December 8, 2022 Public Hearing December 8, 2022 Regular Council Meeting On motion by Councilmember McDaniel and seconded by Councilmember Sims, Council approved the December 14, 2022 Special Called Meeting minutes. Councilmember Claxton abstained due to him being absent from the meeting. On motion by Councilmember Claxton and seconded by Councilmember McDaniel, Council unanimously approved Resolution No. R2023-0001 establishing and fixing the qualification fee to be paid by candidates seeking election in the November 7, 2023 General Election. Council heard the second reading of Ordinance No. 592 from City Manager Turner. On motion by Mayor Pro Tem Shropshire and seconded by Councilmember Hightower, Council approved Ordinance No. 592 and rezoned 30.21 acres on the southwest corner of Highway 41 and Martin Luther King, Jr. Parkway for Twiggs Pleasure LLC. The vote was 4 to 1. Councilmembers Claxton, Hightower, McDaniel, and Mayor Pro Tem Shropshire were in favor ofthe rezoning and Councilmember Sims was opposed. Council heard the second reading of Ordinance No. 600 by City Manager Turner. On motion by Councilmember Sims and seconded by Councilmember Claxton, Council unanimously approved Ordinance No. 600 and amended the 2022-2023 Budget to reflect a total Cost of Living Adjustment of 5%. City Manager Turner updated the Council on the CDBG Bid. He said the original bid was rejected due to it being too high and the project was rebidded and it came in cheaper at $1 million from $1.5 million. Councilmember Hightower asked for clarification on the original amount of the project and grant amount and the change in the project's scope. He stated he wanted to ensure what the City said would be donel has or will be done. City Manager Turner reported that what the City said would be done has already been done. On motion by Councilmember Claxton and seconded by Mayor Pro Tem Shropshire, Council unanimously accepted the updated CDBG Bid. On motion by Mayor Pro Tem Shropshire and seconded by Councilmember Hightower, Council unanimously approved the reappointment of Mr. Irvin Trice to the Three Rivers Regional Commission as the Non-Public Member for a one year term. Councilmember McDaniel reported they have been having a problem with attendance and he said he'd speak to Mr. Trice about it. Council discussed the 2023 Appointments. On motion by Councilmember Sims and seconded by Councilmember Hightower, Council tabled the appointments until its February 9, 2023 Regular Council Meeting. The vote was 4 to 1. Councilmembers Claxton, Hightower, Sims, and McDaniel were in favor of tabling the appointments and Mayor Pro Tem Shropshire was opposed. On motion by Mayor Pro Tem Shropshire and seconded by Councilmember McDaniel, Council unanimously appointed Bill Claxton as the 2023 Mayor Pro Tem. REPORTS Councilmember Sims asked about the sewer line Sohel Batliwala has been trying to get taken care of. He said he'd like to see them help get this done. Council discussed the issue. Councilmember Sims also asked for an update on the full reopening of Main Street. Councilmember Hightower asked about the street resurfacing. Council discussed the current process, LMIG, and TSPLOST. He also expressed his appreciation of the City staff and acknowledged the passing of the late City Manager David Rose two years ago on this day. Councilmember Claxton reported on the condition of the sidewalk on Elm Street behind the Baptist Church: and on the limbs on Harrell Circle. Mayor Pro Tem Shropshire thanked the City crew and Richard Vereen for removing the dangerous tree hanging over the road. PUBLIC COMMENTS Ms. Jane Huguely of512 Thomaston Street commented the sewer system on Atlanta Street and in the rest oft town is horrible. Ms. Dorothy Carter recommended the state and representatives be contacted for them to provide monetary assistance for the sewer system repairs. She also reported on Taylor Street between Lee Street and Moye Street that the holes are growing. Mrs. Kay Pedrotti reported there is a new exhibit coming on January 20th on photography at Lamar. Arts. Mr. Dan Waller asked Council to not annex the property on Roberts Road. City Manager Turner and Water and Sewer Superintendent Moats updated the Council on the failing infrastructure. City Manager Turner and Civic Center/Swimming Pool Manager Vereen updated the Council on the pool and discussed the available options. Council discussed the 2023 Appointments and agreed not to make any changes this year, but for the Council to look at them ahead oftime for 2024. Mayor Banks informed the Council Gordon State College has sent a request for the Council to adopt a proclamation that recognizes the Gordon State College Club Football Team for winning the national championship two consecutive years that will be prepared and signed tomorrow. Attorney Bobby Melton (Haygood, Lynch, Harris, Melton & Watson) 4) Engineer Carter & Sloope 5) Surveyor Steve Coleman 6) Physician Dr. Lee Woodall 7) Prosecuting Attorney Mark Irvin REPORTS Councilmember McDaniel reported he's been getting a lot of calls on problems with the limb truck. He stated he'd like to see something put in the Herald Gazette informing the public that we're down to one limb truck and ask for the citizens' patience and for them to cut back on putting them out until the new limb truck on order arrives. He also noted the City needs to suspend the $7.50 monthly charge now until May. Councilmember McDaniel commented he feels it's unfair for City residents to be only able to take stuff to the county landfill four times a year. City Manager Turner said he will take care ofit. Councilmember Hightower thanked Councilmember McDaniel for bringing up the suspension of the trash fee. He reported several people had reached out to him about their utility bills and he thanked City Manager Turner for looking into them. Mayor Pro Claxton reported he also had giving a limb credit on his list and he thinks it will be well received. He noted he's receiving comments about speeding on Greenwood Street. Mayor Pro Tem Claxton reported