Municipal Building = 4000 Main Present: Mayor Pro Tem Winget, Councilmember Reaves, Councilmember Bowers, Councilmember Britton and Councilmember Schupp Absent: Deputy Mayor Pro Tem Shinder INVOCATION The invocation was led by Councilmember Britton PLEDGES OF ALLEGIANCE The Pledges of Allegiance were led by the City Council. 1. CALL TO ORDER Mayor Pro Tem Winget called the meeting to order at 7:01 p.m, 2. EXECUTIVE SESSION 2A. The City Council shall convene into Executive Session pursuant to the Texas Government Code, $551.071 (Consultation with Attorney) to seek legal advice regarding housing finance corporations located outside of Rowlett and purchasing and attempting to provide tax exempt status to properties located within Rowlett, including discussion of possible legal action. This item was moved after 6G. Mayor Pro Tem Winget adjourned the meeting into Executive Session at 8:36 pm. 3. RECONVENE INTO OPEN SESSION AND TAKE ANY NECESSARY OR APPROPRIATE ACTION ON CLOSED/EXEXECUTIVE SESSION MATTERS Mayor Pro Tem Winget reconvened the meeting at 9:08 pm. A motion was made by Councilmember Britton, seconded by Councilmember Schupp, to authorize the City Manager to execute an agreement on the terms discussed in executive session to engage the law firm of Daivd Iglesias to provide legal services to the City, including filing of legal actions, relative to extra-territorial housing finance corporations seeking tax exemptions for properties located within the City of Rowlett. Motion passed 5-0. City of Rowlett 10833 4. PRESENTATIONS 4A. Presentation of Rowlett Veterans Recognition Program certificate to Veteran Majorie Hefner. Mayor Pro Tem Winget, Councilmember Reaves, and Councilmember Britton, along with Chris Kizziar of Veterans Resource & Outreach Center of Rowlett, and Lorie Coates of Quilts of Valor, presented Veteran Majorie Hefner with a certificate from the City Council and a quilt. She also received a certificate from Texas State Senator, Bob Hall, as well as a Texas flag that was flown over the state capitol. 4B. Presentation of Rowlett Centurion Recognition and Proclamation for Mrs. Majorie Hefner. Councilmember Britton presented the Proclamation for Mrs. Majorie Hefner. 4C. Presentation of Proclamation recognizing the week of May 4-10, 2025, as Detention Officer Week. Councimember Reaves presented the Proclamation recognizing the week of May 4-10, 2025, as Detention Officer Week. 4D. PresĂȘntation of Proclamation recognizing May 15, 2025, as Peace Officers Memorial Day and the week of May 11-17, 2025, as National Police Week. Councilmember Schupp presented the Proclamation recognizing May 15, 2025, as Peace Officers Memorial Day and the week of May 11-17, 2025, as National Police Week. 4E, Presentation of Proclamation recognizing May 11-17, 2025, as Economic Development Week. Councimember Bowers presented the Proclamation recognizing May 11-17, 2025, as Economic Development Week. 4F. Presentation of Proclamation recognizing the month of May 2025, as National Nurses Month. Mayor Pro Tem Winget presented the Proclamation recognizing the month of May 2025, as National Nurses Month. 4G. Presentation of Winners of the Arts and Humanities Commission's Annual Writing Contest. Laura Tschoerner, Library Services Director, and Mayor Pro Tem Winget presented the Winners of the Arts and Humanities Commission's Annua! Writing Contest. 4H. Presentation of the Comprehensive Monthly Financial Report (CMFR) for the period ending March 31, 2025. Wendy Badgett, Director of Financial Services, presented the Comprehensive Monthly Financial Report (CMFR) for the period ending March 31, 2025. 41. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. City of Rowlett 10834 Councimember Bowers provided the following announcements: CITY SECRETARY'S OFFICE - City Council will canvass the May 3rd Election results May 12th at 5:30 pm. The incoming Mayor and Councilmembers will be taking their Oath of Office at this meeting. We will have a Runoff Election for Councimember Place 6 to be held on Saturday, June 7, 2025. Early Voting will be held Tuesday, May 27, 2025, through Tuesday June 3, 2025. ECONOMIC & COMMUNITY ENGAGEMENT - Live on Main - Music & Market is happening this Friday night on the Downtown Green in Downtown Rowlett from 6:00-9:00pm! POLICE - Rowlett Police Officers will be attending the Rockwall County Police Memorial at Resthaven Funeral Home in Rockwall on May 15th 9:30 AM to 11:30 AM. Officers will give as speech and demonstrate police equipment for career day at Coyle Middle School on May 7th 9:30 AM to 10:30 AM. Councilmember Reaves introduced the Featured Pet, Pluto, this sweet boyi is eager to fill that empty spot in your family. To meet Pluto or one of his companions, please contact Animal Services at City of Rowlett 10835 972-412-6219 or come by the Shelter at 4402 Industrial St. from 10 am to 5 pm, Tuesday through Saturday. The animal shelter is currently at code red. This means that the kennels are full. All adoptions are $25 and include spay/neuter, microchip, and up-to-date vaccinations. Councilmember Bowers added that the Friends of the Rowlett Library just celebrated their 75th Anniversary. 