CITY OF BARNESVILLE PUBLIC HEARING January 3, 2022 Council met at 5:00 p.m. on Monday, January 3, 2022, in the Courtroom at 100 Mill Street in Barnesville, Georgia. Mayor Peter L. Folson City Accountant Tammy York Fire Chief Kelvin Chute Chief of Police Craig Cooper ACTION TAKENBY COUNCIL Mayor Banks stated the first order of business was to present Application #21-11-001 to rezone properties owned by Trice Funeral Home Inc. The properties are located at 147 Mill Street and 149 Mill Street. The properties are in Ward 3 and are currently zoned R-1B, Single-Family Residential, Low Density District to be rezoned C-4, Highway Commercial District. Acting City Manager Turner explained Trice Funeral Home at 147 Mill Street wants all three of its parcels zoned the same to expand the business. He gave the first reading of Ordinance No. 586. Mayor Banks asked if there were any questions about the rezoning. There were no public comments. Mayor Banks stated the second order of business was to present Application #21-11-002 for a variance request by Zach Westerfield with Southern Venture Partners to reduce the minimum floor area per dwelling unit and to increase the non-commercial use oft the first floor at 215 Main Street. Thej property is in Ward 1. Acting City Manager Turner read Resolution No. R2022-0001. Mayor Banks introduced Mr. Westerfield and he presented his variance request to the Council. He stated he purchased the property last month, but it's been in the planning phase for five months and he plans on holding and owning it long term. Mr. Westerfield further stated it is listed as a historic building on the registry and he would like to bring the storefront back to or close to the original. He discussed his company and the floor plan and stated two commercial areas and three apartments units would be maintained downstairs and four apartments upstairs. Mr. Westerfield asked for the square foot minimum to be reduced from 650 to 370. He said he's proposing high end downtown apartments that cater to young professionals and not college students. Mr. Westerfield stated he's asking for two variances to make the project financially viable. Mrs. Kay Pedrotti inquired about the rental price and Mr. Westerfield responded the rent will be based on the current rate of a one bedroom in the area. Chief of Police Craig Cooper asked about parking. Mr. Westerfield reported he was working to lease the parking lot across the street from United Bank. Ms. Dorothy Carter told Mr. Westerfield she appreciated his vision and asked about the size of the apartments. He reported they range in size from 450 to 500 with 357 being the smallest. Mr. Westerfield clarified only downstairs would be in ADA compliance. He noted trash pickup would be in the alley. Councilmember Sims reported every commercial business downtown is opposed to the variance except one and he is opposed to it too because of the parking and fire hazards. Mr. Westerfield said he is working with Fire Chief Chute to make sure hei is compliant with the code in addressing any fire hazards. Councilmember Claxton stated he owns seven storefronts downtown and he doesn't see too many people wanting to spend money downtown. He said parking is an issue and it may be time to address the rules and regulations about parking. Councilmember Claxton noted in Forsyth, residents live downtown and it adds a different dimension. He said in the evenings here, it's dead downtown and there' s not a lot going on. Councilmember Shropshire commented he didn't know any where that allows apartments downstairs on the lower street level in its downtown. Councilmember McDaniel asked Acting City Manager Turner what the variance is for and if a zoning change is going to be made on a resolution. Mr. Turner clarified the City already has a loft apartment ordinance: and Mr. Westerfield is asking for less than 50% ofthe building floor plan be for commercial use. He also noted there is no zoning change because multifamily is already allowed in the commercial district. Mayor Pro Tem Hightower thanked Mr. Westerfield for his presentation and his vision for the City of Barnesville. Mr. Hightower asked if he's put similar projects in commercial areas. Mr. Westerfield said this is his first in a commercial area, but he has in residential areas. Mayor Banks also thanked Mr. Westerfield for his presentation and stated he was personally in favor oft thej project. Acting City Manager Turner read Resolution No. R2022-0001 again. On motion by Councilmember Claxton and seconded by Mayor Pro Tem Hightower, Council granted the variance for 215 Main Street with a vote of 4 to 1. Councilmembers Claxton, Hightower, Shropshire, and McDaniel voted in favor of the variance and Councilmember Sims voted against it. Mayor Pro Tem Hightower noted Mr. Irvin Trice wasn't present when his rezoning request was heard earlier and he asked he be allowed to speak at this time if he desired. Mayor Banks asked Mr. Trice if he had any comments. He said he had no comments. Shropshire, Jr. as the 2022 Mayor Pro Tem. REPORTS Councilmember Sims reported he has a list of street lights that are out and he will get with Acting City Manager Turner about them. Councilmember Hightower thanked the constituents of Ward 2 for contacting him with their concerns and expressed his appreciation of the City administration and Acting City Manager Turner for always addressing and taking care of his concerns. He reported he's excited about resuming the King Celebration Ecumenical Service this year which will be held the third weekend in January on Sunday. Councilmember Claxton reported his pleasure in seeing an improvement on the trash pickup, Greenwood Street looking considerably better, and the truck operating better. He also reported he's received positive comments from the residents on Greenwood Street also regarding this issue. Mayor Pro Tem Shropshire reported he spoke with his constituent Dorothy Carter today about her concerns with the E.P. Roberts Center that she has already brought before the Council and feels haven't been addressed. He reported some of her concerns they discussed were about the cleanliness of the facility, things not happening like they should, and the staff doing what they're supposed to do. Mayor Banks reminded the Council executive session is confidential and not for public discussion. He also reported he's trying to do some more clean up with Dorothy Carter and he will be putting a letter about littering in the utility bills. PUBLIC COMMENTS Ms. Kay Pedrotti reported there will be a members meeting to change officers via Zoom