Mayor Jones called the Regular meeting of the Morehead City Council to order at 5:30 p.m. with a quorum present. Councilmember Ballou gave the invocation, and Mayor Jones led the pledge of allegiance. CONSENT AGENDA ITEMS Mayor Jones asked if the Council wished to make any changes to the Consent Agenda. The Consent Agenda generally consists of housekeeping items that have been previously discussed and recommended by the Council Committees for Council consideration. Councilmember Taylor asked that Item 2.E. be removed from the Consent Agenda and added to New Business as Item 4.D. for discussion. Morehead City Regular Council Meeting May 13, 2025 1 Councilmember Taylor made a motion to adopt the Consent Agenda as amended. Councilmember Stiles seconded, and the motion was carried unanimously. (5-0) Included within the Consent Agenda were the following approvals: A. Approve the minutes of the April 8, 2025, the Regular Council meeting as presented. B. Accept the Finance Director and Tax Collection Reports as presented. C. Accept the Estimated Fund Balance Report as presented and recommended by the Finance and Administration Committee. D. Accept the April 2025 Grant Report as presented and recommended by the Finance and Administration Committee. E. Adept-BudgetOrdinance-Amendment202-07-aspresemieé-andrecemmended-by-the Fimanee-and-Administrationen-Cemmittee. F. Adopt Resolution 2025-R-29, authorizing the lease of riparian and littoral rights located at the south end of 7th Street to MGD Properties, LLC. as presented and recommended by the Finance and Administration Committee. PUBLIC HEARINGS Morehead City Regular Council Meeting May 13, 2025 2 Consider Adoption ofOrdinance 2025-0-07, Approving the Contiguous Annexation of 108, 110, and 132 Jones Road Mayor Jones opened the public hearing and called upon Planning and Development Director Sandi Watkins to make her report. Ms. Watkins reported on the voluntary annexation request submitted by Vesta Enterprises, Inc. for the property located at 108, 110, and 132 Jones Road (Tax PIN #s 636609068823000). This 2.57-acre parcel is contiguous to the present city limits and is located at the Guy C. Lee building materials business location. The property is comprised of two parcels; one being in the corporate limits and the other in the extraterritorial jurisdiction (ETJ). In order to combine the two parcels into a single property, annexation of the ETJ portion is needed. Water and sewer service are not requested at this time; however, any future costs associated with extending the water/sewer service to the newly annexed property will be the responsibility ofthe property owner. Notice of this public hearing was published in The Carteret County News Times once, on Sunday, April 27, 2025. Notices were also posted on the City's website, on the bulletin boards in City Hall, and upon the property. At this time, Mayor Jones invited anyone who wanted to speak in favor of or in opposition to the annexation request to come forward. PUBLIC COMMENTS Glenn Weeks, 904 Marina Court, Sneads Ferry: Mr. Weeks stated that he was present representing the owners of the property. He stated that they would like to combine the property to facilitate their plans for the property and to clean the tax billing. Seeing that no one else was coming forward to speak, Mayor Jones closed the public hearing. Councilmember Taylor, as the Chair ofthe Planning Committee, made a motion to adopt Ordinance 2025-0-07, approving the contiguous annexation of 108, 110, and 132 Jones Road (Tax PIN# 636609068823000 as presented. Councilmember Abell seconded, and the motion was carried unanimously. (5-0) Ordinance 2025-0-07 is filed in Ordinance Book #10. Consider Adoption of Ordinance 2025-0-12, Approving the Rezoning of 4723 Country Club Road Mayor Jones opened the public hearing and called upon Planning and Development Director Sandi Watkins to make her report. Ms. Watkins reported that a request was submitted by Glad Tidings Pentecostal Holiness Church to rezone approximately three (3) acres of a 9.4 acre split- Morehead City Regular Council Meeting May 13, 2025 3 zoned tract located at 4723 Country Club Road (Tax PIN #636611553985000, from CH (Highway Commercial) District to IC (Institutional Campus) District. The site includes part of Glad Tidings Church as well as the Sea ofLearning private school. Surrounding land use includes Glad Tidings Church and West Carteret High School, Country Club Apartments, and Sunrise Pediatrics. Surrounding zoning includes Institutional Campus, Office and Professional, and Highway Commercial. The property is in the "Midtown" Neighborhood Planning Area and is classified as Civic Campus and Commercial Corridor on the Future Land Use Map. The approved uses for both the CH and IC districts were displayed. Both church and private school are permitted uses in the IC district. Private schools are allowed in the CH district as special