffic is not that different than what is experienced in farming. Commissioner Cowan stated that he would be in favor of something other than rezoning this small portion of a parcel. With there being no further comments or questions from the Planning Commission, Chairman Carpenter invited the applicant, Jonathan Baughan, to the podium. The applicant introduced himself, and stated that he is actively working with VDOT, and that he can meet the standards for a low-volume commercial entrance. The applicant has changed his inventory delivery from semi- trucks to box trucks in order to avoid unloading material with trucks parked on the road. Commissioner Snider inquired as to what material is being delivered to the applicant's property. The applicant responded that 50lb bags of sand are being delivered. Discussion followed regarding the nature of the applicant's business. Commissioner Snider inquired about how many deliveries by truck are required each year. The applicant stated about five truck deliveries. Discussion followed about the applicant's business practices. Commissioner Smith asked when the applicant planned to build his house on the subject property. The applicant responded that building plans are already under review by Jamie Wilks, the Madison County Building Official. With there being no further questions for the applicant, Chairman Carpenter asked the Planning Commission if there was any further discussion. Commissioner Cowan stated that he is inclined to recommend denial of the application. Commissioner Elliot stated that the denial of the application is problematic based on the use of truck delivery to the site, and the collection of taxes to be derived from the rezoning. Discussion followed. Commissioner Whitman suggested that the rezoning is the best course of action, as has been discussed with the zoning administrator. He went on to state that while this application may be an example of spot zoning, it is likely the best course of action for the County. Commissioner Elliot made a motion to recommend Case No. RZ-03-25-1 to the Board of Supervisors for approval, seconded by Commissioner Whitman. (Case No. 2024-ZOA-12-18-02) Adoption of Personal Campground definition. (Public Hearing) The adoption of a definition for a personal campground is being proposed to allow for by-right recreation on private property but regulate the use of recreational vehicles (RVs) and tents to prevent their use as permanent residences. Chairman Carpenter read the case. Allen Nicholls presented the updated language of the personal campground definition. Commissioner Snider inquired if adoption as a by right use would appear in the verbiage. Allen Nicholls explained where the language would appear in the zoning ordinance if adopted. Discussion followed. Chairman Carpenter opened the floor for public comment. Hearing none, thet floor was closed. Commissioner Snider made a motion to recommend Case No. 2024-ZOA-12-18-02 to the Board of Supervisors for approval, seconded by Commissioner Whitman. Adoption of 2025 Comprehensive Plan (Public Hearing) The Madison County Planning Commission and Board of Supervisors will consider the final draft of the 2025 Comprehensive Plan for adoption. Chairman Carpenter invited Allen Nicholls to illustrate the minor changes to the comprehensive plan prior to recommendation for adoption. Allen Nicholls explained that at typo was corrected, as well as a revision to the vision statement to say 2025 plan instead of 2024 plan. Allen Nicholls pointed out that the word "unreimbursed" had been erroneously removed from one of the goals on page 55 of the comprehensive plan. The word will be added. Chairman Carpenter opened the floor for public comment. Don McCowan with Piedmont Environmental Council made a statement that Madison County got the comprehensive plan right by accurately prioritizing goals and land uses. The adoption of the comprehensive plan was encouraged on behalf of the Piedmont Environmental Council. Peter Work, former Planning Commission member, stated that while it was a long effort, an improved document was produced. He thanked everyone who participated in its development. With there being no further comments, Chairman Carpenter closed the floor for public comment. Chairman Carpenter extended his thanks to all those who worked on the plan, including PEC. Commissioner Elliot made a motion that the Planning Commission resolve to recommend the Comprehensive Plan, with the proposed changes, to the Board of Supervisors for adoption. Other Items from the Planning Commission, Staff, or Public Commissioner Elliott made a comment that he was disturbed to learn that a special use permit is being required for someone to keep a couple of goats behind their house. Commissioner Elliott went on to state that he understands that staff is operating by the rules. However, livestock should be a by right use. Chairman Carpenter stated that Commissioner Elliot is referring to the upcoming case no. SU-05-25-01. Informational Correspondence Allen Nicholls read the following upcoming cases and agenda items: (Case No. SU-04-25-02) River House at the Swinging Bridge - Special Use Permit (Second Workshop) Scott (Taki) Sidley is seeking a special use permit in accordance with Madison County zoning ordinance 4-1-1/3-1- 22 (reference article 20-160A) to operate more than one short-term lodging unit. The subject property is identified as 36 Meadows Ln and further identified as Madison County tax map 21-40. The parcel is 13.24 acres (GIS) and is zoned A-1. (Case No. RZ-04-25-01) Madison Wood Preservers - Rezoning Application (Second Workshop) Kari Gaviria, on behalf of Madison Wood Preservers, has applied to rezone property identified as 98 Oak Park Rd (Madison County tax map 39-96, 0.936 acres) and 206 Oak Park Rd (Madison County tax map 39-98, 0.701 acres) from R-2 (Residential, General) to M-2 (Industrial, General). The purpose of the rezoning application is to facilitate the expansion of Madison Wood Preservers.
