Municipal Building - 4000 Main Present: Mayor Winget, Councilmember Reaves, Councilmember Gibbs, Councilmember Bowers, Councilmember Britton and Councilmember Schupp INVOCATION The invocation was led by Councimember Britton. PLEDGES OF ALLEGIANCE The Pledges of Allegiance were led by the City Council. 1. CALL TO ORDER Mayor Winget called the meeting to order at 7:00 p.m. 2. EXECUTIVE SESSION (To be held after Regular meeting.) 2A. The City Council will convene into closed, executive session pursuant to Section 551.071(1)(A) of the Texas Government Code (Consultation with City Attorney) regarding pending litigation, to wit: (a) City of Rowlett, Texas and Garland Independent School District V. Pecos Housing Finance Corporation and Shane Docherty, in his official capacity as Chief Appraiser of the Dallas Central Appraisal District, Cause No. DC-25-07779 in the 134th Judicial District Court of Dallas County, Texas; and (b) City of Rowlett, Texas and Garland Independent School District V. Pleasonton Housing Finance Corporation and Shane Docherty, in his Official capacity as Chief Appraiser of the Dallas Central Appraisal District, Cause No. DC-25-07778 in the 191st Judicial District Court of Dallas County, Texas. 2B. Pursuant to Section 551.071(2) of the Texas Government Code regarding regulation of activities by extraterritorial housing finance corporations. Mayor Winget adjourned the meeting into Executive Session at 7:48 pm. 3. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY OR APPROPRIATE ACTION ON CLOSEDIEXECUTIVE SESSION MATTERS City of Rowlett 10857 Mayor Winget reconvened the meeting at 8:27 pm. No action was taken. 4. PRESENTATIONS 4A. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community interest. Mayor Winget provided the following announcements: CITY SECRETARY'S OFFICE - The City will have a Runoff Election for Councilmember Place 6 to be held this Saturday, June 7, 2025 from 7 am to 7 pm, at the Rowlett Community Centre. City of Rowlett 10858 POLICE - Operation Safe Summer Underway, The Rowlett Police Department's "Operation Safe Summer" officially launched on May 24th and will run through August 10th. This initiative is an all- hands-on-deck approach by the Rowiett Police Department to reduce crime, improve response times, and increase community engagement during the summer months. Throughout this period, residents can expect to see an increase in uniformed patrols and intentional community engagement efforts. Our police department is concentrating resources on addressing crimes that most impact quality of life and enhancing response times, especially during peak activity hours. We appreciate our communities continued support as we work together to ensure a safe and enjoyable summer for all in Rowlett. Buik Waste Collection: The City's contractor, Republic Services, will change to weekly collection of Bulk Waste on June 30th. Collection will occur on the same day as regular waste and recycling collection. Bulky Waste must be placed at the road edge at the front of the property before 7:00 am on the day of collection. Two (2) cubic yards will be collected. That is about the same size as two washing machines or nine 45-gallon trash bags. Those with excess bulky waste should contact Republic Services to arrange a collection which may incur additional charges. As a reminder, all waste generated by tree trimming or yard maintenance contractors must be hauled away by that contractor and not set out for bulky collection. Watch for a postcard with additional information or check the City's website. Councilmember Reaves introduced the Featured Pet, Auggie, this handsome boy people, is completely house-trained and is eager to make you his own! To meet Auggie or one of his companions, please contact Animal Services at 972-412-6219 or come by the Shelter at 4402 Industrial St. from 10 am to 5 pm, Tuesday through Saturday. The animal shelter is currently at code red. This means that the kennels are full. All adoptions are $25 and include spay/neuter, microchip, and up-to-date vaccinations. 5. CITIZENS INPUT No Online Input Forms were received. 1. George Marc, Rowlett - Spoke about damage to his fence caused by the Parks Department. Stated this is about Lakeside Park and the dying trees. The Parks Department are trying to keep up with them. These dying trees present a public and private danger to his property. On May 28th, a tree had fallen into the street and the Parks Department get it removed. On June 3nd, he contacted the Parks Department again because a tree with a split trunk was leaning on his property. He was told that they would be getting back with him. September 25th, a storm blew the tree into his yard damaging his fence, missed the house. The Parks Department came in cleared out the tree and debris. Was told that someone would be getting back to him regarding his fence. He never heard from them. October 31st, he received communication from the insurance company who rendered a verdict that the City was not negligent or caused by any wrongful act or omission. He is a semi-retired broadcaster, and he has nothing but time on his hands. He wants to get his fence fixed. 2. Steve Horwitz, Rowlett - Spoke regarding Mayor Winget's campaign comments and short-term rentals. In a Waterview campaign event, Mayor Winget statements were that he would not bring back the DEI Committee and would not put trails behind the take area of any lakefront properties. He further added that he voted today and there was an election irregularity with the ballot. There was Vietnamese writing on his ballot even though he chose English. It stated thank City of Rowlett 10859 you for voting in Vietnamese. This did not settle well with him. Suggested putting election information on the water bills and have some type of system, like the Nixle system that Rockall has, to inform people about voting. He thanked the Rowlett Police Department for coming out - - to break up a party at a short-term renal this past weekend. There were 42 cars on the street. He would like to see a public posting of all the violations and maybe a text message regarding short-term rentals. 