ISSUES, REVIEW & FINANCE WORK SESSION May 1, 2025 A special meeting of the St. Clair Borough Council was held to review issues and finance on Thursday, May 1, 2025, beginning at 6:30 p.m. In attendance were council members Joann Brennan, Cheryl Dempsey, Norm Diehl, Judy Stednitz-Julian, Bill Dempsey, President Thomas Dempsey and Mayor Tomko. Absent was Councilman Tony Klazas, Others in attendance included Solicitor Ed Brennan, Borough Secretary Roland Price, Treasurer Carol Sutzko, Electric Light Superintendent Bob Petrozino, Barbara Artz, Blake Herndan, Tom Kelly, John Zachar, Mike Petrozino, and Vaughn Vesay. PUBLIC COMMENT - A 17-year resident, Blake Herndan, asked for permission to begin a summer recreational basketball program at the Third Street basketball courts. Councilman Bill Dempsey who runs a similar program within the St. Clair School, mentioned the school is undergoing construction this summer, forbidding the program to take place. Pat McCord offered to help run the program if coordinated with the Pottsville Barefield Program. Council consented. Councilman Norm Diehl suggested they run a basketball tournament as a fundraiser for the 175th Anniversary events. Secretary Price will confirm if we need to add this event to our insurance policy. Mayor Tomko asked for an executive session for personnel matters. He asked if an enforcement of a Burn Ban be placed on the agenda. This will be discussed with the fire chief. Treasurer Carol Sutzko presented the 1st Quarter Financial Report to council members. She also added, the annual CPA audit will begin the week of June 16th. Borough Secretary Roland Price reviewed his Secretary's Notes. Borough Secretary's Notes Statement of Financial Interest Forms due May 1. The Schuylkill Conservation District and the County of Schuylkill applied for funding to conduct a study for the Schuylkill River Port Carbon Flood Mitigation Plan which is aimed at reducing flooding events mainly in the Boroughs of Port Carbon, Middleport, New Philadelphia, and St. Clair. St. Clair Borough and nearby communities will be listed as Co-Sponsors. AMP representatives held a meeting in Kutztown on Tuesday, April 22 providing an energy update. Following the recommendation from Sergeant Brad Blanner, Tim Walsh will be on Tuesday's agenda to be added as a part-time police patrolman. Porcupine Pat is requesting permission to add additional book racks to be placed next to the current book racks at the Police Station and outside of Boone Park. The Borough Secretary request an executive session for personnel issues. The Borough's Insurance review was completed as of May 1, 2025. The borough received approximately $55,000 in return dividends. The small increase this year in the premium is due to the inclusion of about $3,500,000 increased coverage for all the Electric Poles, traffic signals, etc. Currently an application is being prepared for Cyber Security insurance. To qualify for cyber insurance certain procedures and protocol must be followed, which are being implemented. The Borough Secretary completed three out of four Advance Flood Plain Management courses, each -hours long. Solicitor Ed Brennan asked for an executive session to discuss personnel issues. The proposed Game of Skill Ordinance was discussed. The ordinance was already advertised, but minor changes can be made before it is approved at the council meeting. Ordinance #446 = Customer Owned Generation as well as the Ordinance known as XXXXX needs to be updated and added. Solicitor Brennan asked for the changes to be sent to him. The Technical Requirements also needs to be added by Resolution. Electric Light Superintendent Bob Petrozino added that a resident is potentially going online with their solar power on May 3. Councilman Norn Diehl opened discussions concerning the Game of Skill Ordinance. He mentioned the average charge locally per machine is $650/ year. Electric Light Superintendent Bob Petrozino stated that Josh Poda's last day will be May 27, 2025. He requested to have annual maintenance for the police generator at a cost of $5,333.08 be put on the agenda. He mentioned that he and Roland attended an AMP meeting in Kutztown. Governor Shapiro lowered the cap on how much of the new increased rates can be extended to the public. The auction for capacity and transmission charges for 2026-2027 is expected to be high. The question is again; how will we handle this increase? This increase is for all Pennsylvania, New Jersey and Maryland, not just St. Clair. Council Member Brennan asked how the addition of solar panels would affect us. Petrozino explained the credit system