Union report Mr. LaRossa recognized Prof. Richard Wolfson of AFT Local 1904, who congratulated 2 professors on achieving emeritus status. Professor Wolfson noted that a number of long-term faculty members have retired from the University and suggested that their institutional knowledge and wisdom be preserved. Professor Wolfson asked how many general use classrooms will be constructed in the upcoming capital program, what is the total cost of the OneMontclair program, and stated that the union seeks input into the Vice-President of] Human Resources search process. Audit, Finance and Investment Committee - Dr. Cuss Dr. Cuss reported that the Committee reviewed its minutes from the meeting of September 12, 2013, heard a review of the University's OneMontclair project, Financial Performance, and the quarterly budget report. Contract award authorization: Dr. Cuss moved that the Board of Trustees authorize awarding of the following contracts: Construction services for the renovation of Room 4054 in University Hall into nutrition and athletic laboratories (Frankoski Construction) - $932,250 Training costs for the implementation of PeopleSoft Financial Management System (Oracle University) - $93,240 Consultant services for implementation and integration, managed services, and hosting partner services for PeopleSoft Financial Management System software (Cognizant) - $7,850,000 Universidad de Nebrija summer program (Universidad de Nebrija) - $68,000 Construction services for John J. Cali School of Music (Brockwell & Carrington Contractors, Inc.) - $583,014 The Motion was seconded and the awards were approved unanimously. Academic Affairs and Facilities Committee Mr. Maguire reported that the Committee reviewed it minutes from the meeting of September 12, 2013 and received a capital project report. The committee also reviewed contract award authorizations that the Audit, Finance, and Investment Committee will present for action by the full Board. Matters presented by the President Dr. Cole Dr. Cole reported that construction of the new School of Business and the Center for Environmental and Life Sciences was proceeding on schedule, and the work was proceeding in a very orderly manner which had minimized any disruption to campus activities. She also called attention to recent news articles indicating that some colleges were having difficulties filling their residence halls, but noted that, at MSU, our facilities were filled to capacity. The President reported on the success of Homecoming activities, including a sold-out parents' breakfast. She noted that the University had very successfully mounted the second and last gubernatorial debate between Governor Chris Christie and Senator Barbara Buono. The debate was broadcast live by NJTV and several radio stations. The President made note of a special program provided by the University to assist students who have aged out of the foster care system. The President also noted the very large and strong applicant pool the University had received for the first round ofthe Woodrow Wilson Teaching Fellowship program. Student Representative Report - Mr. Bunting Mr. Bunting reported that large incoming class has contributed to a vibrant community with increased school pride. Resident students are staying on campus on the weekends, which is having a positive impact on academics as evidenced by increased demand for library hours. Homecoming was a tremendous success. The women's field hockey and soccer teams have had great seasons. The Student Government Association engaged in a voter registration drive at Homecoming and students were active participants in the October 16, 2013 special election for United States Senate. Matters Presented by the Chair Mr. LaRossa reported that the Board received correspondence from Trionaid Associates, Inc. and in closed session that occurred prior to the Public Session earlier today, the Trustees received an update on legal and personnel matters, and discussed potential honorary degree recommendations. Motion to enter closed session Mr. LaRossa made the following motion, which was seconded and passed unanimously: Be it hereby moved pursuant to N.J.S.A. 10:4-13 that the Montclair State University Board of Trustees entered into Closed Session on September 12, 2013 to discuss the following pursuant to N.J.S.A. 10:4-12.b: 1) review of University ethics requirements; 2) acquisition of property in Essex County, New Jersey; 3) negotiations regarding contracts related to the University branding campaign; and 4) review of a report concerning pending litigation and personnel matters. Be it hereby further moved pursuant to N.J.S.A. 10:4-13 that the Montclair State University Board of Trustees shall enter into Closed Session prior to the next scheduled Public Session to discuss the following pursuant to N.J.S.A. 10:4-12.b: 1) litigation; 2) personnel matters; and 3) other matters which may arise consistent with N.J.S.A. 10:4-12.b. President Cole recommended Wang by Professor Wang from his employment as a tenured professor pursuant to N.J.S.A. suspension 18A:6-18; of 18A:6-18.1, and N.J.S.A. 18A:60-8. The Appeals Committee also reviewed Professor N.J.S.A. and Affirmative Defenses dated October 21, 2013 and the September 20, 2013 Hearing Wang's Officer's Answer Report prepared by Gilbert Rivera. The Appeals Committee oft the Montclair State of Trustees found that the Board of Trustees had University Board jurisdiction over this matter and that a contested was presented and recommended that the matter be referred to the Office of Administrative Law case pursuant to N.J.S.A. 18A:6-18. Referral ofDetenuring of] Prof. John Wang to the OAL for a Full Hearing Mr. Hiltzik moved that the detenuring of Professor John Wang be referred to the Office of Administrative Law pursuant to N.J.S.A. 18A:6-18 for a full hearing. No. 2960 SGAI President Report SGA President George Juzdan reported that he was proud that Montclair State, and in particular, President Cole, supported the Dream Act and worked to receive the endorsement of other public education higher institutions in the State. The SGA Executive Board is committed to enhancing student life at the University. This includes registering students to vote, operating a polling place on campus, and ensuring the Greek community has greater accountability. Homecoming was both fun and safe. Mr. Juzdan requested that student fees be increased modestly to allow the SGA to become members in organizations that promote increases in higher education funding. Tuition Hearing Executive Director of Budget and Planning David Josephson provided an overview related to State appropriations, the budget, and comparative tuition and fee data. He reported that the general appropriation from the State ofNew Jersey was expected to remain flat at $38.6 Million, no increases in state appropriations were expected related to State negotiated contracts despite an increased cost of $3.5 Million to the University, and the University will incur increased debt-service costs related to the University's S 25% share ofthe Building Our Future Bond funded projects. Montclair State University's undergraduate tuition continues to be below average for New Jersey senior public higher education institutions. James Anderson, Director of Financial Aid, provided an overview of financial aid programs and stated that the University is committed to providing tinancial aid funds. The University's Institutional Grants and Scholarship Budget will be increased by 11% in FY: 2015 over FY 2014 funding levels. 