Notice hereby given that the City Council of the City of Cumby, Texas will conduct a Special Meeting on JUNE 17th, 2025 L 6:00PM L 100 E Main St, Cumby, TX. 75433. PRESENTATION BY CITIZENS The City Council welcomes "Presentation by Citizens." 1 If you wish to speak, you must follow these guidelines Presentation by Citizens Guidelines: The Mayor will recognize those citizens who have signed up prior to the start of the meeting. Pursuant to Resolution No. 2020-12 Citizens are given three minutes (3:00) to speak during Presentation by Citizens.' Members of the public may only speak once and cannot pass the individual's time allotment to someone else. Direct your comments to the entire Council, not to an individual member. Show the Council members the same respect and courtesy that you expect to be shown to you. The Mayor will rule any disruptive behavior, including shouting or derogatory statements or comments, out of order. Continuation of this type of behavior could result in a request by the Mayor that the individual leave the meeting, and if refused, an order of removal. In compliance with the Texas Open Meetings Act, no member of City Council may deliberate on citizen comments for items not on the agenda. (Attorney General Opinion - JC 0169) 5. CITY COUNCIL COMMENTS Pursuant to TEX. GOV'T CODE 551.0415, the Mayor, a City Council member and Staff may report on the following items of community interest:(1) expression of thanks, congratulations or condolences (2) information about holiday schedules (3) recognition of individuals (4) reminders about upcoming events organized or sponsored by the City Council (5) Information about community events and (6) announcements involving imminent threat to public health and safety. Discussion/Action: Discussion and possible action regarding the resignation of Mayor Amber Hardy, including formal acceptance of resignation, acknowledgment of the vacancy in the office of Mayor in accordance with Texas Local Government Code for a Type A General Law Municipality, and recognition of the Mayor Pro Tem's authority to perform the duties of Mayor until the vacancy is filled as provided by law. (City Secretary) 7.2. Discussion/Action: Resignation of Current Mayor Pro Tem and Selection of New Mayor Pro Tem. Council to discuss and consider accepting the resignation of Mayor Pro Tem Brandon Phipps and selecting a new Mayor Pro Tem from among the current council members, as authorized under Texas Local Government Code S 22.037. The Mayor Pro Tem shall serve in the absence of the Mayor and perform the Mayor's duties as needed. (Mayor Pro Tem, Brandon Phipps) 7.3. Discussion/Action: Adoption of Ordinance 2025-06-17, Authorizing Signatories on City of Cumby Bank Accounts. Proposed Authorized Signatories: Mayor Pro Tem, City Secretary, Associate Judge, Chief of Police, and one (1) additional signatory (if any), to be determined during this meeting. Discussion/Action: Council to discuss and consider approval Resolution 2025-06-17-1, budget amendment reallocating the unspent mayoral salary previously budgeted at $1,200 per month to the Street Maintenance Fund for the months between the vacancy of the mayoral office and the upcoming election in November 2025. Purpose: To utilize the budgeted but unused salary funds for needed street maintenance and improvements during the interim period without a sitting mayor. (Alderman 4, Julie Morris) 7.5. Discussion/Action: Council to discuss and consider amending Resolution 2025-01 (Resolution 2025-01-A) to which originally imposed a $10.00 monthly Street Maintenance Fee on all utility accounts. The proposed amendment would reallocate the revenue generated by this fee to cover the annual balloon payment of $53,436.24 due each November 15th on the Cumby Volunteer Fire Department's pump truck loan. Purpose: To provide a stable, designated funding source to meet the City's financial commitment to the Cumby Volunteer Fire Department's critical firefighting equipment. (City Secretary) 7.6. Discussion/Action: Adoption of Ordinance No. 2025-05-02 Prohibiting Parking in Designated Fire Lanes Council to discuss and consider adoption of Ordinance No. 2025-05-02, prohibiting parking in designated fire lanes within the City of Cumby. The ordinance provides for enforcement and penalties in accordance with the Texas Transportation Code. (City Secretary) June Tle 2025 Page 213 7.7. Discussion/Action: Discussion and possible action regarding matters deliberated in Executive Session concerning the Public Works Administrator, including but not limited to appointment, employment, evaluation, reassignment, duties, discipline, or dismissal. Discussion/Action: Update on various grants and other potential funding requests by City of Cumby (Alderman 5, Rosina Duckworth, and Miranda Randle, City Secretary) 9. EXECUTIVE SESSION The City Council will convene into Executive Session pursuant to Texas Government Code, Section 551.074 (Personnel Matters) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, job description change, or dismissal of a public officer or employee, specifically regarding the Public Works Administrator. 10.ADIOURNMENT Executive Sessions Authorized - The City Council for the City of Cumby reserves right to adjourn into executive session at any time during the course of this meeting to discuss any matter authorized by Texas Government Code; 551.072 (Deliberations related to Real Property); 551.073 (Deliberations related to prospective gifts or donations); Section 551.074 (Personnel Matter); 551.076 Deliberations regarding the deployment of security devices or the implementation of security policy); and 551.087 (Deliberations regarding Economic Development negotiations).
