COMMUNICATIONS Alexander Tauber, Ranch Road, expressed his appreciation for Kevin Bryant. Mayor Dombkowski Invited all to join in celebrating Kevin Bryant's retirement on May 9, 2025. PRESENTATION OF TRAIL APPRECIATION. AWARD Barry Kuhl, Trails Committee, presented Sean Rose, retired Town Engineer, the Trail Appreciation Award. PRESENTATION OF HONOR COIN Mayor Dombkowski read a Proclamation honoring Vicki Coe and presented her an honor coin. TOWN MANAGER REPORT Mr. Bryant stated: the solar installation project is complete, and will be active in a few months; he will be in the May Day Parade, and would like to know which other Counciimembers would be attending; the first meeting about the Town Center Area Plan is anticipated to be on June 10; the next Town Manager, Jason Ledbetter, is in the audience tonight. Motion seconded by Councimember Brown and approved by roll call vote: AYES: Councimembers Aburish, Brown, Goeld, Wall, and Mayor Dombkowski NOES: None Regarding 6, Brown expressed concern about the unreliability of receiving federal funding in the future, and urged Council to heavily consider whether the Town should supplement this project and future projects; he suggested moving forward with the project with a not-to-exceed amount the federal government is promising Mr. Emrani stated: the rule of thumb is funding seven to 10 percent on top of whatever the design cost is; the project could end up costing $1 million or less; the scope has been reduced; in negotiations with the consultant, they have committed to getting the Town the obligated funds (ie., E76 Permit from Caltrans); there will be another check at the end of the process; Council can decide how the project proceeds, depenaing on the cost; the $800,000 grant was received five years ago, and prices have increased since then. Mayor Dombkowski stated: unfortunately, grants do not cover the design cost; it is difficult to reject a $800,000 grant; personally, he would be reticent to do a cap; Councimember Brown would be satisfied with getting a chance to review the document and putting a cap if the Council decides whether to move forward; there is a typo in the Resolution where the grant was awarded in 2021, not 2023. Councimember Brown moved approval of the Consent Calendar Item 6. Review and Recommended Approval of Resolution Denying Appeal (APPI2023-0003) Thereby Confirming Planning Commission's Approval of Resolution No. 2023-002, Completing the Required One-Year Review of Conditional Use Permit (CUSE2019-0001) and Finding the Permittee, Menlo Country Club, in Compliance with the OperationaIConditons of Approval in its Conditional Use Permit. Resolution No. 2025 - 7747 Councimember Brown recused himself because he lives within 500 feet of the subject property, and left the room at 7:35 p.m. Mr. Schaan presented the staff report. Town Council Meeting Minutes April 22, 2025 Page 3 Docusign Envelope ID: FB7AF83-2875-483C-BE52-B69AA2E80272 Council's questions included: clarification about the additional operational conditions of the Conditional Use Permit (CUP) and the action to take tonight; the CUP was drafted and approved before the shade structure Building Permit was issued, SO would the Menlo Country Club (MCC) be allowed activities related to the shade structure without any accountability; if Council had granted the appeal, would that have opened the possibility for Council to redraft the CUP. In response, Mr. Schaan stated: the additional operational conditions relate to the direction Council provided at the last meeting regarding the appeal; there would be no further noise study, unless there was some need in the future for some other reason; not allowing seating was related to a noise concern; Council reviews whether the MCC is in compliance with their CUP; the objective data collected demonstrates that the MCC is in compliance of their CUP, SO staff recommends denying the appeal without any additional restrictions; there is nothing in the CUP that regulates the shade structure; the noise restrictions still come into play for the entire property; the last time this was heard, there was a lot of discussion about not having chairs, tables, or entertainment. In response, Ms. Savaree stated: at the last meeting, Council denied the appeal; Council still expressed concerns about the appellants contentions that the MCC was operating in a way that was violating the noise limitations in their CUP, but there was no objective evidence for Council to look at; Councilmember Fluet requested independent objective evidence to determine