G. 911 - Transfer the following amounts from the Contingent Expenditures and Grant Account No. 91050-7041 to the 911 Accounts as follows: > $45.00 to Account # 035600-8109-15 (Donation from James K Koger Jr.) PRESENTATION BY JIM BALDWIN Jim Baldwin from Cumberland Plateau Planning District Committee gave a presentation on the Roadmap to Economic Resiliency for Tazewell County. In this presentation Mr. Baldwin explained that Tazewell County was the recipient of certain CARES funds to look into economic December 7, 2021 BOS MEETING MINUTES Page/4 recovery opportunities. He stated that they hired a Economic Recovery Coordinator, Scotty Wampler, to oversee the process. He said this plan made some strategies and recommendations for ift there was another pandemic. Some primary components of this strategic report were: 1. Stakeholder Engagement Responses, 2. Cluster Verification, 3. Asset Mapping, and 4. Business/Tourism Resiliency Strategies. He stated that the goal of this Roadmap to Economic Resiliency is to help local leaders achieve their vision for this region. Mr. Baldwin also stated that the health of the business community is integral in achieving long-term prosperity. KENNETH DUNFORD = DIRECTOR OF ENGINEERING EVAS WALK Mr. Dunford stated that this is located in the Western District and that the Home Owners Association owns the road. They have petitioned the county to take over this road. The engineering department has looked at the work on this road and has no issues with the drainage work. He also stated the legal department still needs to review the legal documents for Evas Walk. County Attorney, Chase Collins, stated that he has received all legal documents and that he has reviewed these documents. Mr. Collins stated that they want to make sure this road work is done properly by the bylaws. Mr. Collins stated he had no objection to make the recommendation for a public hearing for this issue. Mr. Dunford asked the board to approve a public hearing once everything has been reviewed by the legal department. Upon motion of Supervisor Lester, seconded by Supervisor Stacy and adopted by a vote of51 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes a public hearing to be held once documents have been reviewed by the legal department. 2022 RANKING LIST Mr. Dunford presented a list of the ranked roads in Tazewell County. He stated that the first five roads are the top roads, one from each district. He requested that the board approve for him to place the below list on the county website in January 2022. Upon motion of Supervisor Stacy, seconded by Supervisor Hymes and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes Mr. Dunford to place the below list on the county website in January 2022. INCREASE OF BUDGET FOR EMERGENCY ACTION PLAN December 7, 2021 BOS MEETING MINUTES Page/5 $33,550.00 FROM CAPITAL CONTINGENCY Mr. Dunford explained that the county had originally set a budget of $20,000.00 for the Emergency Action Plan project. He stated that the only bid received was from Thompson and Litton. He also stated that their bid was for $33,550.00, which was $13,550.00 over budget. He requested that the board approve a higher budget for this project. Upon motion of Supervisor Stacy, seconded by Supervisor Asbury and adopted by a vote of 5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes the amount of $33,550.00 from the Capital Contingency fund for an increased budget to perform Emergency Action Plan by Thomas and Litton. PUBLIC HEARING The Chairman called to order a public hearing that was duly advertised according to law regarding, PROPOSED ORDINANCE TO AMEND AND REENACT SECTIONS OF AN ORDINANCE TO IMPOSE A TRANSIENT OCCUPANCY TAX IN TAZEWBLL COUNTY, VIRGINIA IN ACCORDANCE WITH SECTION 58.1-3819. Proposed Ordinance to approve the language of the Transient Occupancy Tax in Tazewell County, Virginia. Ethel Perkins ofTazewell, VA rose to speak. She asked that the fact this tax wouldn't affect the town ofTazewell be put on public record. The County Attorney then stated this tax December 7, 2021 BOS MEETING MINUTES Page/7 would not affect town ofTazewell AirBNB's. He stated that if the town imposed a transient occupancy tax it was completely separate from the county transient occupancy tax. Connie Bailey of Bluefield, VA rose to speak. She stated that she has been paying the transient occupancy tax on her AirBNB for the last 6 years. She also stated that she felt the rate of4.8% wasn't exactly fair. She said she couldn't deduct AirBNB rental expenses like