APPROVAL OF AMENDED AGENDA: Mayor Cawley mentioned the Agenda was amended to add items 9c-Resolution 2025-049 and 9d-Ordinnace 2025-026. Commissioner Thacker made a motion to approve the Amended Agenda and it was passed unanimously. CONSENT AGENDA: On motion by Commissioner Vaughn and passed unanimously, the following items were approved by way of Consent Agenda: APPROVAL OF FEBRUARY 18. 2025 STRATEGIC PLANNING MEETING MINUTES: (end of consent agenda) PRESENTATIONS: a) Franklin Street Streetscape Project Update: Darren Lewis gave an update on the Franklin Street Streetscape Project. They have run into some granite when replacing the water and sewer lines on Franklin Street. The water portion is almost completed other than some connections with the sewer for Franklin Street. Also, from Main to Willow, it should be completed by April 17, 2025. The lower section of Franklin Street is anticipated to be easier than what has been dealt with at this point. The next step is the conduit for the buried power lines on Franklin Street (from Main Street to Willow Street). Duke Energy is performing upgrades on Oak Street, which is not specific to the Streetscape Project or Westside Water/Sewer Project. The contractors are working daily along with the City Public Works Department supervising to keep this project on schedule. PUBLIC FORUM: Mayor Cawley deelared the Publie Forum open for comments. Carol Burke, 121 W Poplar Street (city resident): Invited the Board to the Rotary Club Meeting on April 8, 2025. The Rotary Club will be hosting a program on "The Past, Present, and Future of Historic Main Street" presented by Gene Rees. Butch Martin (city resident): Moved to Mount Airy in October 2024. Expresses a need for additional Pickleball courts. The courts being considered to be placed on Carter Street will be separate from the existing courts at Riverside Park, which could cause problems if there are tournaments. Distributed some options for additional courts for the Board to review. John Pritchard, 128 Ridgecrest Drive (city resident): Spoke about the Board not lowering the tax rate since the City would be receiving additional funding from the taxpayers because of the revaluation. The voters feel betrayed because the candidate they supported isn't going 1 in the direction they thought. Feels the City needs to cut expenses. Surry County is a Tier 1 County, which is at the bottom of the three tiers. The Economic Development Commission says that it is measured on average income, taxes, and population growth with Surry County doing poorly in all three. Also, the EDC has said in the past that Surry County's average income couldn't buy the average home and says the answer is better jobs and population growth to get out of' Tier 1. It is nice to say it is good to live somewhere where people want to visit, but there is another saying that it is nice place to visit but wouldn't want to live there. Seeing no other speakers, Mayor Cawley deelared the Public Forum closed. NEW BUSINESS a) Kesolution 2025-047-Resolution Approving Interlocal Agreement for 911 Fund Distributions: On motion by Commissioner Hutchens and passed unanimously, Resolution 2025-047 was approved. RESOLUTION NUMBER 2025-047 RESOLUTION APPROVING INTERLOCAL AGREEMENT BETWEEN THE CITY OF MOUNT AIRY AND COUNTY OF SURRY-DISTRIBUTION OF 911 FUNDS WHEREAS, a monthly 911 service charge is imposed on each active voice communications service connection that is capable of accessing the 911 system with the charge being payable by the subscriber to the provider and remitted to the State's 911 Board; and WHEREAS, Surry County is a designated primary Public Safety Answering Point (PSAP) and under current legislation, the State's 911 Board must make monthly distributions to primary PSAPs from the amount allocated to the 911 Fund for PSAPs; and WHEREAS, in order for the City of Mount Airy (a secondary PSAP) to receive 911 funds, it is necessary for the City to enter into an interlocal agreement with the County in which the County will receive 911 surcharge funding and return a portion to the City on the condition the City agrees to hold the County harmless in the events the funds are not used by the City in a manner consistent with the law; and WHEREAS, it is staff recommendation to approve an interlocal agreement with the County for said 911 service charge funds: NOW, THEREFORE BE IT RESOLVED BY THE CITY OF MOUNT AIRY BOARD OF COMMISSIONERS MEETING IN OPEN SESSION THAT: Section 1. The Board of Commissioners does hereby approve the Interlocal Agreement between the City of Mount Airy and the County of Surry for the distribution of911 funds. 2 Section 2. The Board of Commissioners does hereby authorize the City Manager to execute said Interlocal Agreement per review and approval by the City Attorney. Section 3. This resolution shall become effective upon approval. Approved and adopted this the 3rd say of April, 2025. b) Resolution 2025-048- Resolution Authorizing Staff to Make Application for PARTF Grant: Peter Raymer, Director of Parks and Recreation is requesting permission and support to make application for a Parks and Recreation Trust Fund Grant for the development of a community park on the city-owned property located on Carter Street. Projected cost would be approximately $1 million with the grant being $500,000 and requires a dollar for dollar match. The City has already secured State funds for Greenway development that will serve as the match for this grant. The proposed community park will be based off of the most recent Parks and Recreation Master Plan and the feedback that was received. If approved, staff will have