Haba SLN MINUTES Aransas Pass City Council Regular Meeting Monday, May 19, 2025 at 6:00 pm City Hall = Council Chambers 600 W. Cleveland Blvd., Aransas Pass, Texas 78336 enathe 1. Call to Order and Certification of a Quorum Mayor Jason Knight called the Aransas Pass City Council Regular Meeting to order at 6:00 p.m. With Council Members present, a quorum was established. Council Members present: Council Members Ruth Camarillo-Smith, LuAna "Lulu" Martin, and Mayor Knight. Council Member Haskins joined the meeting at 6:06 pm. Staff present: City Manager Mary Juarez, City Secretary Kandice Garrett, Finance Director Sandra Garcia, Planning Director Brenda Joyas, Police Chief David Perkins, Public Works Director David Flores, Fire Chief Michael Neujahr, and Community Enrichment Director Kaylynn Paxson. Also present was City Attorney Epimenio Ysassi. 2. Invocation City Manager Mary Juarez delivered the invocation. 3. Pledge Mayor Knight led the Pledge of Allegiance to the U.S.A. flag. 4. Special Consideration tems a. Consideration to approve Ordinance No. 2025-4494 declaring the May 3, 2025 election results. City Secretary Kandice Garrett explained that this is the Ordinance declaring the results of the May 3, 2025 General and Special election and upon completion of the canvass, the election results became official on May 13, 2025 and all six Charter Amendment Propositions passed and will be incorporated into our City Charter. Council Member Martin made a motion to approve Item 4.a., seconded by Council Member Camarillo-Smith and the motion passed with the following vote: Knight, Camarillo-Smith, and Martin voted Aye. b. Consideration on selection of Mayor Pro Tem for the ensuing year. City Secretary Garrett stated that the next item for consideration is appointing a Mayro Pro Tem for the ensuing year as set forth in the City Charter, Article III, Section 5. Council Member Camarillo-smith made a motion to appoint Council Member Haskins for Mayor Pro Tem, seconded by Council Member Martin and the motion passed with the following vote: Knight, Camarillo-Smith, and Martin voted Aye. Regular City Council Meeting Minutes - May 19, 2025 Page 1 of 5 C. Consideration to approve a Resolution declaring the vacancy for Council Member Place 2. City Secretary Garrett noted the next step to create a vacancy is pass a Resolution declaring the vacancy for the office of Council Member Place 2 effective May 19, 2025, for the remainder of the unexpired term. Council Member Martin made a motion to approve Item 4.c., seconded by Council Member Camarillo-Smith and the motion passed with the following vote: Knight, Camarillo-Smith, and Martin voted Aye. d. Consideration on the process for filling the City Council Member Place 2 vacancy. City Secretary Garrett briefly went over the process for filling the vacancy noting that the City of Aransas Pass will be accepting applications for individuals interested in being considered to fill the unexpired term of City Council Member Place 2 and the application and Letter of Interest will be accepted until Friday, June 13, at 5:00 PM. She further stated that the person will fill the unexpired term until the General City Election scheduled for May 2, 2026 and went over the qualifications. Council Member Camarillo-Smith made a motion to approve Item 4.d., seconded by Council Member Martin and the motion passed with the following vote: Knight, Camarillo- Smith, and Martin voted Aye. e. Consideration on selecting a date to appoint a person to fill the City Council Member Place 2 vacancy. City Secretary Garrett informed the Council that applications will be considered at a Special Council Meeting where applicants will be interviewed and selected. Afterwards a swearing- in will be conducted immediately following the appointment of a new City Council Member, Place 2. There was discussion on the selection of a date. Council Member Martin made a motion to approve Item 4.e. selecting the date of June 18, 2025, seconded by Council Member Haskins and the motion passed with the following vote: Camarllo-Smith, Martin, and Haskins voted Aye. 5. Presentations a. Introduction to Public Improvement District (PID) - Mark McLiney, SAMCO Capital Mark McLiney, with SAMCO Capital presented this item and reviewed the Public Improvement District (PID) provisions according to Chapter 372 of Local Government Code Statute and showed how it works and how it can be used as an economic development tool for our city. b. Budget Calendar for FY: 25-26 City Manager Juarez provided an overview of the budget calendar for Fiscal Year 2025- 2026 and discussed important dates of the budget process. 6. Board and Commission Appointments Planning and Zoning Commission (City Secretary) City Secretary Garrett informed the Council that some new information has come in and Regular City Council Meeting Minutes - May 19, 2025 Page 2 of 5 requested that this item be moved to the June 2 meeting. 7. Announcements a. City Manager's Announcements i. Workshop Items - June 2, 2025 a. Unified Development Code b. Amendment to Personnel Policy Manual City Manager Mary Juarez informed the Council of the announcements. 