CALL TO ORDER Mayor Craig Fenter called the meeting to order. 2. INVOCATION The invocation was led by Tyler Harmonson.. 3. PLEDGES TO THE FLAGS Pledges were led by Mayor Fenter, 4. PUBLIC COMMENTS a. Ron Butler, from the Texas Department of Emergency Management gave an update to the council and public about the recent weather that Jack County has received. He advised the Council and citizens in attendance of an upcoming possibility of heavy rains and flooding in the Wichita Falls and Jacksboro areas. b. Rod Hetzel presented a request for public information and pictures of flooding near his business to the Council, City Manager and City Secretary. 1. CONSENT AGENDA All matters listed under Item 5, CONSENT AGENDA, are to be considered routine by the City Council and will be enacted by one motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. a. EXCUSED ABSENCES. b. Discussion was held. Alderman Hood made a motion to approve the April 22, 2025 meeting minutes as presented. Alderman Sisson seconded the motion. Motion carried with unanimous consent. Alderman Sisson made a motion to approve the March 24, 2025 meeting minutes as presented. Alderman Robinson seconded the motion. Motion carried with unanimous consent. 6. PRESENTATIONS AND REÇOGNITION a. COACH HILLARY DEFFEBACH (COACH D) REÇOGNIZED FOR VOLUNTEER EFFORTS AT THE JACKSBORO ANIMAL SHELTER. Animal Control Officer, Michael Booher, presented a certificate and gift of appreciation to Hillary Deffebach, and recognized her efforts in providing volunteers and any extra help for the animal shelter and events, such as the rabies clinic. City Council Minutes Regular Meeting 04/28/2025 Page 1 of 4 b. FISCAL YEAR 2023-2024 FINAL AUDIT PRESENTATION - EDGIN PARKMAN FLEMING AND FLEMING, P.C. Mike Edgin of Edgin, Parkman, Fleming and Pleming, P.C., presented the final audit report for Fiscal Year 2023-2024, ending September 2024. Mr. Edgin thanked City Staff for their diligence in supplying documents for the audit. Alderman Hood inquired if the use of FundView had made any difference in the preparation of the audit, and Mr. Edgin stated that it made the process much easier for their firm to organize and gather information. C. CITY OF JACKSBORO WATER CONSERVATION PLAN - GARVER ENGINEERING. Tina Hanson from Garver Engineering presented the Water Conservation Plan prepared for the City of Jacksboro. The plan is renewed every five years and submitted to the Texas Commission on Environmental Quality. Ms. Hanson stated that one correction would need to be made to change the source. of our water from the lake to Lost Creek Reservoir. Alderman Hood asked if the new updated water meters could help with the conservation of water, and Ms. Hanson stated it does because people are able to review their data of usage. Alderman Gonzales inquired if the City had begun to set aside funds to replace these meters since they had a ten year life-span. The City Managers stated that the USDA would require a rate adjustment to help absorb the effects of the loan for the new water plant. 7. ORDINANCES a. 0-03-2025: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF JACKSBORO, TEXAS AMENDING THE WATER CONSERVATION AND DROUGHT CONTINGENCY PLAN, CHAPTER 12, SECTION 12.05.004 WATER CONSERVATION AND DROUGHT CONTIGENCY PLAN ADOPTED; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Discussion was held, and Council members felt that the information presented needed to be reviewed further before accepting the Ordinance to adopt the plan. Alderman Hood requested a comparison of the changes between the prior plan and the plan being presented. Alderman Robinson made a motion to table the Ordinance to the following meeting. Alderman Gonzales seconded the motion. Motion carried with unanimous consent. 8. DISCUSSION REGARDING THE WATER DRAINAGE AT 218 MCCOMBS STREET. Mr. Joseph Garza first addressed the council and gave a summary of the issues that he and his neighbors have encountered with flooding on McCombs Street. Mr. Garza relayed his experence with the City's attempts to mitigate the drainage problem and he felt that the City Manager had not been transparent, did not provide legal documents that were requested, and created financial hardships. Alderman Sisson stated that he knew there needed to be a solution and asked if a cuivert had been discussed. Mr. Garza stated that the plan had changed several times and currently there was no plan in place. Alderman Sisson inquired about the large rocks that were placed there for drainage, and Mr. Garza stated Jesse Lee had confirmed that they would dig and then add concrete, which was agreed to. He further explained Mr. Garza stated that he had asked about a that it was raining, and the City was waiting for the area to dry. pouring cement sidewalk to their home at the same time that the cement culvert was being poured. Mr. Garza