DEVICE MANAGEMENT The Customer can easily manage, configure, and deploy their in-car and body-wor cameras in VideoManager EL Cloud. Body-wom cameras are checked out to a given officer, where VideoManager EL Cloud keeps record of who last had the body-wom camera. In contrast, in-car video systems are configured with a list of officers who are authorized to use it. When an officer logs into the device, the officer is marked as the owner of any evidence that is created by the device. VideoManager EL Cloud does not display the officer's name who is currently associated with the in-car vdeo system, but it does for body-wom cameras. VideoManager EL Cloud's Rapid Checkout Kiosk feature allows agencies to take advantage of pooled body-wom cameras. The cameras can be checked out at the beginning of a shift using an easy-to-use interface. At the end of a shift, the body-wom camera will be returned to its dock, where video is automatically uploaded. The camera is then ready to be checked out for the next shift. (Motorola) and the Customer for the implementation of body-worn camera(s) and/or in-car video system(s) and your digital evidence management solution. For the purpose of this SOW, the term "Motorola" may refer to our affiliates, subcontractors, or certified third-party partners. A third-party partner(s) Motorola-certfied installer) will work on Motorola's behalf to install your in-car video system(s) (if applicable). This SOW addresses the responsibilities of Motorola and the Customer that are relevant to the implementation of the hardware and software components listed in the Solutions Description. Any changes or deviations from this SOW must be mutually agreed upon by Motorola and the Customer and will be addressed in accordance with the change provisions of the Contract. The Customer acknowledges any changes or deviations from this SOW may incur additional cost. Motorola and the Customer will work to complete their respective responsibilities in accordance with the Project Schedule. Based on Section 5.12, a Motorola employee is defined as someone who is required to be on the Customer's property with unescorted access. Motorola employees will also have access to the Customer's network(s) and stored information. Motorola has remote access tools to support virtual escorted access to on-premises customer assets. Additionally, Motorola performs independent criminal background investigations including name based background checks, credential and educational vetting, credit checks, U.S. citizen and authorized worker identity verification on its employees. Motorola will support the Customer in the event of a CJIS audit request to validate employees assigned to the project requiring CJIS Section 5.12 Personnel Security screening and determine whether this list is up to date and accurate. Our experience has shown customers who take an active role in the operational and educational process of their system realize user adoption sooner and achieve higher levels of success with system operation. The subsections below provide an overview of each Motorola Project Team Member. Project Manager (PM) The PM will be the principal business representative and point of contact for Motorola. The PM's responsibilities may include but are not limited to: Manage Motorola responsibilities related to the delivery of the project. Provide product education as defined by this SOW and described in the Education Plan. Provide on-site training based on the products the Customer purchased. Technical Trainer / Instructor The Technical Trainer / Instructor provides training on-site or remote depending on the training topic and deployment services purchased. Video Management Point of Contact (POC) The Video Manager POC will educate users on digital media policy, participate in Discovery tasks, and complete the Video Management. Administration training. The Customer is responsible for its own creation and enforcement of media protection policies and procedures for any digital media created, extracted, or downloaded from the digital evidence management system. Subject Matter Experts (SMEs) SMES are a core group of users involved with the analysis, training and provisioning process, including making decisions on global provisioning. The SMES should be experienced users in their own respective field (evidence, dispatch, patrol, etc.) and should be empowered by the Customer to make decisions based on provisioning, workflows, and department policies related to the proposed system. Residents of the city are best served by a variety of retail, service, office, entertainment and other establishments catering to consumer needs. An excessive number of establishments offering similar consumer goods can preclude opportunities for such a diverse range of businesses. The compact development pattern characterizing Thomaston can produce a concentration of businesses vying for consumer attention. Coupled with the long history of Thomaston, this circumstance can mean that few undeveloped lots remain. Those lots that do remain are typically smaller and cannot accommodate more desirable developments such as mixed use developments or large department stores. Accordingly, a need exists in Thomaston, particularly in the downtown, for larger stores capable of supplying a more