8. Citizen Comments Stacy Durham, Certified Public Accountant and board member on the Housing Authority spoke about law violations and defamation of character conducted by City Council members. Jason Followell spoke about transparency and the Open Meetings Act. Kelly' Vollmering thanked the council for attending the Housing Authority Board Meeting and spoke about personal issues concerning treatment of a family member by the Executive Director and commended Stacy Durham for her actions and the role she has played in serving on the Housing Authority Board. Andy Davilla spoke about his concerns and involvement at the Housing Authority. Bill Averbach congratulated the new council members and complained about the road in the area of W. Gile on a stretch between Commercial and SH 35 that needs repair. Bart Brasselton, developer for Aransas Oaks, congratulated the newly elected council members and commended his work relationships with Mark McLiney and staff at the City ofA Aransas Pass. 9. Monthly Departmental Reports submitted and provided in the Agenda Packet. City Manager Mary Juarez stated that the monthly reports were in their packets. 10. Consent Agenda a. Consideration of approving the April 21, 2025 Regular Meeting Minutes (City Secretary) b. Consideration of approving the May 5, 2025 Regular Meeting Minutes (City Secretary) Council Member Camarillo-Smith made a motion to approve Items 4.a & 4.b., seconded by Council Member Martin and the motion passed with the following vote Camarillo-Smith, Martin, and Haskins voted Aye. (City Manager) City Manager Juarez presented this item and reviewed two proposed amendments; number 5.d. Rules of Procedure and number6 6. Council Travel in the policy with the Council. Council Member Camarillo-Smith made a motion to approve Item 11.a., seconded by Council Member Haskins and the motion passed with the following vote: Camarillo-Smith, Martin, and Haskins voted Aye. b. Consideration of appointing a council member to serve on the committee to review Request for Qualifications. (City Manager) City Manager Juarez presented this item and reviewed with Council the duties assigned to the appointment. Council Member Camarilo-Smith made a motion to appoint Council Member Haskins for Item 11.b., seconded by Council Member Martin and the motion passed with the following vote Camarillo-Smith, Martin, and Haskins voted Aye. C. Consideration of approving a Request for Proposals for Hotmix for the Wilson Paving Project. (City Manager) Public Works Director David Flores presented this item requesting to go out and advertise for bid proposals for Hotmix that the City will be paving in-house on the Wilson Paving Project which is the area on Wilson Ave. from the railroad tracks to Huff St. Council Member Camarillo-Smith made a motion to approve Item 11.c., seconded by Council Member Haskins and the motion passed with the following vote: Camarillo-Smith, Martin, and Haskins voted Aye. d. Consideration of approving an Ordinance amending the City Code of Ordinances, Chapter 24 - Platting and Subdivisions, Section 24-7, Standards Manual, by amending the Introduction, Planning Sections and Fees; repealing conflicting ordinances, providing for severance, notice, and penalty, and declaring an effective date. (City Manager) Planning Director Brenda Joyas presented this item and reviewed the Pro Rata Ordinance which allows for partial reimbursement from the City for infrastructure paid out by the developer seven years after the project has been completed and making amendments to the Standards Manual. Council Member Haskins made a motion to approve Item 11.d., seconded by Council Member Martin and the motion passed with the following vote: Camarillo-Smith, Martin, and Haskins voted Aye. e. Consideration of approving a request from Aransas Pass Independent School District (APISD) Education Foundation for the temporary closure of Bigelow (one-way), for the 1st Annual 5K Harbor Run on October 11, 2025, beginning at 8:00 am. (City Manager) City Manager Juarez presented this item. APISD Board President Elizabeth Welborn was in attendance to answer any questions. Council Member Camarillo-Smith made a motion to approve Item 11.e., seconded by Council Member Haskins and the motion passed with the following vote: Camarillo-Smith, Regular City Council Meeting Minutes - May 19, 2025 Page 4 of 5 Martin, and Haskins voted. Aye. f. Consideration of approving an agreement with TXDOT to participate in the Click it or Ticket mobilization initiative. (City Manager) Police Chief David Perkins presented this tem and explained the program is designed to focus on seatbelt violations to help save lives which will occur if approved on May 20, 2025 June 1, 2025 from 6:00 am = 6:00 pm and 6:00 pm - 6:00 am. He also stated that the department pushed the information out to social media to educate the public on May 16, 2025 = May 18, 2025. There was further discussion from Council. Council Member Camarillo-Smith made a motion to approve Item 11.f., seconded by Council Member Martin and the motion passed with the following vote: Camarillo-Smith, Martin, and Haskins voted. Aye. 9. Executive Session The meeting was recessed into Executive Session at 7:23 p.m., under the provision of Section 551, Texas Government Code to discuss the authority of: a. Texas Government Code Section 551.087 Deliberation Regarding Economic Development Negotiations Relating To: i. Aransas Oaks Subdivision ii. JWD Eclipse Investments, LP 10. Action on Executive Session Items Council will reconvene in open session and may take action on any item listed in the Executive Session section of this Agenda. The council reconvened the meeting at 9:20 p.m. No action taken. 11.