the McIntosh Trail tenant was moving out and inquired about the planned use of the space. City Manager Turner reported they moved out on Tuesday to the Old Tag Office and he noted he hadn't decided yet on the use ofthes space. Councilmember McDaniel asked about the impact on losing the tenant. Mr. Turner noted there will be a loss of $2,300 per month. Councilmember Shropshire asked about the reason for the move by McIntosh Trail. City Manager Turner reported they felt since it was a county service that it would be better to be in a county building. Councilmember Shropshire reported he's received calls concerning the trash pickup and asked if the charge had been removed for those customers. City Manager Turner reported the charge was removed if they called. Councilmember Shropshire expressed concern about how removing the charge is going to affect the City. City Manager Turner said it will cut into the revenue. Councilmember McDaniel reported citizens have had to take trash to the landfill themselves at a cost of $15 per occurrence. Council discussed solutions to solving this problem. City Manager Turner said he would speak with Amwaste. PUBLIC COMMENTS Mrs. Kay Pedrotti announced the suspension of the trash fee will be the lead on her story, but she asked that an ad still be placed. City Manager Turner reported one was run this week, but he will put another in for next week. Ms. Dorothy Carter thanked the City for filling in the crater on Lee and Moye Street. On motion by Mayor Pro Tem Claxton and seconded by Councilmember McDaniel, Council unanimously approved the February 9, 2023 Regular Council Meeting minutes as circulated. Mayor Banks presented a proclamation recognizing and commending the Gordon State College Club Football Team for winning the national championship two consecutive years to Gordon State College President Dr. Nooks, Head Coach Kevin Baker, Player Devin Baker, and other staff. City Manager Turner gave the second reading of Ordinance No. 596 to rezone 24.97 acres at the National Guard Armory located at 408 Hwy 41 South for HFG Development. Councimember Shropshire made a motion to approve the rezoning and it was seconded by Councilmember Hightower. Councilmember Shropshire and Councilmember Hightower voted in favor of the rezoning and Mayor Pro Tem Claxton, Councilmember Sims, and Councilmember McDaniel voted against it. The vote was 2 to 3. Council did not approve the rezoning. Mayor Banks noted the variance request for the National Guard Armory, Resolution No. R2023- 0004, is mute due to the rezoning not being approved. City Manager Turner gave the: first reading of Ordinance No. 601 to approve the Job Description for the Chief] Finance Officer. On motion by Councilmember Hightower and seconded by Councilmember McDaniel, Council unanimously accepted the City Manager's recommendation to appoint Interim Chief of Police Belinda Penamon as the new Police Chief of the City of Barnesville. REPORTS Councilmember McDaniel reported he was pleased to learn the limb truck has been cleaned up and everything is going well in Ward 5. Councilmember Sims reported everything is going pretty good and the garbage is being picked up. Councilmember Hightower welcomed everybody and recognized Reverend Doctor Eddie F. Collier being present. He reported he's apart of the Georgia Municipal Association Inaugural Class of municipal leaders that's working on a diversity, equity, and inclusion project and the City will be holding several focus groups later this month. Councilmember Hightower expressed his appreciation of City staff Community Development Director Niki Sappington and E.P. Roberts Supervisor Yasheka Buckner who will be assisting with the focus groups. He asked the public to reach out to them ifthey wished toj participate. Mayor Pro Claxton reported he would like for the City to monitor the rat problem that's developed since the sewer project in the alleys on Main Street. City Manager Turner said he would stay on top ofit. PUBLIC COMMENTS Ms. Juanita Fletcher reported there is a pothole at the end of Atlanta Street and Annie M. Harris Drive. Ms. Sylvia Bush spoke in support of food trucks. Mayor Banks reported the City is preparing now a Food Truck Ordinance. Mr. Michael Rogers reported he first brought it to the Council's attention in 2019 the problem with abandoned cars. He said it is still a problem and there is trash still all over the City. Councilmember Shropshire suggested getting volunteers to help clean the City and he would have taken care oft the pothole on Annie M. Harris Drive if! he'd known about it. Ms. Dorothy Carter reported Keep Barnesville Beautiful has been revived under Mayor Bank's leadership. She said it needs community participation. Ms. Carter asked the Councilmembers to identify two people in each ward to come and help get the program started again and to encourage residents to keep it clean in their wards. Mayor Banks announced he was not going to be a candidate for reelection. He said he's served the City for 16 years and it's been a pleasure and he's loved mostly every minute. Mayor Banks said he appreciated everyone supporting him without opposition. Councilmember Hightower thanked Mayor Banks for his service. He reported he has already spoken with Beck, Owen and Murray and they have agreed to serve as temporary counsel for the City. After much discussion, on motion by Councilmember McDaniel and seconded by Councilmember Hightower, Council approved to temporarily appoint Beck, Owen and Murray as City Attorney for the purpose of answering a lawsuit and for other purposes. Councilmember Hightower and Councilmember McDaniel voted in favor of the temporary appointment while Councilmember Sims and Mayor Pro Tem Claxton voted against it. Mayor Banks broke the tie and voted for the appointment. The vote was 31 to 2. City Manager Turner read the election results from the March 21, 2023 Special Election where the retail sales and the package sale of alcoholic beverages on Sunday between the hours of 12:00 p.m. and 11:30 p.m. passed. Councilmember Hightower