OPENING PRAYER = CITIZENS INPUT a Rob Leuthold - 11259 Center Highway states he is the Executive Director of the North Huntingdon EMS Rescue and wants to extend their thanks to the Board of unwavering support and are grateful for the support of the public. He feels it is important to have a good relationship with community leaders and other public safety entities. He gives some background information about their organization and when it was founded. Currently there are seventeen full-time staffmembers, approximately twenty five part time staff members and a handful of volunteers who staff two ambulances twenty four hours a day. There are four ambulances, the newest put into service last week at a cost of two hundred seven thousand dollars, which is an increase of sixty-one thousand dollars from three years ago. There is also a water rescue division with three boats and two 055 April 16, 2025 inflatable rafts fori ice rescue, a drone that assists the police in search and rescue and a tactical EMS component. A CPR First Aid program is offered and average forty-six hundred calls per year which includes fire calls and standby events. He states their funding mostly comes from reimbursements and subscription drives, grants and donations. He asks the Board that if they speak to any State legislators, to have conversations about increasing insurance reimbursements and to make direct payments mandated. Rick Keenan - 700 Leger Road - states he received a letter expressing concerns about North Huntingdon. The concerns were Commissioner decisions, the police chief and the sports complex. He has concerns about letter because it came from Texas and was from the police association. He would request the Board to look into this and would like an answer at. next month's public meeting. Nick Carrozza - 1223 Guffey Road - states he comes before Board not as a politician or an agitator but as a concerned citizen who has enough of the backdoor deals, retaliation, and members who serve themselves. Accountability Now Norwin is a call to action and exists to inform, empower and organize the residents of the Township, restoring trust in local government and ensuring the children inherit a Township of integrity, not in poverty. He questions Commissioner Gray on multiple issues. Mr. Carrozza asks Commissioner Gray but corrects himself to ask Commissioner Gass (not present) and turns to Chief Rizzo asking ifit was true that he called Commissioner Gass on January gth and cursed him out (repeated expletives) and states "your words, not mine". Commissioner Atwood states "you are here to address the Board" and a conversation devolved with vulgarity resulting in Mr. Carrozza being removed from the meeting by the request of President Atwood. Commissioner Zona calls for a point of order that Mr. Carrozza is violating some laws, one oft them being Title 18 of the Crimes Code 5503 which is disorderly conduct for using obscene language and asks he is treated as he should be under that law. Commissioner Atwood concurs with Commissioner Zona. Bob Danenberg states he defers to his council. Tricia Henning states she is council for Mr. Danenberg and is here to address Lincoln Corner II which is on the agenda. She states she was here last week and presented a packet of documents to which she wants them to be made part ofthe official record. Solicitor Dice states she would prefer a clean copy of the documents to add to the record. Ms. Henning states she would like to address the resolution that has some important pieces to the project that are missing and need addressed before the plan can be voted on. The resolution states the site plan as amended is going to be approved with the following conditions: #7 - outstanding engineering comments from KU review letter as well as the updated Wooster Associates letter dated March 25, 2025 rather than the March 31 that is in the resolution. She addresses Item #2 the major traffic concerns and basing a resolution just on the conditions being met is putting the Board in a bad position in terms of not having all of the information and studies. The traffic has been a major concern for the residents and the North Huntingdon Police Department sent a letter to the Planning Commission last year 051 April 16, 2025 when the project was first proposed suggesting an entrance off of Summitt Drive be ingress only. The Planning Commission agreed and when the amended plan was submitted including both ingress and egress, they did not accept it and disapproved it. Ms. Henning's time is up, but she states she has additional things she would like to make record of as the attorney in opposition to this. Solicitor Dice states generally during citizens input five minutes is allowed and if she wants to use Mr. Danenberg's time would be up to the Board. Ms. Henning states the second report is from KU Resources, Section 304-6I, references the Wooster concerns. Finally, under Grading & Excavation, the engineer discusses a revised geotechnical plan. She states the developer has not given any assurances that the retaining wall would be undermined. Ms. Henning asks the Board to not approve the amended site plan as there are too many outstanding questions, concerns and