ORDINANCE NO. 1177-R AN ORDINANCE OF THE CITY COMMISSION OF LYNN HAVEN, FLORIDA, AMENDING THE UNIFIED LAND DEVELOPMENT CODE TO MODIFY THE PARKING STANDARDS FOR RECREATIONAL VEHICLES ON RESIDENTIAL PROPERTY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City desires to amend the Unified Land Development Code from time to time, including requirements for recreational vehicles and boats, for consistency with comprehensive plan updates and updates to other city policies and objectives; and WHEREAS, the Planning Commission, in its capacity as the Local Planning Agency, considered the amendment, found Ordinance 1179 consistent with the comprehensive plan, and recommended approval at a publicly noticed hearing dated April 1, 2025; and WHEREAS, the City Commission considered the amendment at a publicly noticed hearing dated 2025. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LYNN HAY VEN, FLORIDA: SECTION 1. The Unified Land Development Code shall be amended as follows: GtPkethrougn-text is deleted; underlined text is added): 6.05.15 - Specific Parking Requirements for Recreational Vehicles It shall be unlawful for any person to park or store any recreational vehicle which is commonly used for living or sleeping purposes, whether it is used or not, upon any lot, piece or parcel of land in the City, except in regularly licensed parks, unless such recreational vehicle is; (a) kept entirely within a backyard, sideyard, or the driveway of the owner's residence, but not in any portion of any public right-of- way; and and not used for living or sleeping purposesi and (c) maintained in an operable condition: and (d) properly licensed in accordance with all laws of the state. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. If any phrase, clause, sentence, paragraph, section, or subsection of this Ordinance shall be declared unconstitutional or invalid by a court of competent jurisdiction, Page 1 of2 such unconstitutionality or invalidity shall not affect the remaining phrases, clauses, sentences, paragraphs, sections or subsections of this Ordinance. SECTION 3. It is the intention of the Commission that the provisions of this Ordinance shall become a part of the Unified Land Development Code of the City. The provisions of this Ordinance may be renumbered or re-lettered with cross-references corrected and the word 'ordinance" may be changed to section,' "article", "division" or other appropriate word to accomplish such intention. SECTION 4. Effective Date. This Ordinance shall take effect immediately upon its passage.