and at the Depot on Friday, January 7th, from 6:00 p.m. to 8:00 p.m. Ms. Dorothy Carter said she has already addressed clean up at the E.P. Roberts Center with Community Development Director Niki Sappington and Acting City Manager Tim Turner. She said her concern is with the programs. Ms. Carter noted a letter from the NAACP was given to the Council on November 1 and she asked that they read it and put it on the agenda to hire a Program Director to address clean up of the facility and provide programs and activities for the youth and families. She thanked the Council for the work done on the building and for the new roof and appliances. Councilmember Hightower informed Ms. Carter the Council is in the process of having a Council retreat where they will discuss major projects. Mr. Hightower asked for the opportunity to address her concerns at the retreat in February. Ms. Carter stated another concern is that she hopes the Council makes a decision on Tim Turner soon. She said it's good he lives here and know what's going on and he needs to be made City Manager instead of Acting City Manager. Napier who recently retired on January 31, 2022 after 38 years with the City. On behalf of him and the Council, he thanked her for her service. Acting City Manager Turner read the Black History Month Proclamation. On motion by Mayor Pro Tem Shropshire and seconded by Councilmember McDaniel, Council unanimously approved the proclamation. Mayor Banks presented it to Mr. Dooly Barber. Acting City Manager Turner gave the second reading of Ordinance No. 586. Mayor Banks recognized Mrs. Fran Boggs. Mrs. Boggs said she was here representing herself and several residents of Harrell Circle about their concerns on College Manor. She complained about noise, environmental, and easement concerns. Mrs. Boggs reported they were told there were suppose to be a green space, a fence or sound barriers, and road maintenance. She said they are concerned also about a loss of privacy and diminished property values. She thanked Acting City Manager Turner and Building and Zoning Administrator Aiken for being very responsive to their concerns. Mrs. Boggs reported all of the 39 lots have been converted to rentals for single family occupancy and are now owned by two companies out of Franklin, TN and Jackson, GA. She said they are asking for help from the City to: resolve their concerns and they would like some assurance that Gordon students and Section 81 Housing or HUD will not be allowed. Mayor Banks responded Section 8 Housing is a federal program and it is not going to happen. Building and Zoning Administrator Aiken agreed with the Mayor and added Section 8 is not handled through our housing authority. Mayor Banks noted the owners would still have to follow our zoning requirements. Councilmember McDaniel stated in the future, the City can issue a moratorium on built to rent neighborhoods. Councilmember Claxton added nothing can be done about what's happened in the past, but it can in the future with HB 1093. Councilmember McDaniel also said we as a City will be able to hold the renters in the neighborhood to the same stringent regulations as in your neighborhood and although HB 1093 protects the corporations building built to rent homes, they will be held to the same zoning requirements too. Several other unidentified residents also voiced their concerns against College Manor regarding fencing, tree planting, drainage problems, and poor planning. REPORTS Councilmember McDaniel reported he's done a lot of research on built to rent housing and it is going to be a mess. Councilmember Sims noted another subdivision is about to come into town on Forsyth Street and the Martin Luther King, Jr. bypass across from Breezy Point. Councilmember Claxton commented it needs to be looked at very closely. Councilmember Claxton said he understood the concerns of the Harrell Circle residents and he feels the City needs to address the things that can be done. Councilmember McDaniel inquired about the developer putting up a privacy fence or tree buffer. Building and Zoning Administrator Aiken informed everyone that as of today, they were asked and they said no due to the price. Acting City Manager Turner stated legally the developer has done everything they've been asked to do. Councilmember Claxton also stated he had some graffiti concerns. Mr. Turner said he's talked to the owners about it. Councilmember Hightower stated he appreciated the Acting City Manager for responding to Ward 2 concerns and he asked that the City continue to communicate with the residents on Harrell Circle and focus on their privacy. Councilmember Sims reported the minutes online are not up to date. Acting City Manager Turner noted that's being addressed and they will be by the middle of the month. Mayor Pro Tem Shropshire commended Mr. Aiken and Mr. Turner for their communication with the Harrell Circle residents. PUBLIC COMMENTS Mrs. Kay Pedrotti invited everyone to the Lamar Arts Black History Exhibit and reception Friday night from 5:00 p.m. to 8:00 p.m. at the Depot. February 7, 2022 Regular Council Meeting February 10, 2022 Special Called Meeting February 28, 2022 Special Called Meeting Mayor Banks recognized Mr. Sohel Batliwala, the owner of Hot Shot Convenience Store located at 202 Veterans Parkway. Mr. Batliwala said his desire to discontinue using a septic tank and tap into the City's sewer line in order to build a Steak and Shake and other things started in December 2019 when he discussed it with the late City Manager David Rose. He said he had a survey done that cost him $20,000. Mr. Batliwala said City Manager Turner has now told him the lift station is not big enough to take his sewer. He reported he has documents with approval from former Building and Zoning Administrator Brutz English and he had gotten approval from both Mr. Rose and Mr. English that it was big enough, but now everything has changed after he's spent a lot of money on it. Mayor Banks told Mr. Batliwala the sewer isn't big enough where he wants it to go. Mr. Batliwala responded it was big enough. Mayor Banks called on City Manager Turner. Mr. Turner reported he didn't know what the previous manager had told Mr. Batliwala and there are no files at City Hall with this information. He reported he sent Mr. Batliwala's drawing to the City's engineer for review. City Manager Turner said the first drawing had a lot of 90 degree angles and the engineers said it couldn't be done and they denied it. City Manager Turner said upon review of a second drawing, they asked Ms. Laura Geiger for permission to cross her property