asked for clarification on the stop time for Sunday Alcohol Sales. City Manager Turner said the stop time is 11:30 p.m. on Sunday. Attached are the election results. Council heard the first reading of Ordinance No. 602 from City Manager Turner to amend the Alcoholic Beverages Ordinance to allow Sunday Alcohol Sales. Mayor Banks noted current Ordinance No. 449 prohibits Sunday sales. On motion by Councilmember Shropshire and seconded by Councilmember McDaniel, Council unanimously approved Resolution No. R2023-0007 to recertify the City of Barnesville as a City of Ethics with GMA. City Manager Turner reported to the Council on the status of the swimming pool and provided options and the costs to rehab the current pool, build a new pool, or place a Splash Pad. On motion by Mayor Pro Tem Claxton and seconded by Councilmember Sims, Council unanimously approved to put a Splash Pad where the current pool is. REPORTS Councilmember McDaniel asked for someone to look into the sewer line location and sewer overflowing at Dr. Tuttle's house. Mayor Pro Tem Claxton added since the heavy rain, sewer has been coming up at Dr. Tuttle's behind the Harrell Circle homes. City Manager Turner said he would look at it. Councilmember Sims requested assistance to help the Boy Scouts clean up debris. He asked about the status ofthe pallet company: and reported Lee Street is in bad shape. Councilmember Hightower reported he'd received information on Westchester being a natural water site. He thanked the City Manager, the City staff, and the City for sponsoring Craig A. Ogletree Day. Mayor Pro Tem Claxton commented it was a wonderful event. Mayor Pro Claxton thanked the City Manager for opening up the street projects again and he added Holmes, Elm, Lee, and Byrd Street to the paving list. He stated he appreciated the City Manager revisiting thej projects. Councilmember Shropshire stated he wanted to have something to recognize Henry Murphy for all he did at the Recreation Department. He reported he'd received a call about the trash on Railroad Street and it has been addressed. PUBLIC COMMENTS Ms. Kay Pedrotti clarified the Splash Pad doesn't require lifeguards and asked about supervision. City Manager Turner reported a city staff member will be present and for certain ages, parental presence will be required. Councilmember Hightower presented a proclamation to Dr. Kirk Nooks honoring his service as President of Gordon State College from June 1, 2018 to May 19, 2023. Fire Chief Chute recognized newly appointed Fire Lieutenant Josh Campbell. He: noted Campbell is the first in 150 years to be appointed the first paid fire lieutenant in the City's history. Council heard the second reading of Ordinance No. 602 from City Manager Turner to amend the Alcoholic Beverages Ordinance to allow Sunday Alcohol Sales for both the retail sale and sale by the drink ofr malt beverages, wine, and distilled spirits on Sundays between the hours of 12:00 p.m. and 11:30 p.m. On motion by Councilmember Sims and seconded by Mayor Pro Tem Claxton, Council unanimously approved Ordinance No. 602. City Manager Turner stated it can begin this Sunday. City Manager Turner: read Resolution No. R2023-0009, a Sewer Moratorium. He said the Council has been discussing sewer problems for a while and the city engineers have asked for this due to the City's failing sewer infrastructure. On motion by Councilmember McDaniel and seconded by Councilmember Hightower, Council unanimously approved Resolution No. R2023-0009 imposing a 6 month moratorium on the acceptance of applications for new connections to the sewerage collection and treatment system oft the City of Barnesville. Councilmember McDaniel clarified this applies to homes as well. Mayor Banks recognized Dr. Bridgette Wright who resides at 219 Jenkins Street. Dr. Wright addressed the Council and reported drainage problems on Jenkins and 3rd Street that have been affecting her property since 2020. She reported severe structural and mold and mildew damage to her residence and asked that something be done. Director of Utilities and Public Works Vereen reported the City is getting with the engineers to address her problems. City Manager Turner added the city engineers are coming to see how to reroute the water in the next 2 weeks. Mayor Banks recognized Ms. Mary Rooks who resides at 650 Forsyth Street. Ms. Rooks reported having dirty, brown, and muddy water problems for years and asked for some resolution from the Council. City Manager Turner responded the Water and Sewer Superintendent and the ESG Manager for the Water Treatment Plant and Sewer Treatment Plant have all been to her house and tested her water and it is clean. He said there is something going on between her house and the meter. Mayor Banks noted the: responsibility ofthe City is to the meter and beyond is the citizen. REPORTS Councilmember McDaniel thanked the Chamber, Fire Department, and Police Department for the job done on the BBQ & Blues Festival. He reported Redbud Drive and Pine Street are in bad shape. He reported the Depot water fountain looks great, but we need to work on the Dog Park and the white concrete street markers need to come down. Mayor Pro Tem Claxton thanked the road crew for the Greenwood Street repairs. He reported on all the renovations going on downtown and he encouraged everyone to go down and see what's going on. Mayor Pro Tem Claxton thanked the First Baptist Church for the Relay for Life. He requested an update on the Splash Pad and limb truck for Councilmember Sims in his absence. City Manager Turner replied that a deposit has been made and the materials have been ordered on the Splash Pad andi he will be meeting with the contractor soon for guidance on filling the pool. He reported the limb truck is scheduled to be here this month. Mayor Pro Tem Claxton commented the City needs to be thinking about how it's going to police the parking for the current and coming loft apartments. Councilmember Shropshire asked for an update on Mr. Henry Murphy. City Manager Turner reported he has done the design, but