conditions that still need addressed. Commissioner Gray states when Ms. Henning originally asked if this should be discussed when it was on the agenda, he feels that would have been the better way to proceed because by allowing her to stack time by people who signed up to speak has created aj precedent that somebody else could use others' time. Nathaniel Hayes - 100 McMorris Road, Pittsburgh - states he reviewed the Lincoln Corner II project and the Danenberg property which is upslope and has a retaining wall which supports the residents on Elaine Drive. The retaining wall is twelve feet in height and less than ten feet from the property line. The proposed development consists of a single-story building with a northwest corner wall that is approximately seven feet below the existing service grades. Per the UCC, any excavation greater than five feet should be sloped away from the bottom of the work area to permit safe zone of construction activity for the workers. According to the project plans, the distance between the proposed finish building wall and the upslope retaining wall on the Danenberg property is ten feet which leaves no space for the necessary building of foundations or required drainage. He states there are concerns that the proposed development does not permit safe excavation without potentially destabilizing the upslope wall on the Danenberg property. Additionally, North Huntingdon Township has enacted their own ordinances regulating excavation limits and mirrors the codes being OSHA and UCC, but the Township ordinance is more specific and requires a written sealed statement by the project engineer that they have inspected the site and the material in which the excavation is made is sufficiently stable. The engineer needs to certify that steeper slope will not endanger any property or cause property damage. He states the developer's engineer has not provided any statement that this excavation will comply with the ordinance or that it will not damage the Danenberg property. He states from their review of sections of the ordinances, the excavation necessary for this project cannot be completed in compliance with the ordinances and codes without potentially destabilizing the retaining wall, causing property damage and encroaching on the Danenberg property. RESPONSE TO CITIZENS INPUT EMS Rescue - Commissioner Hemple states Rescue 8 does great work and thanks Rob Leuthold and the entire EMS staff. 057 April 16, 2025 Mr. Keenan - Commissioner Atwood states they will look into the letter he received. PARKS REPORT Commissioner Haigis asks for a follow-up on the pickleball courts and it seems the side fencing is too close to the courts and cannot allow play on that side. Manager Faulk states the pickleball courts were built to design specifications and aftert they were built started to receive some feedback. He states they learned the advanced players like to have more room, but is cost prohibitive to make the courts wider because seventeen fence posts would be have to removed, add more asphalt and 058 April 16, 2025 do an overlay. Commissioner. Zona asks how: much that would cost because people who are serious about pickleball would probably not use those courts. Manager Faulk states it could be tens of thousands of dollars, but will look into the price. Commissioner Zona states he is just worried about people not using them and going to waste. Commissioner Haigis states a resident suggested removing the one side fencing to allow to more room to move. Manager Faulk states that is a possibility of removing the fence. He states whoever is doing that on this Board needs to step down and resign. Hel has no confidence in going into an Executive Session in speaking about confidential matters that are supposed to remain private. Synchro Models: The Opening Year 2025 No Build / Build Condition signal timings do not match in the Existing Year 2024 Condition for the AM and PM peak hours. However, the modified timings fall within the prescribed MIN/MAX times reflected on the signal permit plans. 2. Although capacity, queuing, and sight distance results are favorable, and although there is not an identifiable crash pattern at the intersection of Route 30 with Summit Drive (which is to be expected with minimal volumes observed coming in and out of Summit Drive currently), the high speeds and high traffic volumes observed on Lincoln Highway (SR 0030) remain a concern relative to the ability of motorists to safely enter the roadway and merge into traffic on Route30. As such, the preferred alternative (solely from a traffic standpoint) would be an ingress-only site drive along Summit Drive, with a connection to the adjacent property to the west, which Mr. Ryan Fonzi March 25, 2025 Page 2 of2 would allow patrons to access the signal at the intersection of Lincoln Highway (SR 0030) with N./S. Thompson Lane and enter Lincoln Highway safely. If this option is not feasible, Wooster suggests that a gap study be performed in order to document the availability of acceptable gaps in traffic to accommodate both the existing traffic on Summit Drive, as well as the projected site-generated traffic anticipated to perform this maneuver. ARTICLE 8 = SPECIAL