Minutes 6 City Council Meeting May 12th, > 2025 6:30 pm Baldwin Municipal Courtroom, 155 Willingham Avenue, Baldwin, GA 30511 Mayor Stephanie Almagno, Councilmember Erik Keith, Councilmember Nancy Lehman, Councilmember Kerri Davis, and Counci/member Alice Venter were in attendance. Call Meeting to Order Mayor Almagno called the meeting to order at 6:30 pm. Invocation and Pledge Mayor Almagno listed all those present at the meeting. Action: A motion was made by Alice Venter to amend the agenda by adding under New Business, "Item #5: Consideration/Aproval of Clean Up Day Budget Amendment" with a second by Kerri Davis. Motion Carried 4-0. Consent Agenda a. Approval of Minutes: Spring Council Retreat 4/10/25 - 4/11/25, Council Meeting 4/28/25, and Work Session 5/6/25. Action: A motion was made by Alice Venter to approve the consent agenda as presented with a second by Nancy Lehman. Motion Carried 4-0. Public Comments No one came forward. Public Hearings Reports Old. Business 1. Consideration/Approva of Rescheduling June 23rd Council Meeting Council had no additional questions or concerns about rescheduling the June 23rd council meeting due to the Mayor and two council members being out oftown for training. Action: A motion was made by Alice Venter to reschedule the June 23rd council meeting for June 26th with a second by Nancy Lehman. Motion Carried 4-0. 2. Consiceration/Approva of Highland Pointe Manhole Adjustments Mayor Almagno reviewed the proposed manhole adjustment project in Highland Pointe that was discussed in the May work session. The project will be expensed through LMIG funds. Consideration/Approva: of 15t Reading of Oak Terrace Variance Ordinance #2025- 05162Z Chief Administrative Officer Emily Woodmaster presented an application for a variance for the Oak Terrace subdivision, located off Duncan Bridge Road and B C Grant Road. While these residential properties will not be inside City limits, the development plans submitted last September proposed that they would be connected to Baldwin's water distribution system. Barnhart noted at a site inspection that the now-paved road was adjusted from its original center mark and that the water line is not in the 10-foot utility easement as listed on the approved plans. An as built was submitted to the City, which confirmed non- compliance with the approved plans, as the water line is outside of the easement and is located under the paved road in several ocations. Representatives of DB, LLC. Bryan Whitenton and Oaky Dover attended the meeting, and their application proposes two requests for consideration. One, the City accepts the water line as constructed outside of the utility easement; or two, the Council authorizes use of a master meter at the front of the development, similarly to Apple Pie Ridge. The City would be responsible for the water lines up to the master meter, and the rest of the lines would be privately maintained. A previous Council passed a resolution stating that master meters would no longer be utilized, hence the authorization from current Council. City staff recommended requiring the developer to verify all regulations for a private water system with the EPD before the second reading of the ordinance scheduled for the May 27th meeting. Ifthe EPD agrees with the private system, a master meter would be acceptable with a water line ownership affidavit in place. If the EPD opposes the private system, staff recommended relocating the water lines to the appropriate utility easement. Whitenton stated he didn't believe that the road was moved, but rather that the waterline was simply not placed in the easement as designated on the plans. Both Whitenton and Dover previously met with Woodmaster and Barnhart to discuss options and how to proceed with the variance request. However, they requested to meet with Barnhart and City Engineer Fletcher Holliday to discuss other possibilities for a "palatable, universal solution." Woodmaster reminded Council that the first reading only authorizes bringing the second reading forward, and if they table the first reading, the timeline must restart to comply with public notice requirements. Action: A motion was made by Alice Venter to approve the 1st Reading ofthe Oak Terrace Variance Ordinance #2025-05162Z with conditions as presented with a second by Erik Keith. Motion Carried 3-0-1 (Kerri Davis abstained). 4. Consideration/APprova of FY2026 Master Fee Schedule Revision Woodmaster reviewed the Master Fee Schedule for fiscal year 2026, which was approved by Council at the March 10th council meeting and will take effect July 15E. A few items were left off the approved version in error, SO they have been added for Council's consideration and approval: Council Meeting Minutes May 12+h, 2025 Page 12 Returned Item - For returned items at the bank this fee has been reduced from $36.00 (when the City used South State Bank) to $10.00 (now through United Community Bank). New Driveway Permit - $85.00 for both residential and commercial projects. Utility Encroachment - $115.00 to include time for staff review when plans are submitted to the City and inspections conducted by City staff. Woodmaster pointed out a note at the end of the fee schedule, which states that the master fee schedule is not exhaustive of all fees established by ordinance, and that the fee schedule will be annually evaluated and amended as necessary. Action: A motion was made by Nancy Lehman to approve the revised FY26 Master Fee Schedule as presented with a second by Erik Keith. Motion Carried 4-0. 5. Consideration/Approva. of Clean Up Day Budget Amendment Woodmaster presented a budget amendment request to pay Waste Away Disposal for their dumpster services during Clean Up Week, with a total amount due of $8,523. Barnhart requested moving $8,600 from "Vehicle Maintenance and Repair" to "Garbage Disposal, because a few items will not need repairs before the end of the fiscal year. Action: A motion was made by Alice Venter to approve the Clean Up Day budget amendment to be expensed out of "Vehicle Maintenance and Repair" as presented with a second by Kerri Davis. Motion Carried 4-0. Executive Session Announcements a. The City of Baldwin will host a Town Hall Meeting for the FY2026 budget at 7:30 pm on May 20th at the Baldwin City Hall Community Room. We invite citizens to ask questions, meet department heads and staff, and discuss the future of Baldwin. b. Join us for Theron's Theater (previously Movies in the Market) at the TAP Yard on May 23rd at 8:00 pm for a free screening of Moana 2! Bring a chair or blanket and enjoy a night under the stars with your friends and family! Concessions are available with all proceeds going to Shop with a Hero. C.
