SPECIAL PRESENTATIONS/CEREMONIAL MATTERS: 1. Volunteer Appreciation = Recognition of 2024 City Volunteers Mayor Honig thanked the Volunteer groups that assisted the City of Westlake Village in 2024. City Councilmembers presented a gift to each of the City Volunteers (Community Service Funds Advisory Committee, Cultural Recreation Advisory Board, City Special Event Volunteers, Community Emergency Response Team, Westlake Village Library Book Nook, Public Safety Advisory Board, Westlake Village Community Foundation, Volunteers on Patrol, Santa Monica Mountains Conservancy, and Veteran's Committee) in appreciation and recognition of their many volunteer hours to the City. PUBLIC COMMENTS: Chandler Weber representing the U.S. Small Business Administration = Office of Disaster Recovery Resilience. COUNCIL RESPONSE: None. STAFF COMMENTS: City Manager de Geus announced a flood watch is currently in effect due to a storm with rainfall totals of one to two inches, and potential for up to three quarters of an inch an hour at peak severity. He noted that City staff and contract crews are on standby for the storm. Mr. de Geus reported that a virtual Community Wildfire Protection Plan (CWPP) meeting was held on Tuesday, March 4, 2025 to begin the scoping process for a Community Wildfire Protection Plan. Over 60 residents and community stakeholders participated. Information on the next steps and findings from the scoping process will be available later this month at WLV.org/CWPP. City Council Minutes City of Westlake Village March 12, 2025 3 STAFF COMMENTS (continued): The Community Emergency Response Team (CERT) met on March 5, 2025 for hands- on training in First Aid, Automated External Defibrillator (AED), and Cardiopulmonary Resuscitation (CPR). The next CERT meeting is tentatively scheduled for April. Mr. de Geus reported that St. Jude Elementary School 3rd graders visited City Hall on March 7, 2025, received a presentation on the operation of local government, held a mock City Council meeting, and acted to "Stay Alert, Don't Get Hurt". Mr. de Geus announced that the City is seeking input on Americans with Disabilities Act (ADA) Transition Plan efforts with a community survey through March 14, 2025, Citizen and Youth of the Year nominations are open through March 31, 2025, and the Westlake Village Community Foundation is accepting High School Senior scholarship applications through March 31, 2025. City Manager de Geus highlighted agenda topics for the upcoming Council Committee meetings and City Council meetings. COUNCIL COMMENTS: Councilmember Davis inquired about the location of the Study Session on March 26, 2025, and requested that residents be informed of the meeting. Mayor Honig attended the Oaks Christian School's Founders Day Assembly on March 6, 2025, and the St. Jude's 3rd grade class visit to City Hall on March 7, 2025 along with Mayor Pro Tem McSweeney. Mayor Pro Tem McSweeney commented on the children's enthusiasm of the City's campaign, "Stay Alert, Don't Get Hurt." Mayor Honig stated that it was the 6th anniversary of City Manager de Geus' tenure with the City. CITY COUNCIL COMMITTEE REPORTS: 1. ENVIRONMENTAL COMMITTEE REPORT NEIGHBORHOOD BEAUTIFICATION GRANT PROGRAM For the record, Councilmember Pearl and Councilmember Davis disclosed that they are unpaid members of their Homeowner's Associations (HOA) as both HOAS submitted grants that will be discussed and voted on by City Council. City Engineer Hughes provided an overview of the Neighborhood Beautification Grant Program presented to the Environmental Committee (Davis/Pear!) on February 19, 2025 where the Committee discussed the two preapplications City Council Minutes City of Westlake Village March 12, 2025 4 CITY COUNCIL COMMITTEE REPORTS (continued): submitted for the Neighborhood Beautification Grant Program: Westlake Canyon Oaks HOA and Westlake Trails HOA. Providing background, Ms. Hughes stated that on October 9, 2024 the City Council approved an update to the Neighborhood Beautification Grant program to implement a two-step process, adding a simplified pre-application to be submitted in step one for City review, followed by a complete application for selected projects at the request of the Environmental Committee in step two. She discussed the proposed HOA projects for Westlake Canyon Oaks which included upgrading the irrigation system, planting drought tolerant plants and trees, and replacing the current stacked bricks with a permanent retaining wall. Westlake Trails' proposed project was an upgrade