use. Special uses require separate Board of Adjustment approval. Because this is a conventional, and not a conditional rezoning, no conditions may be applied to this request. Ifthe request is approved, it is probable that no further review by the Planning Board or Council will be required. On April 15, 2025, the Planning Board reviewed the request and unanimously recommended approval having found the request to be generally consistent with the City's Comprehensive Plan, reasonable, and in the public's interest. Daniel Fischler made the motion, and Curtis Oden made the second. Notice of this public hearing was published in The Carteret County News Times twice, on Sundays, April 27 and May 4, 2025. PUBLIC COMMENTS William Moore, 2906 Bridges Street: Mr. Moore stated that he was present representing Glad Tidings Church. He thanked the City Council for their consideration of the request and offered to answer any questions they may have. Seeing that there were no questions and that no one else was coming forward to speak, Mayor Jones closed the public hearing. Councilmember Taylor stated that the Planning Committee reviewed the request and agreed with the Planning Board to recommend approval. Therefore, Councilmember Taylor made a motion to adopt Ordinance 2025-0-12, rezoning 4723 Country Club Road (Tax PIN #636611553985000 from CH (Highway Commercial) District to IC (Institutional Campus) District, and Resolution 2025-R-26 of Plan Consistency in accordance with N.C.G.S. 160D- Morehead City Regular Council Meeting May 13, 2025 4 605 for Map Amendment. Ms. Watkins stated that First Baptist Church of Morehead City submitted a request to rezone the 100 X 120-foot parcel located at 808 Fisher Street (Tax PIN #638619629191000) from R5 (Residential) District to 0&P-CZ (Office & Professional - Conditional Zoning) District. Surrounding land use includes First Baptist Church across Bridges Street to the south and single-family dwellings and vacant residential property to the east, north, west, and southwest. Surrounding zoning includes R5 (Residential) District and 0&P (Office and Professional). The property is located within the Downtown Neighborhood Planning area and is classified as Downtown Residential on the Future Land Use Map. Uses permitted on the site are those allowed in the R5 district, including one and two-family dwellings. Proposed use would be limited to parking facilities and accessory building use. No other conditions are proposed for this request. PUBLIC COMMENTS Lee Dixon, 4602 Bridges Street: Mr. Dixon stated that he is an architect with Coastal Architecture, representing First Baptist Church. The Church would like to place a shelter on the property to protect the church bus. Freeman Upholstery was once located on this lot, evidencing a history of commercial use. He stated that the church has been in the neighborhood for 150 years and hopes to remain in the same location for another 150 years. Morehead City Regular Council Meeting May 13, 2025 5 Seeing that no one else was coming forward to speak, Mayor Jones closed the public hearing. Councilmember Taylor made a motion to adopt Ordinance 2025-0-11, rezoning 808 Fisher Street (Tax PIN #638619629191000) from R5 (Residential) District to 0&P-CZ (Office & Professional = Conditional Zoning) District with uses of parking facility and accessory building/use, and Resolution 2025-R-25 of Plan Consistency in accordance with N.C.G.S. 160D-605 for Map Amendment. Councilmember Ballou seconded, and the motion was carried unanimously. (5-0) Ordinance 2025-0-11 is filed in Ordinance Book #10; Resolution 2025-R-25 is attached to and made a part ofthe minutes herein Consider Adoption of Ordinance 2025-0-02, Amending Chapter 14, Section 24.1 of the UDO by Adjusting Setback Requirements for Drystack Boat Storage Mayor Jones opened the public hearing to consider a request submitted by Ron Cullipher, to amend Chapter 14, Section 24.1 ofthe Unified Development Ordinance (UDO), to reduce the setback requirements for dry stack boat storage facilities that abut residentially zoned properties from 30 feet to 20: feet and to: reduce the setback requirements for facilities that abut non-residential properties from 30 feet to 10 feet. Mr. Turner stated that the applicant has requested that this item be postponed until the July 2025 City Council meeting. He recommended that the public hearing, since opened, be continued SO that no further notices would be required. Councilmember Taylor made a motion to continue the public hearing to the July 8, 2025, City Council meeting. Counclmember Stiles seconded, and the motion was carried unanimously. (5-0) Consider Adoption of Ordinance 2025-0-13, Amending Chapter 20, Section 3.3(L) of the UDO by Adjusting Marina and Boat Storage Parking Requirements Mayor Jones opened the public hearing to consider a request also submitted by Ron Cullipher, to amend Chapter 20, Section 3.3(L) of the Unified