MINUTES OF MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, June 3, 2025, at 5:00 p.m., in Council Chambers. The following people were present: Mayor Rebecca Wyhof Salmon Council Member Byron Buckels Council Member Jean Dabbs Council Member Walter Ferguson Council Member Linda Rhodes Council Member Charles Taylor Council Member James Williams City Manager Hal Hegwer City Attorney Susan Patterson City Clerk Bonnie Bryant Deputy City Clerk Vicki Cannady CALL TO ORDER Mayor Salmon called the meeting to order. Mayor Pro Tem Akinosho led the invocation and the Pledge of Allegiance was recited. PUBLIC COMMENT (Exhibit A) Sanford Housing Authority Interim CFO Deborah Kauba, residing at 911 Merchants Court, Sanford, North Carolina, reviewed Sanford Housing Authority accomplishments since February 17, 2025, that included the completion of the 2023 Audit that was submitted today, as well as the 2024 Audit, that should be completed and submitted no later than June 2025. Funds that were on hold due to non- compliance have been released; water agreements for tenants have been executed, and she noted that the water bills for the mass-metered tenants will be paid through the Sanford Housing Authority. They have initiated their committee meetings with the Sanford Housing Authority Board. Sanford Housing Authority Interim Director of Rental Assistance and Resident Services Renate Bennett, residing at 3103 Cardinal Lake Drive, Durham, North Carolina, 27704, stated that she has been employed with Sanford Housing Authority since April 2022. She explained that there was aj period when staff was not allowed to attend any of the Board Meetings, nor were they allowed to discuss matters and were threatened with termination; therefore issues, such as the outstanding water bills, failure to pay vendors, etc., were not known by staff; the Board meetings were held for the executive staff only. Danielle Tilghman chose not to speak. Sanford Housing Authority Assistant Manager Tonya Buie-Davis, residing at 60 Franklin Court, Sanford, North Carolina, explained that she was employed with Sanford Housing Authority in 2017 and resigned in March 2023, because of the prior management. Approximately three weeks ago, she became employed again with Sanford Housing Authority. She was the ROSS Grant Coordinator in her previous employment with Sanford Housing Authority and her salary was paid through this grant program; however, due to lack of proper management, the Sanford Housing Authority was unable to renew the ROSS Grant, and she resigned her job. CASES FOR PUBLIC HEARING There were no cases for public hearing. DECISIONS ON PUBLIC: HEARING Application by Application by Mark Lyczkowski to amend the Burns Towns Conditional Zoning District to allow the redesign of the townhome community subject property on the east side of Burns Drive to include road realignment, adding an off-street parking area, and adding four townhome lots/units. The proposed redesign affects one of the two parcels included in the overall 7.11 +1- acre project site zoned Burns Towns Conditional Zoning District. All other conditions included in the original 2022 site plan/subdivision plan conditional zoning approval shall remain unchanged. The subject property is a 3.3- acre vacant tract of land located in the southeastern corner of Burns Drive and Friars Drive. owned by Burns Drive, LLC. and is identified as Lee County Tax Parcel 9643-57-6362-00 as depicted on Tax Map 9643.02. The proposed amended zoning district would be referenced as Burns Towns Conditional Zoning District, Amendment #1. (Exhibit E) Senior Planner Amy McNeill reminded Council that the Planning Board met on May 20, 2025, after the public hearing was held on this application and recommended by unanimous vote that the City Council approve this request. The Planning Board determined that this request is consistent with the Plan SanLee Long Range Plan designation of Neighborhood Center because it allows attached single-family dwellings or townhomes as a residential use and the site is included in a larger Neighborhood Commercial area that extends to Burns Drive. The Board found the request is reasonable and in the public interest, since the request amends an existing conditional zoning district that was approved in 2022. Vote to Approve a Statement on Long-Range Land Use Plan Consistency as it Relates to this Zoning Map Amendment Council Member Buckels made a motion that the proposed zoning map amendment is consistent with the Plan SanLee Long Range Plan designation of Neighborhood Center 2 City Council Meeting June 3, 2025 because it allows attached single-family dwellings (townhomes) as a residential use and this site is included in a larger Neighborhood Commercial area that extends all the way to Burns Drive. Seconded by Council Member Rhodes, the motion carried unanimously. Ordinance Amending the Official Zoning) Map ofthe City ofSanford, North Carolina (Exhibit F) Council Member Rhodes made a motion to approve the proposed zoning map amendment, because it is reasonable and in the public interest since the request amends an existing conditional zoning district that was approved in 2022. Seconded by Council Member Buckels, the motion carried unanimously. Application by John Woodlieftoi rezone vacant land with frontage onl Lee Avenue (SR 1133). Commerce Drive and Robert E. Lee Drive from Suburban Neighborhood-Low (SN-12) to the Lee Avenue Conditional Zoning District to allow the development of a townhome community via the site