City OfCalimesa City Council Minutes of Regular Meeting May 5, 2025 CALL TO ORDER 6:00 p.m. by Mayor Molina. ROLL CALL: MAYOR MOLINA, MAYOR PRO TEM CERVANTEZ, COUNCIL MEMBER CUNDIEFF, COUNCIL MEMBER GARCIA AND COUNCIL MEMBER MANLY. ABSENT: None STAFF: CITY ATTORNEY FLOWER, CITY CLERK GERDES, FINANCE DIRECTOR REID, INTERIM PUBLIC WORKS DIRECTOR SHAKIR, CITY ENGINEER THORNTON, FIRE CHIEF O'CONNELL AND SHERIFF CAPTAIN NORTHRUP. Mayor Molina introduced Pastor Olin Richey of the Calimesa Worship Center who greeted the Council and provided an invocation. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mayor Molina. COMMUNICATIONS FROM THE PUBLIC Pursuant to the Brown Act, this is the opportunity for members of the public to directly address the Council on any item within the Council's subject matter, jurisdiction. Please note that this is also the time in which members of the public may address the Council on any item on the Consent Calendar. This is not the time for City Council discussion of non-agenda items After receiving public comments, Council Members, or staff, after being recognized by the Mayor, may briefly respond to statements made by the public or questions posed by the public In addition, Council Members may ask questions for clarification or make a referral to staff for factual information to be reported back to the Council at a later meeting. Howard Reeves, 1017 Douglas Street, Calimesa spoke on behalf of the Parks, Trails and Community Services Commission and thanked staff for their hard work on the Easter Egg Hunt and Earth Day events recently held. He added that both events were very successful and expressed his desire to keep the booths as part of the events, as they provide great information to the public. He thanked the Commissioners and the City Council Members for their attendance. Joyce Mcintire, Yucaipa Valley Water District Board Member spoke regarding the Drinking Water, Recycled Water and Sewer Facility Tour for Elected Officials and Commissioners scheduled for Friday, May 16, 2025 at Crystal Creek from 9:00 am = 1:30 pm. She further provided an update of the drilling that has begun at Roberts Road in the Oak Valley Town Center area, adding that Layne Christensen is the contractor on the project. Larry Fraker, 35080 Chandler Ave., Calimesa spoke regarding the recent change to the Mobile Home Rent Stabilization Ordinance stating his objection to the changes of a hearing officer in place of the Board. City Council Action Minutes of the Regular Meeting of May 5, 2025 Page 1 of 6 Harvey Daulton, 35080 Chandler Ave, Calimesa stated his opposition to the recent change to the Mobile Home Rent Stabilization Ordinance, stating that decisions should not be made by only one person. He questioned why notice is not provided to the public regarding city council meetings and other city information. Donna Johnson, 950 California Street, Calimesa provided copies of photos and information regarding the shuffleboard courts and game room located at The Californian Mobile Home Park. She further expressed her opposition of documents submitted by Mr. Wang in the Capital Improvement Petition, stating that improvements were made in 2022 prior to Mr. Wang's purchase of the Mobile Home Park, adding that he should not be able to include them in the petition. Mayor Molina ntroduced Angelina as the new Yucaipa/Calimesa News Mirror reporter and thanked her for attending. APPROVAL OF THE AGENDA, CONSENT CALENDAR AND WAIVER OF FULL READING OF ORDINANCES - This is the time for the City Council to notify the public of any changes to the agenda; such as removal of an agenda item, rearrangement of the agenda, postponement of an agenda item or continuance of an item to a future meeting. This is also the time for the City Council to. remove items from the Consent Calendar for individual consideration. Waiver offull reading ofc ordinances does not take policy action or approve or disapprove any ordinances on the agenda, it simply means that the entire text of the ordinance will not be read. Mayor Molina asked ift there were any necessary changes to the agenda or any items to be removed from the Consent Calendar for discussion. There were no items removed for discussion. APPROVAL OF WARRANT REGISTERS. a) Check Register Report with a total of $464,968.13 (Check