everyone else on taxes because she just rents out one room and not a whole residence. She asked that the Board consider taxing the AirBnB's at one level ifthel home was renting a room in the residence ifit was short term and taxing a whole residency rental at another level. She also stated she was curious as to where this tax money goes. She stated that the timing of this tax was a burden. Ms. Bailey also stated that there was very little notice of this ordinance and public hearing. She asked that the notices start being posted on the counties website. Supervisor Stacy stated that this tax is to capture money from the people traveling to our area. This is to provide certain services for people visiting our area, such as, fire services, police services, and emergency services. He stated that this helps not raise property taxes for Tazewell County residents. He stated that everywhere you travel has an occupancy tax and this tax benefits that specific region. Supervisor Lester stated that he finds this tax reasonable and that people visiting our area expect basic government services and this tax helps fund those services. Upon motion of Supervisor Stacy, seconded by Supervisor Hymes and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby approves the ordinance to amend the language of the ordinance to impose a transient occupancy tax in Tazewell County, Virginia in accordance with Section 58.1-3819. CITIZEN COMMENTS SCHEDULED CLIFF SERVICES Jackie Atkins from Cliff Services rose to speak. She stated how the new way of doing things at the landfill are greatly affecting her business. She stated you now have to stack tires instead ofjust dumping them. She stated that it takes her employees hours to do this. Ms. Atkins then stated that she only has a few employees, SO this taking more time greatly impacts her employees. She also stated that the price rising was also becoming an issue for their small business. She stated they are paying for water, ice, etc inside oft these tires when they dump them. Ms. Atkins stated she is in fear that the increased prices will cause people to not dispose oft them properly and trash up the county again. She stated everyone has done such a good job of beatifying the county and she would hate to see the county, junked up again. County Administrator, Eric Young, stated that the county is only allowed to keep 1,500 tires on site at the landfill. He stated that the landfill must keep a count on these tires, per DEQ. He stated this was the cause for the new stacking policy. Mr. Young also stated there is an issue with getting rid of tires. He stated they arel hoping that working with Lusk Disposal will be beneficial to the county and the tires will be removed faster than before. COVIID UPDATE CASE NUMBER UPDATE County Administrator, Eric Young, stated that the newest COVID numbers were higher. He mentioned that this is the post Thanksgiving spike. He stated the average number of cases per day is 21. He said at the last board meeting this average was 10. He stated that the average number of positive tests were over 15% now. Mr. Young said he expects this number to rise at the first of the year due to holidays. He encouraged, ifyou were in a vulnerable group to get your COVID booster shot. Mr. Young observed that the county may need to have another State of Emergency close to the middle oft them month. December 7, 2021 BOS MEETING MINUTES Page/9 CARES ACT FUNDING / AMERICAN RESCUE PLAN ACT FUNDING Mr. Young gave a presentation regarding the remaining balance of CARES ACT Funds. He reminded the board that while CARES funds which are unspent must be returned by December 31, 2021, the county has until December 31, 2024 to spend ARPA funds and that it may be better to spend CARES funds instead where possible. CARES FUNDING APPROVAL OF REIMBURSEMENT OF EMERGENCY MANAGEMENT PERSONNEL STIPENDS $22,500.00 FROM CARES ACT FUNDS County Administrator, Eric Young, stated that this money will be going towards stipends that were approved for Emergency Management personnel at the November 2021 board meeting. He also asked that this now be taken from CARES Funding instead of ARPA. Upon motion ofs Supervisor Lester, seconded by Supervisor Plaster and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes reimbursing $22,500.00 for the emergency management stipends from the CARES ACT Fund. APPROVAL TO USE CARES ACT FUNDS INSTEAD OF ARPA FOR BLUEFIELD UNIVERSITY $33,999.00 FROM CARES ACT FUNDS County Administrator, Eric Young, stated that this money is being used for