we may be using for solar usage. Council Diehl asked if we could add to an employee's contract about training; particularly reimbursement if an employee leaves. Solicitor Brennan explained that it must be negotiated in the Union Contract. The executive session began at 6:55 p.m. Councilman Bill Dempsey left the meeting at 7:15 p.m. Solicitor Brennan discussed with council personnel issues and on-going negotiations. Third Street, St. Clair. The meeting began at 6:30 p.m. Answering the roll call were council members: Joann Brennan, Cheryl Dempsey, Norm Diehl, Tony Klazas, Council President Thomas Dempsey and Mayor Tomko. Absent were Bill Dempsey and Judy Stednitz-Julian. Pledge of Allegiance Council member Joann Brennan read the council prayer. A moment of silence was observed for the late Council Member Val Davis. Copies of the minutes of the previous meeting have been given to borough council members and Mayor Tomko, are there any errors or corrections? If not, they stand approved. PUBLIC COMMENT Mike Petrozino questioned whether or not a "Go Fund Me" that is set up for the St. Clair Community Pool is supported by the St. Clair Borough Council. Solicitor Brennan is issuing a cease-and-desist letter to the Administrator of the Facebook account and will also have the Attorney General look into this situation. It is not supported by council as council did not authorize it. MAYOR'S REPORT Mayor Tomko announced he was attending a series of seminars presented by Senator Argall and Representative Twardzik concerning Senior Scams. Mayor Tomko read his report. 1. Residents, especially senior citizens, are urged to be mindful of phone calls where the caller promises free gifts" that require you to pay "shipping and handling" charges, redemption fees" or "gift taxes" before delivery. These are scam calls. Hang up! 2. As the schools will close for the summer, drivers are reminded to be extra cautious with their driving as youngsters will be outdoors playing and riding bicycles. 2 3. I would ask that all residents of St. Clair take a moment on Memorial Day, the 26th of May, to remember the supreme sacrifices that were made by countless men and women of the Armed Forces of the United States over the course of our nation's history SO that their generation and future generations would keep the rights and liberties enshrined in our Declaration of Independence and Constitution. There were many soldiers, sailors, and airmen from St. Clair who made the supreme sacrifice over the past 175 years. Waiting to schedule settlement. 212 Cherry Street - Was on deck to be demolished, bank stepped forward and was considering demolishing it themselves, will wait and see what happens. 214 S. Third Street - Approved by council for demolition. 307 Railroad Street - Successfully completed, case is done. 601 Wade Road = The court approved the sale with the school district. 26 S. Front Street - Petition for approval of sale was done. 6 S. Mill Street - Considering petition of sale, will discuss in executive. 113 E. Hancock Street - On hold since we acquired the neighboring property 311 Broad Street - Just had an approved sale, awaiting a court hearing. The Game of Skill Registration Ordinance was advertised. Minor changes can made. 30 Thompson Street - Will be discussed in executive session. Council Member Diehl asked if they could discuss the Games of Skill Ordinance at this point. Council and the solicitor discussed at length, the details of the proposed, advertised ordinance. After the ordinance is adopted, the registration fee can be amended by Resolution. The following amendments to the advertised Games of Skill Ordinance were made: It was decided that the number of terminals on page six, and the hours of operation on page seven should be deleted from the proposed, advertised ordinance. Sergeant Blanner requested "Emergency Vehicle" signs be placed on the driveway of the Police Station at Second Street in order to make pedestrians aware of vehicles entering and leaving the police station parking lot. He is coordinating with Street Superintendent Kevin Dempsey. President T. Dempsey thanked Sergeant Blanner for allowing the 175th Committee sell tickets for the TNT Fundraiser. At the police station. Dempsey, to authorize Schuylkill Conservation District and the County of Schuylkill to submit an application with St. Clair Borough as a Co-Sponsor for the USDA's Watershed Protection and Flood Prevention (PL-566) Projects to provide technical and financial assistance for planning and carrying out watershed projects, approved. On a motion by Klazas, seconded by C. Dempsey to place Chief