diverse range of merchandise. The comprehensive plan highlights the character of the downtown as having quaint shops and cafes and cites historical commercial uses" as desired future uses. The abundance of convenience stores does not facilitate establishment of these uses and can inhibit the city's efforts to promote Thomaston as a destination for consumers within the 20-mile market radius identified in the July 2021 Downtown Thomaston Master Plan Market Analysis Report. B. Convenience and other food stores that also dispense fuels shall comply with the following standards: 1. No such store shall have a gross floor area less than 3,000 square feet. 2. No such store shall be located within 1,000 feet of any lot zoned for residential purposes as measured in a straight line from property boundary to property boundary. 3. The hours of operation shall be no earlier than 6:00 a.m. and no later than 11:00 p.m. Sunday through Thursday and no earlier than 6:00 a.m. and no later than 12:00 a.m. on Friday and Saturday. These hours of operation shall include solid waste removal and fuel deliveries. 4. Site lighting shall be directed downward and on to the property. 5. No loudspeakers shall be operated on the property. 6. All such store properties shall provide two points of vehicle access to the property. 7. A minimum of two trash receptacles shall be provided in locations and in sufficient sizes to accommodate customer volumes. 8. The traditional gas station has been replaced by convenience stores selling fuel. National chains like Racetrack and QT have established a new standard in gas stations, meeting the needs of the traveling public. To ensure that fueling stations at convenience stores remain a viable option in the marketplace, all new convenience stores shall also sell fuel. A minimum of 12 fueling stations will help address the needs of motorists traveling in Thomaston without being a burden on the operator as recent development in this industry features many more fueling stations. In order to control scale, the number of fuel dispensers shall not exceed 28 individual fuel pumps. D. Limit on number of convenience stores. At some 21 stores meeting or approximating the definition of convenience stores operating in Thomaston, that ratio to population is deemed far higher than a healthy commercial climate would allow. The city seeks to pare this segment of retailers by placing appropriate limits on convenience stores. 1. The findings of a retailing study performed by Urban Partners dated August 31, 2021 support the need for such "paring. Their review of retailing data shows that : .94% of the entire retail supply for Upson County is located in the City of Thomaston.. " Data presented in the study are based on an analysis of "Selected Retail Supply and Demand" figures found in table 15, trade area retail supply and demand characteristics. This analysis documents that 2021 supply sales in convenience stores far outstrip 2021 demand expenditures for a significant gap of $2,020,847. The number of such stores that would be required to best align convenience store supply within the Thomaston Tracts Trade Area Retail Supply with demand expenditures in that trade area is 7.84 stores, or eight convenience stores. 2. Accordingly, convenience stores shall be subject to approval of a special use and shall be limited to eight such stores within the city limits based on data published in the Downtown Thomaston Master Plan Market Analysis Report. No application for a special use to establish a convenience store shall be accepted when the total number of convenience stores would continue to exceed eight such stores. Event centers may be utilized for events held by a third party who provides some form of consideration to the owner or his or her agent. Event centers whose primary venue is outdoors shall have a minimum lot size of two acres; event centers whose primary venue is indoors shall have a minimum floor area of 2,400 square feet and associated parking in compliance with article 9, parking and loading. No grave slabs are allowed in the sections listed herein. An exception is hereby granted for any headstone monument installed in Section G, lots 59-230, on or before April 1, 2025. Thereafter, no monuments will be allowed in Section G, lots 59- 230, and any monuments installled therein after April 1, 2025, will be deemed non-conforming. The city shall be allowed to remove said monuments provided that the city gives the lot owner or the lot owner's S family at least 30 days advance notice of its intent to do SO, and further, the city shall not be liable for any damage to the headstone monuments. iii. As to Sections E. lots 111-257; Section F, lots 1-156; Section G, Lots 59- 230; and Section H, lots 1-172, an exception shall be made to permit markers in each of the designated lots, to include veteran and non- veteran markers. The markers shall either be flat bronze, granite or marble markers. The dimensions of the flat bronze markers shall not exceed 24 inches in length, 12 inches in width, with a three-fourths- inch rise, and it shall weigh no more than 18 pounds, for a single lot. The dimensions of the flat markers made of granite or marble shall not exceed 24 inches in length, 12 inches in width with a four-inch rise, and it shall