and she denied the request. He said he also sent the plans to the Department of Transportation for them to review and they denied it. City Manager Turner said there is nothing we can do and we can't take it because our lift station isn't equipped to handle his load and it adds the risk of potential spillage. City Manager Turner added the only other option is to speak with the person across the street and get permission to bore under 341 and tapi into their lift station or come up Atlanta Street. Councilmember Sims asked about the cost to go up Atlanta Street and to upgrade the City's system. Mr. Batliwala said it will cost him $300,000 on Atlanta Street and $40,000 at Highway 341. City Manager Turner said he hadn't looked into the cost to upgrade the system. Councilmember Hightower asked if the letter referenced granting him approval was it an official letter on City letterhead. Mr. Batliwala stated it was not on City letterhead, but it was sent by email from Mr. English after his employment with the City. Mr. Batliwala told the Council the lift station is running on a temporary pump now and it's the current lift station that won't work sO the City will have to upgrade. He provided copies of Mr. English's letter and email to the Council. He said his other option is to deannex out of the City because he doesn't want to spend $300,000. Mr. Batliwala said ift the City is willing to work with him, he didn't mind spending another $30,000. Councilmember Claxton stated he would like to see it go forward because it seems like a good project, but he didn'tthink it was feasible for the City to spend $300,000 to do it. Councilmember Sims stated he would like to know the number to upgrade our system and City Manager Turner said he'd get it. Mr. Turner noted this would be discussed further at the Council Retreat on March 21". REPORTS Councilmember Sims complained about littering and stated he'd like the signs to fine at the maximum. Councilmember Hightower acknowledged the passing of one of his former students Corey Jackson whom was in the Class of 1997 and the first class he taught at Lamar County. He asked that Jackson's family be kepti in everyone's 's prayers. He reported he has shared with City Manager Turner his ideas and issues that will be discussed at the retreat. Councilmember Hightower thanked Mr. Turner for his response to Ward 2 concerns. Councilmember Claxton congratulated Tim Turner on being appointed City Manager. Mayor Pro Tem Shropshire also congratulated City Manager Turner and stated he feels he's the man for the job and his appointment was unanimous. He wished him well and commended him for wanting to do it. PUBLIC COMMENTS Ms. Dorothy Carter congratulated Mr. Turner. She discussed the streets with litter problems needing to be identified and stated she would like to keep Barnesville beautiful. Mr. Michael Rogers still complained about littering, abandoned cars, and garbage problems city wide. Councilmember Hightower inquired about the abandoned cars process and he stated the City needs to clarify what we can do and be proactive to our residents. City Manager Turner responded the car has to be drivable to not be considered abandoned, Building and Zoning makes the determination, the information will be put on the website and utility bills, and the City has a junk car ordinance. Councilmember Sims asked Chief Cooper about the law on abandoned cars. Chief Cooper reported all abandoned cars that had been tagged have been removed from the city now. Mr. Rogers stated he will provide a list by tomorrow. Councilmember Hightower also asked if residents had been notified about moving garbage bins back after they're emptied. City Manager Turner said they have been, but he will confirm. Councilmember Sims inquired about the process in proceeding to make Market Street a one way street. Councilmember McDaniel stated he was in support ofit as long as it started at the entrance of Main Street down to Ozier Dance Studio and it didn't intrude on the bank's business. Councilmember Claxton reported everyone he's spoken with is in favor of the change. City Manager Turner stated he'll make a mock drawing and email it to the Council and they'll discuss it at the next meeting. Councilmember Hightower reported he has spoken to Mr. Sohel Batliwala and he's waiting to hear back from him. He thanked City Manager Turner and the City staff for being responsive to Ward 2 concerns. Councilmember Hightower asked City Manager Turner to share the process of notifying residents that their properties need to be cleaned up, the policy on picking up old tires, and the status on sending notices to residents on pulling their bins back. Mr. Turner responded Building and Zoning has been sending letters for awhile to residents with junk cars and trash in their yards since Mr. Rogers' comments. City Manager Turner said it's against the code for residents to put out tires, but it hasn't been enforced and we are picking them up now. He responded he will send notices out again on the bins. Councilmember Claxton reported he's been out in Ward 1 assessing the condition of the streets in preparation of the TSPLOST (Transportation Special Purpose Local Option Sales Tax). He noted he will be turning in a list this week on suggestions. Councilmember Claxton commended and thanked City Manager Turner for the wonderful workshop held at Calloway Gardens. Mayor Pro Tem Shropshire commented it has not been in our interest to pick up tires and we are not suppose to, but the City does to keep it clean. Councilmember Hightower said he wanted this clarified to convey the correct message to the citizens. Ms. Denise Groll stated she resides at 127 Holmes Street and it would be best to keep it as single family. Ms. Maggie Page stated she has lived in Barnesville since 1989 and on Holmes Street since 2005. She said the zoning should be for single family dwellings and not rental property. She added her position is from an investment position because shel has invested a lot in her property. Ms. Cindy Jones stated she resides at the corner of College Drive and Holmes Street and has lived there since 2002. She stated she's worried about parking. Mr. Dan Williams stated he owns 150, 144, and 142 Holmes Street and he said he has multiple concerns particularly about properties being grandfathered in. He said the biggest problem is the house has been empty for 24 years and its producing rodents since there's activity in it now. Ms. Kenyatta Walker, CEO and Ms. Leslie Cantrell, Director of the Lamar County Counseling Center with the McIntosh Trail Community Service