BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, APRIL 16, 2025 The regular meeting of the Borough Council of the Borough of Franklin Park was held on Wednesday, April 16, 2025 at 8:00 p.m. at the Municipal Building, 2344 West Ingomar Road, Pittsburgh, Pennsylvania 15237. The meeting was also held virtually via remote audio and video conferencing. Council President Uday Palled called the meeting to order. Insp./Fire & Tech Official.. present Tim Phillips, Building InspectorlZoning Officer. present PRELIMINARY MATTERS None PUBLIC COMMENTS Speakers were encouraged to appoint a spokesperson for a specific matter rather than having several people repeat the same comments. Mark Jennings, 1670 Oakleaf Lane commented that the Borough had notified them of signage violations back in November, and it has escalated into the removal of 14 blue spruce trees that are located in the right of way at the entrance to Oakleaf Lane at the. intersection of Reis Run Road. They are very vested in this situation and would like to come up with a positive resolution to the issue. Bill Kegel, 1668 Oakleaf Lane provided a short history of the trees noting that they provide a barrier, landscaping and beautification to the plan, and they do not obscure the line of sight for drivers. BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, APRIL 16, 2025 Michael Abriatis, 1663 Oakleaf Lane commented that the trees are an appealing amenity to the development, and they add privacy and cut down on the road noise. It is unclear what problem they are causing resulting in their removal. Neil O'Keefe, 1642 Augusta Drive commented that he is the current president of the Franklin Ridge HOA, and the trees have been there since 1991 and should not be removed. He disputed the reasons provided by the Borough for the removal of the trees. Carol Godkins, 1656 Oakleaf Lane asked what precipitated the issue with the trees. Mr. Ebner stated that the Borough received a complaint that the speed limit sign was being blocked and when they went out to investigate it was discovered that the trees were planted in the road right of way which is a violation. Bryce Miller, 1430 North Shevlin Court, is a Boy Scout who commented regarding the condition of Holmes Drive, Pioneer Drive, and Colonial Drive in the Settlers Walk Plan. He asked if there is anything being done about this issue and what someone his age can do to have something done. Mr. Bucuren noted that the specified roads are not scheduled to be repaved this year, but public works will take care of the cracks this summer. MONTHLY REPORTS APPROVAL OF THE MINUTES - Mr. Myslinski moved the minutes of the March 19, 2025 pre/post meeting, the March 19, 2025 regular meeting, and the April 2, 2025 work session, be approved, seconded by Dr. Li and carried. TREASURER'S FINANCIAL REPORT - Mr. Weiskircher summarized the March Treasurer's Financial Report. The General Fund revenues for the month of March totaled $771,789. Year-to-date total revenues are $1,297,261, which represents 9.23% of the 2025 total budget. The General Fund expenditures for the month of March totaled $553,645. Year-to-date total expenditures are $2,032,528, which represents 13.31% of the 2025 total budget. Dr. Li moved the March Treasurer's Financial Report be accepted as read, seconded by Mr. Malkin and carried. POLICE REPORT = Mayor O'Keefe read the Police Report and activity report for the month of March 2025. The police responded to 524 calls for service. Mr. Schwartzmier recommended the Police Report be filed with the Police Secretary. FIRE COMPANY REPORT - Mr. Myslinski read the Fire Company Report for March 2025. The fire company responded to 26 calls for the month and the manpower for the month totaled 470 volunteer hours. BUILDING INSPECTION REPORT - Mr. Phillips read the Building Inspection Report for March 2025. Mr. Phillips issued 24 permits and collected $46,221 in fees. Total value of construction was $3,895,987. ANNOUNCEMENT OF EXECUTIVE SESSIONS ANNOUNCEMENT OF EXECUTIVE SESSION - Mr. Palled announced that on April 2, 2025 the Personnel Committee held an executive session to discuss personnel matters, and Borough Council held an executive session to discuss property acquisition. On April 16, 2025, the Personnel Committee held an executive session to discuss personnel matters, and Borough Council held an executive session to discuss personnel matters and a potential property acquisition. 