BOROUGH OF MT. OLIVER ORDINANCE NO. 1003 AN ORDINANCE OF THE BOROUGH OF MT. OLIVER AMENDING CHAPTER 191 OF THE BOROUGH CODE OF ORDINANCES, SEWERS AND SEWAGE DISPOSAL, ARTICLE II, SHUTOFF OF WATER SUPPLY, TO MODIFY SECTION 191-5, AUTHORITY OF BOROUGH, BY REMOVING THE FORM OF THE NOTICE REQUIRED PRIOR TO SHUTOFF; AND TO AMEND SECTION 191-6, AUTHORITY TO COMPENSATE WATER COMPANY, TO REQUIRE THE REIMBURSEMENT OF THE BOROUGH FOR CERTAIN CHARGES OR FEES INCURRED, PRIOR TO THE RESTORATION OF WATER SERVICE WHEREAS, Section 191-5 of the Mt. Oliver Borough Code of Ordinances ("Code of Ordinances") authorizes Mt. Oliver Borough (the "Borough") to direct Pennsylvania American Water Company to terminate water service to a property owing delinquent sewage bills; and WHEREAS, Section 191-5 of the Code of Ordinances contains the form of notice to be provided, prior to the termination of water service; and WHEREAS, the Borough desires to modify Section 191-5 to continue to require written notice prior to water service termination, but remove the form of said notice as the legal requirements for the content of the notice may change from time to time; and WHEREAS, Section 191-6 authorizes the Borough to pay Pennsylvania American Water Company fees to have water service terminated and subsequently restored at a property, and the Borough desires to receive reimbursement for such fees from the delinquent property owner and/or occupant, prior to water restoration. NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Council of the Borough ofMt. Oliver, as follows: I. The Council ofthe Borough ofMt. Oliver ordains that Chapter 191, Article II, Section 191- 5 of the Borough Code of Ordinances, Authority of Borough, is hereby amended to read, in its entirety, as follows: 81 191-5. Authority of borough. The collector of delinquent sewage bills may direct and authorize, in accordance with the Water Services Act, 53 P.S. SS 3102.501, et seq., the Pennsylvania American Water Company to shut off water service to property owing delinquent sewer rental and sewer service charges, including those charges for garbage grinders authorized pursuant to Section 191-34 of this Chapter. Prior to water service termination, written notice shall be provided to the owner and/or occupant of the property, in accordance with the Water Services Act. Water service at the property shall not be restored until all sewer rental and sewer service charges due and owing, including any garbage grinder charges and those charges incurred by the Borough to have water service terminated and restored pursuant to Section 191-6 herein, are paid in full. II. The Council ofthe Borough ofMt. Oliver ordains that Chapter 191, Article II, Section 191- 6 of the Borough Code of Ordinances, Authority to Compensate Water Company, is hereby amended to read, in its entirety, as follows: $ 191-6. Authority to compensate water company. The Borough is authorized and directed to payt the Pennsylvania American Water Company amounts charged by the Pennsylvania American Water Company for the termination and restoration of water service to property. The owner and/or occupant of property shall reimburse the Borough for such charges, along with all other charges due and owing, in full, prior to water service being restored to the property. III. Ifany provision oft this Ordinance is for any reason held to be legally invalid, such decision shall not affect remaining portions oft this Ordinance and they shall remain in full force and effect, and to this end, the provisions oft this Ordinance are hereby declared severable. IV. In the event of any inconsistency between the provisions of this Ordinance and any prior Ordinance, the provisions hereof shall be determined to govern. V. This Ordinance shall be effective immediately upon adoption.