5. CITIZENS INPUT No Online Input Forms were received. 1. Pat Karacostas, Rowlett = Spoke regarding the Republic Contract. She recognized the hard work by staff and Republic, as well as City Council. However, this is not a fix for her. She asked to reduce the extra bulk pick up fee. She feels that this is the only item left to discuss. 2. Susan Urrutia, Rowlett - Spoke on behalf of DEI and LGBTQ families in Rowlett. Spoke against different phobias. 3. Denise Eljoohi, Rowlett = Spoke regarding 6602 Warwick Drive accessory building. She read a letter from the building official. 4. Hasan Eljoohi, Rowlett - Spoke regarding 6602 Warwick Drive accessory building. Due to the accessory building in the neighbor's yard, it is causing flooding in his backyard. There were no permits issued for the accessory building. He has been trying to get this corrected since 2021. 6. CONSENT AGENDA 6F and 6G were removed from the Consent Agenda to be considered individually. 6A. Consider action approving the minutes. Consider action to approve minutes from the following City Council meeting(s): April 8, 2025, City Council Work Session, April 14, 2025, City Council Work Session, and April 15, 2025, City Council Meeting. 6B. Consider action of receiving the investment report. Consider action to receive the second quarter Investment Report for March 31, 2025. 6C. Consider action approving purchase of two BMW police motorcycles. Consider action to approve a resolution authorizing the purchase of two new 2024 BMW R 1250 RT-P police motorcycles with five-year warranties from BMW Motorcycles of North Dallas, through a City of Fort Worth cooperative contract, for a total price not to exceed $84,156.84; authorizing the City Manager or his designee to execute all necessary documents to effectuate said purchase; and providing an effective date. This item was approved on the Consent Agenda as RES-058-25. City of Rowlett 10836 6D. Consider action approving purchase of three Chevrolet Silverado police pursuit patrol vehicles. Consider action to approve a resolution authorizing the purchase of three Chevrolet Silverado police pursuit patol vehicles and the installation of emergency equipment in said patrol vehicles from Lake Country Chevrolet, through a TIPS cooperative purchasing contract, in the amount of $240,250.74; the purchase of Motorola radios from Motorola Solutions, Inc., through an HGAC cooperative contract, in the amount of $20,421.90 ($6,807.30 each); the purchase of Dell computers from GTS Technology Solutions, through a DIR cooperative contract, in the amount of $11,183.76, for a total price not to exceed $271,856.40; authorizing the City Manager or his designee to execute all necessary documents to effectuate said purchase; and providing an effective date. This item was approved on the Consent Agenda as RES-059-25. 6E. Consider actiona approving purchase of four Durango police pursuit patrol vehicles. Consider action to approve a resolution authorizing the purchase of four Dodge Durango police pursuit patrol vehicles from Grapevine DCJ, LLC, through a BuyBoard cooperative contract, in the amount of $163,892.00; the purchase and installation of emergency equipment in said patrol vehicles from MAL Technologies Fleet, through a BuyBoard cooperative contract, in the amount of $110,762.20; the purchase of Motorola radios from Motorola Solutions, Inc., through an HGAC cooperative contract, in the amount of $27,229.20 ($6,807.30 each); the purchase of Dell computers from GTS Technology Solutions, through a DIR cooperative contract, in the amount of $14,911.68 through a DIR cooperative contract, for a total price not to exceed $316,795.08; authorizing the Cily Manager or his designee to execute all necessary documents to effectuate said purchase; and providing an effective date. This item was approved on the Consent Agenda as RES-060-25. 