Nos.43452-43505) b) April 24, 2025 Payroll of $114,383.44 4. TREASURER'S REPORT FOR THE MONTH ENDED MARCH 31, 2025. RECOMMENDATION: That the City Council receive and file the Investment Report for the month ended February 28, 2025. APPROVE 2nd READING BY TITLE ONLY AND ADOPT ORDINANCE NO. 410, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CALIMESA, CALIFORNIA AMENDING SECTIONS 9.05.030, 9.05.040, 9.05.050, 9.05.090, 9.05.100, 9.05.110, 9.05.120, 9.05.140 AND 9.05.180 OF THE CALIMESA MUNICIPAL CODE RELATED TO THE MOBILE HOME PARK RENT STABILIZATION PROGRAM PERTAINING TO THE MPLEMENTATION OF A HEARING OFFICER PROCESS AND REPEAL OF THE MOBILE HOME RENT STABILIZATION BOARD. RECOMMENDATION: That the City Council approve 2nd reading by title only and adopt Ordinance No. 410, an Ordinance of the City Council of the City of Calimesa, California amending sections 9.05.030, 9.05.040, 9.05.050, 9.05.090, 9.05.100, 9.05.110, 9.05.120, 9.05.140 and 9.05.180 of the Calimesa Municipal Code related to the Mobile Home Park Rent Stabilization Program pertaining to the implementation of a hearing officer process and repeal of the Mobile Home Rent Stabilization Board. 6. RESOLUTION OF OPPOSITION TO SOUTH COAST AIR QUALITY MANAGEMENT DISTRICT'S PROPOSED AMENDED RULES 1111 AND 1121. RECOMMENDATION: RECOMMENDATION: That the City Council adopt Resolution 2025-15, A Resolution of the City of Calimesa, California Opposing the South Coast Air Quality Management District's Proposed Amended Rules 1111 and 1121. 7. RESOLUTION APPROVING THE AMENDMENT OF THE RESTATED CITY OF CALIMESA CAFETERIA PLAN AND PERSONNEL RULES. RECOMMENDATION: That the City Council: 1. Resolution 2025-16, A Resolution of the City Council of the City of Calimesa, California Amending the Personnel Rules and Regulations for the City of Calimesa Adopted by the City Council on November 20, 2017. 2. Resolution 2025-17, A Resolution of the City Council of the City of Calimesa, California Approving the Adoption of the Restated City of Calimesa Cafeteria Plan and Rescinding Resolution 2022-31 in its Entirety. 8. 4TH STREET - PAVEMENT REHABILITATION AGREEMENT WITH SAN GORGONIO PASS WATER AGENCY. RECOMMENDATION: That the City Council authorize the Mayor to execute an agreement with San Gorgonio Pass Water Agency (SGPWA) for 4th Street Pavement Rehabilitation (Flordason Drive to County Line Road). SHERIFF CAPTAIN REPORT Captain Northrup reported Part 1 Crimes for April as follows: 2 robberies, 1 assaults, 2 burglaries, both were burglaries of business, 1 vehicle theft, 8 Theft Larceny's for a total of 14 Part 1 crimes for April and a total of 95 Part 1 crimes year to date. He further reported that on April 24, 2025 members from the Riverside County Sheriff's Department Cabazon Station Crime Suppression Unit and the Calimesa POP Deputy conducted a Quality-of-Life Operation in the City of Calimesa. The below listed statistics are a result of the operation: 1 traffic enforcement stop was made for a vehicle code violation, 1 citation was issued for the vehicle code violation, 7 parking citations were issued, 4 arrests were made for outstanding warrants and they Assisted Code Enforcement with a code violation inspection. He concluded that the Riverside County Sheriff's Office encourages the City Council Action Minutes of the Regular Meeting of May 5, 2025 Page 3 of 6 public to celebrate Cinco de Mayo responsibly by planning ahead and designating a sober driver, adding that there will be additional officers on patrol looking for drivers suspected of driving under the influence of alcohol and/or drugs. FIRE CHIEF REPORT Fire Chief O'Connell reported 861 calls for service year to date, with 589 of the calls being medical aid, 232 misc. calls and 53 fire responses. He further reported 196 calls for service in to Yucaipa and 17 auto aid calls made by Calimesa. He announced that the brush engine was out of service and would be returned to the Forestry and Fire Protection program, adding that alternatives would be considered at a future date. He provided an update on the Fire Hazard Severity Zone stating that a letter was received by the Building Industry Advisory (BIA) regarding the zone and providing their comments. Mayor Molina thanked Chief O'Connell and his team who attended the "Love Yucaipa/Calimesa" event that was held on Saturday May 3, 2025 in Yucaipa, adding that she appreciated the ladder truck being displayed with the American Flag for the event. Fire Chief O'Connell thanked Firefghter/Paramedic Payne, Apparatus Engineer Manus and Firefighter/EMT Ortiz for their commitment to participating in the event. BUSINESS ITEMS 9. COUNCIL DISCUSSION AND CONSIDERATION OF A BUDGET ADJUSTMENT FOR ADDITIONAL FUNDING FOR THE CALIMESA CULTURAL AND PERFORMING ARTS ASSOCIATION FOR FISCAL YEAR 2024-2025.. RECOMMENDATION: That the City Council: 1. Discuss and consider additional funding for the Calimesa Cultural and Performing Arts Association for Fiscal Year 2024-2025. 