Board addressed the Council requesting rent relief at 133 Forsyth Street, Suite 3. Ms. Walker stated their program provides mental health and substance abuse services for seven counties at the building the City recently purchased. Ms. Cantrell added they have been serving Lamar County clients for twelve years and they have been in the building for eight years. She said Lamar County had granted them a building of their own, but the land was taken back due to a lot of circumstances that happened. Ms. Cantrell reported their program also provides free summer camps for 130 children and a lot of other free services. She posed the question ifthey aren't there to provide these services, where would the people go. After some discussion, Council said it would take their request under advisement. Mayor Pro Tem Shropshire stated he thinks they're doing a tremendous job and applauded them for all their work. Ms. Cindy Jones addressed the Council regarding the chaining of dogs in the City. She said she's seen dogs chained to trees and she thinks it's inhumane and cruel. Ms. Jones proposed doing away with chaining animals and the need to address cruelty to animals. She said the current ordinance calls for tethering, but she feels this is like being in dog. jail and she thinks they should be in a fence instead. Mr. Dan Williams stated tethered and chained are two different things and he wanted to make a distinction between them. He explained tethering is used to train dogs and he agrees with it, but not with them being exposed to the elements or chained unless a fence is required. Mayor Banks and Councilmember Claxton said they had gone by the cemetery where Ms. Jones had complained about and it looked fine to them. PUBLIC COMMENTS Ms. Courtney Claxton stated the response by the City crews today was amazing. She thanked the City for posting the agendas and minutes on the website, but she suggested adding email addresses for the Council. Ms. Claxton said there has been an improvement on garbage pickup except on Byrd Street because they're putting items out that won't get picked up. Ms. Sylvia Bush asked why the pool was not opening. City Manager Turner explained the pool is 20+ years old and the concrete bottom is cracked, but the City reached out to four companies to get it repaired and only one responded and they can't get to it until October. He also explained initially a residential pump and not a commercial pump was put in and the City couldn'ti find any lifeguards sO we. just can't open it this year. Ms. Juanita Fletcher asked for the City to consider placing trash cans at the corner of the streets. Mayor Banks responded each trash can costs $600, but the City is going to purchase some more. REPORTS Councilmember McDaniel commended the Bamnesville-Lamar County Library for the Summer Reading Program and suggested it, Gordon State College's soccer camps, and some of the churches' summer programs to serve as other activities that can be found with the pool being closed. He also commented College Manor has gotten worst and they are not in compliance with the City ordinance. Councilmember McDaniel requested for the City Attorney to attend the next Council meeting for an Executive Session to discuss the best and worst outcome for the City. Councilmember Sims stated he would like Sunday Alcohol Sales put on the ballot. He also said Ms. Barbara Allison has done a greatj job cleaning up their area. Councilmember Hightower asked City Manager Turner for an update on the timeline to complete the repairs at Summers Field Park and rentals during the repairs. City Manager Turner reported he wouldn't have a date until the work on College Drive is completed and the park will be closed during the repairs. Councilmember Hightower also complained about the trash on the streets in Ward 2 and inquired how residents are notified if there is a problem as to why items are not picked up. City Manager Turner explained the process. Councilmember Claxton commended the Holmes Street residents for taking action and all working together. He thanked Ms. Jones and Ms. Minton for coming and for all their work. Mayor Pro Tem Shropshire commented he was upset about the pool not opening and he had asked for reasons and then he saw the lifeguard shortage on the news. Folson Chief of Police Craig Cooper ACTIONTAKENEY COUNCIL Mayor Banks stated the purpose of the public hearing was to receive public comments on the following proposed miscellaneous rate changes. Garbage/Recycle (One Bin) Residential Garbage/Recycle (One Bin) Commercial Leaves/Yard Debris and. Junk Collection Meter Deposits Residential Water & Sewer Capacity Recovery Fees Water Capacity Recovery Fees for Rural Water System (RUS) Mayor Banks called for public comments. There were none. Only one person from the public was present at this time. Councilmember Hightower asked for clarification on the reason for the fee increases and when our contract expires with the contractor. He said it's his understanding it's because the City currently charges its customers less than what our contractor charges us for the services. City Manager Turner confirmed the City is losing money because we are charged more by the contractor than the customers are paying and he reported the contract expires in September. Councilmember Hightower expressed concern about increasing these rates now to recover the shortage because the rates may have to be adjusted again in the new budget. City Manager Turner gave the first reading of Ordinance No. 589. He stated he's asking for the increases to just break even. Councilmember Hightower stated since there is a potential to negotiate later with the contractor and these rates may go up, he'd like to hold off on increasing the first three fees now. Mr. Willie Williams who lives at 306 Westchester Drive voiced his concerns about the inconsistencies in the leaves and trash pickup and he asked about the size that can be picked up. City Manager Turner explained only three cubic yards or one scoop can be picked up at a time. Mr. Williams reported there's a hole in his yard from where they've picked up. City Manager Turner said he'd get it filled. Mayor Banks noted we need to make sure people understand the policy. Councilmember Hightower added we need to educate our people and improve our services before we increase them. Mr. Charles Harp reported a problem with someone piling boxes up on Westchester Drive that is making the neighborhood look bad. He said Councilmember Hightower had put up a sign, but they still didn'tstop dumping them. After further discussion by the Council on