August 1, 2017 Page 1 PABB01538 MINOTES Bloomfield Borough Council August 1, 2017 Bloomfield Borough Council met this evening in regular session in the Bloomfield Borough Council Chambers with the following Council members present: President Malinda C. Anderson, Vice President John J. Patterson V., Charles N. Summers, Michael P. Pray, Pierce L. Clouser, Jr. and Karl L. Cless. Also present: Mayor Arlis Krammes, Borough Secretary Danielle Shope, Assistant Borough Secretary Kathleen Miller, Borough Employee Damon Hartman, Perry County Times reporter Jim Ryan, BEO Harry Nazzaro, Zoning Officer and Water Authority Ed Albright, Solicitor Richard Wagner, and Borough residents Kevin & Luann Weller, Polly Eby and Gary Eby. President Anderson called the meeting to order at 7:00 p.m. MEETING OPENING Recording of the Meeting President Anderson advised the attendees that the meeting was being recorded by the Council for the accuracy ofthe minutes and stated that side conversations should be conducted in the hallway sO as to not disrupt the meeting or its recording and reminded everyone that talking when someone else is speaking also disrupts the meeting and affects the recording. President Anderson further requested that those individuals in the audience desiring to speak identify themselves prior to speaking and they have 31 minutes to present their concern. President Anderson stated that Council will: not deviate from the agenda and any questions should be addressed during the appropriate portion of the meeting. Approval of Minutes Councilman Cless made a motion, seconded by Councilman Clouser, to approve the. July 11, 2017: minutes as presented. Motion carried. Approval of McClure Street Meeting Minutes Vice President Patterson made a motion, seconded by Councilman Pray, to approve the June 29, 2017: minutes ofthe McClure Street Meeting minutes. Motion carried. Approval of Financial Report Councilman Clouser made a motion, seconded by Vice President Patterson, to approve the financial report for July, 2017 as presented. Motion carried. Oath of Office - Mayor Arlis Krammes administered the Oath ofOffice to new Council member Kevin C. Weller. Councilman Weller replaced Councilwoman Michelle L. Jones who resigned in July. Resolution No. 2017-06- - A resolution to fill a vaçancy in the elected Office ofBorough Council. Councilman Weller will need to make his name known to the voter registration people for the upcoming election. Councilman Clouser made the motion, seconded by Councilman Cless, to approve Resolution No. 2017-06. Motion carried. August 1, 2017 Page 2 PABB01539 PUBLIC COMMENTS Polly and Gary Eby, 110 Barnett Street 9 brought before Council the issue ofi inappropriate behavior issues and noise nuisançes. They specifically address house #123 West McClure Street. The Eby's have not been able to enjoy their deck because of2 go. karts running up and down the newly stoned alley behind their property. Over the weekend they added another go kart for a total of3. These go karts are being driven by children ages 8-12, and occasionally an adult male with a toddler, who turns around on private property and on the streets, or uses the streets for riding. Sunday night, July 30, all three go karts were using a loop consisting of Barnett, Apple, the alley and Church Streets back to Barnett Street as a go kart track at 9:20 p.m. One oft the karts had a small blue light on the front. Mrs. Eby called Mayor Krammes at 9:25p.m, who called BEO Nazzaro and then Mayor Krammes called the PA State Police who advised Mayor Krammes that there was a police car nearby who would respond. Mrs. Eby stated this is a neighborhood noise nuisance, unsafe, and in addition, they are using Borough streets and alleys for recreational use. Mrs. Eby had been told that there were no ordinances the BEO Nazzaro could enforce in response to their complaints but Mrs. Eby feels Chapter 15 of the Ordinances, page 15-2, lines 13 and 14 do address the conduct of our townspeople in this case. Chapter 15, Article 3. Prohibited Conduct. - No person while on municipal property or recreational facilities shall: Line 13, Operate a snowmobile, mini-bike, motorcycle, four-wheeler or other motorized recreational vehicle on a sidewalk or any other Borough owned property. Line 14,Operate any motorized motor vehicle, recreational or otherwise, in such a manner as to disregard public safety. Mrs. Eby feels their West McClure Street neighbors are in violation of the above stated lines for operating a motorized recreational vehicle on a Borough owned property, and for disregard of public safety. Mr. and Mrs. Eby would like to see this resolved in a timely manner. President Anderson was responsible for updating this Article, sO she is familiar with the ordinance. President Anderson said BEO Nazzaro is not a traffic enforcement officer and does not have the authority to pull over moving vehicles on a street. This would be a PA State Police issue. Solicitor Wagner said the Borough could issue a citation providing the provisions ofthe code. Mr. Nazzaro spoke with the people multiple times. Since this deals with public streets, he feels PSP would be best to handle this situation. Mr. Nazzaro stated the Ordinance lists specific sites such as municipal property, but not public streets and he does not want to look like he is enforcing traffic law. Solicitor Wagner believes the people in question should be put on notice through certified mail and indicate ifany further violations occur the Borough will contact the PSP. PSP citations can be issued based on information received. The Borough will