40% of Montclair State students are receiving Pell Grants. The Financial Aid Office actively seeks funding opportunities for students and promotes financial literacy for the recipients. Mr. LaRossa moved that The Board ofTrustees authorize the President and Vice President for Finance and Treasurer to take any actions necessary to permit the realignment ofYogi Berra Drive to allow both ingress and egress at Valley Road, which realignment may, but is not required to, include the installation and maintenance of a signalized traffic control device. Matters presented by the President Dr. Cole Dr. Cole commended the students for their articulate comments during the tuition hearing and expressed her appreciation for their taking the time to address the Board ofTrustees. Dr. Cole stated that the Administration has listened to the comments and are attempting to keep the tuition and fee rates as low as is reasonable. Dr. Cole reported that the Annual Scholarship Dinner, which honored Mr. LaRossa and raised over $500,000, was a resounding success. Dr. Cole noted that the University was still awaiting the State to release the Building Our Future Bond proceeds, which will be used to pay for construction oft the Center for Environmental and Life Sciences and School ofBusiness, both of which are expected to be commissioned in Summer 2015. There was a fire in a residence caused by an unattended candle. There was some water damage to the room resulting from fire suppression activities. The University Fire Education Program for students will continue to emphasize the need to be vigilant regarding items that may cause fires and in responding to fire alarms. The Little Falls Fire Department and Residence Life personnel performed in an exemplary manner and deserve the University's thanks. Dr. Cole noted that Pharmfest, a semi-annual University event sponsored with the cooperation ofthe Health Care Institute ofl New Jersey was taking place in University Hall. The event brings pharmaceutical and medical technology business in the State together to promote and grow New Jersey's biotech industry. Union Report Professor Wolfson congratulated the four Professors Emeriti on their designations, stated that the University should hire more tenure track faculty, commended Dr. Cole on her eloquent appeal to the State for increased support ofHigher Education and suggested that the Board keep the tuition increases modest, and raised questions regarding the procedure for transition of employees to the new food vendor. No. 2968 Audit, Finance and Investment Committee -Dr. Cuss reported that the Committee reviewed its minutes from the meeting ofFebruary 6, 2014 and heard a review of the Governor's recommended budget for Fiscal Year 2015. No. 2969 Reports Student Government Association representative stated that this would be his last meeting and he welcomed Anthony Fasano as the new non-voting SGA representative. Resolution Honoring Kyle Bunting Mr. LaRossa moved that Kyle Bunting's colleagues on the Montclair State University Board of Trustees express their heartfelt thanks for his significant contributions and wish him every success in all his future endeavors. No. 2970 University Senate President Dr. Saundra Collins thanked the University for its response to the residence hall fire, congratulated her colleagues on being designated professors emeriti, stated that the Senate was looking at the proposed social media policy, and whether to recommend that the campus be made tobacco free. Dr. Collins also wished University Counsel Valerie Van Baaren well on her retirement. Student Government Association President Kristen Bunk introduced the newly elected SGA officers. She reported that the SGA was advancing a bill to lobby the State for additional higher education funding, would be hosting its 80th Inaugural Ball, had awarded $14,000 in scholarships, a new Greek Advisory Board was being interviewed and an adopt a campus program was being pursued. Resolution Honoring Professor Jack Baldwin-LeClair Mr. LaRossa moved that the Montclair State University Board ofTrustees express their sincere appreciation to Professor Jack Baldwin-LeClair for his excellent contributions to the work oft the Board and wish him every success in all his future endeavors. Dr. Cole announced that the University has received a number of major gifts, including $1 Million each from Rita Renucci, Kay Consales, and PSE&G, and $400,000 from Dr. Murray Present. The University has hired 33 new tenure track faculty for the Fall term and the new class of students will be strong in quality, diversity, and size. The new School of Business and Center for Environmental and Life Sciences construction projects are on time and on budget. Union Report Ms. Jennifer Higgins was pleased that 33 new tenure track faculty will be hired and she extended her congratulations to the 35 professional staff receiving promotion and/or reappointments. Ms. Higgins spoke in opposition to the proposed managerial raise pool. Resolution for Property Acquisition Mr. LaRossa moved that the Board ofTrustees authorize the President and Vice President for Finance and T'reasurer to acquire Block 237, Lots 7 and 9 in Little Falls, New Jersey for a purchase price of $335,000. No. 2979 Matters presented by the President Dr. Cole Dr. Cole reported that the Fall 2014 class promised to be a large and high in quality and diversity. The renovation ofMoorehead Hall was completed successfully and the building was now occupied by the School of Communications and Media. The construction of the Center for Environmental and Life Sciences and the new School of Business was proceeding on time and on budget. The Second Annual Red Hawk Open will take place in September to raise funds for the University's athletic and training programs and facilities. Union Report Professor Richard Wolfson thanked the Board for keeping tuition, room, and board increases below 3%. The Finance Division appeared to managing the University's finances prudently and Mr. Wolfson was thankful that University continued to be in a strong fiscal position. Mr. Wolfson asked that the University consider hiring additional instructional and support staff, but limit its use ofi instructional specialists.