public input meetings to get feedback from the community. On motion by Commissioner Cochran and passed unanimously, Resolution 2025-048 was approved. RESOLUTION NUMBER 2025-048 RESOLUTION AUTHORIZING STAFF TO MAKE APPLICATION FOR PARTF GRANT (Carter Street Community Park Development) WHEREAS, City staff is requesting permission and support to make application for a Parks and Recreation Trust Fund Grant in the amount of up to $500,000 to develop a community park on the city-owned property located on Carter Street (PIN 5929-12-77-8052); and WHEREAS, the local match (dollar for dollar) will come from existing river restoration and greenway grant funds; and WHEREAS, should the grant funds be awarded, they will help address community needs including additional soccer fields, pickleball courts, a basketball court, and an accessible playground; and WHEREAS, it is staff recommendation to authorize the application of said PARTF grant: NOW, THEREFORE BE IT RESOLVED BY THE CITY OF MOUNT AIRY BOARD OF COMMISSIONERS MEETING IN OPEN SESSION THAT: Section 1. Approved and adopted this the 3rd day of April, 2025. e) Resolution 2025-049-Resolation Awarding Westwood Industrial Park Site Development Projeet Contract: On motion by Commissioner Hutchens and passed unanimously, Resolution 2025-049 was approved. RESOLUTION NUMBER 2025-049 RESOLUTION AWARDING WESTWOOD INDUSTRIAL PARK SITE DEVELOPMENT PROJECT CONTRACT WHEREAS, the City of Mount Airy received a $1.5 million grant from the Golden Leaf Foundation (GLF) to be used for the development of a graded industrial site in Westwood Industrial Park; and WHEREAS, the North Carolina Foam project initiated last year requires this planned GLF site to be shifted further west, which requires Boggs Drive and the water and sewer system to be extended an additional 2,000 feet; and WHEREAS, the City received a grant from the NC Department of Commerce in the amount of $1,102,500 for the extension of Boggs Drive and the water and sewer system; and WHEREAS, in addition to these two grants, the City also allocated $400,000 to the project and if the budget revisions requested by City staff are approved by the granting agencies, it is anticipated that only approximately $62,000 of allocated City funds will be used; and WHEREAS, The City advertised for bids for this site development project and results are as follows: Contractor: Bid: Sowers Construction Company, Mount Airy, NC $2,225,592.50 Mountaineer Contractors, Kingwood, West Virginia $2,853,270.30 Triangle Grading and Paving, Burlington, NC $3,587,679.30 WHEREAS, it is staff recommendation to award the Westwood Industrial Park Site Development Project to Sowers Construction Company for the amount of $2,225,592.50 with a total budget approval of $2,336,872.13 to allow for contingencies: NOW, THEREFORE BE IT RESOLVED BY THE CITY OF MOUNT AIRY BOARD OF COMMISSIONERS MEETING IN OPEN SESSION THAT: Section 1. Asked everyone to have patience with the Franklin Street and Oak Street projects. April is National Child Abuse Prevention month. It is astounding the number of children that DSS has had to take custody of over the last couple of months. There have been several tragedies involving children-asked everyone to be aware and informed. Darren Lewis: Thanks to the staff making everything happen in this great City. The annual Spring Cleanup will be the two weeks after Easter (April 21-25 and April 28-May 2). This year, the City is partnering with Mountain Valley Hospice to pick up items that can be resold in their retail store. Hugh Campbell: The property located at Pine Street and Gilmer Street the City sold to CAS Investment will close tomorrow. Mayor Cawley: Thankful for the work that City staff does. Mentioned that almost every City Department Head is in attendance. The Department Heads lead the City in a wonderful way. Wishes that when people get their drivers license, it should be required for them to spend a couple of hours picking up trash on the side of the road to help eliminate the problem of littering. Mount Airy is a beautiful place. There is no sense in littering and no reason for it. Mayor Attested: City Clerk RESOLUTION NUMBER 2025-062 RESOLUTION SETTING PUBLIC HEARING REGARDING CITY OF MOUNT AIRY CODE OF ORDINANCES AMENDMENTS REGARDING BOARDED UP PROPERTIES WHEREAS, the City of Mount Airy proposes to amend the City of Mount Airy Code of Ordinances as follows: 4-27.1 BOARDED UP STRUCTURES PURPOSE AND AUTHORITY. (A) It is the purpose of this subchapter to promote the health, safety and welfare of the citizens of the City by establishing reasonable regulations and opportunity for boarding up structures in order to prevent their detrimental effects in the City's neighborhoods. (B) The Code Enforcement Official shall be responsible for the administration and enforcement ofthe provisions of this subchapter. The Code Enforcement Official or designee(s) shall have the following authority: (1) Toinspect the properties; (2) To obtain administrative search and inspection warrants, if necessary, as provided in G.S. S 15-27.2; and (3) Toissue notices of violation and impose civil penalties. DEFINITIONS. For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning. Board Up: The boarding up of any means of egress and ingress, including, without limitation, windows and doors to an unoccupied structure. Code Enforcement Official: The person who has been designated, in writing, by the Board of Commissioners to enforce this subchapter. Department: The Code Enforcement Department. Owner: The holder of title in fee simple. Structure: Any building, residential or non-residential structure, manufactured