PAULDING COUNTY PLANNING COMMISSION MEETING April 22, 2025 The regular meeting of the Paulding County Planning Commission was held on April 22, 2025 in the Watson Government Administration Building. Planning Commission members in attendance were Vice-Chairman Roger Leggett; Ellis Astin; Sammy Callahan; Helene Fitzgerald; Jacob Wix; Commissioner Chairman Tim Estes; Commissioner Keith Dunn; Commissioner Sandy Kaecher; Commissioner Dean Schneider; Commissioner Virginia Galloway and County Attorney, J. Jayson Phillips were present. Staff in attendance included Community Development Director, Ann Lippmann; Planning and Zoning Division Manager, Chris Robinson; Planning and Zoning Planning Tech, Leah Wilson; Department of Transportation Director, George Jones; County Manager, Tabitha Pollard and Deputy Rodney Schubert from the Paulding County Marshal Bureau. Planning Commission Vice-Chairman Roger Leggett called the meeting to order at 2:01 PM. while introducing himself, as Chairman Palmer would not be in attendance at today's meeting. Vice- Chairman Leggett requested everyone turn off or silence any mobile devices. Vice-Chairman Leggett announced the save the date for the Comprehensive Safety Action Plan open house on Tuesday, April 29th from 5 - 7 PM. Policy and Procedures states applicants and anyone speaking on behalf of the application will have fifteen (15) minutes to make their presentation and any opposition will also have fifteen minutes to present. The fifteen minutes are cumulative for each side. All comments are to be addressed to the Vice-Chairman. Approval of Minutes Sam Callahan motioned to adopt the meeting minutes from March 25, 2025; seconded by Helene Fitzgerald. Motion carries. (4-0-I). FOR: Astin, Fitzgerald, Callahan and Wix AGAINST: None ABSTAIN: Leggett 2025-07-Z: Application by JAMES ALDRIDGE requesting to rezone 6.104 acres from R-2 (Suburban Residential District) to I-1 (Light Industrial District) for the intended commercial use of heavy equipment rental(s). Property is located in Land Lots 967 & 968; District 2; Section 3; at the southeast intersection ofLaird Rd and Bill Carruth Pkwy [725 Laird Rd). POST 3. Mr. Robinson announced there have been no calls with questions. Staff recommends DENIAL; however, ifthe Board votes in favor ofthe application, staff provided five (5) stipulations for consideration. Will Summey, with Elite Engineering, on behalf of the applicant restated the intended purpose consisting of heavy equipment rentals. Mr. Summey stated his client is amenable to the recommendations. Applicant and/or applicant's agent must be present for consideration 2025-04-SUP: Application by WILLIAM F. HARRELSON requesting a Special Use Permit on 51.24 acres of R-2 (Suburban Residential District) for the seasonal event operation of a containment haunted house amusement themed attraction. Property is located in Land Lots 292 & 339; District 19; Section 3; on the south side of Holly Springs Rd, west of SR HWY 101 N. POST 2. Mr. Robinson stated staff did receive calls with general questions to the application. Staff recommends approval with nine (9) stipulations. William Harrelson reiterated the request for a special use permit in order to operate a 26-storage container seasonal Halloween themed attraction for thirty days. Mr. Harrelson stated he has run this business in different locations over the past 8 years, and seems to do well. There was a brief discussion between Jacob Wix and Mr. Harrelson, in which Mr. Harrelson elaborated on the security and safety measures he plans to incorporate for these events. No further questions from Planning Commission. Superumputcomments There was no one to speak on behalf of the application. Opposition/Input/Comments There was no one with comments or concerns regarding the application. Vice-Chairman Leggett stated anything to keep our kids out ofharm's way is a great thing. Owner/Applicant agrees approval of this SUP is not transferable to another owrier other than the current applicants. 2. Owner/Applicant agrees all applicable state and local regulations for an event facility will be adhered to for the site including but not limited to build, fire, life- safety, and health department codes. 3. Owner/Applicant agrees any expansion and lor addition of new buildings / facilities not presented with this application would require an amended Special Use Permit. 4. Owner/Applicant agrees to low or boxed / shielded out-side lighting. 5. Owner/Applicant agrees to not have outdoors public address systems. 6. Owner/Applicant agrees to limit hours of operation form 6 pm to 11:30 pm. 7. Owner/Applicant agrees not to provide any alcohol beverages. 8. Owner/Applicant agrees access to be improved and an updated driveway permit obtained from Paulding County DOT. 9. Owner/Applicant agrees to provide a traffic control plan which details traffic control measures, that will be utilized and implemented for events, to be reviewed and approved by Paulding County. ZONING ORDINANCE TEXT AMENDMENT: Public Hearing: The Paulding County Planning Commission and Board of Commissioners will consider Zoning Ordinance Text Amendments to Title 1: Administration, Chapter 110 Definitions", Section 110-40 "General Definitions", Title 2: Zoning, Chapter 210 "Base Districts", Section 210-60 "MPR Master Planned Residential District" and Section 210-100 "R-55 Active Adult Residential District", Chapter 220 "Overlay Districts", Section 220-20 "Corridor Overlay District", Chapter 240 "Standards Applying to All Districts", Section 240-10 Dimensional Standards of Zoning Districts", Chapter 260 "Off-Street Parking Standards", Sèction 260-20 "Required Spaces", Chapter 280 "Planning Commission", Section 280- 140 "Traffic Memo Report Contents" and Appendix, Section 3.0 "List of Amendments" of the Unified Development Ordinance for Paulding County, Georgia. Minutes: Paulding County Planning Commission April 22, 2025 Page 3 of 4 Community Development Director Ann Lippmann briefly summarized the revisions to this ninth (9th) edition of the UDO (Unified Development Ordinance). A few of these items included: updated R-55 (Active Adult Residential District) & MPR (Master Planned Residential District) zoning requirements, and corridor roadway and boundary assignments. There was a brief discussion between Planning Commission and Ms. Lippman regarding the previous minimum lot requirements for R-55 and MPR as well as input from Mr. Leggett as to additional roadways he would like to have added to the list. Vice-Chairman Leggett opened the floor for public comments, in which there were none and the public comment portion was closed. A brief discussion ensued between Mr. Wix and County Attorney Phillips as to the recommendations the Committee received regarding the text amendment along with the comments from Mr. Leggett; whether today's vote is for the information/comments gathered at this meeting or to allow staff to review and add said comments for further discussion at the May meeting. Mr. Wix motioned to APPROVE the drafted text amendments as presented, with staff review of the items of today's meeting SO they potentially can be incorporated into the May text amendments when they are presented. Seconded by Sam Callahan. Motion carries (4-0-1). APPROVE: Astin, Callahan Fitzgerald and Wix AGAINST: None ABSTAIN: Leggett Mr. Robinson announced the next Planning Commission will be May 27, 2025 - the day after Memorial Day, and to be on the lookout for an email as to establish a quorum. There being no further business, a motion to adjourn was made by Helene Fitzgerald; seconded by Jacob Wix. Motion carries (4-0-1).