plan/subdivision plan conditional (re)zoning process. The subject property is a 36.38- acre +/- tract of land owned by AGA Corporation and identified as Lee County Tax Parcel 9651-90-8705-00 as depicted on Tax Map 9632.01. (Exhibit G) Senior Planner Amy McNeill reminded Council that the Planning Board met on May 20, 2025, after the public hearing was held on this application and recommended by unanimous vote that the City Council approve this request. In making this recommendation, the Planning Board determined that this request is consistent with the Plan SanLee Long Range Plan designation of Mixed-Use Activity Center because it allows attached single-family dwellings or townhomes as a proposed use. They determined the request is reasonable and in the public interest since the adopted Plan SanLee Long Range Plan is supportive of the land uses and the site is in the corporate City Limits and has access to public water, sewer, and streets. Topics of discussion included the following: Fifty percent of the site is proposed as open space; the area along Commerce Drive is growing and evolving; the Lee Avenue traffic concerns are valid and North Carolina Department ofTransportation approval will be required for the Commerce Drive connection and Lee Avenue connection, which may require a Traffic Impact Analysis (TIA) and roadway improvements; and, the extension of Commerce Drive to Lee Avenue creates good connectivity. Ordinance Amending the Official Zoning Map ofthe City of Sanford, North Carolina (Exhibit H) Council Member Rhodes made a motion to approve the proposed zoning map amendment because it is reasonable and in the public interest since the adopted long-range plan is supportive of the land uses, the site is in the corporate City limits and has access to public water, sewer, and streets. Seconded by Council Member Dabbs, the motion carried unanimously. NEW BUSINESS Petition Requesting Contiguous Annexation of32.466 +/- Acres Owned by Sanford Bowman, LLC Long-Range Planning Administrator David Montgomery reviewed the information related to this request as defined in the agenda packet. Resolution Directing the Clerk to Investigate al Petition for Contiguous Annexation Under G.S. 3 City Council Meeting June 3, 2025 160A-31 (Exhibit I) Council Member Dabbs made a motion to approve the Resolution Directing the Clerk to Investigate a Petition for Contiguous Annexation Under G.S. 160A-31. Seconded by Council Member Ferguson, the motion carried unanimously. Receive Certificate of Sufficiency (Exhibit J) City Clerk Bonnie Bryant confirmed that the Certificate was sufficient. Resolution Fixing Date of Public Hearing on Ouestion of Annexation Pursuant to G.S. 160A- 31 (Exhibit K) Council Member Ferguson made a motion to approve the Resolution Fixing the Date ofPublic Hearing on the Question of Annexation Pursuant to G.S. 160A-31, which will be held on June 17, 2025, at 6:00 P.M. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. Ordinance Amending the Annual Operating Budget for FY 2024-2025 (General Fund GASB 87 Entries) (Exhibit L) Assistant City Manager Beth Kelly explained that this amendment is for the appropriated fund balance and lease financing proceeds to be divided between the Debt Service, Public Building and Fire Departments. Council Member Buckels made a motion to approve the Ordinance Amending the Annual Operating Budget for FY 2024-2025 (General Fund GASB 87 Entries). Seconded by Council Member Ferguson, the motion carried unanimously. Ordinance Amending the Annual Operating Budget for FY 2024-2025 (General Fund GASB 96 Entries) (Exhibit M) Assistant City Manager Beth Kelly explained that this amendment is for the appropriation of fund balance and subscription financing proceeds for the Service, Finance, and Fleet Departments. Council Member Rhodes made a motion to approve the Ordinance Amending the Annual Operating Budget for FY 2024-2025 (General Fund GASB 96 Entries). Seconded by Council Member Dabbs, the motion carried unanimously. Ordinance Amending the Annual Operating Budget for FY 2024-2025 (Utility Fund GASB 87 Entries) (Exhibit N) Assistant City Manager Beth Kelly explained that this is Utility Fund Appropriations for retained earnings and lease financing proceeds. Mayor Pro Tem Akinosho made a motion to approve the Ordinance Amending the Annual Operating Budget for FY 2024-2025 (Utility Fund GASB 87 Entries). Seconded by Council Member Buckels, the motion carried unanimously. Ordinance Amending the Annual Operating Budget for FY 2024-2025 (Utility Fund GASB 96 Entries) (Exhibit O) Assistant City Manager Beth Kelly explained that this Ordinance will appropriate retained earnings and subscription financing proceeds to be divided between the Debt Service and Utility Fund Warehouse Departments. 4 City Council Meeting June 3, 2025 Council Member Dabbs made a motion to approve the Ordinance Amending the Annual Operating Budget for FY 2024-2025 (Utility Fund GASB 96 Entries). Presentation of] Proposed Annual Operating Budget for Fiscal Year 2025-2026 (Exhibits P.O) Assistant City Manager Beth Kelly gave a slide presentation and an overview ofthe proposed City of Sanford Fiscal Year 2025-2026 Annual Operating Budget, (Exhibit P) including the Utility Fee Schedule changes as described in (Exhibit Q). She explained that the budget will be presented at the June 10, 2025, City Council Workshop for discussion and then aj public hearing and adoption will be scheduled for June 17, 2025. OTHER BUSINESS There was no other business.