6. CONSENT AGENDA 6A. Consider action approving the minutes. Consider action to approve minutes from the following City Council meeting(s): May 19, 2025, City Council Work Session and May 20, 2025, City Council Meeting. Mayor Winget noted a couple of corrections, May 19, 2025 minutes, the day of the week is listed as Tuesday, but it was Monday and change Mayor Pro Tem to Mayor in the "Call to Order" and Adjournment" sections. For May 20, 2025, the consent agenda should read "The motion passed 6-0" and change Mayor Pro Tem to Mayor in the Adjoumment" section. A motion was made by Councilmember Britton, seconded by Councilmember Reaves, to approve the minutes as corrected. The motion passed 6-0. 7. INDIVIDUAL CONSIDERATION 7A. Conduct a public hearing regarding a request by Stacy Tucker, on behalf of property owners Jeff and Debbie Maxey, to amend the Comprehensive Zoning Ordinance and Map by amending the zoning for an approximately 0.46 acre lot situated southeast of the intersection of Hickox and Toler Road, being further described as Lot 13, Block 1, Chandler Park, an addition to the City of Rowlett, Texas according to the map recorded in Volume 77151, Page 2168 of the Deed Records of Dallas County, Texas and being more commonly known as 3205 Toler Drive from Single Family Residential = 40/24 (SF-40) to Single Family Residential - 40/24 with a Special Use Permit to allow for an enclosed accessory structure with an area greater than 500 square feet and not exceeding 1,140 square feet (SF-40-SUP). Lilyana Morejon, Planner II, presented this item. The applicant has requested an accessory structure over 500 sq. ft. Per Section 77-1105 an accessory building or accessory structure is a permanent building or structure affixed to the ground, subordinate to the primary structure, the use of which is incidental to the dominant use of the primary structure or the premises. The applicant intends to store an antique vehicle, have a workshop, and storage of household goods. The accessory structure is smaller than the primary structure and the use is clearly incidental to the primary structure. Fifteen 200-foot Public Notices were mailed with two being returned in favor of the accessory building and Forty-nine 500-foot Public Notices were mailed with two being returned in favor of the accessory building. The Planning & Zoning Commission recommended approval of the request at their May 27, 2025 meeting. Mayor Winget open at the public hearing at 7:18 pm. Mayor Winget closed the public hearing at 7:19 pm, with no one speaking for or against. City of Rowlett 10860 7B. A motion was made by Councilmember Schupp, seconded by Councilmember Britton, to approve an ordinance regarding the Special Use Permit (SUP). Motion passed 6-0. This item was approved as ORD-016-25. 7C. Conduct a public hearing regarding on a request by Akhila Reddy, on behalf of property owner Sreelakshmi Tinnanooru to amend the Comprehensive Zoning Ordinance and Map by granting a change in zoning from Revised Planned Development 1-6-98A (PD 1-6-98A Revised) to Revised Planned Development 6-3-25 (PD 6-3-25 Revised) by amending the development regulations to allow for day care use, to allow for up to forty (40) off-street parking spaces, and to eliminate the requirement for drop-off/pick up lanes for an approximately 1.49 acre lot located within the planned development, said lot being identified as Lot 2, Block A, Tallal Addition in the City of Rowlett, Dallas County, Texas and being more commonly known as 5602 Dexham Road. The applicant has requested to amend a Planned Development District (PD) for General Commercial/FRetail (C2) uses (ORD1-6-98A) to allow a daycare use by right, increase the maximum allowed parking spaces, and elimination of dedicated drop-off/pick-up lanes. The amendment will apply solely to Lot 2 and will not affect any other properties within the existing PD boundary. Thirteen 200-foot Public Notice were mailed with no response and thirty-eight 500-foot Public Notice were mailed with no response. The Planning & Zoning Commission voted 5-1, with one abstention, to recommend approval, at their May 27, 2025 meeting. The applicant gave a presentation. The daycare will be named The Learning Experience Academy of Early Education. The franchise operates nearly 500 daycare centers nationwide and serve over 54,000 children. Their team runs similar centers in Keller and Richardson. To adequately address safety, licensing standards, and traffic flow, the applicant respectfully request the approval of a minimum of 40 parking spaces and eliminating the need for a drop-off and pickup lanes. Councilmember Schupp stated this fits in with the surrounding area. He is concerned about traffic backup on the street. Applicant stated that there are two points of egress. Mayor Winget asked why bi-directional traffic? Applicant replied that the City Engineer suggested it and there will be a median cut. Councilmember Gibbs asked if they would have buses. The applicant stated as of now, no. 7D. Councilmember Reaves voted to appoint Councilmember Schupp to be Mayor Pro Tem. Councilmember Gibbs voted to appoint Councilmember Britton to be Mayor Pro Tem. Councilmember Bowers voted to appoint Councilmember Schupp to be Mayor Pro Tem. Councimember Britton voted to appoint Councilmember Britton to be Mayor Pro Tem.