to a past beautification project by installing electrical power and new light fixtures. The Committee supported obtaining full applications for both projects and also expressed interest in including the design cost as reimbursable upon grant award. City Council provided unanimous support of both grant applications and moving to step two and obtaining full applications for both projects. Ms. Hughes noted that staff and the Environmental Committee will continue to move forward on this program. PUBLIC HEARINGS: 1. ALLOCATION OF FISCAL YEAR 2025 - 2026 COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FUNDS; RESOLUTION NO. 2393-25 Mayor Honig opened the Public Hearing. Planning Director Asp requested that City Council identify the Housing Rehabilitation Program as the program to be funded by the Community Development Block Grant (CDBG) program for Fiscal Year (FY) 2025-2026, estimated at $27,526. Federal Funds are received yearly through the Los Angeles County Development Authority with funds utilized for projects or programs that assist residents of low or moderate income to eliminate blight. The grant amount will be $15,000 to expand the reach of the program, rendering larger projects more feasible. Mayor Honig closed the Public Hearing. The City Council inquired on the number of applications received and the waiting list numbers. RESOLUTION NO. 2393-25: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WESTLAKE VILLAGE APPROVING ALLOCATIONS FOR FISCAL YEAR 2025-2026 FOR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS 2. REQUEST FOR COUNCIL DIRECTION REGARDING CONDITIONAL USE PERMIT NO. 24-002 Mayor Honig opened the Public Hearing. Planning Director Asp presented a request for City Council direction on an application for Conditional Use Permit (CUP) No. 24-002 to relocate an existing motor vehicle repair facility from 31129 Via Colinas, Suite 701 to 31117 Via Colinas, Suite 403. Providing background, Ms. Asp stated the applicant, CS Motorwerks, currently operates a motor vehicle repair facility at 31129 Via Colinas, Suite 701. The business originally operated at Suite No. 801 at 31129 Via Colinas, which was approved on January 12, 2011 for a period of five years. A modification was approved on April 24, 2013, to authorize the relocation of the business to Suite No. 701. On March 23, 2016, and February 24, 2021 City Council authorized the continued operation of the facility, both times with a five-year extension. The applicant is requesting to relocate the motor vehicle repair facility to a larger location at 31117 Via Colinas, Suite 403. The proposed relocation site is within the Westlake Commerce Center complex and approximately 300 feet away from the existing site. On June 24, 2020, the City Council adopted the North Business Park Specific Plan (NBPSP). The proposed relocation site for the business is in the Business Park East Zone of the NBPSP. The NBPSP sets forth a list of uses that are prohibited throughout the Specific Plan area and includes new motor vehicle repair and washing facilities. The prohibition was limited to new businesses with the intent to allow existing businesses to continue as legal nonconforming operations. It is the goal of the Zoning Ordinance to bring nonconforming uses into conformity. City Council Minutes City of Westlake Village March 12, 2025 6 PUBLIC HEARINGS (continued): However, language in the NBPSP directs readers to the appropriate chapters of the Zoning Ordinance (Article 9 of the Municipal Code) for use regulations that apply to the Business Park Zone and to two other zones in the Specific Plan area. This cross-reference to the Zoning Ordinance could be misinterpreted if both the NBPSP and Zoning Ordinance are not carefully considered together because motor vehicle repair facilities are listed as a conditionally permitted use in the Business Park Zone. The applicant has stated that he relied on this Business Park Zone language to pursue relocation at the new address and apply for a conditional use permit. On February 3, 2025, the Land Use Committee McSweeneylaper, reviewed the CUP request and were supportive but recommended forwarding it to the full City Council without a recommendation to allow the full Council to deliberate on the matter. Applicant, Christian Sniady, addressed the City Council and provided a PowerPoint Public Speakers: Ed Corridori, Matthew Mejia, and Jay Porter; all in support of the CUP approval. Mayor Honig closed the Public Hearing. City Council discussion included setting a precedent, business