home (not a mobile home), or part thereof, intended to be used for human habitation and includes any appurtenances therewith. Mobile Home: any portable or moveable dwelling designed for residential use. Sometimes referred to as; house trailer, motor home, trailer, RV, Camper, coach. Unoccupied: A structure that is not occupied or that is occupied by unauthorized person for a minimum of Ninety (90) days. In the case of a multi-unit residential structure, UNOCCUPIED means when any one unit is unoccupied or occupied by unauthorized persons for a minimum of Ninety (90) days. REQUIREMENTS; TIME LIMIT. (A) An owner who registers a boarded up structure pursuant to the Registration section below must comply with the guidelines or boarding up structures established from time to time by the Department. (B) An owner's registration of a boarded up structure shall expire six months from the date ofr registration with the Department and may not be renewed. GRACE PERIOD. Any owner who has boarded up a structure prior to the effective date ofthis subchapter shall comply with the regulations contained herein within Sixty (60) days after the effective date of this subchapter. If after Sixty (60) days, if an owner has failed to register the structure, the owner shall be in violation of this subchapter. REGISTRATION. (A) No owner shall board up a structure without registering the structure with the Code Enforcement Officer no later than forty-eight (48) hours after boarding it up. (B) An application for registration must be made to the owner of the boarded up structure on a form prescribed by the Department, and submitted to the Code Enforcement Officer. The completed registration form shall contain at a minimum the following information: (1) The full true name and mailing address of the owner; (2) The full true address and tax parcel number of the structure to be boarded; (3) An accurate telephone number at which the owner may be reached; (4) Ifthe owner is a partnership or corporation, the owner shall designate one of its general partners or officers to act as its agent and provide the present residence and business addresses and telephone numbers for the agent; (5) The owner's plan for the occupancy, repair, or demolition of the structure; (6) The owner's plan for the regular maintenance during the period the structure is boarded up; and (7) Such other information as the Code Enforcement Office shall from time to time deem necessary. (C) The owner, under this section, shall have a continuing duty to promptly supplement registration information required by this section in the event that the information changes in any way from what is stated on the original registration. (D) Registration of a boarded up structure does not excuse the owner from compliance with any other applicable ordinance, regulation, or statute, including, without limitation, Article Il, Article V, and Article IX. By accepting an owner's registration, the Code Enforcement Office has not determined that the structure being registered is in compliance with any applicable local or state regulation or law. NOTICES. Any notice required or permitted to be given by the Code Enforcement Office under this subchapter to the owner may be given either by personal delivery or by first class United States Mail, postage prepaid, the most current address as specified on the registration, which has been received by the Department or to the address listed for the responsible person in the county property tax record if an owner has not registered with the Department. Notices mailed as above shall be deemed given upon their deposit in the United States Mail with proper postage prepaid and shall be deemed to have been received on the third regular postal delivery day thereafter, excluding Sundays and federal holidays. VIOLATIONS. (A) It shall be unlawful for the owner of a boarded up structure to fail to register the structure with the Department as required by the Registration Section above, except as otherwise provided in this subchapter. (B) It shall be unlawful for an owner who has registered a boarded up structure to leave the structure boarded up after the expiration of the registration as set forth in Time Limits Section above. (C) It shall be unlawful for an owner to board up a structure in a manner that does not comply with the Department's guidelines unless the owner has obtained the Code Enforcement Officer's prior written approval for an alternative method of boarding up a structure. (D) A: structure may be boarded up with the use of shutter or plywood milled to have the appearance of shutters and painted. NOT AN INFRACTION OR MISDEMEANOR. A violation of any provision of this subchapter shall constitute a civil violation only and shall not constitute an infraction or misdemeanor punishable under G.S. $14-4. NOTICE OF VIOLATION; PENALTIES. Except as otherwise provided in this subchapter, the Code Enforcement Official or designee(s) shall notify the owner of a boarded up structure of a violation of any provision of this subchapter and the owner shall have ten (10) days from the date of notice of violation to correct the violation. Any owner who fails to correct the violation within the time specified shall be subject to a civil penalty in the amount of five-hundred dollars ($500.00) for the first day of noncompliance and fifty dollars ($50.00) each day thereafter until the owner complies. The civil penalty may be recovered in the nature of a debt through a civil action filed in the appropriate North Carolina court if the owner does not pay the penalty within thirty (30) days of assessment of the civil penalty