Shives BY-LAWS BOARD OF COMMISSIONERS OF FULTON COUNTY, PENNSYLVANIA NOW, this 3rd day of January 2023 the following By-Laws are adopted by the Board of Commissioners of Fulton County, Pennsylvania, for the regulation of business of the Board, pursuant to provisions found in the County Code, the Act of August 9, 1955 (16 Purdon, Section 503 and 509 as amended). ARTICLE Section 1. The proceedings of the Board of Commissioners of Fulton County shall be governed as a general matter by the County Code, insofar as the text of the Code specifies particular procedures. Section 2. The purpose of these By-Laws is to establish a uniform mode of conducting the business of the Board in matters not specifically regulated by the County Code sO that members and the general public can be aware at all times concerning the schedule of meetings, mode of proceeding and other prevailing rules in order that the transaction of public business may be accomplished in a manner characterized by promptness, efficiency, fairness and courtesy. ARTICLE II Section 1. Two members of the Board shall constitute a quorum for the transaction of business (County Code, Section 504). Section 2. Meetings of the Board of Commissioners shall be governed, SO far as practicable, by Robert's Rules of Order, using the latest published edition with the following exceptions: a. It shall not be necessary that any motion be seconded. b. Any motion by a Commissioner shall be considered on the floor and subject to discussion and action by the Board whether presented by the Chairman or by any member. C. Every member including the Chairman is entitled to vote on any matter brought to the floor. Section 3. Regular meetings will be held at the Commissioner's Office, 116 West Market Street, Suite 203, McConnellsburg, Pennsylvania, on every Tuesday of each week. Special meetings may be held at the call of the Commission, which all the Commissioners shall have received at least twenty (20) hours written or oral notice (County Code Section 503 b). All meetings of the Board shall comply with Act 84 of 1986, 65 P.S. 271 et seq. known as the Sunshine Act. Section 4. The Chairman or any member may request a vote of the Board on any motion by voice or by show of hands. The secretary shall record in the minutes the names of those voting for and those against the motion, and those abstaining. ARTICLE III Section 1. The Board of Commissioners at its regular meeting in January of each year shall nominate and at the same meeting elect by open ballot the following officers who shall preside during that calendar year: (1) Chairman (2) Vice-Chairman (3) Secretary Section 2. Each officer SO elected shall continue to serve until his successor shall have been designated. Section 3. The Chairman and Vice-Chairman shall be elected from the membership of the Board. The Secretary may be a member of the Board or may be a non-member, elected by the Board for this duty. Section 4. Upon the death or resignation of any officer elected by the Board, the vacancy shall be filled by action of the Board and the designee shall hold office for the remainder of the current year. Section 5. The duties of the respective officers named shall be those customarily attached to these offices. ARTICLE IV AMENDMENTS Section 1. These By-Laws may be amended at any regular or special meeting of the Board of Commissioners, providing notice of the text of the proposed amendment has first been given in writing to each member of the Board at least ten (10) days in advance of the meeting at which action concerning adoption by By-Laws takes place.