send a certified letter to residents at #123 West McClure St. with a copy of the Ordinance. ENFORCEMENT Solicitor's Report - Mr. Richard Wagner reviewed the proposed ordinance #331 prior to last month's s meeting which he could not attend and the only thing he found was one typo error which he reported. It can be advertised for purpose of adoption. Mr. Wagner had the opportunity to speak with both President and VP of Council about a deep concern in the Borough that there seems to be a history for a significant period oft time that there is a difficulty filling Council positions. There was a discussion about reducing the number of Councilmen. August 1, 2017 Page 3 PABB01540 There is a provision in the Borough code that permits a reduction of Borough Council, This is initiated by way of a petition that has to be signed by 5% ofthe electorate. Then, the petition has to be filed with the Court and the Court will conduçt a hearing to determine the propriety of reducing the number of Councilmen from 71 to 5. Councilman Cless made the motion, seconded by Councilman Pray, to direct Solicitor Wagner to draw up a petition to be circulated among the voters. Motion carried. Of course going from 7 to 5 Council members means things will not get done as quickly and each member will have more responsibilities. This information can be put in the September newsletter and on the Facebook page to inform Borough residents ofthis change. Enforcement Committee Report Councilman Clouser reported about the grass growing up on the brick sidewalks and he noticed low hanging trees especially on the square. Mr. Hartman will look into this issue. President Anderson suggested Councilman Clouser inform the residents through a letter. He is looking for a template of a previous letter. President Anderson suggested she and Mr. Clouser work on the letter verbiage together. Warnings will be issued for high grass around fire hydrants, etc. or the Borough will help keep fire hydrants clear. Mayor's Report - Mayor Krammes reported things are good. She had a complaint concerning Mr. Nazzaro giving too many notices on a particular resident' s high grass. Mayor Krammes told the resident his grass was long and a grown man should not have to be told to mow his grass. The resident apologized. The newly painted house across from the Veteran' 's Building has a brick missing on the steps. She will send a letter asking him to fix the step. The house with the plywood in the window cannot be addressed. The Borough cannot tell the home owner about the boarded up window. Mayor Krammes applied for the permit for the Street Fair in September. Parking Enforcement Officer Report - Mayor Krammes reported 15 tickets were issued, 2 voided and 2 remain unpaid. Borough Enforcement Officer Report - BEO Officer Mr. Harry Nazzaro reported a busy month. He is having more issues with people in the cemetery and the park after hours. He has been doing more night patrols. He is working with the Dog Warden about barking/loose dogs. President Anderson asked him to get copies of the new Tether Law to give dog owners. Mr. Nazzaro is having a problem with 42 W. Main issuing warnings to tenants or property owners for grass/weeds, trash, littering, items blocking sidewalk, etc. 30 W Main has the same issue plus plywood over windows and for dogs barking incessantly. 11 W.I Main rear is often a problem as the tenants continue to place trash out in the alleyway more than 24 hours before pickup and trash is found lying in the yard and the landlord is not mowing again. Mr. Nazzaro spoke to the, landlord, left warnings at his office and it is still not being done. He would like to cite this property owner for grass and weeds. Warnings issued include: Plywood/cardboard over home windows-1; violation ofl Park Hours past posted hours-3; trash and nuisance vehicle on private property-1; 24 hours trash pickup-9; 1St time warnings grass/weeds-13; grass/weeds 2nd, warning-1; grass/weeds 3rd warning-1; handicap spot check-1; violation of Cemetery Hours-3; skateboarding-4; dog defecating in cemetery and owner did not cleanup-1; littering-1; curfew-4; trash/junk on property-3; items for sale for extended perior-1; nuisance vehicle(street)l" warning-8; nuisance vehicle(street)2" warning-1; nuisance vehicle(parking lot)-1; sidewaiks blocked-1. August 1, 2017 Page 4 PABB01541 ADMINISTRATIVE Announcements and Correspondence - Budget Meeting Dates - The Budget meetings have been scheduled for October 16, 17 and 18 starting at 4:00 p.m.. Hopefully, it can be completed in one night. It will be a working dinner. All committee heads were reminded to bring their anticipated needs and wants for the upcoming year. Resolution #2017-07 - The Borough is reapplying for the PA Small Water and Sewer Program Grant for the replacement ofultra-violet bulbs used in the Wastewater Treatment Plant Ultraviolet Disinfection System Replacement project. To be in compliance with the Grant a new resolution with a new updated cost figure must be passed. The project is not to exceed $128,000.00. Councilman Pray made a motion, seconded by Vice President Patterson, to approve Resolution #2017-07. Motion carried. President Anderson stated Councilman Pray will now be handling grants. President Anderson asked Councilman Weller to be responsible for the Borough building however Councilman Cless stated he would be able to Chair the Building Administration Committee with Councilman Weller as a member. Water Authority Report - Mr. Albright stated Main Street was dug up and replaced a service line going into the Bed and Breakfast. This was done in a