Pastor Kristie Firme, Christ United Methodist Church, gave the invocation. Mayor Foos led the Pledge of Allegiance. The City Council of the City of Sterling, Colorado, met in regular session in Council Chambers of City Hall on Tuesday, January 14, 2025. Councimember Haynes seconded the motion. By a seven-yes vote, the motion was approved Items on the consent agenda were: approval of agenda, City Council minutes of December 10, 2024, Special City Council minutes of December 23, 2024, application for renewal of Lodging & Entertainment Liquor License for Ice Lanes located at 208 North 10th Avenue, application for renewal of Hotel & Restaurant Liquor License for Fiesta Mexican Restaurant located at 807 Sidney Avenue and an application for renewal of Tavern Liquor License for Mi Ranchito Mexican Restaurant located at 203 Broadway Street. COMMUNICATION AND PERSONAL APPEARANCE OF NON-SCHEDULED CITIZENS BEFORE THE COUNCIL: Ms. Jordon Jensen was present. Ms. Jensen is a business owner and has strong concerns regarding transient problems in the area of 214 North 3rd Street. Mr. Collin Mudd had questions regarding the marijuana map. He advised the City needs to have more transparency, and the map needs to match the regulations. There are concerns of allowing stores in the downtown areas. Mr. Mudd feels a definition is needed for what a residential area is. Ms. Sheri LaPore advised Council she is backing up Ms. Jensen on the transient people in that area. Mr. Louie Delgado was there regarding concerns about a property cleanup issue. City Attorney Richardson advised he will check into this. UNFINISHED BUSINESS: SECOND READING AND PUBLIC HEARING - ORDINANCE NO. 10, SERIES OF 2024 = AN ORDINANCE AMENDING THE STERLING CITY CODE, CHAPTER 19, TAXATION AND FINANCE, BY THE ADDITION OF ARTICLE VII, MARIJUANA TAX: City Manager Blankenship advised Council this Ordinance amends Chapter 19, Taxation and Finance, of the City Code by the addition of an Article VIII, Marijuana Tax, which implements the Marijuana Tax that was approved in the November 5, 2024 election. The net revenues derived or received by the city from the imposition of the marijuana tax shall be deposited in the general undesignated fund. City Clerk Forbes read the Ordinance by title. Mayor Foos opened the public hearing. There were no comments. Mayor Foos closed the public hearing. Councilmember Haynes made a motion to approve Ordinance No. 10, Series of 2024. Councimember Raffaeli seconded the motion. By a seven-yes vote, the motion was approved. SECOND READING AND PUBLIC HEARING = ORDINANCE NO. 11 SERIES OF 2024 - AN ORDINANCE AMENDING THE STERLING CITY CODE, APPENDIX. A, ZONING, CHAPTERI, USE REGULATIONS SEC. 402, SCHEDULE OF PERMITTED USES, TO ADD A CATEGORY FOR MARIJUANA SALES-MEDICAL AND MARIJUANA SALES-RETAIL, AS A USE BY RIGHT IN THE COMMUNITY BUSINESS (CB) DISTRICT ZONING CLASSIFICATION. THE CENTRAL BUSINESS DISTRICT (CBD) DISTRICT ZONING CLASSIFICATION, THE LIGHT INDUSTRIAL (LI) DISTRICT ZONING CLASSIFICATION, AND THE HEAVY INDUSTRIAL (HI) CITY OF STERLING - CITY COUNCIL MINUTES - JANUARY 14, 2025 - PAGE 3 DISTRICT ZONING CLASSIFICATION: AND AMENDING CHAPTER VII, SPECIAL REGULATIONS, SECTION 713, TO ADD MARIJUANA SALES: City Manager Blankenship advised Council this Ordinance amends City Code Zoning to add a category for Marijuana Sales-Medical and Marijuana Sales-Retail in Sec. 402, Schedule of permitted uses, and to amend Section 713 to add Marijuana Sales special regulations. City Clerk Forbes read the Ordinance by title. Mayor Foos opened the public hearing. Mr. Collin Mudd was concerned regarding the map being more restrictive than the Ordinance. He had concerns regarding the residential area. Mr. Mudd advised he filled out the zoning portion of the application and has not heard back. Mayor Foos closed the public hearing. Councilmember Haynes had questions regarding public zoning. Councilmember Wolf made a motion to approve Ordinance No. 11, Series of 2024. Councilmember Haynie seconded the motion. By a seven-yes vote, the motion was approved. CITY MANAGER REPORT: City Manager Blankenship advised Council he will review the 2025 projects at another meeting. He updated Council about the DOLA grant. He advised this was presented to Council in November and they gave their consent to move forward at that time. Salary Survey Study being conducted in 2025. Chamber of Commerce Banquet - He asked Council to let him know by Friday, January 17, 2025, if they are attending. He attended a meeting with Logan County regarding EMS. They discussed the functionality. They are focusing on short-term. The IGA with the County expires in May. City Manager Blankenship gave his resignation as of March 2025. His last Council meeting will be March 11, 2025. NEW BUSINESS: MAYOR'S RECOMMENDATION OF APPOINTMENTS TO THE PLANNING COMMISSION: Mayor Foos made a motion to re-appoint Kristi Knowles and Peter Moulton to the Planning Commission. Councilmember Janes seconded the motion. By a seven-yes vote, the motion was approved. MISCELLANEOUS COUNCIL BUSINESS: MISCELLANEOUS MATTERS: Mayor Foos asked Council about appointing Mr. Donald Saling as interim City Manager since City Manager Blankenship will be leaving. The timeframe for hiring a new City Manager was discussed. Councilmember Haynes brought up the question that was previously asked about the shipping containers, Council would like more discussion on this. Mayor Foos asked Council of their opinion of residential. The wording should be residential zone instead of residential area or changing the definition to match the ballot. Capping the number of dispensaries for three years. It would be good to have a special meeting for these topics, which would be the Consultant for the hiring of a City Manager, the shipping containers, residential area and the dispensaries. SECTION 24-6-402(4)e) FOR THE DISCUSSION OF MATTERS WHICH MAY BE SUBJECT TO NEGOTIATIONS: DISCUSSION OF POSSIBLE LEASE AND SALE OF CITY OWNED REAL ESTATE: Mayor Foos made a motion to go into executive session pursuant to C.R.S. Section 24-6- 402(4)(e) for the discussion of matters which may be subject to negotiations: Discussion of possible lease and sale of City owned real estate. Councilmember Janes seconded the motion. By a seven-yes vote, the motion was approved.