then stated the rock then showed up, which he had not agreed to. He stated he received no details or documents, and requested a plan in writing. City Manager, Michael Smith stated that the City had drawn up an easement agreement. Mr. Garza replied that the appraisal district had stated there would be a $30,000 loss of land value with the easement. Mayor Fenter stated that the cement culvert may not solve all of the problems, and Mr. Garza argued that raising the street 6 inches when repaving it with the curbing was the issue and it had concerned him when it was done. Mr. Garza stated that the new curbing had directed more water to his and his neighbors homes and had contributed to the flooding situation. Neighbors in the McCombs area in attendance stated that they understood the area had been surveyed and an engineer had looked at the area, but the City Manager stated no engineer had been consulted. Alderman Gonzales addressed the citizens and stated that despite what had or had not been done, at this point there needed to be a short term and a long term solution discussed, especially in light of the coming rain. The need for an engineer to survey the drainage was discussed as a long term solution. Jesse Lee, Superintendent of the Streets Department addressed the council and reviewed all of the steps that the City and Mr. Garza had agreed upon, and that the City had taken to alleviate the drainage problem. Mr. Lee also spoke with Mr. Garza's neighbor about her flooding, and she stated that she noticed the flooding when the neighboring property began to dig up their property and landscape. Mr. Lee insisted that he would never go onto property uninvited, and that his goal throughout the entire process was to make the property owners happy with solutions for the drainage. Again, the need for a specific storm drainage engineer was discussed as a long term solution, and council members discussed the availability of a pump for a short term solution to prevent Mr. Garza's neighbor's home from flooding this week. City Council Minutes Regular Meeting 04/28/2025 Page 2 of 4 Council members directed City Staff to reach out for proposals for an engineering firm to look at the drainage solutions for the area of McCombs. Mr. Garza stated that he does want to work with the City on a solution, and would like to request a council member be involved in the process. Mayor Fenter called the meeting into a closed session at 6:51 p.m. Joining the Mayor was City Attorney Reid Spiller and the Council Members in attendance. TML Attorney Jim Jeffrey and Attorney for Chief Bryan Corb, Cody Robinette, attended the closed session meeting by phone. 9. CLOSED EXECUTIVE SESSION. a. CONSULTATION WITH AN ATTORNEY; CLOSED MEETING $551.071 (1), PENDING OR CONTEMPLATED LITIGATION; (2) THE DUTY OF THE ATTORNEY TO THE GOVERNMENTAL BODY UNDER THE TEXAS DISCIPLINARY RULES OF PROFESSIONAL CONDUCT CLEARLY CONFLICTS WITH GOVERNMENT CONFLICTS WITH THIS GOVERNMENT CODE CHAPTER 551. i. DISCUSSION AND DELIBERATION REGARDING CONTEMPLATED OR THREATENED LITIGATION BY THE CHIEF OF POLICE. 10. OPEN SESSION CONSIDERATION OF ANY OFFICIAL ACTION ON THE CLOSED EXECUTIVE SESSION ITEMS: a. CONSULTATION WITH AN ATTORNEY; CLOSED MEETING $551.071 (1), PENDING OR CONTEMPLATED LITIGATION; (2) THE DUTY OF THE ATTORNEY TO THE GOVERNMENTAL BODY UNDER THE TEXAS DISCIPLINARY RULES OF PROFESSIONAL CONDUCT CLEARLY CONFLICTS WITH GOVERNMENT CONFLICTS WITH THIS GOVERNMENT CODE CHAPTER 551. i. DISCUSSION AND POSSIBLE ACTION TO PROVIDE DIRECTION OR RECOMMENDATION TO THE ATTORNEY REGARDING CONTEMPLATED OR THREATENED LITIGATION BY CHIEF OF POLICE. The Mayor reconvened the meeting into open session at 8:54 p.m. Alderman Sisson made a motion to approve the mutual settlement agreement and release, as presented by Chief Corb's Counsel at 8:44 p.m. on April 28, 2025, including execution of all necessary documents to fulfill the terms set forth in the agreement. Alderman Moffit seconded the motion. Mayor Fenter called for a record vote. The motion carried as follows: Alderman Gonzales - yes; Alderman Sisson - yes; Alderman Robinson - yes; Alderman Hood - yes; Alderman Moffit - yes. 11. UPDATES a. TNT FEST DOWNTOWN CELEBRATION UPDATES. b. JEDC GRANT FOR INDUSTRIAL PARK ENTRANCE AND INFRASTRUCTURE UPDATE. Updates were given to the Council on the above listed items. Alderman Sisson addressed the Council and citizens with appreciation for them and the town. He hated what they had recently gone through, but he stated the city of Jacksboro was a hidden gem with great potential. He wanted to show his appreciation and love for the town, and requested that everyone show grace for all that the council and city were trying to do. 12. ADJOURNMENT. Alderman Sisson made a motion to adjourn the meeting. Alderman Moffit seconded the motion. Motion carried with unanimous consent.