matter of hours. The Swift test at Well #3 site is still going on. They. just went over 51 million gallons of water pumped down the little creek. The test goes until October. Centre Township is signing the plans for the land development for Well #3. Planning Commission Report - Ms. Rowlands was absent sO no report. Zoning/Permit Officer's Report - Mr. Albright stated he issued 5 zoning applications, 2 for solar roof panels (214 Maple Lane and 405 timber Circle), 1 for installing a new window at 48 W. Main, and 2 above ground pools (one at 200 W. High St and one at 319 West. Main St.) Administrative Committeel Report President Anderson stated the Borough is considering blinds for the windows on the Office for privacy and heating/cooling issues. Mr. Cless performed several things. He did the annual safety inspection on the building emergency lights and fire alarm system. He replaced 3 batteries and a bulb. He replaced several ceiling lights on both floors. He requested estimates from two security system companies, TYCO and IDT, for installation of security camera systems. IDT responded with a price of$4,717.06 for the initial installation with an annual maintenance fee ofS1,240.20. This is for 9 cameras and a 16 channel system. He is still waiting to hear from TYCO for their estimate. He called BORTECH for replacement paper towel dispensers for easier use than the present ones. He made inquiries as to what it would cost to convert the building from T12s to T8s light bulbs. PPL is offering further incentives to convert to LED style bulbs. He received information and will need to confirm the cost effectiveness ift the existing ballasts can be used with LED bulbs.. Mr. Cless stated a need to name a new chairman for the Municipal Authority. Mr. Long has declined. Mr. Cless volunteered. Councilman Clouser made a motion to nominate Mr. Cless as Municipal Authority Chairman for Bloomfield Borough, seconded by Councilman Weller. Motion passed. President Anderson asked Mr. Cless to follow up with Mr. Jason Blumenschein to check on the air conditioner that the Library purchased and as of yet is not installed. FEMA/PEMA Report - Councilman Cless reported he completed the NIMS forms and returned them to County 911. The County will notify the Borough if there is a training day, etc. August 1, 2017 Page 5 PABB01542 PCBA/COG Mr. Albright reported the next meeting will be in November. Capital Tax Collection Bureau Report - Councilman Pray stated there was a meeting two weeks ago and the Executive Director is retiring in September. Last year the new system to scan all taxes has been caught up to date. AESTHETICS Aesthetics Committee Report Councilman Summers had two calls about trimming trees sO he handed out permits and is waiting to receive them back. He contacted the Boy Scouts and gave them a September Ist, 2017 date to have the shuttle removed. He will keep emailing them to make sure they are trying to remove it. Councilman Summers presented Council with 2 possible replacement pieces of playground equipment. He will need to get the prices for next year's budget, etc. and to see about possible installation by Borough employees. He has checked into grants also. President Anderson complimented Mr. Summers on the many compliments the flower barrels around the Square have received. FINANCE, INSURANCE, AND SAFETY Finance, Insurance & Safety Report - Vice President Patterson had nothing to report. It will be discussed under Rights of Way & Utilities report. Grants Councilman Pray had nothing to report but will work with Councilman Summers on possible playground equipment grants. Personnel Committee Report - President Anderson stated Councilman Pray would also be taking over the Personnel Committee. She will give Mr. Pray the health insurance papers he will need. RIGHTS OF WAY & UTILITIES Rights of Wav& Utilities Committee Report - Vice President Patterson stated just about everything is finished from both Glace and the Borough. Glace has to take it into SEDA/COG which will be done soon. Bidding should go out in the next week and a half: for the McClure St. project. This will also include the Bridge and Water projects. All the requests for bids will go out at the same time. Paper bids must also be accepted. The bidders must come into the office to look at the specs. The Borough does not have to provide them with a copy ofthe specs according to SEDA/COG and the Borough engineer. Because of engineering changes and paving for a resident the McClure St. Project estimate cost was updated to approximately $152,000. This is $58,000 more than expected. It will be a full depth reconstruction with some curbing being added. He has been in contact with the Firemen's Association and quote from Justin Kretzing: "Do to some unforeseen problems we have to delay again to getting the site development to the Borough for approval. So we are hoping to do that in the next two weeks. 9 Pending - Security Cameras - President Anderson suggested Councilman Cless check with another security camera company named Shearer, located in Harrisburg. August 1, 1027 Page 6 PABB01543 Councilman Pray mentioned that on August 26th the area code (717) must be included when dialing a phone number. This will be placed on Facebook, etc. Councilman Cless will put an announcement letter on the website about the Council wanting to go from a 7 member council to a 5 member council. Closing Comments There being no further business, upon motion by Counçilman Clouser, seconded by Councilman Pray, the meeting adjourned at 8:15 p.m. to meet on Tuesday, September 5, 2017 for a regular meeting.
