The 5 purpose of our meeting will be to go through 6 a few nousekeeping motions. We'11 then go 7 down the table and we'17 hear from our 8 mayor, our council members, our department 9 heads. 10 The chief of police has a public 11 sign-in sheet if anyone would like to sign 12 in and address us at the end of the meeting. 13 Before we go to our regular meeting 14 Mayor Legg has a statement he would like to 15 make. He'd like to read a proclamation for 16 one of our citizens. 17 MAYOR LEGG: For those of you who 18 don't know this gentleman - and I don't 19 think there's anybody who does not this 20 is Mr. Robert Gillette and his lovely wife, 21 Janet. He is the proprietor of Ferri & 22 Gillette Funeral Home. It's been there as 23 long as I've been alive and I'm older than 24 dirt. 25 Bobby, sorry for all the mystery. I 4 1 couldn't tell you why I wanted you here 2 tonight. The last person that came two 3 weeks ago thought I had a sniper waiting. 4 You do sO much for the community. 5 Most people don't even know what you do. I 6 know a lot of what you did do and I don't 7 think I know a third of it. Anytime 8 something is going down you're there. You 9 roll up your sleeves but you're not out in 10 front to get your picture in the paper. 11 You're there for the time, energy, effort, 12 money, whatever has to be done. You are a 13 tremendous person, you are a great citizen. 14 I have a little something I would 15 like to give you, if I may. KOMENSKY: Good news. Then the 22 guy with the trailer on 23 MR. SOKOLOWSKI: I called him, never 24 got a return call. I'17 follow up on that. 25 MR. KOMENSKY: Like we did the other 13 1 guy. BUTLER: Mike, I wanted to thank 6 you because I know I've been busting your 7 chops meeting after meeting with these 8 condemned houses. You did a great job. 9 MR. RUSSELL RINALDI: Thank you, 10 Michael. 11 Dave Lopatka, engineer, anything for 12 the meeting tonight? 13 MR. LOPATKA: I have nothing, 14 really, for the meeting. We did do a final 15 inspection at Pagnotti last week, last 16 Thursday. Couple minor punch list items. I 17 have them listed on the report. They're 18 minor things that they're going to get 19 cleaned up. I approved their pay 20 application to Marylynn. They did a good 21 job. 22 I also met over there two days prior 23 with Aris and the engineers helping us with 24 the electrical and water and stuff just to 25 have them take a look at what was installed 14 1 and what we need to make sure we add it to 2 the second phase. There isn't a lot of 3 additional stuff. One or two things we 4 pointed out with regard to what was 5 installed. There were a bunch of spare 6 breakers that were required in the box that 7 weren't there. That ended up being a punch 8 list item and a couple other minor things. 9 Other than that I don't really have 10 that much. I guess to go over MS4 stuff a 11 little bit, we did have an inspection with 12 the EPA yesterday. Last week or the week 13 before they sent an e-mail out requesting a 14 bunch of information from the borough. I 15 provided them everything that we had. The 16 ordinances, inspection stuff. A bunch of 17 ordinance stuff we passed back in 2020 as 18 part of the stuff they were looking for. We 19 actually went out and looked at a couple 20 basins that the borough owns. We kind of 21 went over that stuff. 22 Also, as part of that - - and this 23 has been going for the last couple months. 24 I've been putting together your new MS4 25 permit application in addition to your plume 15 1 reduction plan. I sent Marylynn, yesterday, 2 the ad. So it has to be advertised, the 3 PRP. Is has to be advertised and there's a 4 30 day public comment period that we have to 5 document any questions that come in to the 6 borough and address them however they need 7 to be if they need to be included in the 8 final application that we have to put in 9 after that 30 day period. 10 So she has the PRP posted on the 11 website, and the ad is going to be in this 12 week? 13 MS. BARTOLETTI: Yes. 14 MR. LOPATKA: Starting on Friday, 15 the 18th, and it will go to May 19th. That 16 30 day period after we just have to answer 17 any questions that come up from the public, 18 and then we'11 make the submission for your 19 new permit. 20 EPA has a number of other items that 21 they requested from us. Get that within the 22 next seven days. 23 MR. RUSSELL RINALDI: Anything else? 24 MR. LOPATKA: That's all. 25 MR. RUSSELL RINALDI: Any members 16 1 have any questions for Dave? 2 MR. BUTLER: Can we get estimates 3 for the sod up there early? Because come 4 fall these guys are going to be busy and 5 that sod has to go in in the fall down 6 Pagnotti. 7 MR. LOPATKA: The sod likely - - the 8 project will be starting in June. I mean, 9 all you really have to do is water it heavy 10 for the first two or three weeks for the 11 roots to take. I actually specked a certain 12 sod. I think Rick had mentioned a couple 13 companies that somebody he knew or something 14 at one time had a field done. I actually 15 called the company. I think they're down 16 towards Philadelphia. It's just a sod farm. 17 They make the sod that we specked for the 18 field. So really the sod, it's really two 19 weeks to a month where you have to water it 20 heavy for the roots to take and it will be 21 fine after that. 22 MR. BUTLER: But let's bid, get the 23 bids early. 