he wants him to look at it. Councilmember Shropshire asked the City Manager to contact Mrs. Marge Virden by tomorrow to discuss her concerns. She encouraged the City to get the Splash Pad and she reported she has spoken with the Chamber and Library about doing movies for the kids for the summer. Community Development Director Sappington reported the conceptual plan has been completed, but it has to be converted to the engineering plan. She discussed the homelessness issue affecting 45 students and expressed the need for more housing in Lamar County. Chief Penamon informed the Council of the recent Police Department promotions that have been made from five interviews conducted on May 24" within the department with her and Chief Flowers of the Gordon State College Police. She reported the three highest ranking officers were selected. Lieutenant Ernie McWhorter was promoted to Captain over Operations, Sergeant Michael Rainer was promoted to Lieutenant in Investigations, and Sergeant Michael Blankenship was promoted to Lieutenant over Patrol. Chief Penamon said they will be pinned on July 124i. With all three officers present, Council congratulated them. REPORTS Councilmember McDaniel expressed kudos to City Manager Turner and the road crew for the great paving job on Redbud Drive and the good patch work job on Memorial Drive. He said the paving done on Memorial Drive and Atlanta Street should be used as the standard. Councilmember McDaniel reported Spencer Street needs work. He reported his takeaway from the Savannah Conference was the big push to promote the Mayor's reading program due to the fact that in the State of Georgia, 68%, 6 out of 10 4th graders can't read. Councilmember McDaniel said he signed up to receive a packet to be used in conjunction with the library's program. He reported at 304 Spencer Street, the City is waiting on a report from the engineers and Mr. John Bennison, the owner of the property, is here tonight. Councilmember McDaniel stated we need to do whatever we can to help him address the run off issues there and get with the engineers and come up with some recommendations. Councilmember Sims stated he'd like to see all elections at one place instead of two when City and County elections are held on the same day. City Manager Turner said he is looking into it. Councilmember Sims also asked for an update on the Splash Pad. City Manager Turner reported a portion of the total cost has been paid and the parts have been ordered. He further reported the bottom of the current pool will be saw cut and next week, they will start filling it and the piping willl be run the last of August or the beginning of September. Councilmember Hightower thanked the City Manager for his response to his Ward 2 concerns. He asked the City Manager for aj paving report on the order of resurfacing and paving of streets. City Manager Turner replied the Director of Utilities and Public Works will work on the report for him. Councilmember Hightower reported the Savannah GMA Convention was great again and he learned a great deal that he looks forward to sharing hopefully at the Council's Fall Retreat. Mayor Pro Tem Claxton commended the paving on Forsyth Street. He said Savannah was also a good trip this year where he received recognition on his training hours. Mayor Pro Tem Claxton officially announced he's running for reelection this year. He said we've made a lot of good progress and we have a good conducive Council. He also said we have a long way to go and a lot of work ahead of us and he looks forward to those challenges. Mayor Pro Tem Claxton thanked everyone for allowing him to be a part ofthis group. Councilmember Shropshire asked for an update on Mrs. Marge Virden. Director of Utilities and Public Works Vereen reported he spoke to her three weeks ago and the ditch will be dug out on Wednesday. Councilmember Shropshire commented that he received some good training in Savannah where he learned a lot. He also announced he will be running for reelection as well for Ward 3. Mayor Banks reported the Savannah Conference was good and he really enjoyed the fellowship with the Council. He commented Atlanta Street is progressing and looking prettier each time he goes by. He expressed he appreciated Ward 2 constituents communicating with him. Councilmember Hightower recognized The Play Pen Sport Bar whose owners were present and commented on it drawing attention and crowds downtown. Mr. Vince Gilmore and Mrs. Tomika Duffey commented they saw a great need to bring their business to Barnesville, a good, family oriented City. They said they expect to be here as long as the City will have them to create a great atmosphere. Mayor Pro Tem Claxton welcomed Mr. Gilmore and Mrs. Duffey and he also said it looks like their business has brought a lot of activity downtown. He commented on the Relay for Life event at the Womens Clubhouse, the Reverse Raffle, and the new owner at 211 (B) Main Street. Mayor Pro Tem Claxton asked for an update from the City Manager on the Recycling Center. City Manager Turner reported we're cleaning it up and moving the Street Department to the Recycling Center. Mayor Pro Tem Claxton reported on the power lines on Elm and Zebulon Street. Councilmember Shropshire also welcomed The Play Pen owners to Barnesville. He asked for an update on Henry Murphy. City Manager Turner reported he has received the picture and scanned it into digital. He said he is ready for Councilmember Shropshire to come by to review it. Councilmember Shropshire also reported several Mill Street residents have come to him concerning the trees. Mr. Shropshire reported he's received complaints of dead and overgrown trees and that no one is doing anything about it. City Manager Turner reported the City has taken up the concrete squares around several of the trees and the dead ones are going to be taken down. PUBLIC COMMENTS Ms. Dorothy Carter commented on the workforce that Councilmember McDaniel mentioned in his report on Three Rivers. She reported Carlee Robinson is the youth facilitator that helps