Belton City Council Meeting May 27, 2025 = 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor David K. Leigh, Mayor Pro Tem John R. Holmes, Sr., Councilmembers Craig Pearson, Wayne Carpenter, Daniel Bucher, Stephanie O'Banion and Dave Covington. Staff present included Sam Listi, John Messer, Mike Rodgers, Amy Casey, Chris Brown, Larry Berg, Daniel Aguirre, Jon Fontenot, Bob van Til, Megan Odiorne, Amanda Cox, Christina Sparks, Scott Hodde, James Grant, Joe Dyer and Debbie Smith. The Pledge of Allegiance to the U.S. Flag was led by Mayor David K. Leigh. The Pledge of Allegiance to the Texas Flag was led by City Clerk Amy Casey. The Invocation was given by Councilmember Daniel Bucher. 1. Call to order. Mayor Leigh called the meeting to order at 5:32 p.m. 2. Public Comments. (Audio 2:06) Rosemary Sims, 436 E. 14th Avenue, voiced her concerns about the water and sewer rates and the new billing methodology that has tripled their utility bill. Dominica Garza, 3012 Mystic Mountain Lane, spoke against approving the appeal of Item #12. She stated that the denial should be upheld. Steve Calderon, 206 S. Burnett, stated that his neighbor on Avenue A is making masonry blocks and is disturbing the peace. There were no other public comments. 3. Present Scholarships from Waste Management, Inc., to Belton ISD graduating seniors. (Audio 12:37) Director of Communications Paul Romer discussed the City's partnership with Waste Management and thanked this year's judges for their work in selection of the scholarship recipients. Paul Daugereau of Waste Management presented the scholarship money to this year's recipients, Estevao Arantes, Abriella Joyner, Asa Jackson and Jaidan Mauk. Consent Agenda Items 4-13 under this section are considered to be routine by the City Council and may be enacted by one motion. Consider an appeal to the 500-foot separation requirement for the non-owner- occupied Short-Term Rental at 212-1/2 N. Sparks Street. 13.Consider granting authority for these actions regarding Oncor's acquisition of 8.9 acres, located east of IH-35 and adjacent and east of Rose Lane, for expansion of an Oncor substation: A. Authorize the City Manager to execute an agreement with Oncor regarding annexation of the subject property at the appropriate time. B. Authorize the City Manager to execute a Disclaimer of Interest, removing Belton from the condemnation lawsuit underway by Oncor. Upon a motion by Mayor Pro Tem Holmes and a second by Councilmember Covington, Consent Agenda Items 4-11 and 13, including the following captioned resolutions, were unanimously approved upon a vote of 7-0. RESOLUTION NO. 2025-21-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, AUTHORIZING THE SUBMITTAL OF A GRANT APPLICATION TO THE MOTOR VEHICLE CRIME PREVENTION AUTHORITY SB224 CATALYTIC CONVERTER GRANT PROGRAM; AND DESIGNATING AUTHORIZED OFFICIALS. RESOLUTION NO. 2025-22-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, APPROVING THE AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR A LOCAL ON-SYSTEM IMPROVEMENT PROJECT AUTHORIZING THE CITY OF BELTON TO CONSTRUCT A CROSS-ACCESS CONNECTION BETWEEN 106 AND 108 LAKE ROAD; AND HEREBY AUTHORIZES THE CITY MANAGER TO EXECUTE THE AGREEMENT FOR A LOCAL ON-SYSTEM IMPROVEMENT PROJECT Director of Development Services Bob van Til presented Item 12. Councilmember Bucher made a motion for approval of the appeal. Councilmember Covington seconded the motion which was approved upon a vote of 6-1 with Mayor Pro Tem Holmes providing the dissenting vote. Planning and Zoning 14. Z-24-30 = Hold a public hearing and consider appeal of the Planning and Zoning Commission decision regarding a zoning change from Agricultural to Planned Development Commercial Highway on approximately 18.2 acres located at 5890 Toll Bridge Road. Public Hearing: Joey Najera, 6101 Tollbridge Road (representative of developer of River Farm), spoke against the zoning change. Barbara Peck, representative of Love's Travel Stops, spoke in favor of the zoning change. Tess Dula, representative of Hunt Communities (River Farm), spoke against the zoning change. Karen Wunsch, Pape-Dawson (applicant's representative), spoke in favor of the zoning change. Kenneth Stone, 5900 Tollbridge Road, spoke against the zoning change. Sarah Ulusoy, Pape-Dawson (applicant's design engineer), spoke in favor of the zoning change. Dominica Garza, 3012 Mystic Mountain, spoke against the zoning change. No one else spoke for or against the item. Upon a motion by Councilmember Covington, and a second by Mayor Pro Tem Holmes, the zoning change from Agricultural to Planned Development Commercial Highway was denied with prejudice upon a vote of 5-2 with Councilmembers Bucher and O'Banion providing the dissenting votes. 15. Z-25-15 = Hold a public hearing and consider a zoning change from Planned Development Retail to Planned Development Retail with a Specific Use Permit for a Package Store located at 2511 N. Public Hearing: Ron Thrower, applicant's representative, spoke in favor of the zoning change. No one else spoke for or against the item. Upon a motion by Councilmember Bucher and a second by Councilmember O'Banion, the zoning change from Planned Development Retail to Planned Development Retail with an SUP for a package store, was unanimously approved upon a vote of 7-0 with the following conditions: The development must conform to all applicable standards of the Retail Zoning Districts. Future improvements shall conform to applicable City ordinances. Belton City Council Meeting May 27, 2025 = Page 5 ORDINANCE NO. 2025-37 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM PLANNED DEVELOPMENT-RETAIL TO PLANNED DEVELOPMENT-RETAIL WITH A SPECIFIC USE PERMIT FOR A PACKAGE STORE ON APPROXIMATELY 1,746 SQUARE FEET LOCATED AT 2511 N. MAIN STREET, SUITE 112. 16.Z-25-16 = Hold a public hearing and consider a zoning change from Single Family-1 to 2-Family for duplex construction on approximately 0.38 acres located at 805-12 W. 7th Avenue. A final subdivision plat meeting the requirements of the adopted Subdivision Ordinance is required for future construction. Building plans in compliance with adopted standards are required. ORDINANCE NO. 2025-38 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM SINGLE FAMILY-1 TO 2-FAMILY ON APPROXIMATELY 0.38 ACRES LOCATED AT 805%2 W. 7TH AVENUE. 17.Z-25-17 = Hold a public hearing and consider appeal of the Planning and Zoning Commission decision regarding a zoning change from Planned Development-48 (Restaurant w! Drive-Thru) to Planned Development (PD) = Retail on approximately 1.65 acres located at 121 Lake Road. (The applicant has requested this item be postponed to the June 10, 2025, City Council meeting.)