2 BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, APRIL 16, 2025 OLD BUSINESS CARDINAL RIDGE PLAN, 26LOTTOWNHOUSE SUBDIVISION, 2570 ALDON DRIVE = Mr. Myslinski moved to grant revised final approval for Subdivision Application SF-25-01-01, submitted by LaTerra Holdings, LLC for the Cardinal Ridge Plan, a 26-lot townhouse subdivision, located at 2570 Aldon Drive in the M-2 zoning district, contingent upon compliance with the Building Inspector's Staff Report dated April 9, 2025, and the letter from Lennon, Smith, Souleret Engineering, Inc. dated February 14, 2025, seconded by Dr. Li, Mr. Schwartzmier noted that Council had received the additional documentation requested last month. He asked which units would have the extended rear as shown on a new drawing, and he asked for assurance that the applicant would allow for the additional stormwater runoff from the additional roof areas. Mr. Mike McAneny of Foxland Homes responded that the rear and side elevations show options that will be available to buyers. The buildings were originally 40 feet deep and then they added an extra 10 feet for the rear elevation extensions that could include options such as a patio, a covered patio, a half patio with a dining room extension or an owner's bedroom extension. The stormwater has been engineered and addressed. He estimates that two out of four buyers may take advantage of the options. Mr. Phillips will be checking the impervious areas and stormwater as the units are constructed. Mr. Myslinski asked for confirmation that two porches are an option for buyers, and Mr. McAneny confirmed. The motion was then voted on and carried. NEW BUSINESS APPROVAL OF THE BILLS - Dr. Li moved Council authorize the payment of the bills, which have been reviewed and approved since the last meeting, and are available for viewing on the Borough website, seconded by Ms. Czekaj and carried. BLACK OAK INVESTMENTS OFFICE BUILDING, SECOND ADDENDUM TO DEVELOPMENT AGREEMENT - Mr. Schwartzmier moved to authorize the Borough to enter into a Second Addendum to Development Agreement with Black Oak Investments, LLC, for site development and construction of the Black Oak Investments Office Building located at 2402 Nicholson Road, in order to extend the completion period until April 29, 2026, seconded by Ms. Czekaj and carried. BLISS RESIDENTIAL LAND DEVELOPMENT PLAN, THIRD ADDENDUM TO DEVELOPMENT AGREEMENT - Ms. Czekaj moved the Borough enter into a Third Addendum to Development Agreement with Memory Lane Venture LLC for the development and construction of the Bliss Residential Land Development Plan, located at 2041 Reis Run Road, in order to extend the completion period until May 21, 2026, seconded by Dr. Li. Mr. Schwartzmier asked how many homes have been completed in the development, and Mr. Phillips stated that five permits and three occupancies have been issued. There are a total of ten lots The motion carried. Mr. Malkin abstained from voting and an abstention form is on file. RESOLUTION NO. 1382-205, SALE OF POLICE VEHICLE ON MUNICIBID PUBLIC AUCTION - Mr. Stone summarized Resolution No. 1382-2025. Mr. Myslinski moved to adopt Resolution No. 1382- 2025 declaring a 2018 Ford Interceptor SUV (last four digits of VIN # are 8414) as surplus personal property; declaring the estimated fair market value over $2,000; authorizing the sale and disposition at public auction on Monday, May 12, 2025 at 12:00 p.m. prevailing local time on the Municibid Online Auction, intps.lmuniciid.com, and directing the Secretary to advertise the sale, seconded by Mr. Malkin and carried. 