William Dempsey under the Heart & Lung Act effective March 24, 2025, approved. On a motion by Diehl, seconded by Klazas to assign Sergeant Brad Blanner to Acting Chief of the St. Clair Police Department and adjust his salary retroactive to March 24, 2025, approved. On a motion by Diehl, seconded by C. Dempsey, to authorize Powerton Generators, Inc. to repair the Generac 60 KW generator located at the Police Station at a cost of $5,333.08, approved. Dempsey, seconded by Diehl to authorize the St. Clair Community & Historical Society to use the borough's parking lot on June 14 from noon to 2 p.m. for the truck to pick up unsold sidewalk sale items, approved. On a motion by Klazas, seconded by Diehl to conditionally hire Tim Walsh as a part-time police officer pending his passing of a physical and psychological examination at the rate of $28.00/hour including the purchase of uniforms and equipment, along with a ballistic vest, if needed, approved. Mayor Tomko spoke to Fire Chief Frank Uhrin concerning the motion to declare a 30-day burn ban on fire pits, fire rings, and outdoor burning. Currently the county does not have a burn ban. Therefore, on a motion by Brennan, seconded by Klazas to give Fire Chief Frank Uhrin the authority to declare a burn ban within the Borough of St. Clair, approved. Discussion was held to train borough employees as ground hands for the Electric Light Dept. was briefly discussed. On a motion by C. Dempsey, seconded by Brennan to post the position of Assistant Lineman for 10 days, approved. The motion to accept a settlement agreement with Chad Seitzinger was tabled, to be discussed in executive session. Council President Dempsey called an executive session at 7:30 p.m. to discuss personnel issues, sale of conservership properties and potential litigation. Dempsey Council President 16 S Third Street St. Clair, PA 17970 RE: Consulting Engineer's Report (CER) Benesch Project No. 0325-609049.02 Dear Mr. Dempsey: The following is the status of engineering services pertormed by our firm as of this date: ENGINEERING CONSULTATIONS & CONSTRUCTION PROJECTS Grant Assistance 0325-609049.02, Task 4) 2022 PCCD Police Grant The final report to PCCD was submitted to close out the $87,660 grant. However, this grant was selected bythe PCCD for a random audit. We will assist the Borough with preparing the requested documentation and provide that the PCCD prior to their requested May 13, 2025, deadline. St. Clair Little League Project (31226.20) A special Council Meeting to specifically discuss the Little League Project was advertised and then held on April 10, 2025. At that meeting, Council authorized a change order to place 4000 SF of sod, including grade preparation and other incidentals, for a price of $6000.00. The contractor was immediately informed of this decision, and the sod placement commenced on April 16, 2025, with completion the following day. Later this week, the contractor will deliver a trailer full of Diamond Tex infield mixi to replace and supplement that which was used during the sod placement. Based upon the sod being placed, the contractor did submit an Application for Payment for the sod work which was completed, minus a $600 retainage (10% of change order). This application is attached for your reference along with our recommendation for payment. Firehouse Addition 0325-609049.02, Task 7) On March 27, 2025, the Alert Fire Company did provide our office with their plans and specifications to use forbidding documents related to the $400,000 LSA grant received for the fire house addition. The Alert Fire Company and the Borough should enter into a cooperative agreement to define responsibilities for bidding and construction including costs, reimbursements, bidding, review, and inspections. This Solicitor should work with the Borough to prepare this agreement prior to bidding the project. Ann Street Resurfacing 0325-609049.20) Bids to mill and overlay a portion of Ann Street from Lowe's Driveway to the AutoZone Driveway were received on April 1, 2025. At the April Council Meeting, Council awarded the project to the lowest bidder Construction Masters Services, LLC (CMS), for the amount of $64,879.00. Our office issued the Notice-of- Award to CMS on April 3, 2025, and a Pre-Construction Meeting was held on April 17, 2025. Northward Basketball Courts (0000-031433.20) Youth Basketball Court 0325-609049.21) Earlier this year the Borough received a PA DCED CFA Greenways, Trails, Recreation Program (GTRP) grant in the full-requested amount of $64,175 to construct a youth basketball court adjacent at the Third Street Playground. We intend to