with ages 161 to 24 and Kevin Williamson is the contact for bus services that employees the youth. Mrs. Kelly Hughes thanked Electric Superintendent Jami Copeland and the City for their quick response in cleaning up a fallen tree on Collier Road. She asked for an update on the SPLASH Pad and said she can get volunteers to help clean up. Mayor Banks and City Manager Turner reported it will be in by the end of the month or the first of September. Mrs. Hughes asked who do you contact to hold an event at the fountain or Womens Clubhouse. City Manager Turner responded any City facilities available for rent will go through Civic Center Manager Felicia Vereen. She also reported there are some signs leaning and asked if these can be straightened up with Buggy Days coming. Mr. Turner asked if she can give him a list and he said they will be repaired by William Perdue. A citizen inquired about the City having its own fireworks display for other holidays besides Buggy Days. Mayor Banks reported there is one this year that will be in the Gordon State College parking lot. Mayor Pro Tem Claxton asked about renting the Depot Fountain. He said an individual has rented it for October, November, and December which prevents other organizations from using it. Mr. Claxton said as a Council, we need to look at and address this in the future. City Manager Turner reported there is no use limit on the application, but he will meet with Felicia Vereen and Niki Sappington to change the form. A citizen inquired ifthere is a time period for the repairs on the alley behind Main Street and what happened to the music downtown. City Manager Turner responded there is no time period for the repairs and the downtown music was pulled because of complaints. Mayor Pro Tem Claxton requested for the downtown music to be: restarted. Ms. Wanda Brothers of 315 Redbud Drive stated she has reached out to Councilmember McDaniel about the empty lot next to her property. She inquired about the procedure for issuing building permits. Mayor Pro Tem Claxton abstained from voting due to him having to leave the meeting early. City Manager Turner gave the first reading of Ordinance No. 603 to adopt the 2023-2024 Operating Budget, set the 2023 Ad Valorem Tax Rate at 3.067 mills, and amend the 2022-2023 Operating Budget. City Manager Turner gave the first reading of Ordinance No. 604 to adopt the 2023 Schedule of Fees, Charges and Rates. Councilmember Hightower inquired if the fees are posted for the public to view. City Manager Turner responded they are not, but the public can come by City Hall and request a copy. Mr. Hightower noted these were discussed at the Budget Workshop and they don't include the Parks and Facilities Fees. He also inquired of the effective date of the new fees. City Manager Turner said October 1, 2023. REPORTS Councilmember McDaniel thanked City Manager Turner for the Carter & Sloope report on the Spencer Street property. He asked for an update on the Redbud Drive lot next to Wanda Brothers. City Manager Turner reported they were able to clear the lot and they will be using a septic tank. He further reported Director of Utilities and Public Works Vereen had looked at the pipe and said it was clear. Councilmember McDaniel reported the limb truck missed him last week and he inquired if there were any issues. Mr. Turner acknowledged he had been missed due to a new driver and they will get caught up this week. Mr. McDaniel complained about loud mufflers and he said he didn't think we were issuing citations or tickets. City Manager Turner said he would talk to Chief Penamon about this. Councilmember Sims asked for an update on the Food Truck and Short Term Rentals Ordinances. City Manager Turner reported they have been written and the attorney has reviewed the Short Term Rentals and he said it looks good. He reported the Food Truck Ordinance is being reviewed now by the attorney. Councilmember Sims reported the trash and limbs on Gordon Road are looking awful again. He inquired if any parking permits have been issued yet. City Manager Turner reported none have been issued, but they will be issued at the same time when the Collier Building is completed. Mr. Sims expressed concern about the manhole risers on Redbud Drive. Director ofUtilities and Public Works Vereen said he's already done what he could do. Councilmember Hightower reported he has spoken with City Manager Turner about several requests and he thanked him for having responded. He reported there have been household goods out on Johnson Street for three weeks and he asked for them to be picked up. Councilmember Hightower thanked City Manager Turner and Director of Utilities and Public Works Vereen for following up on the requests of Ward 2. Mayor Pro Tem Claxton reported he'd met also with the City Manager. He reported the contents from the Summers Field two story apartments have been moved on City property and he'd like this cleaned up and to make sure it doesn't happen again. City Manager Turner said he'd take care ofit. Councilmember Shropshire said to make sure there is a loud noise ordinance in the Food Truck Ordinance. He also said he appreciated the update on Mr. Murphy. Councilmember Shropshire told Director of Utilities and Public Works Vereen he appreciated him coming out to talk to his constituents. He asked for an update on the Mill Street trees discussed last month. City Manager Turner reported they have identified the dead ones and they will be taken down after Buggy Days. Mayor Banks thanked everyone for their prayers after having a heart attack last month on his 851h Birthday. He reported he was back now and doing pretty good. PUBLIC COMMENTS Ms. Jane Huguely said she had come before the Council two months ago and asked about the subdivision down by Dr. Fuller's Office. She said now she's learned about a new subdivision in the Aldora area and asked ifi it was going to be anything like College Manor which she said is not a plus to the City and Harrell Circle suffers for it. Ms. Huguely said the same people planning the two subdivisions are