3 BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, APRIL 16, 2025 MCCANDLESS FRANKLIN PARK AMBULANCE AUTHORITY, FIRST PAYMENT OF 2025 - Ms. Czekaj moved to authorize the first of three payments in the amount of $14,000.00 to the McCandless-franklin Park Ambulance Authority as part of the 2025 annual donation, seconded by Mr. Myslinski and carried. NORTHLAND LIBRARY, SECOND QUARTER PAYMENT - Mr. Schwartzmier moved to authorize the second quarter payment in the amount of $94,468.25 to Northland Library as part of the 2025 annual donation, seconded by Dr. Li and carried. ANNOUNCE THE 2025 SCHOLARSHIP RECIPIENTS Mr. Malkin moved to announce the 2025 Scholarship recipients, seconded by Dr. Li and carried. Mr. Palled then read the names of the scholarship recipients: Anna Bridges, North Allegheny High School Caden Currykosky, North Allegheny High School Linda Kong, North Allegheny High School Andrew Li, North Allegheny High School Tanay Mishra, North Allegheny High School Julia O'Keefe, North Allegheny High School Emily Quinlan, North Allegheny High School Neelansh Samanta, North Allegheny High School Emily Sobehart, North Allegheny High School Katherine Varghese, Sewickley Academy Arshia Zaidi, North Allegheny High School PURCHASE 2024 FORD F550 BUCKET TRUCK - Dr. Li moved to authorize the purchase of a 2024 Ford F550 Bucket Truck for the Public Works Department from Mobile Lifts, LLC of Collegeville, PA at a cost of $166,200.00 delivered, under COSTARS Contract No. 025-E22-472, seconded by Mr. Myslinski. Mr. Schwartzmier asked about the trade-in or sale of the old bucket truck. Mr. Bucuren indicated that the old bucket truck and other vehicles will be put up for sale on the Municibid website in the future. Mr. Schwartzmier noted that the old bucket truck was becoming a safety concern in its current condition even though it was certified each year. The Borough received a grant toward the purchase of the new bucket truck. The motion carried. ADVERTISE FORI RE-BID OF CLOVER HILL GOLF COURSE CLUBHOUSE EXTERIOR RENOVATIONS - Mr. Myslinski moved to authorize advertising for the re-bid of the Clover Hill Golf Course Clubhouse Exterior Renovations, seconded by Mr. Schwartzmier and carried. SQUIRE RIDGE PLAN PHASE III, RELEASE MAINTENANCE AGREEMENT SECURITY - Mr. Malkin moved to release United Casualty and Surety Insurance Company Maintenance Bond No. UCSX386X1839 posted as the security for the Maintenance Agreement for the Squire Ridge Plan Phase III, in accordance with the letter from Lennon, Smith, Souleret Engineering, Inc. dated April 8, 2025, seconded by Ms. Czekaj and carried. LAPLACE POINTE/TAYLOR RIDGE APARTMENTS, ADDENDUM TO MAINTENANCE AGREEMENT Ms. Czekaj moved to authorize the Borough to enter into an Addendum to Maintenance Agreement for the Public Improvements in the LaPlace Pointe Land Development Plan a/kla The Taylor Ridge Apartments with Kress Brothers Builders, LP in order to extend the maintenance period until October 31, 2025, in accordance with the letter from Lennon, Smith, Souleret Engineering, Inc. dated April 8, 2025, seconded by Mr. Myslinski. Mr. Schwartzmier asked for an update on when Deerfield Estates developer will make the sidewalk connection to Taylor Ridge. Mr. Phillips indicated that the developer will be required to make the connection, but there is no specified time period. The motion carried. 4 BOROUGH OF FRANKLIN PARK BOROUGH COUNCIL REGULAR MEETING MINUTES WEDNESDAY, APRIL 16, 2025 MCELROY ROAD LLC SEWAGE FACILITY, CASH BOND REDUCTION - Mr. Schwartzmier moved the Cash Bond in the amount of $12,500.00 being held for the maintenance of the McElroy Road LLC Sewage Facility, located at 2453 Rochester Road, be reduced by $10,000.00 to $2,500.00, in accordance with DEP regulations, seconded by Dr. Li and carried. INTRODUCE ORDINANCE NO. 692-2025 - Mr. Stone introduced Ordinance No. 692-225, authorizing the condemnation, by eminent domain, or the purchase in lieu thereof, of temporary and permanent real estate interests in real property for municipal purposes. This is in conjunction with the Borough's MS4 Program, and it involves a construction easement and a permanent drainage easement over two properties located in the Borough. This ordinance will be advertised for action at the May 21, 2025 regular meeting. MS. CZEKAJ thanked those who came out to comment this evening and to share their views regarding the trees on Oakleaf Lane.