bid this project at the same time as the Northward Playground project since both are similar in scope, SUBDIVISIONS & LAND DEVELOPMENTS Rennick Subdivision (0325-609049.30, Task 2) At your March 4, 2025, Council Meeting, Council granted Conditional Final Plan Approval. We are still working with the applicant's plan preparer to address some minor outstanding issues. Once those are addressed, Borough signatures can be placed on the plans. POTENTIAL FUNDING/GRANT SOURCES 0325-609049.02.Task 4) RECREATION 2025 Commonweatth Financing Authority (CFA): Greenways, Trails, Recreation Program (GTRP) Current Status: OPEN (as of Feb 1, 2025) Application Deadline: May 31, 2025 Uses: Can fund planning grants, as well as construction/fepair/renab grants, for a wide variety of community recreation facilities, like baseball and soccer fields, basketball courts, playgrounds, pools, etc. Can fund indoor or outdoor facilities and purchase of property to create new or expand existing recreational sites. Funding: Grants shall not exceed $250,000 for any project. 15% localn matchrequired. Can be land value and other state grant funds. In-kind match NOT accepted. Engineering, design, and nspection is limited to 10% of grant award, which is often insufficient. Repaired inlet on North Front Street. Cleaned parks and playgrounds daily. Cleaned and Repaired sidewalk on Patterson Street Bridge both north and south side mixed and poured concrete for repair. Swept Pearl, Thompson and Fairview after heavy rain. Cleaned inlets of debris after every storm. Used 2 ton of cold patch filling potholes and sealing also. Cleaned John Siney Park and surrounding area of leaves, debris and trees. Repaired fence at Boone park and Third Street playground. Cut down the tree on the South end of Front Street in the creek. Helped the Sewer Department with the manhole on Third and Hancock cut grass several times in all playgrounds and parks and abandoned properties. Cleaned and cut the bridges and sidewalks. Started to open up the pool which includes welding and grinding of the swimming pool diving board base and having it powder coated. Fixed gate valve in the pit to receive water. Cut and disassembled old filtration. Shoveled 4 tons of old sand out of filtration system and disposed of it. Placing new filtrating system in place and prepping for piping. Cut out cement joints, jackhammered them, and prepped for patching. Cleaned out bath house, Maintenance Department Serviced all lawn care equipment. Disassembled John Deere tractor and put in new bearings in the rear, welded up frame, completed rebuilt mower deck which consist of lots of welding, pulleys, hubs, blades and belts. Services 6MC Electrical Truck. Rebuilt air conditioner and charged and serviced Replaced air brake chamber on the recycle truck. Diagnosed G-1 Garbage truck for overheating problem changed two sensors, problem solved. Multiple air leaks all found and fixed. Changed lines and replaced two new brake chambers on G-1 garbage truck. Pressured washed the underneath of the new garbage truck and prepared for fluid film treatment. Sprayed and applied fluid film to new garbage truck for rust prevention. Quote for fluid film was $4,700, which we did in house for $625.00. Film spray result on garbage truck is amazing. Roland and myself attended AMP Regional Power Supply Conference held in Kutztown on Tuesday 4/22. Wednesday 4/2 terminatted service to 3 for non-payment, Thurs. 4/24 Terminated 3 more for non-payment. Several phone calls with Lawyer in regards to Landlord not paying electric and tenant's power being shutoff. Call form Brian, replaced a broken 10" cover for under ground electric quanzi box at Little League Field. Asplundh cleared trees and sprayed herbicide west side of Bypass from Russell Street to Ann Street. Setup account on P.U.C. Web Portal for responding to Customer complaints Fax & emails no longer accepted. Meter Accuracy test done at 105 South Mill Street (Judy Hulets) meter tested accurate results mailed to her. Comments: The following alarm boxes were tested; 33,32,26,42,16 The St. Clair Fire Department was notified by EMS of a property located at 19 West Patterson Street. EMS was on a call at that address and found conditions at that address to be inhabitable. A separate report will be forwarded to the Code Enforcement. The Saint Clair Fire Department applied for smoke alarms through the American Red Cross. The American Red Cross has obtained alarms that we will be working together to get these smoke alarms installed for the residents who may have not received them before along with those in need of one currently.