the same ones who did College Manor. She asked the City to look into it and to stop them if they're shady. Councilmember McDaniel clarified Aldora is not in the City and Aldora has its own Mayor. City Manager Turner and Mayor Banks explained about the Grove Street subdivision. Ms. Huguely expressed she doesn't want to see them change Barnesville because it is a great place to live and work. Ms. Debbie Cone complained about the overgrowth on both sides of the double bridges on Veterans Parkway and inquired who takes care of these areas. Director of Utilities and Public Works Vereen reported part of it is the Department of Transportation (DOT) and the other part is the City. He said he will try to get in touch with the DOT. Ms. Cone also complained about the trash on Brown Street and Johnson Street and she asked for a no dumping sign to be put up. She asked for the ditches to be cleaned out completely and the bamboo cut back or cleared on Woodruff Avenue. Ms. Cone also reported at the Atlanta Street bypass at the triangle area going north pass Hot Shot, iti is dangerous here and it needs to be addressed. He thanked Chief Finance Officer York for all her hard work. He said the City's financial statements are fairly presented in all respects. Mr. Irvin reviewed all three funds and reported they are all in good standing. Councilmember McDaniel asked Mr. Irvin ifit is typical to transfer funds from the Electric Fund to the other funds. Mr. Irvin responded it is and Mr. McDaniel noted Mr. Irvin has confirmed that this is a good thing. City Clerk Folson read into the record the Notice of Election Cancellation from the Lamar County Board of Elections and Registration which noted the November 7, 2023 General Election for Mayor has been cancelled due to no opposition against Mrs. Kelly G. REPORTS Councilmember McDaniel thanked City Finance Officer York for the tremendous job done on the audit and for all her hard work and dedication. Hei reported he had asked City Manager Turner last week about the overgrown trees on College Drive adjacent to Mayor Pro Tem Claxton's mother's house that's making it difficult to see when coming out. Councilmember McDaniel also reported he had spoken to the City Manager about the property on Spencer Street and the engineering report is back. He said Mr. Bennison called him today and asked what's the City's position and what is the City proposing. Councilmember Sims reported there is a lot of debris not being picked up by the limb truck on Collier Road in front of Ms. Jill's old daycare that has been sitting out for two months. He requested that it be cleaned up. Councilmember Hightower extended prayers and thoughts to the City Manager. He publicly thanked the City's Public Works staff for cleaning up and restoring the City after Buggy Days and Homecoming. Councilmember Hightower asked for the record if the City engaged in cleaning up any private property during these activities. Director of Utilities and Public Works Vereen responded the City is only responsible for cleaning the right-of-way which is the back side of the sidewalk to the road. Councilmember Hightower added he has communicated Ward 2 concerns with the City Manager and Mr. Turner and Mr. Vereen have responded. Mayor Pro Tem Claxton reported he has spoken to City Manager Turner about the paving priorities in Ward 1 and workshop topics. He said Mr. Turner has his list and City Manager Turner has been very attentive in taking care of the repairs. Councimember: Shropshire thanked Director of Utilities and Public Works Vereen for the completion of the Jackson Street project. He reported two lights out on Northside Village. Allen-Smith Consulting was the only submission received for Grant Witing/Administration Services on the 2024 Community Development Block Grant (CDBG). Community Development Director Sappington responded to questions from Councilmember McDaniel, Councilmember Shropshire, and Mayor Pro Tem Claxton about the CDBG process. On motion by Mayor Pro Tem Claxton and seconded by Councilmember Shropshire, Council unanimously approved Allen-Smith Consulting for Grant Witing/Administratiye Services for the 2024 CDBG. City Manager Turner reported the City received four submittals for Engineering Services for the 2024 CDBG. He recommended Carter & Sloope. On motion by Councilmember McDaniel and seconded by Mayor Pro Tem Claxton, Council unanimously approved Carter & Sloope for Engineering Services for the 2024 CDBG. City Manager Turner reported the sewer infrastructure is still in bad shape and under advisement of the Environmental Protection Division and our engineers, he recommends the sewer moratorium be extended until May 2024. Mr. Turner said the engineers are due to come and speak with the Council directly in the middle of first quarter. City Manager Turner read Resolution No. R2023-0011 to extend the sewer collection moratorium. Council discussed the sewer collection moratorium. City Manager Turner stated he doesn't feel comfortable letting anyone onto the system due to its current state. On motion by Councilmember McDaniel and seconded by Councilmember Shropshire, Council approved to extend the sewer collection moratorium for 6 months in light that it can be ended at anytime after meeting with the engineers ift they deem the sewer system fine and stronger. The vote was 4 to 1. Mayor Pro Tem Claxton, Councilmember Hightower, Councilmember Shropshire, and Councilmember McDaniel voted in favor and Councilmember Sims voted against extending the sewer collection moratorium. REPORTS Councilmember McDaniel thanked City Manager Turner on the work done on the bridge on College Drive. He reported it may need additional work because of the limbs up in the line, but it looks better. Councilmember Sims asked the City Manager to look at business licenses for people who live in the City, but they don't own their houses. He: requested this to be added to the workshop agenda. Councilmember Hightower thanked the City Manager and the Director of Utilities and Public Works for attending to Ward 2 concerns and