the proposed miscellaneous rate changes, Mayor Banks and City Manager Turner stated they doubted the rates would have to be increased later if they are done now. Councilmember Hightower stated he's heard concerns from his constituents about the quality of the services and he didn't know how the residents were going to feel about these changes being made now. He reminded the Council it's almost time to renegotiate the contract, set a: new budget, we are still in a pandemic, and people are not working. Mr. Richard Miller asked if he could get a study of the terrain and underground water for Westchester Drive. City Manager Turner said he would get with our engineers. Mrs. April Scott suggested the City send out changes to policies in the bills. She said she wanted to make sure she's putting out her debris in a timely manner. City Manager Turner reported everything should bej picked up on Monday, Tuesday, and Wednesday. Mr. James Haygood expressed his concern about speeding on Westchester Drive and said it also needed to bej paved. City Manager Turner reported Westchester Drive was on the list to be paved, but after two requests for bids were advertised, no bids were received. July 5, 2022 Public Hearing July 5, 2022 Regular Council Meeting Councilmember Claxton asked that tonight's 's agenda be amended to remove Executive Session. Chief Cooper recognized retired Major Anthony Kendall. He said Major Kendall had been with the City for 25 years where he was always professional andi if anything needed to be done, he did it. Chief Cooper expressed he will be sorely missed and thanked him for his service. Retired Major Kendall thanked the Council and expressed his appreciation for all the work they've done for the City. He addressed the community present and said it's been a pleasure. Chief Cooper announced the appointment of Ms. Belinda Penamon as the new Barnesville Police Department Major/Assistant Police Chief. He noted she is currently a Sergeant who is totally for the department and community. After Ms. Penamon was pinned by Chief Cooper, she thanked everyone who came out today, her family, Principal Stephen Boyd, School Counselor Tonya Walker, the Council, and the City of Barnesville for entrusting her to help run the department. City Manager Turner gave the second reading of Ordinance No. 589 on proposed miscellaneous rate changes relating to garbage/recycle, leaves/yard debris, junk collection, meter deposits, and water and sewer capacity recovery fees. Councilmember McDaniel made a motion to approve the ordinance and it was seconded by Councilmember Sims. Councilmember Hightower made a second motion to approve the increase in fees with the elimination of residential fee increases relating to leaves/yard debris and junk collection. The amendment died due to the lack of a second. After some discussion, Council adopted Ordinance No. 589 with a vote of 3 to 1. Councilmembers Claxton, Sims, and McDaniel voted in favor and Councilmember Hightower was opposed. Council agreed to discuss adding Juneteenth as a City employee Holiday at the Budget Workshop. REPORTS Councilmember McDaniel thanked City Manager Turner and City employees for repairing the Depot pump. He reported he had the pleasure of attending the send off of Bennie Horton, a first class gentleman, who served 20 years on the County Commission. He added Councilmember Hightower did an excellent job representing the City. Councilmember Sims noted the power bills are very costly and he asked about looking into providing budget billing. City Manager Turner stated we will have to look to see if the system can do it. He also suggested picking up the entire pile of debris instead ofj just one scoop. Councilmember Hightower congratulated Mr. Horton on his upcoming retirement and he said he appreciated his service. He congratulated Christian Allen on his commitment to attend the University of Georgia. Councilmember Hightower thanked Councilmember Sims for his recommendations on how to help on power bills and trash pickup. He asked City Manager Turner ift the resurfacing on Richardson Street was because of funding or work done. Mr. Turner replied it was due to repair. Councilmember Hightower asked ifthere was any word on resurfacing. City Manager Turner reported there was none. Mr. Hightower stated his prayers and thoughts remain with ChiefCooper and his family. Councilmember Claxton reported he had met last Friday with the City Manager and he has his list for his Ward. He also reported the City has received 6 or 7 façade grants and he applauded the business owners for doing this. Councilmember Claxton said the sidewalks and curbs are dirty downtown. City Manager Turner stated he's looking at pressure washing them. Councilmembers Claxton and Sims said they're on board to start the initiative ifthe City will provide the water and get volunteers to help. They stated they would like to have this done by Buggy Days. Councilmember Claxton also stated he'd like to have a Public Hearing on Sunday Alcohol Sales to hear both sides. PUBLIC COMMENTS Mrs. Kay Pedrotti spoke about the condition of the Depot which houses the Lamar Arts Gallery. She reported on several occasions she has asked City employees for assistance to help patch the roof and floor. Mrs. Pedrotti requested the City to do a grant with Lamar Arts for renovations. She distributed copies to the Council and asked that it be taken up at the Budget Workshop. Ms. Tammie Smith, a resident of Atlanta Street, stated the Lamar Arts Banner is wonderful and wel have beautiful murals. She said building codes need to be enforced. Ms. Smith added we need music and art and downtown needs to come to life. She reported there are rumors that two Councilmen don't live in their districts and there needs to be a way to stop the rumors. Councilmember McDaniel explained this had been brought up in the last election and he stated he lives and resides at 494 College Drive. Councilmember Hightower said he lives in Ward 2. Councilmember McDaniel also said this Council is very receptive to changing ordinances to bring things to downtown, but a lot is up to the Chamber and Lamar Arts to bring people in. Councilmember Claxton noted we don't have the population to support locally sO the merchants have to offer something to bring people from out of town and locally. Councilmember Hightower thanked Ms. Smith for being here and he stated at the Budget Workshop, he plans to discuss some ideas other cities do to bring people to downtown. Ms. Smith stated she wants music on the loud speaker. City Manager Turner replied we have the system, but