24 MR. LOPATKA: It's going out to bid 25 in probably two to three weeks. I have to 17 1 go back to the that's why I brought them 2 up here the other day, to make sure it's 3 taken care of with regards to the 4 irrigation. The controls and all that 5 stuff. I actually talk to him earlier 6 today. He should have that for me by the 7 end of the week or sometime early next week. 8 The rest we have ready to go. Once I get 9 this information it will go out to bid 10 probably in the next two or three weeks. 11 MR. RUSSELL RINALDI: Any other 12 members have any questions for Dave? Dave, 13 one question. Any update on the guardrail 14 on Howard Street? 15 MS. BARTOLETTI: I have that. The 16 work is going to be done on April 22nd. 17 MR. LOPATKA: There was some 18 confusion on there the way that they sent it 19 out. I know Marylynn had to go on and 20 accept it, and then they sent an e-mail 21 saying they changed their system. STULL: The only thing I have is 19 I just want to thank Chief Dubernas and the 20 police department for putting up the signs 21 for our training last week. So that worked 22 out pretty good. Plus the letters we sent 23 out and whatever we put on social media. So 24 I don't think we had any complaints. That's 25 all I have. 19 1 MR. RUSSELL RINALDI: That training 2 that you put on, it was really interesting. 3 I only saw what you posted on Facebook, but 4 how many towns were involved? 5 MR. STULL: There was Taylor, 01d 6 Forge, Moosic, Avoca and Duryea. I think we 7 had 28 guys for the two days. It was really 8 nice oecause this gives the firefighters a 9 very real flashover, the simulator. They 10 put OSB inside of it. It's a controlled 11 situation. They put a burn barrel in there, 12 they starve it for oxygen, then they slowly 13 open the doors on it and let it flash and 14 then shut the doors again. They teach the 15 firefighters how to use a hose line to back 16 down the flames and everything before it 17 really flashes. It's pretty good. 18 They left here Tuesday and went up 19 to Dickson City. They use it up there. 20 Then they're going to Mount Pocono. 21 MR. RUSSELL RINALDI: Good. 22 Anything else? 23 MR. SOKOLOWSKI: Unless they're 11 coming to planning again. 12 MR. RUSSELL RINALDI: You can stop 13 over there tomorrow because we watched them 14 for at least a half an hour, 45 minutes. 15 They were carrying all kind of things. 16 Wood, carrying an easel, cardboard boxes, 17 shelving. They were constant for 45 18 minutes. I don't see them over there now, 19 but if you could stop over there tomorrow 20 and find out. Especially if they haven't 21 been to planning yet. 22 MR. SOKOLOWSKI: They were but 23 they 24 MR. RUSSELL RINALDI: So if they 25 came and were told what they needed to do, 23 1 never came back but started doing what they 2 wanted to that's an issue. 3 MR. SOKOLOWSKI: They never came 4 back. 5 MR. HOOVER: Right now the number is 6 zero. 7 MR. RUSSELL RINALDI: Quick rundown, 8 what did they exactly want to do over there? 9 MR. SOKOLOWSKI: First they said it 10 was a smoke shop. First thing was games. 11 They want to put games. 12 MR. RUSSELL RINALDI: Did they 13 mention how many? So just smoke shop and 14 games? 15 MR. SOKOLOWSKI: Yes. 16 MR. RUSSELL RINALDI: Do we have 17 their name? 18 MR. SOKOLOWSKI: I have something in 19 there, yes. 20 MR. RUSSELL RINALDI: Are they from 21 01d Forge? No? 22 MR. STULL: No. 23 MR. RUSSELL RINALDI: I haven't 24 heard anybody who wanted to do anything. I 25 wasn't sure. So if you can stop over there 24 1 tomorrow, find out what they were doing, 2 notify them what they shouldn't be doing. 3 MR. STULL: One question. I know 4 they're moving in before the occupancy 5 permit is signed off by the fire department, 6 that we need to do an inspection. The one 7 on Lonesome Road, that transport guy. The 8 old Blooming Idiots. He's been in there 9 since shortly after Christmas or before 10 Christmas, even. 11 MR. RUSSELL RINALDI: Probably been 12 in there at least two, three months. 13 MR. STULL: So my question is how 14 did they get in there if we don't issue them 15 an occupancy permit to do what they're 16 doing? 17 MR. KOMENSKY: Mike, did they come 18 to planning? 19 MR. SOKOLOWSKI: Yes. Emmett has 20 those. 21 MR. STULL: So when they came to 22 planning we pretty much told them what they 23 needed. One of the things was the HOP and 24 everything else down there. They said they 25 weren't doing any renovations or anything in 25 1 there, but they moved completely in there 2 doing work. I know the fire department 3 hasn't been down there since it was Blooming 4 Idiots. 5 But I just wanted to know how 6 they're getting in there without us signing 7 off on it. 8 MR. BUTLER: Could it be the 9 planning commission is telling them to do 10 this? 11 MR. SOKOLOWSKI: No. The guy told 12 me he was moving his equipment in there and 13 just getting set up, his equipment. I told 14 him not to operate. 15 MR. HOOVER: They always push it to 16 the max. 17 MR. SOKOLOWSKI: There's no 18 construction or nothing. He brought his 19 plans. 20 MR. KOMENSKY: I guess as long as 21 everybody agrees, Mike, you and Billy are 22 going to have to go down there. Billy needs 23 to get that occupancy permit signed. 