longevity, lack of complaints, ambiguity in Specific Plan language and adjusting for clarity, personal testimonials, due diligence and professional support. Councilmember Halpern moved to direct staff to bring back a resolution for approval of the CUP application. Mayor Pro Tem McSweeney seconded the motion. CULTURAL RECREATION ADVISORY BOARD APPOINTMENTS AND GUIDELINE UPDATES = City Council appointed Suzanne Corwin, Laura Dawson, Peggy Frank, Michael Lang, Andrea Robinson, Marcus Shapiro and Christianne Winthrop with the term ending December 31, 2026 and approved the revised Cultural Recreation Advisory Board Guidelines related to Student Membership ending dates, adjusting to end in June, thus extending all current students (Ashley Tenenbaum, Christina psen, Daniel Torres and Finleigh Williams) ending dates by six months. 2. RIGHT OF ENTRY AGREEMENT WITH WESTLAKE VILLAGE GOLF COURSE FOR THE 2025 FIREWORKS EVENT = City Council approved the Right of Entry Agreement with the Westlake Village Golf Course for the 2025 July 4th fireworks event and authorized the Mayor to sign and execute the agreement on behalf of the City. OLD BUSINESS: 1. CONSIDERATION TO ALLOCATE $60,000 FROM GENERAL FUND TO PREPARE THE STORM DRAIN TRANSFER APPLICATION TO THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT FOR THREE DEBRIS BASINS THAT DRAIN TO STORM DRAIN PD1721 IN THE THREE SPRINGS NEIGHBORHOOD City Attorney Boga stated for the record that Mayor Honig and Mayor Pro Tem McSweeney have a conflict of interest for this agenda item and must be recused due to the location of the project and that they are members of the Three Springs Homeowners Association. Mayor Honig and Mayor Pro Tem McSweeney left the dais at 8:07 p.m. City Council Minutes City of Westlake Village March 12, 2025 8 OLD BUSINESS (continued): City Engineer Hughes presented a request to authorize the allocation of $60,000 from the General Fund to prepare the Storm Drain Transfer Application to the Los Angeles County Flood Control District (LACFCD) for three debris basins that drain to Storm Drain PD1721 in the Three Springs Neighborhood. Providing background, City Engineer Hughes stated eleven debris basins are located in the Three Springs neighborhood, built in the 1980's. City staff routinely performs pre-rain inspections, annual weed abatement, and emergency cleanout for the basins and recently discovered that basin maintenance was the Three Springs Homeowners Association's (HOA) responsibility, per their covenants, conditions and restrictions (CC&Rs). Following some research and additional information sharing, the HOA relayed to City staff that they would like to request the City to assist them in gaining relief from this responsibility. The Three Springs Debris Basins maintenance responsibility issue was presented to the Land Use Committee (Davis/Pearl) on June 5, 2024. The functionality of debris basins was explained, with an overview of the locations and infrastructure involved. The Committee supported that such infrastructure should be maintained by a governmental entity and not an HOA. It was agreed by all parties that transferring the basins into the LACFCD for operation and maintenance would be the preferred and prudent course of action. Staff engaged with Los Angeles County to pursue the basin transfers and were directed to the Land Development Division which oversees processing storm drain transfers. Upon gathering the necessary information on process and fees, this item was brought before the Environmental Committee (Pearl/Davis) on February 19, 2025. Ms. Hughes reviewed the maintenance options including that the HOA maintains basins, the City assists HOA to transfer to LACFCD, or the City maintains basins, and discussed costs, requirements, and fiscal impacts. She stated there are two storm drains in the Three Springs Neighborhood, an upper one (PD1729) and a lower one (PD1721). The downstream storm drain system (PD1721) includes three of the largest basins in the neighborhood, while the upper system (PD1729) includes the remaining eight basins. Staff recommended that the initial effort be focused on PD1721 and the three basins that are located on Snowpeak Drive, Fastwater Court and Barrett Drive. The outcome can then inform the strategy for a future effort to transfer storm drain PD1729. Staff estimated the initial cost of $60,000 to complete the application process, including fees, transferring easements, required regulatory permits, and excluding capital investments to correct deficiencies.