we don't have anything to hook into the system and we have to have streaming. Councilmember Claxton pledged to provide the IPad and Councilmember Sims said he'dp provide the internet. Ms. Courtney Claxton stated she felt defensive with the Facebook post made by Tammie Smith. She said people should be looking at what's being done rather than what's not as far as what the Chamber can provide. She commented the yield signs on Market Street/Greenwood Street don't flow as well and she suggested changing the right of ways and reevaluating which direction they need to flow. Council also discussed the City's failing infrastructure, LOST negotiations, the 10% penalty imposed on late bill payments, budget billing, hosting a City sponsored event to promote the City and bring people in, allowing food trucks, options for the swimming pool, adding an Assistant City Manager, amending Council's retirement plan, changing the debris pickup policy, and the 2021 CDBG Project. City Manager Turner reported this year's budget is conservative and realistic with a total of$17,541,549 and an overall 7% increase. Mayor Banks recognized Mrs. Shelley Harris-Mason who resides at 240 Wilson Street. Mrs. Harris-Mason requested her water line be switched back from Watts Circle to her residence. She said this has caused her water to be contaminated. Mayor Banks stated Mrs. Harris-Mason is incorrect on how the lines run and her water has been checked by the manager of the system and he found there was nothing wrong with her water. City Manager Turner confirmed the water line is directly in front of her house. Mayor Banks asked that the Water and Sewer Superintendent show Mrs. Harris-Mason the location of the water line. Councilmember McDaniel asked for a show of hands of those in favor of or opposed to a referendum to let the citizens vote in an election on whether or not they want to allow Sunday sales. Many people were in favor. None present indicated they were opposed. Mayor Banks called for public comments. Ms. Melissa Cline asked it be put on the ballot to give the citizens the right to vote. Mr. Edward Whitelock who resides at 401 Zebulon Street stated he was in favor of a voting referendum on Sunday sales. Mr. Caleb Anthony with Tailgaters stated: it will produce tax dollars for the community and more festivals and things to do. He said he feels Barnesville can still be Barnesville with alcohol sales on Sunday. Ms. Penny Hudson of Milner stated she feels it will do great here, generate a lot mor revenue, and it's really needed. Ms. Mary Rooks who resides at 650 Forsyth Street stated she feels it would be more convenient and safer tol be able to buy locally rather than traveling long distances and keep businesses open. Ms. Anna Perdichizzi stated it shouldn't matter what day of the week it is as long as you drink responsibility. She said it definitely needs to be put on the ballot to let the people vote and it's about making money. Ms. Angela Hardy Boatfield who resides at 602 Greenwood Street stated she's in favor of putting it to a vote and would like to have a ceremony to celebrate in an informational and meaningful way. Mayor Banks stated there would not be a vote tonight, but there will be a vote and decision made at a later time. Ms. Dorothy Carter who resides at 323 Forsyth Street asked the Council to please poll their constituents, not just the business owners, to see what their opinion is. She added it's not about the money, but it's more of a morale issue and alcoholism is a problem here. She said she's ok with pouring, but not buying in stores. Councilmember McDaniel noted the Council would not make the decision, but they would put it to a vote for the citizens to decide. City Manager Turner reported if approved by the Council, a Special Election would be held on March 21, 2023 along with the SPLOST. Mr. Christopher Deraney of Deraney's Two City Tavern asked why the Council was kicking the can down the road again and not voting tonight. Mayor Banks noted tonight they were just having aj public hearing and would be making a decision later, but not tonight. September 6 2022 Public Hearing September 6, 2022 Regular Council Meeting September 8, 2022 Special Called Meeting Councilmember Claxton asked to address his constituents. Mr. Claxton made a motion for Sunday Alcohol Sales to be placed on the ballot in the form of two questions. Councilmember Hightower, Councilmember McDaniel, and Mayor Banks expressed the motion was out of order and they didn't support the procedure on how the motion was made. Mayor Pro Tem Shropshire stated he felt Councilmember Claxton should be allowed to make the motion. City Manager Turner clarified a Councilmember can make a motion at any time even ifi it's not on the agenda. After some discussion, Councilmember Sims seconded the motion. Mayor Banks called for a vote for Resolution No. R2022-0017 to be read calling for a Special Election. All the Council agreed except Councilmember Hightower. The vote was 4 to 1 with Councilmembers Claxton, Sims, McDaniel, and Mayor Pro Tem Shropshire in favor of the Resolution being read and Councilmember Hightower was opposed. City Manager Turner read the resolution. On motion by Councilmember McDaniel and seconded by Mayor Pro Tem Shropshire, Council approved Resolution No. R2022-0017 4 to 1 with Councilmembers Claxton, Sims, McDaniel, and Mayor Pro Tem Shropshire voting in favor and Councilmember Hightower was opposed. City Manager Turner gave the first reading ofOrdinance No. 591 to adopt the Barnesville Municipal Court Fine Schedule. He noted there is an increase of $24 on each fine due to Courtware Solutions fee increases. On motion by Councilmember Claxton and seconded by Mayor Pro Tem Shropshire, Council unanimously approved Resolution No. R2022-0014 on the Local Option Sales Tax (LOST) Distributions. Mayor Banks noted it's almost the same distribution as the Special Purpose Local Option Sales Tax (SPLOST). On motion by Councilmember Claxton and seconded by Mayor Pro Tem Shropshire, Council unanimously approved Resolution No. R2022-0015 reactivating the Downtown Development Authority. Mayor Pro Tem Shropshire thanked City Manager Turner for carrying this out. On motion by Councilmember Claxton and seconded by Mayor Pro Tem Shropshire, Council unanimously reappointed Mrs. Sherry Farr to the Barnesville Housing Authority Board for a five year term ending October 1, 2027. Mr. Al Hosford and Mr. Robert Knight updated the Council on their proposed projects on Johnstonville Road/Roberts Road, the National Guard Armory/Old Booker School, and Van Mar