2. If additional funding is approved, adopt Resolution 2025-18, A Resolution of the City Council of the City of Calimesa, California, Amending the FY 2024-25 Budget to Include an Adjustment in the Community Services Community Partnerships Account in the General Fund. Deputy City Manager/City Clerk Gerdes presented the agenda report. Steve Negrete, President of the Calimesa Cultural and Performing Arts Association spoke in support of his request for funding for the Annual Concerts. After discussion there was Council consensus not to approve any funding to the Calimesa Cultural and Performing Arts Association at this time and encouraged Mr. Negrete to apply for funds during the 25/26 Fiscal Year through the soon to be implemented Community Partnership grant program. City Council Action Minutes of the Regular Meeting of May 5, 2025 Page 4 of 6 MAYOR & COUNCIL MEMBER REPORTING OF COUNTY & REGIONAL MEETINGS/CONFERENCES This is the time for general comments, announcements, reports on meetings attended at public expense as required by AB 1234, requests of staff, and other issues of concern to Council Members may be presented briefly at this time. The Council may not legally take action on any item presented at this time other than to direct staff to investigate a complaint or place an item on a future agenda unless (1) by a majority vote, the Council determines that an emergency situation exists, as defined by Government Code $ 54956.5 or (2) by a four-fifths vote, the Council determines that there is a need for immediate action and the need for action arose subsequent to the agenda being posted as required by Government Code $ 54954.2(b). Council Member Cundieff reported that he attended the SCAG Annual Conference in Palm Desert on May 1st and 2nd. He thanked staff for the fantastic job they did with the May 3rd Earth Day Event, adding that the booths were great and CR&R did a great job. Council Member Manly reported that the Pavement Management Project is close to being complete and thanked staff for a great Earth Day event on May 3rd, adding it was a well-attended great event. Council Member Garcia reported that he attended a conference with the Beaumont Unified School District and would be making a presentation at the Riverside County Department of Education on May 6th. He further thanked staff for their work at the Summerwind Park with the recent reported issues. Mayor Pro Tem Cervantez reported that he attended the Earth Day Event, adding it was a fantastic event, the booths were great and thanked staff for a great job. He stated that it was good to see the community excited about getting rid of their junk. He further reported that he attended meetings of the WRCOG and the RCA and would provide a written summary to the Council. Mayor Molina reported that she attended a Metro Link meeting on April 22nd, LAFCO on April 24th, RTA Board April 24th, a training in Murrietta on April 27th, an RCTC Budget meeting on April 28th and the SCAG Annual Conference on May 1st and 2nd where they adopted the fiscal year budget and ratified the 25/26 officers that were installed. She further reported that she attended the Earth Day Event on May 3rd, stating that it was good to see the Commissioners and Council members in attendance, adding it was a great event with a long wait for trash drop off. She further reported that she attended the Love Yucaipa/Calimesa event in Yucaipa on May 3rd and thanked the Fire Chief for bringing the ladder truck to fly the American Flag at the event. CITY MANAGER COMMENTS & REPORTS Deputy City Manager/City Clerk Gerdes reminded Council of three events and requested that they confirm with her their attendance to each.