Development Ordinance (UDO), to amend the parking requirements for "marina and/or boat storage" to read: Parking spaces equal to 30 percent of the number ofb boats for which facilities for dry storage are available plus one (1) space for each four (4) wet slips plus one (1) space for each employee. Mr. Turner advised that the same applicant has requested that this item also be postponed to the July 8, 2025, City Council meeting. Councilmember Taylor made a motion to continue the public hearing to the July 8, 2025, City Council meeting. Councilmember Stiles seconded, and the motion was carried unanimously. (5-0) NEW BUSINESS Morehead City Regular Council Meeting May 13, 2025 6 Consider Adoption ofOrdinance Amendment 2025-0-14, Amending Chapter 30 - Traffic and Motor Vehicles, Section 30-247 SCHEDULE X = Stop Intersections, Adding the Intersection of White Drive and Player Lane City Manager Chris Turner presented Ordinance Amendment 2025-0-14, amending Chapter 30 - Traffic and Motor Vehicles, Section 30-247 Schedule X - Stop Intersections by adding an item (C) White Drive and Player Lane to the list of four-way stop intersections. This amendment is presented as a result of a petition received from the Country Club Run Homeowners Association asking that the two-way stop at this intersection be changed to a four-way stop to improve the safety ofthe neighborhood. As a result of this request, Staff will continue to review intersection signage to determine if others need to be added to the list. Mr. Turner stated that the petition was reviewed by the Planning Committee. As the Chair of the Planning Committee, Councilmember Taylor stated that the Committee reviewed the request and was favorable for adoption. Therefore, Councilmember Taylor made a motion to adopt Ordinance Amendment 2025-0-14, amending Chapter 30 = Traffic and Motor Vehicles, Section 30-247 Schedule X - Stop Intersections by adding item (c) White Drive and Player Lane, to the list of four-way stop intersections. Councilmember Abell seconded, and the motion was carried unanimously. (5-0) Ordinance 2025-0-14 is filed in Ordinance Book #10 Consider Adoption of Resolution 2025-R-30, Opposing Changes to Local Planning and Zoning by the North Carolina General Assembly City Manager Chris Turner presented Resolution 2025-R-30, opposing changes to local planning and zoning by the North Carolina General Assembly as directed by the City Council during the April 8, 2025, Council meeting. To limit the resolution to one page, not all legislation was listed. Hei noted that House Bill (HB) 765, which: is an omnibus bill that would significantly limit the public's ability to engage with the City Council regarding planning and zoning matters and would remove the City's planning authority. Mayor Jones stated that the North Carolina League ofMunicipalities is actively fighting against this legislation also, which in his opinion, is about the State encroaching on the local government authority. Mr. Turner stressed that Senator Norman Sanderson and Representative Celeste Carines are supportive ofthe City and are not sponsors ofthese bills. Councilmember Taylor made a motion to adopt Resolution 2025-R-30, opposing changes to local planning and zoning by the North Carolina General Assembly as presented. Councilmember Abell seconded, and the motion was carried unanimously. (5-0) Ordinance 2025-0-14 is filed in Ordinance Book #10 Morehead City Regular Council Meeting May 13, 2025 7 Morehead Marlins License Discussion Mr. Turner stated that the requests submitted by Morehead City Marlins General Manager Buddy Bengel have been reviewed by all five Council Committees and was added to this meeting's agenda to give the Council another opportunity to provide feedback on Staffs final recommendation. A timeline of how the revised agreement evolved was included in the packet and reviewed by Mr. Turner. The timeline began with a request from Mr. Bengel to renegotiate the agreement in advance ofthe August 2026 expiration. The timeline was presented as follows: December 5, 2024 - Mr. Bengel submits letter of notice to City Manager for extension and renegotiation of license with request to meet in early 2025 February 14, 2025 - Mr. Bengel & City Manager meet to discuss the license agreement. February 18, 2025 - City Manager begins "all subcommittees" feedback process for Councilmember input February 24, 2025 - Mr. Bengel requests dates & times of subcommittee meetings SO that he may attend March 31, 2025 - City Manager concludes "all subcommittees" feedback process and begins draft work on license with City Attorney and City Staff April 13, 2025 - Mr. Bengel submits public information requests to City Clerk for all March subcommittee meeting minutes and audio recordings May 1, 2025 - City Manager & City Attorney complete draft license work, prepared to present to Licensee & City Council for execution Mr. Turner then reviewed each of Mr. Bengel's requests stating that the Committees were unified in the position to each request. 