REGULATIONS S 810.2 Provide clarification as to the exterior wall surfaces that will be utilized for the buildings. Updated renderings should be provided for the new building. $8 819.3 Truck turning movements should be provided to confirm that a refuse truck has adequate spacing to turn around without backing out of the development. $ 823 Signage is not included with this application and will not be included with any approval related to the same. A separate application for signage is required and must be submitted to the Township for review and approval. SUBDMSION, AND LAND DEVELOPMENT ORDINANCE No. 1011 ARTICLE 3 - APPLICATION REQUIREMENTS S 302.4 This application qualifies as a Major Land Development. $304.1.G Each plan should have a legend to indicate existing and proposed features. No legend was provided on the E&S Plan sheet ES-2. $304.4.A The plan should provide a clear and safe access route for pedestrians to traverse the parking lot between the buildings and the proposed concrete patio to access the development on the adjacent property. S 304.5.M & .N Provide the updated architectural elevation views of the proposed building. S 304.6.B Provide the status of the modification to the NPDES permit application. As a condition of any approval that may be granted for this application, a copy of the approved permit modification along with all related plans and documents must be provided to the Township. S 304.6.1 A Transportation Impact Study was reviewed by Wooster and Associates in accordance with S 416. We note the concerns raised by Wooster and Associates in their memo dated 3/25/2025 which should be addressed with any revised submission. S 305.1 Financial Security for the development will be required prior to any construction activities may commence. An updated cost estimate was not provided. ARTICLE 4 - STREET IMPROVEMENTS AND DEDICATION STANDARDS $ 416 A Transportation Impact Study is required for this development. We note the concerns raised by Wooster and Associates in their memo dated 3/25/2025 which should be addressed with any revised submission. ARTICLE 5 - DESIGN AND IMPROVEMENTS STANDARDS S 506, 507 & 514.5 A revised geotechnical analysis and related wall designs are required prior to issuance of any building permit based on the proposed modifications to the application. The report and design plans should reflect the design changes as proposed with this most recent submission, as well as address the remaining outstanding comment regarding differential settlement. 1. We note that the building is positioned so that the foundation will be set upon a variety of subsurface materials = weathered bedrock, residual soll, and fill. The report recommends over excavation of the subsurface and recompacting ofa a structural fill to provide a consistent bearing surface. It appears that a portion of the building, particularly in the area of TB-7, will still be underlain by almost 9 feet of lean clay, while other portions at the western end will be underlain by weathered bedrock. It was noted that up to 1" of total settiement will be anticipated with the discussion, but we did not see any discussion of differential settlement due to these subsurface conditions. RE: Engineering Review of Proposed Site Walls Lincoln Corner Plaza II Development SP-01-2024 North Huntington Township, Westmoreland County, Pennsylvania This review letter is intended to supplement our previous review letter dated April 10, 2025 and submitted to t Board of Commissioners at the Special Meeting held April 10, 2025. As authorized, we have completed our review of the project plans dated March 5, 2025 for the. proposed Lincoln Corner Plaza II Development. Our review consisted of an analysis of the existing and proposed slopes and walls llustrated on the project drawings and whether we believe those elements of the project may negatively impact the upslope property (the Danenberg Property") and appurtenances. From our review of the development drawings and a site visit, the Danenberg Property contains a retaining wall which supports the rear driveway of the Elaine Drive residences. The retaining wall is 12 feet in height and less than 10 feet from the as-staked property line. The proposed development consists of a single-story building with a northwest corner wall that is approximately 7 feet below the existing surface grades. Per the Uniform Construction Code (the UCC") and the Occupational Safety and Health Administration ("OSHA") (collectively referenced herein as the "Codes") guidelines for excavations, an excavation greater than 5 feet should be sloped away from the bottom of the work area to permit a safe zone of construction activity for the workers. Based on the type of soils noted on the project drawings, the Codes require that temporary slopes be laid back on a 1.5:1 ratio (1.5 feet of horizontal distance for every 1 foot of vertical excavation). The resulting horizontal distance of excavation to permit a safe and code compliant slope for this portion of the project is 10 feet. According to the project plants, the distance between the proposed finished building wall and the upslope retaining wall on the Danenberg Property is 10 feet. This calculation, however, leaves