Municipal facilities and services will be provided to the Annexation Area at the following levels and in accordance with the following schedule: A. Police Protection: The City provides municipal police protection to its residents, including routine patrols throughout the City and law enforcement services upon call. Upon the effective date of the Annexation, said services will also be made available to the Annexation Area on the same basis as they are made available to other parts of the City with land uses and population densities similar to those reasonably contemplated or projected in the Annexation Area. B. Fire Protection and Emergency Medical Services: The Property presently received fire and emergency medical services provided by the Gunter Volunteer Fire Department. C. Solid Waste Collection: The City's solid waste collection is provided by private companies contracted by the City. Upon the effective date ofthe Annexation, the City will provide solid waste collection to the Annexation Area on the same basis as it is made available to other parts of the City with land uses and population densities similar to those reasonably contemplated or projected in the Annexation Area. D. Water and Wastewater Service and Maintenance Water: Water The Annexation Area is within the Mustang Special Utility District exclusive Certificate of Convenience and Necessity area for the provision of water service. Routine maintenance of the existing public water system, which is not within the service area of other water service providers, will begin in the Annexation Area on the same basis as other parts of the City with land uses and population densities similar to those reasonably contemplated or projected in the Annexation Area (upon the effective date of Annexation). Except, however, areas served by other water service providers will have their existing service maintained under that provider'sjurisdiction. Wastewater Wastewater service to the Annexation Area will be provided on the same basis as other areas of the City with topography, land uses and population densities similar to those reasonably contemplated or projected in the Annexation Area. The Annexation Area is currently served by individually owned Exhibit "B" Page 1 Onsite Sanity Sewer Facilities and will continue to be served and maintained in this manner. When property develops in the adjacent areas, sanitary sewer service shall be provided in accordance with the present extension ordinance. Extension of service shall comply with applicable codes and ordinances. E. Maintenance of Roads, Street, and Street Lighting: The Property contains no public roads, streets, and street lighting within the boundaries of the property. All public roads, streets or alleyways in the property which have been dedicated to the public shall be maintained to the same degree and extent that other roads, streets, and alleyways are maintained in areas with similar topography, land use and population density. All lighting of roads, streets, and alleyways which may be positioned in a right-of-way, roadway, or utility easement shall be maintained by the applicable utility company servicing the City of Gunter, company Texas, pursuant to the rules, regulations, and fees of such utility. F. Parks, Playgrounds and other Public Recreation Facilities and Services: At this time there are no public or private recreation facilities in the Annexation Area. G. Public Library Services and Other Publicly Owned Facilities, Buildings and Services: At this time there are no public library services in the Annexation Area. H. General Municipal Administration: General municipal administration services will be available to the Annexation Area upon the effective date oft the Annexation. This Service Plan provides for full municipal services to the Annexation Area that are adequate to serve the Annexation Area on the same basis as municipal services are made available to other parts of the City with land uses and population densities similar to those reasonably contemplated or projected in the Annexation Area. Further, said municipal services are equal to or greater than the services and level of such services in existence in the Annexation Area immediately preceding the effective date of Annexation. This Service Plan does not constitute a right to a superior level of services in the Annexation Area. WHEREAS, The City of Gunter is a type A general law municipality located in Grayson County, Texas, created in accordance with provisions of the Texas Local Government Code and operating pursuant to the enabling legislation ofthe State ofTexas ("City"), and WHEREAS, the Texas Local Government Code, chapter 51 authorizes the City to adopt ordinances or regulations not inconsistent with the laws of the State of Texas that are necessary for good government and to protect the interest, welfare or good order of the municipality; and WHEREAS, by authority and direction of the City Council of the City of Gunter, Texas, an engineering and traffic study and survey was made by the Texas Department of Transportation, Transportation Operations Office to determine the maximum reasonable and prudent speeds for vehicles traveling upon the following named streets and highways and parts thereof, to facilitate the most effective use of said streets and highways and the safe and effective movement of vehicular traffic thereon; and WHEREAS, such study and survey established, and it is hereby found by the City Council of the City of Gunter, Texas, that the following are the maximum reasonable and prudent rates ofs speed for vehicular traffic upon said streets and highways and parts thereof. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GUNTER, TEXAS: SECTION 1. An operator of a motor vehicle shall not drive such vehicle upon a public road, street, or highway in the City of Gunter, Texas, at a speed greater than is reasonable or prudent under the conditions and circumstançes then existing. Except when a special hazard exists that requires lower speeds for compliance with the above requirements, the following prima facie maximum speed limits indicated in this section for motor vehicles are hereby determined and declared to be reasonable and safe, and such maximum speed limits are hereby fixed at the rate of speed indicated for motor vehicles traveling upon the named street or highway, or parts thereof, and no motor vehicle shall be operated along or upon such portions of City of Gunter Ordinance No. Speed Limit - FM 121 (cgm:6/16/25) Page 1 of3 such named street or highway within the corporate limits of the City of Gunter in excess of the speeds now set forth in the following limits: On Farm-to-Market (FM) 121, approximate highway mile point 11.364 in an easterly direction for a distance of approximately 0.200 miles, a speed limit of thirty-five (35) miles per hour at all times, then continuing easterly for a distance of approximately 0.200 miles, a speed limit of forth-five (45) miles per hour at all times, then continuing easterly for a distance of approximately 3.274 miles, a speed limit of fifty-five (55) miles per hour at all times. Exception: A school zone speed limit of thirty-five (35) miles per hour shall be effective on school days only at the school crossing zone, from approximate highway mile point 13.442 to highway mile point 13.631 during the following hours: 1. From forty-five (45) minutes before school opens until classes begin for the school day. 2. If the school has an open campus lunch, from the beginning to the end of the school day lunch period. 3. For thirty (30) minutes beginning at the end oft the school day. SECTION 2. Severability. If any section, subsection, article, paragraph, sentence, clause, phrase or word in this Ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 3. Repeal of Conflicting Ordinances. All ordinances, orders and resolutions heretofore passed and adopted by the City Council of the City of Forest Hill, Texas are hereby repealed to the extent said ordinances, orders or resolutions or parts thereof are in conflict herewith, except for the City's Zoning Ordinance unless repealed or amended consistent with state law and city ordinance. SECTION 4. Prior Offense. That an offense committed before the effective date of this Ordinance is governed by prior law in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 5. Penalty. That any person, firm, or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of the City of Gunter, as previously amended, and upon conviction shall be punished by a fine not to exceed the sum ofTwo Hundred Dollars ($200) for each offense. SECTION 6. Proper Notice and Meeting. It is hereby officially found and determined that the meeting at which the Ordinance was passed was open to the public and that public notice City of Gunter Ordinance No. Speed Limit - FM 121 (cgm:6/16/25) Page 2 of3 of the time, place and purpose of said meeting was given as required by the Open Meetings Act, Chapter 551 oft the Texas Government Code. SECTION 7. Effective Date. This Ordinance shall be and become effective immediately upon and after its passage and publication as may be required by governing law. IT IS ACCORDINGLY SO ORDAINED.