Boulevard. REPORTS Councilmember McDaniel reported on the potholes on Harrell Circle and Pine Street and the need for paving. Councilmember Sims asked about the Zoning Board Appointment vacancy that's been open for 10 months. City Manager Turner reported Anita Buice is trying to restructure the board and has asked to hold off for now. Councilmember Sims reported limbs hanging from Collier Road to Sims Street and kudzu on Forsyth Street. He also asked for the status on the fire truck. Fire Chief Kelvin Chute gave an update. Councilmember Hightower reported meeting some College Manor residents where he officially welcomed them to Barnesville. He stated the Council moved very rapidly tonight on the Sunday Alcohol Sales and changed our process and he didn't have time to give it thought. Councilmember Hightower asked City Manager Turner to look at our process and make sure we're following it. He also asked if the Council is still having a November retreat. City Manager Turner stated Community Development Director Niki Sappington is finalizing the date. Councilmember Claxton asked for an update on the limb trucks. Mayor Pro Tem asked for an update on the Northside Village investors. PUBLIC COMMENTS Mrs. Kay Pedrotti expressed Lamar Arts is working to draw people to downtown. Ms. Jane Huguely reminded the Council not to forget the impact fees with new development. Ms. Anna Perdichizzi gave suggestions on how to bring money back to the community. Ms. Dorothy Carter asked for consideration to reactivate Keep Barnesville Beautiful to assist in addressing the blight. She inquired about the Myles-Wimberly Park survey. Councilmember Hightower inquired about some decreases he noted. City Manager Turner responded they are being realigned with our code. On motion by Councilmember McDaniel and seconded by Councilmember Hightower, Council unanimously adopted Ordinance No. 591. City Manager Turner gave the first reading of Ordinance No. 593 to adopt the Defined Benefit Retirement Plan Amendment. Mr. Turner noted the minimum age requirement for in service distribution and if there is a gap in service, this plan allows the prior years to be counted and you don'thave to start over. City Manager Turner gave the first reading of Ordinance No. 594 to deannex Powell Place. Apartments from the City of Barnesville. Mayor Banks stated the owner's approval has been obtained and the Town of Aldora will begin their procedure as soon as the City passes this. Councilmember Hightower asked what services the City will still provide. Mayor Banks reported water, sewer, and fire protection. Councilmember Claxton inquired if the City will provide electricity. City Manager Turner replied no because it's not in our territory, but Georgia Power's. Mayor Banks said the City will receive from the Town of Aldora what's loss in taxes. Councilmember McDaniel noted the City will receive the money back in the form ofa donation to the Fire Department. Mayor Pro Tem Shropshire inquired whose Ward is it in. Councilmember Claxton responded it was in his. REPORTS Councilmember McDaniel reported there is a lot of activity coming up in December starting with the parade on December 10th. He reported he had received an email from the Chamber that listed all the upcoming events and he expressed how impressed he was. Councilmember McDaniel encouraged all to get out and come to the festivities. Councilmember Hightower stated he appreciated the residents of Ward 2, the residents of the City who are comfortable communicating with him, and the City Manager. Councilmember Claxton reported on all the activity going on downtown on the buildings. He reported some residents have asked what happened to the music and he's had a lot of good compliments on the music downtown. City Manager Turner said he'd check on it. Mayor Pro Tem Shropshire reported the Downtown Development Authority (DDA) has been reactivated. He applauded the DDA for making downtown look better and he said they're doing a wonderful job. Mayor Banks asked when the City is going to get new awnings for our buildings. City Manager Turner reported he has bids out for them. He discussed with the Council the cost of$50,000 to replace them all by Macon Tent and Awnings. Mayor Banks stated the second order of business of the public hearing was to hear Application #22-09-01 to rezone 30.21 acres at the southwest corner of Highway 41 and Martin Luther King, Jr. Parkway from C-4 Highway Commercial and R-2 Multi-Family to C-4 Highway Commercial and I-1 Industrial for Twiggs Pleasure LLC. Mr. David Smith with Construction Logistics Services presented to the Council the plan to rezone 30+ acres for a truck stop that will provide additional space for truck and trailer storage, an area for electric vehicles, and an opportunity for expansion. He added the area will be well lit and will be an asset to the community. Councilmember Claxton inquired if the site will be gravel, the plans for buffers, about elevation, and the ability to get ingress/egress permits. Mr. Smith replied the entrance and exit will initially be gravel, there will be landscaping around it with some island to make the location look attractive, it will be elevated, and he feels he will be able to get the required permits. Councilmember McDaniel asked what the acreage will be for C-4 and I-1 and he summarized the corner will essentially be a truck stop where both the entrance and exit will come out. City Manager Turner gave the: first reading of Ordinance No. 592 to rezone the property. City Manager Turner gave the first reading of Ordinance No. 595 for Application #22-10-01 by HFG Development to annex and rezone 46.12 acres south of the intersection of Johnstonville Road and Roberts Road from AR Agricultural Residential to R-1C Single Family High Density. Mr. Al Hosford reported the Planning Commission had reviewed his application on November 3, 2022 and he received their approval. Mr. Hosford informed the Council he's requesting annexation and rezoning, but he's not asking for the variance now. He added after feedback from the Council and Planning Commission, he's reduced the plan from 170 to 145 lots with no variance request and he officially withdrew Application #22-10-02 that requested a variance. Mr. Hosford said all the homes will be for sale and not rent to purchase or built for rent. Councilmember McDaniel noted Mr. Hosford had mentioned he's worked with the City of Stonecrest on a similar project. Hei inquired if there were any closer projects. Mr. Hosford said he would get something closer for the Council to look at hopefully by next week. Mr. Newton