COUNCIL RESPONSE: STAFF COMMENTS: City Manager de Geus stated the new Pickleball Court windscreens at the Westlake Village Community Park were installed for improved play during windy conditions and noted that feedback has been positive. Mr. de Geus announced a virtual Community Wildfire Protection Plan (CWPP) community meeting on Tuesday, March 4, 2025 at 6:00 pm and invited residents and community stakeholders to participate in identifying ways to improve fire safety in the City. Registration details at Www.WIVor/CWPP Mr. de Geus announced that the City is seeking input on ADA Transition Plan efforts with a community survey through March 14, 2025, applications for the 2035 Strategic Plan Citizen's Advisory Committee were open through March 7, 2025, and the Westlake Village Community Foundation is accepting High School Senior scholarship applications through March 31, 2025. Mr. de Geus highlighted agenda topics for the upcoming Council Committee meetings and City Council meeting. COUNCIL COMMENTS: Councilmember Pearl reported that he and Mayor Honig attended the Las Virgenes/Malibu Council of Governments (COG) meeting and stated that the Los Angeles County Board of Supervisors voted to approve the Calabasas Landfill to accept wildfire debris. He also reported that he and Councilmember Davis, visited Mr. Jason Busby's AP History classes at Agoura High School. City Council Minutes City of Westlake Village February 26, 2025 3 MONTHLY DEPARTMENTAL REPORTS: 1. Sheriff's Department Report Deputy Brian Knott presented the Sheriff Department's report for January 2025 including crime statistics. He reported that Deputy Blanco, who serves Westlake Village, will be receiving a recognition award for being the number one ticket writer in Los Angeles County; St. Jude's students toured the Lost Hills Sheriffs Station, and the Girl Scouts will also be visiting the station soon. 2. Fire Department Report Battalion Chief Velazquez presented the Fire Department's report for January 2025 including the number of fires, medical response calls, and rescue activities conducted. He reported on a structure fire on February 19, 2025 on Allenby Court and noted the fire was contained to the garage and did not impact the residence. 3. Library Report Julie Frieze, Manager, Westlake Village Daniel K. Ludwig Library, presented the Library's report for the month of January 2025 covering traffic, circulation, programs, and reference requests. CITY COUNCIL COMMITTEE REPORTS: None PUBLIC HEARINGS: 1. CONDITIONAL USE PERMIT NO. 14-008 - MODIFICATION NO. 2; RESOLUTION NO. 2385-25 Mayor Honig opened the Public Hearing. Planning Director Asp presented a request for approval of Modification No. 2 of Conditional Use Permit (CUP) No. 14-008, for a time extension of an approved Conditional Use Permit to authorize the continued sale of alcoholic beverages for on-site consumption at 30768 Russell Ranch Road, Suite A, Prince Street Pizza Restaurant. Providing background, Ms. Asp stated on May 14, 2014, Hook Burger received approval by the City Council to sell alcoholic beverages for on-site consumption in conjunction with a restaurant. On July 10, 2019, the City Council approved Modification No. 1 to allow the continued sale of alcoholic beverages for on-site consumption at the subject site. BBQ Hut took over the restaurant space in 2023 and closed in late 2024. City Council Minutes City of Westlake Village February 26, 2025 4 PUBLIC HEARINGS (continued): Prince Street Pizza has taken over the tenant space and proposes to operate a pizza restaurant with beer and wine sales. There would be both indoor and outdoor seating like the prior restaurant uses. In addition, the applicant is proposing to include an area inside the restaurant for up to six arcade games that are children- friendly, token operated and are non-ticket redemption with no prizes. Staff recommended approval of the CUP modification with an expiration date of February 26, 2030. On February 3, 2025, the Land Use Committee MC5weeneylaper, reviewed the CUP time extension request and recommended forwarding it to the City Council for a Public Hearing. Applicants: Daniel Selleck, Jr., Landlord, and Dane Markanson, Project Management Director addressed the City Council. Mayor Honig closed the Public Hearing. City Council discussion included the hours of operation and commented favorably. Councilmember Halpern moved that the City Council adopt Resolution No. 2385- 25, determining Modification No. 2 of Conditional Use Permit No. 14-008 is exempt from CEQA and authorizing the continued sale of alcoholic beverages for on-site consumption at a new restaurant, located at 30768 Russell Ranch Road, Suite A, Prince St. Pizza. Planning Director Asp presented a request for approval of Planned Development Permit (PDP) No. 24-004 and Modification No. 2 of Conditional Use Permit (CUP) No. 23-005 to authorize the expansion of an outdoor covered patio with additional seating for a restaurant and to modify an approved CUP for the sale of alcohol for on-site and offsite consumption in conjunction with the patio expansion in the Lindero Oaks commercial center at 31149 Via Colinas, WeVino. Providing background, Ms. Asp stated the CUP was approved on September 13, 2023, to authorize the sale of beer, wine, and distilled spirits for on-site and offsite consumption within Suites 601 and 602. On December 6, 2023, a modification to the CUP was approved to expand the kitchen and dining areas into Suite 603. The applicant is now requesting to expand the patio area by 687 square feet (SF) for a new total patio area of 1,325 SF. The outdoor patio structure will be made of corrugated metal, enclosed by a 42-inch-high horizontal wood railing, and will include a new fireplace. The project also includes retrofitting the front setback landscaping while preserving the