as authorized by G.S. $160A-175(c). ADJUDICATORY HEARING. (A) An owner who has been assessed a civil penalty for a violation of this subchapter may request a hearing with the City Manager or his or her Designee. The request must be made in writing, filed with the City Manager within Ten (10) business days of the notice of assessment, and state the reasons why the civil penalty should not have been assessed. Failure to request a hearing in the time and manner specified shall constitute a waiver oft the right to contest the penalty. The City Manager will notify the appellant of the date of the hearing within Five (5) business days of receipt of the appeal. The hearing will be scheduled within Ten (10) business days from the date of notification to the appellant. The City manager will notify the appellant of the decision of the hearing within Three (3) business days after the hearing. (B) The City Manager or his or her designee shall serve as the hearing officer. An owner against whom a decision of the hearing officer is made may seek judicial review of the decision by filing a written petition within thirty (30) calendar days after receipt of the notice of the decision, but not thereafter, with the Superior Court of the county. The proceeding in Superior Court shall be in the nature certiorari. PENALTY. (A) Any person who violates a provision of this subchapter for which no penalty is set out shall be subject to civil penalties as provided in G.S. 9160A-175. GENERAL. All windows and doors shall be boarded in an approved manner to prevent entry by unauthorized persons and shall be painted to correspond to the color of the existing structure. MATERIALS Boarding sheet material. Boarding sheet material shall be minimum %-inch (12.7 mm) thick wood structure panels complying with the North Carolina State Building Code and the International Building Code as adopted by North Carolina. Boarding framing material. Boarding framing material shall be minimum nominal 2-inch by 4-inch (51 mm by 102 mm) solid sawn lumber complying with the International Building Code. Boarding fasteners. Boarding fasteners shall be minimum 3/8-inch (9.5 mm) diameter carriage bolts of such a length as required to penetrate the assembly and as required to adequately attach the washers and nuts. Washers and nuts shall comply with the International Building Code. INSTALLATION AND METHOD Boarding Installation. The boarding installation shall be in accordance with Figures A and B. using materials described above and methods described below. Boarding sheet material. The boarding sheet material shall be cut to fit the door or window opening neatly or shall be cut to provide an equal overlap at the perimeter of the door or window. Windows. The window shall be opened to allow the carriage bolt to pass through or the window sash shall be removed and stored. The 2-inch by 4-inch (51 mm by 102 mm) strong back framing material shall be cut minimum 2-inches (51 mm) wider than the window opening and shall be placed on the inside of the window opening 6-inches minimum above the bottom and below the top of the window opening. The framing and boarding shall be predrilled. The assembly shall be aligned and the bolts, washers, and nuts shall be installed and secured. Doorwalls. The door opening shall be framed with minimum 2-inch by 4-inch (51 mm by 102 mm) framing material secured at the entire perimeter and vertical members at a maximum of 24-inches (610 mm) on center. Blocking shall also be secured at a maximum of 48-inches (1,219 mm) on center vertically. Boarding sheet material shall be secured with screws and nails alternating every 6- inches (152 mm) on center. Doors. Doors shall be secured by the same method as for windows or door openings. One door to the structure shall be available for authorized entry and shall be secured and locked in an approved manner. Miscellaneous Service Fees and Charges Application Fee: The fee for processing a new service application is $15.00. Connection Fee: Ai fee of $25.00 is applied for each connection of service during normal business hours (i.e. new service, transfer of service, etc.) Deposits : A deposit of $60.00 is required for residential customers who are renters in order to establish service. Upon termination of service, the deposit will be applied against outstanding balances owed on the account and any excess then refunded. Late Payment Fee: A5.00% penalty is added to the outstanding balance as of the close of business 25 days after the bill date; with a minimum fee of $25.00. (Bills are due 10 days after the bill date and are considered delinquent if not paid by the due date.) Disconnection for Outstanding Delinquent Charges: Accounts with delinquent charges outstanding as of the close of business 40 days after the original bill date will be scheduled for disconnection for nonpayment on the next business day. No separate notice of pending disconnection will be mailed (Bills are due 10 days after the bill date and are considered delinquent if not paid by the due date.) After Hours Fee: In addition to the standard connection fee or nonpayment fee, a fee of $25.00 is applied for each connection of service after normal business hours (i.e. reconnection related to delinquent payments, new service, transfer of service, etc.) Returned Item Charge: In accordance with North Carolina Law (G.S. 25-3-506) a $25.00 charge is made for each check/draft returned. Availability Fees: In accordance with (G.S. 160A-317) an availability fee is charged for properties inside the City limits that have water and/or sewer service available but have not connected to these services.