weigh no more than 130 pounds, for a single lot. In addition to the marker described, one square piece of granite or marble, which shall not exceed 12 inches by 12 inches, may be placed adjacent to either the left or the right of the marker which shall have an area carved out for placement of flowers. Should there be two contiguous lots at which one marker is desired: (1) the dimensions of the flat bronze marker shall not exceed 48 inches in length, 20 inches in width, with a three-fourths-inch rise, and it shall weigh no more than 36 pounds, and (2) the dimensions of the markers made of granite or marble shall not exceed 48 inches in length, 20 inches in width with a four-inch rise, and it shall not weigh more than 260 pounds. In addition to the marker described, one square piece of granite or marble, which shall not exceed 20 inches by 20 inches, may be placed adjacent to either the left or the right of the marker which shall have an area carved out for placement of flowers. Further, all markers and the square granite or marble base installed for placement of flowers shall be placed in the ground and installed flush with the ground surface. The markers shall be installed SO that lawnmowers may easily traverse the grave site without causing damage to the mower or the stone marker. Installation of the markers shall be performed by either a funeral home or monument company. The city reserves, and it shall have, the right to remove any markers that are non-conforming to the provisions set forth herein above. The city shall be allowed to remove said markers if they are non-conforming to the provisions set forth herein above, provided that the city gives the lot owner or lot owner's S family at least 30 days advance notice of its intent to do SO, and further, the city shall not be liable for any damage to the markers. iv. As to Section F, lots 1-90 ("cremation section"), an additional exception shall be made to permit horizontal markers for any individual buried in this section provided that the total number of markers per lot does not exceed two. The lots are six feet wide and nine feet Iong, and four urns are allowed in each lot. Said markers shall either be flat bronze grave markers, similar to the flat bronze grave markers for veterans, or flat granite or marble markers, similar to those for veterans. The dimensions of the flat bronze markers shall not exceed 24 inches in length, 12 inches in width, with a three-quarter-inch rise, and they shall weigh approximately 18 pounds. The dimensions of the flat markers made of granite or marble shall not exceed 24 inches in length, 12 inches in width with a four-inch rise, and they shall weigh approximately 130 pounds. In addition to the marker described, one square base of granite or marble, which shall not exceed 12 inches by 12 inches, may be placed adjacent to either the left or the right of the marker which shall have an area carved out for placement of flowers. Further the markers and square granite or marble base installed for placement of flowers shall be placed flat in the ground and installed flush with the ground surface. Installation shall be performed by either a funeral home or monument company, and the markers shall be installed SO that lawnmowers may easily traverse the grave site without causing damage to the mower or the stone marker. The city shall be allowed to remove said markers if they are non-conforming to the provisions set forth herein above. b. Mausoleums may be placed only in Section E, lots 1-110. C. Cremains may be placed in the cremation section, which is Section F, lots 1-90. For Section F, lots 1 - 90, only, up to two urns are allowed per lot. Cremains may also be placed in another section, if the lot is purchased at the full price of the lot selected, and only one urn is allowed per lot. d. The following lots in Section Care to be sold as a one grave Iot due to the ambulance drive encroaching upon the lots. The cost of the lot will be one- half the lot cost for Section C as set forth in the schedule of fees at the time of purchase. The schedule of fees for Section Cis set for each lot being a two grave lot. The lots include 34, 35, 72, 110, 111, 146, 147, 182, 183, 381, 404, 427, 454, 477, 504, 527, 554, 627, 654, 677, 704, 727, 754, 777, 804, 827. e. No curbing, fencing, border or enclosure of any sort shall be erected on, in or around any burial lot in the cemetery, and the city reserves the right to remove any such enclosure. The city reserves the right to erect curbing along the walks and driveways, if it sO desires. f. It shall be unlawful for any person to install a cement or gravel floor or covering on any burial Iot. (3) Conditions, restrictions, rules and regulations applying to all cemeteries of the city: a. For each burial lot and mausoleum lot the city shall charge and receive a sum as set forth in the schedule of fees and charges adopted, from time to time, by the mayor and council, copies of which shall be available from the city clerk's office. b. Conveyances of burial lots shall be executed in the name of the city by the mayor or city manager, and the city clerk. Such conveyances shall not convey fee simple title, but shall convey to the purchaser of each burial lot an easement for the exclusive right of interment and sepulture