what to do; the data gathered shows that the MCC is not in violation of their CUP, SO staff is suggesting that the Council not impose a condition that prohibits chairs, tables, or dining; there must be some nexus to redraft the CUP. The Public Comment Period opened at 7:49 p.m. Debbie Mendelson, Sheridan Way, stated: her frustrations with the process; the timeline of events after the July 25, 2023, meeting; complications with the independent noise consultant; her appreciation of Councimember Goeld's efforts to resolve the issues; how they continue to be inconvenienced because they cannot use their home; since the beginning of February, there has been a broken fan running nightly that has yet to be fixed. Kevin Greenwood, Sheridan Way, objected to statements that the CUP protects neighbors and that the MCC has complied with all the conditions. Steve Gonzalez, General Manager at MCC, stated: they believe they comply with the CUP, and has demonstrated that to Council; he appreciates and agrees with staff's recommendation. Bonnie Schreiber, Sheridan Way, concurred that the noise has been difficult to live with. The Public Comment Period closed at 8:18 p.m. Councimember Wall's comments in opposition included: there is a lot of detail and history; an essential feature of her vote in denying the appeal is the inclusion of additional operational conditions to rectify obvious deficiencies of the CUP; the MCC strenuously objected to the Town Council Meeting Minutes April 22, 2025 Page 4 Docusign Envelope ID: OFB7AF83-2875-483C-BE52-B69AA2E80272 operational conditions; this is a failure of due process; either Council continues to include those operational conditions, or find another procedural way forward. Council's comments included: the MCC is meeting the conditions of the CUP; Council was not responsible for adding conditions; support for the Resolution; the decibel levels were all in the allowed range at the property line; they can empathize living with noise; Council has the objective data from the sound monitoring expert; Council needs to do what is fair for all parties involved; the MCC made real efforts to try to resolve this; there was a total failure of process and communication issues on the staff's side; neighbors are encouraged to talk to each other and find compromise for a reasonable path forward; Council tried to directly encourage a mediation process. Counciimember Goeld moved approval of Item A. Motion seconded by Councimember Aburish and approved by roll call vote: AYES: Councimembers Aburish, Goeld, and Mayor Dombkowski NOES: Councimember Wall RECUSED: Councimember Brown Councimember Brown returned to the room at 8:52 p.m. NEW BUSINESS B. Letters of Support for Community Project Funding Applications. Mr. Bryant presented the staff report. Council and staff discussion included: aligning priorities with Congressman Sam Liccardo may increase chances of funding; there were no affordable housing projects that worked with the timeline. The Public Comment Period opened and closed at 8:56 p.m. Council's comments included: the priorities are clear and work strongly in the Town's favor; there is no risk associated with requesting more support; interest in requesting support for Housing Element compliance; scope and portability beyond structures is going to lower probability of success; support for the two letters. Councimember Wall moved to approve Item B with the addition that staff will conversate with Congressman Liccardo about other projects that increase access to affordable housing that could be applicable to Woodside, and if SO, will submit a letter. Volunteer Committee Updates. Ms. Cardinale spoke of: the May Day Fun Run/Walk; and, a Sound Immersion session. D. Mayor and Councilmember Communications. Councimember Brown spoke of: an upcoming Wildfire Prevention Workshop on May 22, 2025; the increased use of electric bicycles, and the need for regulations, which the Circulation Committee will create. Councimember Wall stated: she also has concerns about electric bicycle regulations; this will culminate in a study session in June; she welcomes Council's thoughts on stakeholders (e.g, school). Councimember Goeld stated: the Emergency Services joint powers group discussed how the federal government has withdrawn many grants, and the Town may need to increase the amount paid for mutual aid. Mayor Dombkowski spoke of the importance of ensuring a priority like fire prevention is adequately funded. COMMUNICATIONS David Mittelman, Grandview Drive, expressed his appreciation for Kevin Bryant.
