CITIZEN'S INPUT None May 5, 2025 OLD BUSINESS RZ-01-2025 Bock Rezoning Mr. Andrykovitch asked the gallery if anyone from the Bock Rezoning was at tonight's meeting. No applicant was in the gallery. This is the reason this was tabled at the last meeting. Mr. Kerber asked if the applicant was aware he needed to be at this meeting. Mr. Andrykovitch stated it was sent out in an email, and he responded to the email. Mr. Kerber stated he would make a motion to table this again, with no one being represented. Mr. Cross stated before we second that he has a concern about the time limit. Mr. Andrykovitch stated the 90 day time limit will expire after the voting meeting for the Commissioners. Mr. Kerber stated he would change his motion due to the time limit. Mr. Cross stated his thoughts are to decide tonight . He is not a big fan of spot rezoning to begin with and then to put a dog kennel in the middle of a residential area. There are noise issues to be problematic. He would make a motion to deny this. Mr. Kerber made a motion to second this. Mr. Robert Deglau stood up in the gallery to speak on this. He offered to contact Mr. Bock, SO he could save his money and may not have fully understood this process. He does not represent them but offered to contact them SO the applicant would not be throwing away $750.00. Mr. Cross thanked Mr. Deglau for offering to reach out but stated we still need to do something tonight on this. Mr. Andrykovitch stated this was already tabled once and the special meeting has already taken place. The 90 days would run out before the Commissioner would vote. Mr. Flynn stated if they table the rezoning and the 90 days runs out, it is an automatic denial. As long as this does not get approve if the 90 days runs out, it does not matter if its tabled again. 2 May 5, 2025 Ms. Stump stated that the Planning Commission is only a recommending body. Mr. McHugh asked if they could put denial due to not showing, and if he shows up to the Commissioner's Meeting, would that work? Mr. Chapman stated it would put the Commissioners in a bad position if the Planning Commission does not give them an opinion. Mr. Andrykovitch stated the special meeting did take place. Mr. Bock was able to present his case. It was just kicked back to the Planning Commission because the Commissioners needed a recommendation from the Planning Commission. The Commissioners still have the work session to speak on this before they go to a vote. Mr. Cross stated it was truly kind of Mr. Deglau to offer to reach out, and he would not want to base a denial on them not being here. This may give them the false impression that if they were here, it would be approved. After looking at this, and where it is located in the residential area, he is still not a fan ofi it. His recommendation, even if they were sitting here tonight, would still be a no. He is not saying this to sway anyone's opinion, but it would still be a no, for him, had they shown up. There are two separate pieces of property that are not attached to the commercial property on Route 30. This is in the middle of a residential area and to put a dog kennel that is a constant noise issue. Mr. Andrykovitch stated this parcel is actually attached to commercial, SO it would not be spot zoning. It does touch commercial that runs along Route 30. Ms. Stump commented that he is surrounded on two sides by residential. Mr. Flynn asked if there was a big wall behind the commercial property. Mr. Kerber asked if the applicant reached out to talk to Mr. Andrykovitch on this submission. Mr. Andrykovitch stated he has not spoken to him about being here tonight. He did go to the public hearing and state his case. There was no vote after the public hearing. Mr. Flynn asked if there was any public that spoke against this. Mr. Andrykovitch stated there was some public opposition. Mr. Flynn stated that with no access to Route 30, this lot is land locked. If there was access to Route 30, this may be different. Mr. Andrykovitch stated there is a driveway access from Clifton Drive. 3 May 5, 2025 Tony Naret, 200 Christine Drive, stated he was at the special meeting. If someone proposes a rezoning and ignores both (Planning Commission) meetings, that he was supposed to attend, that is the type of person with which we are dealing. He is busy but made time in his schedule to be here. The forty dogs, as Mr. Bock stated at the special meeting, would be housed at the kennel, which is in Mr. Naret's backyard. This would be a constant barking, which would get other dogs in the area and neighborhood to start barking. He has beautiful woods in his backyard and enjoys the peacetulness of sitting on his deck. Traffic down Clifton Drive, which is the only way in, will increase the traffic and speeding of vehicles. If he goes to sell his property, the resale of having a commercial property in his backyard will create havoc in the price for his house. If the dog kennel business does not work out and this property is sold, this parcel of land can be anything commercial. The odor, especially during the summer, will be almost as bad as the barking dogs. If this was in your back yard, would you want to constantly hear barking dogs. The trees beyond this property will not eliminate the sound of dogs barking. Mr. Cross stated this gentleman (Mr. Naret) just made his case but did it better than he did. Mr. Flynn stated he just believes if you cannot access this from Route 30, even though it connects to commercial property, it also has R-1 next to it. With the grade change, you cannot buy it and add it to the existing. There is a big wall in the back of this property. The hill subsided behind Pizza Marsala's lot that is just down from this location. Mr. Andrykovitch stated he is unsure of a wall but there is a steep drop off. There is a driveway off of Clifton Drive. The applicant owns a lot next to this and has a driveway that comes off Clifton Drive through this parcel and accesses another property. Ms. Stump stated she agrees with Mr. Cross and Mr. Flynn but reminded everyone since there is a motion and a second, if you are voting no, your vote is aye. Mr. Chapman stated there is a motion to deny with a second, SO they voted. Motion: Mr. Cross Motioned to Deny Second: Mr. Kerber Motion Carried: 7 a 0 a 0 4 May 5, 2025 NEW BUSINESS: S-09-2025 Sumpman Subdivision This is a boundary line revision between tWO adjacent lots located on Guffey Rillton Road. Joseph and Paula Sumpman of 11400 Guffey Rillton Road own Lot 1 (0.71 Acres) of the previously recorded Stratton Plan. Martin and Mary Ann Sumpman of 11424 Guffey Rillton Road own the proposed Lot 2 (0.51 Acres). The reason for the boundary line revision is to move the detached garage from Lot 11 to Lot 2. After the boundary line revision, both lots would still meet the minimum dimensional requirements in an R-3 zoning district. This application was complete, SO we can recommend approval with no conditions.