in the lot, shall state the maximum number of graves allowed on each such burial lot as shown by the plat referred to in the deed, with the exception of the lots described in section 30-3(2)d. and by reference therein made shall convey each lot subject to all the provisions of this chapter and all amendments thereto as fully as if set out in each such conveyance. A copy of this chapter shall be delivered to the buyer upon purchase of each lot. C. At the time the city conveys any burial lot, in addition to collecting the purchase price of the burial lot, the city shall collect from the purchaser an amount sufficient to have such conveyance recorded in the clerk's office, county superior court, and shall have such conveyance sO recorded before delivery thereof to such purchaser. d. The city manager or his designee is designated as superintendent of the cemeteries. e. It shall be unlawful to remove, cover, or in any other manner disturb the survey markers located in the cemetery. f. For sections allowing slabs, all slabs shall conform to the contour of the lot on which they are located, and the top of all slabs shall be flush with the ground SO that no portion of the slab shall exceed ground level at any point. &. A mausoleum must be located a distance from the front line of the lot on which it is placed at least equivalent to the depth, from front to rear, of the structure itself, and, from all other sides of the lot, it shall be located a distance equal to the greatest height of the structure. No bodies shall be placed in such mausoleum except in sealed caskets and in hermetically sealed compartments. h. Each poured headstone foundation shall extend beyond the bottom base of the headstone at least one inch in all directions, and the vertical measurement of the poured headstone foundation shall be the same as the vertical measurement of the bottom base of the headstone monument. i. The maximum width of a headstone monument base shall not exceed 60 percent of the burial lot width, and there shall be no more than one upright marker for every two graves permitted on a burial lot. j. : No mound over any grave nor any other change in the grade or contour of any burial lot, except temporarily in connection with interment, shall be made by any lot holder or other person. k. The number of graves located in or on a burial lot shall not exceed the maximum fixed for each such lot and the graves and grave slabs shall be symmetrically placed as illustrated by the lot detail on plats of the cemetery referred to in this chapter. I. No monument, statue, inscription or other thing which is unsightly or which in any way negatively reflects on any person, living or dead, or on any religious sect, shall be erected or maintained in the cemetery. The city reserves the right to remove. any such item. m. No trees or shrubs of any kind shall be planted, or allowed to remain, within the borders of any burial lot or lots. Plantings in all areas outside of burial lots shall be under the control of the mayor and council. The city retains the right to enter upon any area of the cemeteries and remove any tree or shrub which is either deemed to be in violation of this subsection or which may cause damage to any grave site or the area around a grave site. n. All flowers must be placed in a permanent base or placed on the headstone. (A permanent base shall be a flower vase attached to or made aj part of the headstone or a permanent base installed adjacent to a horizontal marker as allowed by Sec. 30-3(a)(iii) and (a)(iv) above.) Dead flowers erunsightly-items are to be removed from the grounds. Any flowers that are not placed in a permanent base or on the headstone, such emslelenthegawegor items which are not permitted, may be removed at the discretion of the cemetery superintendent or any agent contracted with the city to care for cemeteries. Items that are not permitted included, but are not limited to solar lights, windmills, blankets, and figurines. Such items will be removed without warning and without compensation to the parties placing such items on the cemetery grounds. O. The mayor and city council reserve to themselves and their successors in office the right to alter, amend, modify or add to the rules, regulations, conditions and restrictions set forth in this chapter, at any time it is deemed advisable SO to do in order to carry out the purposes of this chapter, or to assure the proper care and administration of the city's cemeteries. p. It shall be unlawful to bury a decedent in a lot in which the decedent owns no interest and has no permission to be buried in. SECTION TWO The sections, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any section, subsection, paragraph, sentence, clause or phrase shall be declared illegal by the valid judgment or decree of any court of competent jurisdiction, such illegibility shall not affect any of the remaining section, subsections, paragraphs, sentences, clauses and phrases of this ordinance. SECTION THREE All ordinances or parts thereof in conflict with the terms and provisions of this ordinance be, and the same hereby are, repealed. SECTION FOUR The adoption date of this ordinance is April 2025, and the effective date of this ordinance shall be April 2025. ORDAINED this day of April, 2025.