1. Single User License for use ofBig Rock Stadium with the Carteret Community College's license agreement nested under the Morehead City Marlins for management of the stadium. The Committees agreed that to maximize the stadium's use and to ensure equitable use it would be best to establish a separate license agreement for each user group. Carteret Community College is seeking a license agreement to use the stadium for its men's baseball athletic program to begin in 2027. 2. License period of 5-years plus automatic 5-year renewal. The City is not authorized to enter into long-term agreements; therefore, a 3-year term is recommended. 3. Removal of the 30-day termination for any reason by City or Licensee with notice. Mr. Bengel preferred mediation rather than termination with notice; however, the Committees feel it is important for the City to maintain control ofits facilities. 4. Baseball schedule to City by February 1st ofe each year. The Committees and Staffa agreed. Morehead City Regular Council Meeting May 13, 2025 8 5. Use oft the stadium for 15 additional days for other baseball related events. Such may be allowed on a case-by-case basis with the approval of the Parks and Recreation Director as the schedule allows. 6. Right to negotiate other field use. All other external baseball scheduling shall be coordinated by Parks and Recreation, which is now capable of handling the task without assistance from the licensee. 7. Use of Mizelle property for one year (1) before the building is razed. The Morehead Marlins currently use this building as an office and Staff recommends that they be allowed to use it for one (1) year only while the City prepares to raze it. It is proposed that the License Fee be reduced from $25,000 per year to $20,000 as a result of losing the office space. 8. Transfer the trash pick-up burden to the City. The City has agreed to assume responsibility for the trash receptacle because the City uses it as well. The licensee will continue to be responsible for other utilities. 9. Approval to hire independent security rather than utilizing City Police, and to allow Mr. Bengel to determine the level ofsecurity needed at the location. Staff denied this request, and Committees agreed, that the stadium is a city facility, and the level of security shall be determined by the Police Chief based on the level of attendance and activities, especially where alcohol is served. 10. First right of refusal for concession rights. The Marlins will have concession rights only during Marlin events in order to give other users the same opportunity to raise funds for their organizations. 11. Merchandising sales. The City maintains that all items must be approved in advance by the Parks and Recreation Director as specified in the license agreement. 12. First right of refusal for all advertising inside the stadium. The City maintains that all user groups must be given the same opportunity; therefore, the Marlins will only be allowed to advertise during the May 1-August 31 playing season. 13. Right to place sports betting kiosks within the stadium. The Committees agreed that they would not discourage device to device or phone gambling as such is legal in the state; however, they were not willing to promote it through onsite sports betting kiosk machines. 14. Freedom to sell any non-tax stamped beverage or ready-to-drink (RTDs) alcohol mixtures classified above beer and unfortified wine. The Committees were not in favor of expanding the alcoholic options. Morehead City Regular Council Meeting May 13, 2025 9 In response to a question, Mr. Turner stated that the proposed license agreement could go into effect immediately or at the end of the current license; the choice would be offered to Mr. Bengel. Mayor Jones questioned who would make the determination regarding a 30-day termination clause. Mr. Turner stated that the City Manager would; however, a notice will be provided noting the reasons for the termination and the City Council would be given the opportunity to support or disagree with the City Manager. Attorney Taylor noted that the termination clause is for the City's benefit; it states that the City may, not that it shall. The City Council expressed consensus ofapproval authorizing the City Manager to move forward with the agreement as presented. Consider Adoption of Budget Ordinance Amendment 2025-07 as Presented and Recommended by the Finance and Administration Committee. Councilmember Taylor stated that this budget amendment transfers funds in support of the Adopt A Marlin project, which would allow businesses to sponsor painted fiberglass marlin replicas. The Council has allocated money for several similar programs in the past, noting the Downtown Morehead City Revitalization Association (DMCRA) benches, the fish walk, sidewalk drawings, and building murals, but