24 MR. RUSSELL RINALDI: Emmett, are 25 you here for them tonight? 26 1 MR. MANCINELLI: I am not, but we 2 are working on that project. So we were at 3 planning maybe December, January, I can't 4 quite remember, and we submitted plans to 5 the engineer, Mike. They were under review. 6 We had a couple waivers. I was not aware 7 that they're in there. 8 The only thing we were doing on the 9 plan is we've applied to PennDOT, we've 10 gotten three comments sent on to the owners, 11 and then PennDOT wants a letter of intent on 12 what they plan on doing. The property was 13 Track Faster Corporation or something, SO 14 they want to know who is able to sign 15 legally for the corporation for the permit 16 application. So I sent all that stuff over 17 to the owner. I'm waiting for that. Then 18 they also wanted the deed, which we have. 19 Some of the comments that we 20 discussed at planning were about the 21 connection to the sewer. So we were able to 22 reach out to the sewer authority to get a 23 copy of paid bills. I think January or 24 something. That was about evidence of 25 connection to the sewer. 27 1 As far as inside, all we're planning 2 on is a PennDOT permit for a minimum use 3 driveway out front. We're going to curb the 4 front of the property SO it's just one 5 access. Then we have, I think, based on the 6 zoning ordinance, the size of the building, 7 we put eight or nine parking spots behind 8 the building. So just a small parking area 9 behind the building just to comply with 10 zoning. 11 So our plan basically showing some 12 E&S stuff for the work, for the parking in 13 the back and the curb for PennDOT in front. 14 So that's all we've been asked to do. We 15 haven't been asked to do anything inside the 16 building. So I'm under the impression 17 what's in the building is staying as it is. 18 MR. RUSSELL RINALDI: Mike said 19 there's no construction on the inside of the 20 building. You're just the architect. 21 MR. STULL: It is a change of use. 22 MR. RUSSELL RINALDI: So going back 23 to your question, you and Mike should get 24 together and go down there and see exactly 25 what he's doing. If he's operating, he's 28 1 not supposed to be without the permit. 2 MR. MANCINELLI: Just for the record 3 we submitted application for a change in use 4 and land development. 5 MR. Okay. 17 So tonight on the agenda we have two 18 resolutions, and the first one I just want 19 to give you a little information on SO it 20 will be easier when we pass it. So 21 resolution number 17 is to apply for a DCNR 22 grant for Pagnotti Park, and it is called 23 the Entrance Enhancement Phase I. So we are 24 applying for this grant, and it's through 25 myself, Dave and our grant writers. We've 32 1 been working on this, and it is basically to 2 try to construct a bridge, a walking bridge, 3 which we've been discussing for a very long 4 time. 5 The grant is through the Department 6 of Conservation and Natural Resources, and 7 it is a cash match type of grant. So the 8 total of the grant that we are applying for 9 is $432,533, and the borough's portion of 10 that would be $216,266.96. So we will vote 11 on that in a little bit, but I just wanted 12 to give you a little bit of information on 13 it. Does anyone have any questions on that? 14 Then the next item on the agenda is 15 resolution number 18, but it is to adjust 16 resolution number 16 of 2024. It is for an 17 LSA grant that I had applied for, and we put 18 it under safety. So it came back to us that 19 they want us to change the name. We had to 20 adjust some of what we were asking for. So 21 now it's going to go from being called 22 safety equipment to purchase of new 23 vehicles. Anyone have any questions on 24 that? 25 Then the next item is just the 33 1 invoice for Linde Corporation, and that's 2 for the work at Pagnotti. 3 So Dave had started to tell you 4 about the meeting that we had yesterday with 5 EPA, and one thing I just wanted to ask 6 council, I think that it might be beneficial 7 for us to add to our committee list or add 8 MS4 to our committee list since it's 9 something that each year gets bigger and 10 bigger, and it's something that I think 11 council really needs to be much more 12 involved in. So I don't know if you would 13 like to add it to a committee that's already 14 on our list or if you would like to create a 15 new committee. 16 MR. Because there's SO much 21 involvement with EPA and DEP it's much more 22 than just Dave and myself and Joe meeting 23 with these people. LOPATKA: It actually goes 16 parallel down his driveway. It goes into 17 his property and then the water continues 18 beyond there. 19 MR. HOOVER: It continues down and 20 goes into the field. He asked if we can 21 clean that culvert out, that swale. It's 22 all overgrown with trees and bushes and 23 twigs. He said if we can clean that out, 24 maybe get the vac truck there and clean that 25 pipe out as a temporary fix, eventually 37 1 maybe put a pipe in there. Like Dave said, 2 we'd still have to get the pipe down to 3 Milwaukee Avenue. But where do you go from 4 there? Then it's across the street to Saint 5 John's Creek. That's another story. So it's 7 kind of an attack on each and every one of 8 us. We should all be offended.