beyond Ward 2. He said he appreciates the Chief of Police and City Clerk for always responding to his requests. Councilmember Hightower recognized Mr. Graham Adamson, a senior at Lamar County High School and dual enrolled student at Gordon. He inquired about the lights out on Northside Drive and asked for a timeline for repairs. Director of Utilities and Public Works Vereen gave an update on the lights. PUBLIC COMMENTS Mrs. Kay Pedrotti thanked the City for its assistance in helping fix the plumbing at Lamar Arts. Ms. Jane Huguely encouraged all the Councilmembers to support the City Manager to get the sewer problems fixed. She said the City was doing a goodj job on this. Mayor Pro Tem Claxton inquired on the latest cost estimate to fix the sewer system. City Manager Turner said $25 million. Mr. Claxton said it is extremely expensive and it will take time. Councilmember McDaniel said the sewer system is 100 years old and he said we will need to come together with the County, the State, Beth Camp, and Marty Harbin for assistance. Mr. McDaniel agreed the City Manager has done an excellent job with the phase approach to repairing the sewer system. Ms. Sylvia Bush inquired about city facilities and asked for the City to be more informative on whom to talk to about them. City Manager Turner explained the City has lead and copper issues. Mr. Turner said the City reached out to ESG and they secured the funds. He reported he asked ESG's engineer to come and explain the lead and copper issues to the Council. Mr. Trey Gavin, managing partner of ESG engineering, and Ms. Chelsea Fallin of ESG addressed the Council. He gave a presentation on the lead and copper issues, EPA requirements, and the City's program to identify all the lead and copper lines and then implement a system to replace them. He said the inventory deadline is October 16, 2024. Mr. Gavin said all reimbursement will come from GEFA. Mayor Banks thanked Mr. Gavin and called for questions from the Council. Councilmember Hightower asked who will send out the mailers, will there be prior communication to the customers, and what will be the cost to our customers. Mr. Gavin responded education of the public is extremely important. He added either ESG or the City can send the mailers or brochures and there will be no cost to the customers. City Manager Turner said the City will send out notices in the bills, post them to the website, and place an ad in the newspaper. Mayor Pro Tem Claxton asked will the City personnel or ESG do the work. City Manager Turner and Chief Finance Officer York said the ESG will do the work. Mr. Gavin added ESG will be the umbrella over everything. Councilmember McDaniel asked if this obligated the City beyond $159,000. City Manager Turner said this is a loan forgiveness sO we don'tl have toj pay it back. City Manager Turner said this resolution is asking the Council for approval to get $159,000 for doing the inventory. He reported the City has partnered with 120 Water to get the inventory list done. City Manager Turner said the City has no choice, but to get this done or risk being fined by EPD. Chief Finance Officer York reported the City has 4,600 water customers and they have been working on thei inventory and the list is down to 2,200 remaining to inventory. She said if the City doesn't get help, the Water Department will have to be pulled from their regular jobs. Mrs. York said this money is just to get the inventory. Councilmember McDaniel stated the plans look great, but he has some concerns about liability and safety. He inquired ifa approved, would the City be liable. Mayor Banks said the City would not be liable and he doesn't see a problem with the request. Councilmember McDaniel and Mayor Tem Claxton asked several questions regarding the plans. Councilmember Hightower said Dairy Queen is in Ward 2, he's proud of Dairy Queen, and he's glad they are remaining in the City. He commented they are helping to make Barnesville "The Greatest City." Councilmember Hightower stated he appreciated Councilmember Sims going and looking at the property and the owners of Dairy Queen for answering the Council's questions. He concluded he supports this application for a variance and he looks forward to their continued success in Ward 2 and Barnesville. Councilmember Sims clarified what Councilmember Hightower was referring to. He said before this morning, he was totally against the request, but he went and looked at the property and his concerns went away. Mayor Pro Tem Claxton also expressed his support to approving the variance and he said he was proud to have the owners here in Barnesville. CITY OF BARNESVILLE COUNCIL PROCEEDINGS December 4, 2023 Council met at 5:30 p.m. on Monday, December 4, 2023, in the Courtroom at 100 Mill Street in Barnesville, Georgia. Mayor Peter L. Banks called the meeting to order at 5:30j p.m. Councilmember Sammie D. Shropshire, Jr. opened the meeting with prayer. MEMBERS PRESENT Mayor Peter L. On motion by Mayor Pro Tem Claxton and seconded by Councilmember McDaniel, Council unanimously approved the following minutes as circulated. November 6, 2023 Regular Council Meeting November 21, 2023 Special Called Meeting November 21, 2023 Council Workshop Mayor Banks called on Mr. Bill Thornton with the Georgia Municipal Association (GMA). Mr. Thornton thanked everyone for their service to the community. He reported there are 500 new elected officials and 70: new Mayors in the State of Georgia. Mr. Thornton stated GMA is here to support cities and it is our organization and it only exists to serve cities. He thanked the City for its active engagement. Mr. Thornton stated he was here tonight to pay tribute to Mayor Banks with this being his last meeting and as he winds up 16 years as a remarkable public servant. He thanked Mayor Banks for what he has done for GMA through serving on various committees.. Mr. Thornton said Mayor Banks is a statesman, selfless, kind and gracious, civil, a role model, and a real pleasure to work with. He presented a Certificate of Distinguished Public Service