no space for the necessary building foundations or the required perimeter drainage. FULLSERVICE CIVIL ENGIN EERING AV - - NICAL GATEWAYENGINEERS A FULL-SERVICE CIVIL ENGINEERING FIRM We have concerns that the proposed development does not permit safe excavations that would allow construction of the proposed building without potentially: 1. Destabilizing the upslope retaining wall on the Danenberg Property, or 2. Necessitating temporary excavations steeper than the Codes allows. Additionally, North Huntingdon Township has enacted their own Ordinances ("Ordinances") regulating excavation limits. Section 84-19.B is relevant to the installation of the below grade building or site walls for thi project. This ordinance section covers permanent and temporary slopes for site grading, retaining wall, and trench utility excavations. 84-19.B. Grading Standards (2) Excavation Requirements. A. Finished Slope. The finished slope, or cut face, shall be rounded at the top and shall not be steeper than two (2) horizontal to one (1) vertical in soil and one and one-half (I 1/2) to one (1) in shale or rock, except under one (1) or more of the following conditions: [1] The excavation is located SO that a line having a slope of two (2) horizontal to one (1) vertical and passing through any portion of the cut face will be entirely inside the property lines of the property on which the excavation is made. [2) A written statement is provided bearing the signature and seal of a registered professional engineer experienced in soils engineering, certifying that he has inspected the site and that the material in which the excavation is made is sufficiently stable to sustain a slope steeper than the requirements above. The statement must further certify that said steeper slope will not endanger any property or result in property damage. The statement must be submitted with the application. [3] A retaining wall or other approved support designed by a registered professional engineer is provided to support the face of the excavation. The Township Engineer may, upon recommendation of the Township Engineer, require an excavation to be made with a cut face fiatter in slope than two (2) horizontal to one (1) vertical if the soil analysis has indicated unstable soils or if field conditions indicate the material in which the excavation is to be made is unusually subject to erosion or if other conditions exist, under applicable engineering practice, to make such flatter cut slope necessary for stability and safety. Additionally, in residential areas, it is to be encouraged that flatter slopes than provided herein be constructed. This Ordinance mirrors the Codes but the Township Ordinance is more specific and requires the condition that the cut face of the excavation be entirely inside the property lines of the property on which the excavation is made. Additionally, the Ordinance requires a written, sealed statement by the project engineer that they have inspected the site and the material in which the excavation is made is sufficiently stable to sustain a slope steeper than the Ordinance requirements. The Ordinance goes on to state that the engineer certify tha the steeper slope will not endanger any property or cause property damage. The developer's engineer has not provided any statement that this excavation will comply with the Ordinance or that it will not damage the Danenberg Property. GATEWAYENGINEERS A FULL-SERVICE CIVIL ENGINEERING FIRM Additionally, Township Ordinance 84-19.B states: 84-19.B. Grading Standards (2) Excavation Requirements, C. Excavation adjacent to footings, foundations or structures states, Excavations adjacent to any footing, foundation or structure shall not extend below the angle of repose or natural slope of the soil under the nearest point of the same unless such footing, foundation or structure is first properly underpinned or protected against settlement. Our wall is a structure under this Ordinance and the excavation will extend below the natural slope of the soi supporting the wall. Therefore, the Ordinance requires that an engineer must show that the structure is property underpinned or protected against settlement before the project begins. From our review of these sections of the Township Ordinances, the excavation necessary for this project cannot be completed in compliance with the Ordinances and Codes without potentially destabilizing the retaining wall, causing property damage, and encroaching on the Danenberg Property. None of the Ordinances allow the excavation into adjacent properties. The Ordinances require that the excavated slope shall be no steeper than 1.5:1 unless an engineer provides written justification for steeper slopes. We assert that 1.5:1 is likely as steep as one may excavate this temporary slope. Given this the excavations will still encroach upon and may negatively affect the upslope retaining wall on the Danenberg Property. A steeper excavation would cause an unstable and unsafe excavation site, and a lesser slope will further undermine the existing retaining wall. We believe these issues must be addressed as the proposed project does not currently comply with the Code and the Township's OWI Ordinances.
