If approved, the replat will result in three (3) lots approximately 0.23 acres each in area. The dimensions for the three proposed lots are approximately 50 feet by 200 feet. The proposed lots will each front 14th street. The current site consists of two (2) lots each of which are approximately 0.34 acres in area. The northeastern portion of the site is partially within Flood Zone X and Zone X (0.2%).1 The total area of the two lots combined is approximately 30,000 square feet. The current Future Land Use designation and zoning district are Residential Low Density for both categories. The property usage tax code is vacant for both parcels according to the Bay County Property Appraiser's website. This review considers minimum lot area, minimum lot frontage, median lot size, and maximum density requirements. Minimum Lot Area and Frontage The City of Mexico Beach Land Development Code (LDC) does not have minimum lot size requirements. However, all development in Mexico Beach is required to have a total land area sufficient to meet all development design standards. 2 This requirement would preclude the applicant from receiving a setback variance. Further, there are no minimum lot frontage requirements for individual lots within a residential development. Density requirements must be met, and the total land area must be sufficient to meet all other development design standards (see Section 3.01.01.B). 3 In addition, "Land, exclusive of individual lots to be conveyed in fee simple ownership, shall be controlled and maintained through a condominium association, property owners'a association, or other similar provision, or may be conveyed to governmental or not-for-profit organizations." These lots are not controlled by a condominium or property owners' association. The density requirements are met as discussed below in subsection 3 of this report. This requirement is met. 2. Median Lot. Size Section 3.07.00 states "Lots created by lot split or subdivision of an existing lot in a platted or unplatted residential area zoned "Residential - General" or Residential - Low Density" shall be no more than ten percent (10%) smaller than the median size of all other lots located in the subdivision, on the same street, or neighborhood, as originally platted in a recorded or unrecorded plat, and no less than the minimum lot size sufficient to meet all development design standards in this Code." The median size of lots surveyed within a % mile distance of the subject lots is 0.172 acres. The newly created lots will each be 0.23 acres in size. This requirement is met. 3. Maximum Density The maximum allowable density within the Residential Low Density zoning district is six (6) units per acre. 4 This equates to a minimum area (to meet density) of 7,260 square feet of land. The replat to three (3) lots with an approximate total acreage of 0.23 acres ( or 10,019 square feet) will allow a maximum of one unit per parcel. (Anchor) completed a review of the replat application for 104-102 14th Street, Mexico Beach, FL; parcel ID numbers for these vacant lots are 04398-010-000 and 04398-010-010. Below is a summary of Anchor's review of this plat application regarding stormwater. PLAT REVIEW Anchor reviewed the replat application to determine if a stormwater review would be a requirement as part of this replat process. Based on conversations with City staff and the City Planner, it was determined this would not be considered a residential subdivision development; therefore, Article II: Subdivision Regulations of the Land Development Code would not apply and this would be considered a "Subdivision (of Property). The Land Development Code further states that Stormwater Management permitting for single family units is exempt from Florida Department of Environmental Protection Chapter 17-25 F.A.C. requirements; however, the parcels shall be designed, constructed, and maintained in accordance with Land Development Code subsection 4.06.03. regarding water quality, quantity, aesthetics, grading, storage, etc. See excerpts below from the Mexico Beach Land Development Code. 3.00.00 General Provisions 3.00.04 Definitions Subdivision (of Property) The subdividing or splitting of any platted or unplatted parcel into three or more parcels, each of which will become independent parcels with individual Parcel Identification numbers. The parcels created must be of sufficient size and configuration to meet the requirements of the Zoning District in which they are created and the requirements of this code. 4.06.00 Stormwater Management 4.06.02 General Requirements A. All non-exempt development (exemptions are defined in Section 17- 25.030 F.A.C) must obtain a stormwater discharge permit from the Department of Environment Regulation pursuant to Chapter 17-25, F,A.C. ghdhoue BI and be designed, constructed, and maintained in accordance with subsection 4.06.03. 1. Single-family units, duplexes, triplexes, and quadplexes exempted from the requirements of Chapter 17-25 F.A.C. shall be designed, constructed, and maintained in accordance with subsection 4.06.03. FINAL COMMENTS Itisi important to note that while stormwater review and/or permitting is not required for this replat. a stormwater review may be required for future development on these sites depending on how the Applicant intends to develop the site after replating.