existing oak and sycamore trees. The patio expansion requires a Planned Development Permit. In addition, due to the expanded outdoor seating area, a modification to the CUP is required. Staff recommends approval of the proposed modification to the CUP with an expiration date of February 26, 2030, and approval of the Planned Development Permit for the expanded patio area. On February 3, 2025, the Land Use Committee MCSweeney/raper, reviewed the CUP time extension, Planned Development Permit request and recommended forwarding it to the City Council for a Public Hearing. Engineering Department Report City Engineer Hughes provided the Engineering report and stated that contracts have been awarded for the Community Park Improvements Project (entry monument sign and trash enclosure) and the Annual Street Improvement Project. Ms. Hughes reported that staff attended the North Santa Monica Bay Watershed Area Steering Committee meeting on February 13, 2025 to discuss the stormwater investment program budget and that the next meeting is scheduled for February 25, 2025. Ms. Hughes announced the public outreach component for the Americans with Disabilities Act transition plan launched and encouraged residents to share accessibility concerns and priorities by going to the City's website to complete the ADA survey. Paper copies of the survey are available at City Hall. 2. Planning Department Report Planning Director Asp provided the Planning Department Status Report stating a Code Enforcement Study Session will be held on Wednesday, March 26, 2025, development standards for recommended Zoning Code amendments are being drafted for presentation to the Land Use Committee in April, and as part of the ongoing implementation of the Housing Element, staff is preparing amendments to the Zoning Code to present to the Land Use Committee in March to allow for large group homes. City Council Minutes City of Westlake Village February 26, 2025 7 MONTHLY IN-HOUSE DEPARTMENTAL REPORTS (continued): 3. Cultural Recreation Report Community Services Coordinator Roush provided the Cultural Recreation report with an overview of the Westlake Village Discovers: Sports event held at the Civic Center on February 8th. Ms. Roush stated that recruitment interviews for new members of the Cultural Recreation Advisory Board were conducted on February 25, 2025 and the City to Schools Program brought Community Services Coordinator, Kaitlyn Roush, along with the City Engineer, Roxanne Hughes, Planning Director, Kristen Asp, and Associate Planner, Miles Orr, to White Oak Elementary School 4th graders. Ms. Roush announced upcoming City events including Earth Day, Movie in the Park, summer concerts and the 4th of July festivities. FISCAL YEAR 2025-2026 ASSESSMENTS FOR LIGHTING AND LANDSCAPE ASSESSMENT DISTRICTS: RESOLUTION NUMBERS 2387-25 THROUGH 2392-25 City Manager de Geus introduced the item and City Engineer Hughes presented the proposed Fiscal Year (FY) 2025-26 assessments for Lighting Maintenance Assessment District No. 1, Landscape Maintenance Assessment District No. 1, and Westlake Spectrum Local Landscape Assessment District No. 15. Ms. Hughes stated the City Council must annually review and levy assessments against all assessable parcels within the three districts for installation, operation and maintenance of certain street landscaping and street lighting improvements and City Council Minutes City of Westlake Village February 26, 2025 8 NEW BUSINESS (continued): provided background on each assessment district. She presented a summary of the current and proposed assessments by zone and discussed the importance of addressing the funding imbalance. Ms. Hughes discussed the sustainability of Assessment Districts including the impact to the General Fund of not increasing assessment rates beyond FY 2025- 26 and the Proposition 218 process. She provided an overview of the annual process for Assessment Districts which included identifying operation and maintenance costs, allocating costs proportionally, preparing the Engineer's Report based on the analysis including the detailed proposed assessments and methodology, City Council review and approval, and the levy and collection process. Each fiscal year, staff reviews fund balance projections for the assessment district program, which have been experiencing a negative fiscal trend as the level of funding provided by assessments and Ad Valorem is insufficient to keep up with the escalating operational and maintenance costs. Historically, expenditures have exceeded assessment revenues while assessments per equivalent dwelling unit (EDU) have remained unchanged since the mid-1990s. For FY 2025-26 a General Fund contribution in the amount of $73,000 will be needed to cover funding deficits for Lighting District 1 ($70,000) and Spectrum Landscape District 15 ($3,000). In addition, $130,000 will be re-allocated from Landscape District Zone 1 to cover deficits amounting to $123,147 in Landscape District Zones 2, 3 and 4. City Council discussion included reserve balances, increased costs, Proposition 218 process, future tax rates, general fund allocations, accurate budgeting, and true costs and transparency. Responding to City Council questions, City Attorney Boga clarified the multi-step process of setting and collecting the annual assessments for Assessment Districts. Councimember Pearl moved that City Council adopt Resolution Nos. 2387-25 through 2392-25 approving the Engineer's Reports with a modification to include a general fund contribution of $175,150.00 ($102,150 Landscape District 1, Zone 1, $70,000 Lighting District 1 and $3,000 Spectrum Landscape District 15) and setting a public hearing of public protests of the Districts to be held at the March 26, 2025 City Council meeting and that the City Clerk be directed to give notice of the Public Hearing.