6F. Consider action approving purchase of playground flooring and equipment for Kids Kingdom. Consider action to approve a resolution authorizing the purchase of playground flooring and equipment for Kids Kingdom, from Play By Design, Inc., through a SourceWell Cooperative Contract, for a price not to exceed $1,471,751.10 and 5% contingency for a total authorization of up to $1,545,338.66; authorizing the City Manager or his designee to execute all necessary documents to effectuate said purchase; and providing an effective date. Kristoff Bauer, Deputy City Manager, presented this item. The city will refurbish the existing facilities and add new features. Will add turf in the entry area of Kids Kingdom. The costs were reviewed and discussed. The final authorization should be for $1,598,653.46 and not $1,545,338.66 as stated on the agenda. it is correct on the staff report. For Phase I Kids Kingdom will be closed for 3 to 4 days in early June to refurbish the main structure. For Phase 2, Kids Kingdom will be closed for 4 to 6 weeks in July/August for surfaces and installation of new elements. City of Rowlett 10837 A motion was made by Councilmember Schupp, seconded by Councilmember Reaves, to approve the resolution as presented with the correct amount in the staff report. Motion passed 5-0. This item was approved as RES-061-25. 6G. Consider action approving Right-of-Way Easement Encroachment and Hold Harmless Agreement. Consider approval of a Resolution Authorizing the City Manager to Execute a Right-Of-Way Easement Encroachment and Hold Harmless Agreement with 6917 Residence, LLC (David Holly relating to the commercial property located at 6917 Miller Road. This item was pulled from the agenda to be brought back at a later date. A motion was made by Councilmember Britton, seconded by Councilmember Schupp, to include all the preceding items marked as having been approved on the Consent Agenda. The motion passed 5-0. 7. INDIVIDUAL CONSIDERATION 7A. Consider approval of a resolution objecting to housing finance corporations engaging in development outside the boundaries of their sponsoring local governments; urging a responsive opinion by the Texas Attorney General to Request for Opinion RQ-0587-KP; supporting HB 1585; directing the City Secretary to transmit a certified copy of this resolution to the Attorney General and the State House and Senate representatives for the City of Rowlett; and providing an effective date. Councimember Bowers encouraged citizens to reach out to Senator Bob Hall that we support this bill. A motion was made by Councilmember Reaves, seconded by Councilmember Schupp, to approve a resolution objecting to housing finance corporations engaging in development outside the boundaries of their sponsoring local governments; urging a responsive opinion by the Texas Attorney General to Request for Opinion RQ-0587-KP; supporting HB 1585; directing the City Secretary to transmit a certified copy of this resolution to the Attorney General and the State House and Senate representatives for the City of Rowlett; and providing an effective date. Motion passed 5-0. This item was approved as RES-062-25. 7B. Consider approval of a resolution authorizing the City Manager to execute the First Amendment to the Solid Waste Collection and Disposal Contract with Republic Services. Kristoff Bauer, Deputy City Manager, presented this item. He reviewed the previous discussion at the April 18, 2025, meeting. He reviewed option 4, which is weekly bulk pickup of 2 cubic yards on the same day as recycling and trash. Councilmember Bowers stated she is concerned about additional trips causing damage to the streets and alleys. David Hall, City Manager, stated that the City of Rowlett 10838 city use to have weekly bulk pickup, SO not much more damage than previously had. Mayor Pro Tem Winget asked if bulk can do something like to get an additional cart for trash. Rick Bernas, with Republic, stated that no, there are too many homes to determine who has extra bulk pick up and who does not. A motion was made by Councilmember Reaves, seconded by Councilmember Britton, to approve a resolution authorizing the City Manager to execute the First Amendment to the Solid Waste Collection and Disposal Contract with Republic Services. Motion passed 4-1, with Councilmember Bowers voting against. This item was approved as RES-063-25. 8. MEMBERS OF THE CITY COUNCIL MAY REQUEST TOPICS TO BE PLACED ON AN AGENDA FOR A SUBSEQUENT MEETING. ANY DELIBERATION OR DECISION SHALL BE LIMITED TO A PROPOSAL TO PLACE TOPIC ON THE AGENDA FOR A SUBSEQUENT MEETING. Councilmember Bowers requested an update on the CIP in the near future. Councilmember Reaves seconded the request. 9.