Tazewell County Employees Covid Testing. He stated this testing is letting employees get out of quarantine as quickly as possible. He also stated that this money is being used for student testing for residential students of Bluefield University. Upon motion of Supervisor Stacy, seconded by Supervisor Plaster and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes payment of$33,999.00 to Bluefield University from CARES Funds for Covid Testing and testing supplies. APPROVAL OF REIMBURSEMENT OF VACINATED TAZEWELL COUNTY EMPLOYEES BONOS $22,575.00 FROM CARES ACT FUNDS December 7, 2021 BOS MEETING MINUTES Page_/10 County Administrator, Eric Young, stated that this money should now come from CARES funds instead of ARPA. This is the previously approved bonus for vaccinated full time county employees. Upon motion ofSupervisor Hymes, seconded by Supervisor Lester and adopted by a vote of 5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes $22,575.00 from CARES Funds be paid for full time county employees for vaccination bonuses. $5,700.00 FROM CARES ACT FUNDS Mr. Young stated that the Board had intended to only give vaccination bonuses to full time employees but many long term, part time employees had gotten the vaccine expecting the bonus, SO he asked that they now be included. County Administrator, Eric Young, stated that this money should now come from CARES funds instead of ARPA. This is a bonus for vaccinated permanent part time county employees. Upon motion of Supervisor Hymes, seconded by Supervisor Lester and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes $5,700.00 from CARES Funds be paid for permanent part time county employees for vaccination bonuses of$150.00 each. APPROVAL OF RETURNED MONEY TO CARES FUND $7,016.02 TO RETURN TO CARES FUND County Administrator, Eric Young, stated that the Center for Christian Action returned what CARES money they didn't use. This amount was $7,016.02. He stated that this money needs to be transferred to the CARES Act Fund. Upon motion of Supervisor Asbury, seconded by Supervisor Stacy and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes the transfer ofs $7,016.02 to CARES Fund. APPROVAL OF REIMBURSEMENT EMS SALERIES $74,941.41 FROM CARES ACT FUNDS County Administrator, Eric Young, stated that at a previous board meeting there was discussion of authorization for reimbursing the county for its EMS salaries paid by the county during the pandemic from CARES funds if enough CARES funds remained at the end ofthe year. He further advised the board he felt remaining CARES funds could be used for this purpose. AUTHORIZATION FOR RETURNED CARES FUNDS The Board discussed that they did not want to return CARES funds if they could be used. County Administrator, Eric Young, asked the board for authorization for him to reimburse the county from any returned CARES funds money for expenses in any previously approved line item category. Upon motion of Supervisor Stacy, seconded by Supervisor Plaster and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes the county administrator to reimburse the county from any returned CARES funds for any previously approved CARES line item category. APRA DISCUSSION OF FUNDS TO HELP PURCHASE AERIAL TRUCK FOR TOWN OF TAZEWELL $250,000.00 FROM ARPA FUNDS Supervisor Hymes asked the board for consideration of $250,000.00 from ARPA funds for the Town ofTazewell for an aerial fire truck. He stated that the Town ofTazewell's current truck is 40 years old. He stated that for the town to purchase this truck it will be $1.5 Million. County Administrator suggested that this be referred to the Emergency Services Committee and the Budget Committee. The board discussed other town's needs for fire trucks and other volunteer department needs. Upon motion of Supervisor Hymes, seconded by Supervisor Stacy and adopted by a vote of 4 to 1, the Tazewell County Board ofSupervisors hereby authorizes $250,000.00 from ARPA funds to help the Town ofTazewell purchase an aerial truck upon recommendation of Emergency Services Committee and the Budget Committee. ADMINISTRATIVE REDISTRICTING December 7, 2021 BOS MBETING MINUTES Page_/12 County Attorney, Chase Collins, stated that he wanted to bring to the board's s attention that the Jewell Ridge Polling place has been moved on an emergency basis. He stated that it was well received at Presbyterian Church. He stated that the electoral board was planning on voting to keep this location. Mr. Collins stated there needed to be a public hearing for this. Mr. Collins requested