Legislative Hearing 1. 4th and 5th Alley Vacation (Continued item from 3/12/25): Right-of-Way Vacation Application No. 24-SV-07 request for Right-of-Way Vacation approval to vacate an approximately 6,003-square foot portion of alley located between 4th Street and 5th Street, between N. Tamiami Trail and Coconut Avenue, and re-route the alley south to 4th Street, in order to develop the subject property as part of a mixed-use development along with the surrounding parcels. (Rebecca Webster, Planner, Planning Department) Staff Presentation: Rebecca Webster, Planner, Planning Department presented. Ms. Webster provided a brief description of the proposed request. Ms. Webster discussed the location, the reasons for the request and the route of the proposed diverted alley. Ms. Webster briefly discussed traffic circulation, minimizing access points on N. Tamiami Trail and the Standards for Review. Planner Webster noted that Staff recommends approval to the City Commission subject to the conditions listed in the Staff Report. PB Member Clermont posed a question regarding public benefits and setbacks. Ms. Webster spoke to the questions. Alternate PB Member Neihaus posed a question regarding average daily traffic. Ms. Webster spoke to the question. PB Member Clermont posed questions regarding public benefit. Ms. Webster provided examples noting most of the public benefits are tied to the pending Administrative Site Plan. PB Member Clermont spoke to current pedestrian traffic. Chair Deleo posed questions regarding the status of the Administrative Site Plan. Ms. Webster spoke to the questions. Applicant Presentation: Patrick Seidensticker, Bill Waddill, and Danielle Stewart presented. Mr. Seidensticker provided the location, alley reroute and noted that the relocation of utilities is the applicant' S responsibility. Mr. Seidensticker discussed public benefits, attainable housing, and pedestrian experience. Mr. Seidensticker briefly discussed the Standards for Review. Mr. Wadell discussed proposed public benefits attached to the pending Administrative Site Plan. Mr. Waddill presented renderings of the proposed building. Vice Chair LaMay posed a question regarding alley connections to the entrance of the proposed building. Mr. Seidensticker spoke to the question. Vice Chair LaMay spoke to the proposed request. Mr. Seidensticker spoke to the proposed request. Ms. Stewart provided the application number for the Administrative Site Plan (25-ASP-03). PB Member Clermont posed questions regarding proffers and proposed setbacks. Mr. Waddill spoke to the questions. PB Clermont posed a question regarding trees. Ms. Stewart spoke to the question. Mr. Waddill briefly discussed the average daily traffic count. Ms. Webster spoke to the question. Mr. Waddill posed a question regarding the Engineering Design Criteria Manual (EDCM). Ms. Stewart spoke to the question. PB Member Salem posed a question regarding the number of proposed units, proposed attainable units and number of bedrooms. Mr. Waddill spoke to the question. PB Member Salem posed questions regarding the location of attainable units and Area Median Income. Ms. Stewart spoke to the questions. Chair Deleo spoke to the proposed request and pending Administrative Site Plan. Citizen Input: Citizen Input received. Staff Rebuttal: Rebecca Webster, Planner, Planning Department noted that building over the alley right- of-way is not recommended per the Utilities Department, addressed Standards for Review and explained the Traffic Study will be reviewed concurrently with the Site Plan. Ms. Webster provided dimensions for the diverted right-of-way that is proposed to be designated as public right-of-way. PB Member Clermont posed a question regarding traffic and safety. Ms. Webster spoke to the question. Alison Christie, General Manager, discussed traffic study requirements. Vice Chair LaMay posed a question regarding city utility vehicles going underneath the building. Ms. Christie spoke to the question. Applicant Rebuttal: Bill Waddill discussed meeting with surrounding neighbors, tree requirements and utility upgrades. Patrick Seidensticker discussed setbacks, and public benefits. PB Member Salem posed a question regarding additional bonus units. Mr. Seidensticker spoke to the question. Vice Chair LaMay posed a question regarding green space. Mr. Seidensticker spoke to the question. Vice Chair LaMay posed a question regarding retail for the proposed Administrative Site Plan. Mr. Seidensticker spoke to the question. Vice Chair LaMay posed questions regarding public benefits. Mr. Waddill spoke to the questions. The Planning Board Members held a discussion regarding the proposed request and proffers. Deputy City Attorney Shamsey spoke to the proffers. Ms. Christie spoke to the question. PB Member Clermont made a motion to recommend approval to the City Commission. Motion failed 3-2. The Planning Board Members discussed the motion. Alternate PB Member Neihaus made a motion to recommend denial of the proposed request to the City Commission. Motion passed 3-2. V. CITIZEN'S INPUT NOTICE TOTHE. PUBLIC: At this time Citizens may address the. Planning Board on topics of concern. Items which have been previously discussed at Public Hearings may not be addressed at this time. (A maximum 5- minute time limit.) There was no citizen's input. VI. APPROVAL OF MINUTES No Minutes to approve. VII. PRESENTATION OF TOPICS BY STAFF Alison Christie, General Manager noted that the Zoning Code does not require a Site Plan and Street Vacation to be presented concurrently and noted that the Planning Board can make a recommendation to City Commission to change the Code. The Planning Board members held a discussion regarding the process. VIII. PRESENTATION OF TOPICS BY PLANNING BOARD Items presented are informational only (no action taken).