they were unsustainable because there was no program established or funding mechanism to repair them over time. He suggested that a policy be developed to ensure that the program can be maintained. Ms. Lancaster stated that this program was suggested during the Council's strategic planning retreat. The program is set up where the City will initially purchase a few, using current budget funds, to get the program started but as popularity grows, businesses will purchase them from the City. The marlins replicas will be their property, and they would be responsible for the maintenance going forward. Councilmember Ballou asked if the City has the authority to require individuals to maintain property they own. Another question was raised about whether they should become an asset of the purchaser to be placed upon City property (sidewalk), or City property to be placed upon the purchaser' property. In either case, can the City expend city funds to maintain them? Attorney Taylor stated that he would inquire to see how the New Bern Bears program is set up. Councilmember Taylor made a motion to adopt Budget Ordinance. Amendment 2025- 07 with the establishment of a policy to ensure that the program's sustainability. Councilmember Ballou seconded, and the motion was carried unanimously. (5-0) Mr. Turner advised that the goal is to pass the program off to a non-profit entity after it is up and running. Morehead City Regular Council Meeting May 13, 2025 10 CITY MANAGER'S REPORT Mr. Turner had nothing further to report CITIZEN REQUESTS/COMMENTS (3 Minute Time Limit) Nick Eatmon, Executive Director of the North Carolina Seafood Festival (NCSF): Mr. Eatmon stated that he has a lot to learn and what he has learned SO far is that NCSF has a working board that wants to give back to the City. The Board is very appreciative of what the City does for the Festival, and he will be working with and for the City. Paula Hoffman, 907 Evans Street: Ms. Hoffman provided two (2) written documents to the Council opposing the requests to reduce setbacks for drystack boat yards and a reduction in parking requirements for drystack boat storage facilities near residential areas. She also requested a review of how public hearings are posted on the City's website and suggested that they be placed under the Public Notices section, stating that she does not subscribe to the newspaper and the website is her only source of such information. She also mentioned that she was unable to find notification of this meeting on the website. Mr. Turner asked the City Clerk for confirmation of when the regular Council meeting notices are published and where. City Clerk Cathy Campbell advised that all meetings are posted on the City Hall bulletin boards at the first of every year and are simultaneously added to the website calendar. Attorney Taylor advised that Staffhas already started using the Public Notices section ofthe website for all public notices. COUNCIL COMMENTS Councilmember Walker thanked everyone for coming to the meeting. Councilmember Ballou also thanked everyone for coming and participating in the governing process. Councilmember Stiles thanked everyone for coming as well as those that attended the earlier budget session. He stated that he was very excited about the Pop-Up-Park City Skate that will be open Friday, May 16, 2025, through Sunday, May 18, 2025. On Friday, it will be open from 4:00 p.m. to 8:00 p.m.; on Saturday, 10:00 a.m. to 8:00 p.m.; and on Sunday from 12:00 noon to 6:00 p.m. He thanked Mr. Turner, Ms. Lasater, Public Services/Assistant City Manager Daniel Williams, and other staff for preparing the budget; and thanked Ms. Lasater and Purchasing Manager Sarah Currie for making the City Skate a reality. Councilmember Taylor shared that there will be one more budget meeting when the final decision will be made. He did not guarantee a revenue neutral rate but stated that the Council will do the best to keep the rate as low as possible. Councilmember Abell announced that the History Museum will host a discussion on early law enforcement in Carteret County on May 30, 2025, beginning at 12:00 noon. Morehead City Regular Council Meeting May 13, 2025 11 APPROVE THE APRIL 8, 2025, CLOSED SESSION MINUTES AS PRESENTED After a silent review of the minutes, Councilmember Ballou made a motion to approve the April 8, 2025, Closed Session minutes as presented. Councilmember Walker seconded and the motion was carried unanimously. (5-0) CLOSED SESSION Councilmember Walker moved to enter into Closed Session at 6:34 p.m. per N.C.G.S. 143-318.11(A)6) to consider the qualifications, competence, performance, character, fitness, and/or conditions of appointment of a current or prospective public officer or employee; or to hear or investigate a complaint, charge, or grievance by or against an individual public officer or employee. Councilmember Ballou seconded, and the motion was carried unanimously.