that contingent on the electoral boards vote, to have a public hearing on moving Jewell Ridge's polling place. Upon motion ofSupervisor Plaster, seconded by Supervisor Stacy and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby approves on having a public hearing for moving theJewell Ridge Poling Place to the local Presbyterian Church. APOINTMENTS COAL AND GAS ROAD COMMITTEE Upon motion of Supervisor Hymes, seconded by Supervisor Plaster and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board ofSupervisors hereby appoints Andy Hrovatic to the Coal and Gas Road Committee. AIRPORT AUTHORITY Upon motion of Supervisor Hymes, seconded by Supervisor Stacy and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby reappoints Michael Hoops to the Airport Authority. SWVA ALCOHOL SAFETY ACTION PROGRAM POLICY BOARD Upon motion of Supervisor Lester, seconded by Supervisor Asbury and adopted by a vote of4 to 0, with Supervisor Plaster abstaining, the Tazewell County Board of Supervisors hereby reappoints Chris Plaster to the SWVA Alcohol Safety Action Program Policy Board. He stated that he suggest the board send them a letter to request the money for next year from the board. DAVENPORT UPDATE County Administrator, Eric Young, stated that Davenport is the county's financial advisors. They helped the county with restructuring the counties debt. He stated that Davenport is now looking into the PSA's s debt. Mr. Young stated that the PSA's debt is carrying about $34 Million in debt. He stated that Davenport is restructuring this debt by refinancing this debt and saving the PSA about $22,000 annually with lower interest rates. This will be a savings of almost $400,000.00 over a 20 year period. Mr. Young stated that Davenport will come before the board in March with the PSA asking that the board co-sign on this debt. RADIO UPDATE County Administrator, Eric Young, stated that he met with the Sheriff's S office. He said the Sheriff's S office asked the board for $1.8 Million for new radio systems at the October Board of Supervisors meeting. Mr. Young asked ift the Sheriff's department could breakdown this amount and split it up to be able to purchase over a few years. He stated that the Sheriff's department will be applying for another Federal Grant for this. Mr. Young said he was going to present this to the board and try to take ARPA funds for this. Mr. Young says he is hoping the Sheriff S department gets the grant and it should bring the total down to $1.5 Million from ARPA. STARLINK DEPLOYMENT County Administrator, Eric Young, stated that the county allocated 60 units to the secondary school system. He stated that the schools had only used 7 at the last count. Mr. Young suggested that the board look to the community college to see if they could deploy these units. Mr. Young asked the board if they would want to completely pull these units from the school or to split them 30/30 between the school system and the community college system. Upon motion of Supervisor Plaster, seconded by Supervisor Stacy and adopted by a vote of4 to 0, with Supervisor Lester abstaining, the Tazewell County Board of Supervisors hereby authorizes 30 units being allocated to the school system and 30 units to the community college system. CONSIDERATION OF ADOPTING BURN BAN County Administrator, Eric Young, asked the board to extend the burn ban to the end of the calendar year. Upon motion ofSupervisor Plaster, seconded by Supervisor Lester and adopted by a vote of5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby extends the burn band until the end ofthe calendar year. SHERIFF'S DEPARTMENT REQUEST County Administrator, Eric Young, stated that the Sheriff S Department is requesting that the two open part time positions be combined into one full time position. Mr. Young asked the board to approve this change. The amount needed for this is $31,594.00 for salary and $22,608.00 in benefits. Upon motion of Supervisor Lester, seconded by Supervisor Plaster and adopted by a vote of 5 to 0, with all members present and voting in favor thereof and no one against the same, the Tazewell County Board of Supervisors hereby authorizes $31,594 for one full time sheriff's department employee salary and $22,608.00 in benefits for this position to be paid from the Sheriff' s previously approved payroll budget. DECEMBER 23. 2021 County Administrator, Eric Young, stated the state of Virginia will close their offices on December 23, 2021. He asked the board to close the county offices on December 23, 2021 as well.