to Mayor Banks for 20 years of service, 4 for the State Senate and 16 for the City of Barnesville. City Manager Turner presented the results from the General Election held on November 7, 2023. For Mayor, Kelly G. Hughes was unopposed. For Councilmember Ward 1, William Claxton received 126 votes and Christopher J. Deraney received 41 votes. For Councilmember Ward 3, Andreas Romero received 44 votes and Sammie D. Shropshire, Jr. received 103 votes. City Manager Turner gave the second reading of Ordinance No. 605 to amend Section 635, Central Commercial District (C-1), of the Zoning Ordinance to permit and add Mobile Food Service Units. Councilmember Hightower inquired if food trucks are allowed at city approved events at the park. City Manager Turner confirmed they would be allowed. On motion by Councilmember Shropshire and seconded by Mayor Pro Tem Claxton, Council unanimously approved Ordinance No. 605. Councilmember Hightower asked for clarification that the trucks that have been operating will need a permit and pay an annual fee. City Manager Turner confirmed this is correct and it will be issued after it is verified they have a Department of Health certificate and their home base has been identified. Mayor Pro Tem Claxton asked for clarification on the effective date. City Manager Turner confirmed it will become effective tomorrow, December 5, 2023. City Manager Turner gave the second reading of Ordinance No. 606 to amend the 2023 Schedule of Fees, Charges and Rates. On motion by Councilmember McDaniel and seconded by Councilmember Sims, Council unanimously approved Ordinance No. 606 and set the Mobile Food Service Unit permit fee at $125. City Manager Turner gave the first reading of Ordinance No. 607 to change the Council Meeting time. City Manager Turner gave the first reading of Ordinance No. 608 to amend Section 46-1 of the City of Barnesville Code of Ordinances and revise the Grass Ordinance. REPORTS Councilmember McDaniel congratulated Mayor Pro Tem Claxton and Councilmember Shropshire on their reelection and welcomed unopposed Mayor Elect Kelly Hughes to the Council. Councilmember McDaniel reported he has spoken to the City Manager about a street light out between 326 and 328 Pine Street. City Manager Turner said a work order has been submitted. Councilmember McDaniel asked that an update be given to Mr. Bennison on Spencer Street. City Manager Turner reported the City is going toj put a culvert and clean out the ditch in January and he said he will call Mr. Bennison tomorrow. Councilmember Sims expressed it's been an honor working with Mayor Banks. He thanked him for his service. Councilmember Sims said everything is looking good and we're slowly getting where we need to be. Mayor Pro Tem Claxton wished best wishes to the Mayor and said he is the ultimate gentleman. He said even though they have not always seen eye to eye, they have been able to work together and get things accomplished. Mayor Pro Tem Claxton thanked those who supported him and he congratulated Councilmember Shropshire on his reelection and Kelly Hughes on her election. He reported City Manager Turner and the city crews have been very responsive in picking up dead animals. Mayor Pro Tem Claxton said it was good to hear from Building and Zoning Administrator Mike Aiken that the City is taking action on abandoned cars in Ward 1 and the other wards. He commented on the sewer work being done in town. Director of Utilities and Public Works Vereen and City Manager Turner reported they're using cameras in the lines and smoke testing to see what lines need fixing. Councilmember Shropshire asked Director of Utilities and Public Works Vereen for an update on Northside Village. Mr. Vereen reported the Electric Department has been tied up, but it's on their schedule to repair. Councilmember Shropshire said it's been a pleasure working with Mayor Banks even though they haven't always agreed on everything. He said he highly respects Mayor Banks and his view point and he feels he has done a wonderful job. Councilmember Hightower stated it has been an honor and pleasure to work with Mayor Banks. He said he's been a mentor to him and motivator to make our City "The World's Greatest City." Councilmember Hightower said Barnesville and Peter Banks go together and are one. He thanked the Mayor for his service. Mayor Banks stated tonight is bittersweet and he loves the City. He said he appreciated the work this Council has done over the years and they're still friends and have worked through issues and have gotten a lot oft things accomplished. Mayor Banks said one of the highlights ofl him being Mayor is our City is beautiful especially the park. He told Mr. Thornton he appreciated the certificate. Mayor Banks said farewell to all and he thanked them for their friendship. To Chief Penamon, he commented they need to pay more attention on the loud mufflers. He thanked City Manager Turner and the staff for all they do for the City and added they do a great job and he knows how hard they work and they always come through with flying colors. PUBLIC COMMENTS Mayor Elect Kelly Hughes thanked Mayor Banks for his service and expressed her appreciation for what and all he's done. She said he's leaving a legacy. Mayor Elect Hughes said she looked forward to working with everyone. Mrs. Kay Pedrotti said she's met a lot of Mayors and has been a reporter for 50 years, but Mayor Peter Banks has always been humble, kind, and never said no. Mr. Dooly Barber congratulated Mayor Banks on his retirement and said he hoped he'd have many successful days. He said he was a good Mayor and worked with everyone. Mr. Barber said he hopes andj prays Kelly will follow the same footsteps. Mr. Dee McLeroy said he's got some apartments on Grove Street and Highway 41 and he would like sewer to put in 60 more townhouses. He said he's willing to share the costs. Mr. McLeroy also said congratulations. After no further business, on motion by Councilmember McDaniel and seconded by Councilmember Shropshire, Council unanimously adjourned at 6:08 p.m. Peter L.