Galloway, Zoning Ordinance Lawyer out of Griffin who's working with HFG Development, informed the Council the property is not conducive now for the County AR zoning and the County Comprehensive Plan calls for the property to be annexed residential for it to comply with their Comprehensive Plan. He said HFG just completed a project around High Falls Road that is going to havei industry and housing is going to have to be addressed. Ms. Melanie Foster reported her mom's property is near here and their land has been in the family for six generations. She said the intersection is not equipped to handle the traffic coming out, they all will go left and there is no red light at Sims Street, and there will be 35 to 40 cars running all the time. She added she doesn't feel it's appropriate to build 160 houses and she's asking for the Council to vote no to the annexation. Mr. Jason Lovett, Lamar County Commissioner Elect for District 2, addressed the Council and told them to look at the County zoning and they will know why they want to annex. Mr. Lovett asked them to proceed with caution and to not look at the immediate economic impact for the City. Mr. Adrian White informed the Council HFG Development' 's proposal on a similar development in the City of Lovejoy was denied on January 3, 2022. He also said they have proposed a development in the City of Stockbridge which is also nearby. Mr. White noted ift the development is allowed, the Council needs to make sure they are held accountable. Mr. Hosford noted the project in Locust Grove is in the planning stage and it was approved and not denied. City Manager Turner gave the first reading of Ordinance No. 596 for Application #22-10-03 by HFG Development to rezone 24.97 acres at the National Guard Armory at 408 Highway 41 South from R-1B Single Family to R-2 Multi-Family. Mr. Hosford noted he had come to the Council in July and October proposing a standard apartment community requesting multi-family rezoning and two variances to: increase the maximum units per apartment building from 8 to 24 units and to increase the maximum building height from 35 to 50 feet. He reported he had met with Fire Chief Chute to make sure the fire equipment can accommodate the apartments and he received some recommendations from the Fire Chief. Mr. Hosford noted the Planning Commission had suggested a plaque be placed to recognize the site being where the first African American school inl Lamar County stood. He said they had agreed to the recommendation and will be glad to do it. Mr. Galloway: noted the National Guard Armory needs to be cleaned up and redeveloped and it is appropriate for this use and not for institutional. He expressed he hoped the Council would approvei it sO it can be cleaned up and redeveloped. Mr. White suggested the property be put on the historic registry even if it's developed. Mayor Banks noted he agreed with Mr. White's suggestion and it was a wonderful thought, but no one has showed interest in doing it and he didn't think it would happen. Mr. Hosford noted the remediation cost is going to be over $400,000. November 9, 2022 Council Workshop November 16, 2022 Joint SPLOST Meeting November 30, 2022 Public Hearing November 30, 2022 Regular Council Meeting Mr. David Irvin, the City Auditor with Mauldin & Jenkins, gave an overview of the 2020-2021 Audit. He explained the financial statements are the responsibility of management and the auditor is responsible for providing an opinion. Mr. Irvin stated this year's audit is clean, unmodified, and fairly stated. He thanked the staff for all their assistance. He noted all three enterprises, especially the Water and Sewer, are in good standing. Mr. Irvin informed the Council they were receiving a clean opinion that'si independent oft the City with no uncorrected mistakes. Councilmember Claxton asked about the building sold last year and if the money has now been spent since it was in the General Fund. City Accountant York responded the money is in the Economic Development Fund. Councilmember McDaniel asked Mr. Irvin about how much progress has been obtained since his firm began auditing the City. Mr. Irvin responded how far the City has come is attributed to your staff Tammy York and Tim Turner. He further noted City Accountant York is proactive and not reactive and he said this provides for a smoother audit. Councilmember McDaniel thanked both City Manager Turner and City Accountant York. On motion by Councilmember Claxton and seconded by Councilmember McDaniel, Council unanimously accepted the 2020-2021 Audit. On motion by Councilmember Hightower and seconded by Councilmember Sims, Council unanimously added Juneteenth as a paid holiday for City employees. City Manager Turner gave the second reading of Ordinance No. 593 to adopt the Defined Benefit Retirement Plan Amendment. City Manager Turner gave the second reading of Ordinance No. 594 to deannex Powell Place Apartments from the City of Barnesville. On motion by Councilmember Claxton and seconded by Mayor Pro Tem Shropshire, Council unanimously approved Ordinance No. 594. Mayor Banks explained the reason why the City is doing this is sO the Town of Aldora can annex the property and be able to apply for grants for funds to operate. City Manager Turner gave the first reading of Ordinance No. 597 to adopt a Short Term Rental Ordinance. Councilmember Sims expressed he thinks the City should have a Town Hall Meeting to let the people talk about it. He added we have one, the Black Chateau, in the neighborhood on Collier Road where the City Attorney issued a cease and desist. Mayor Banks asked for comments from Police Major Belinda Penamon. Major Penamon responded she's not in a position to answer because she was not in the position at the time. Councilmember Hightower asked for clarification on the Black Chateau. City Manager Turner said it's not legal because it's in a single family area. He said this ordinance allows them in multi-family areas. Council discussed again needing an updated street map that identifies single and multi-family areas and establishing objective criteria for issuing variances. City Manager Turner gave the first reading of Ordinance No. 598 to adopt the Water Standards Design Requirements. Mr. Turner noted the current design standards are antiquated and the engineers have updated them. City Manager Turner gave the first reading of Ordinance No. 599 to create the Fire Department Hierarchy Personnel Structure. Mr. Turner noted it will be similar to the Police Department and the Fire Chief wants to create a Fire Captain and Fire Lieutenant. Councilmember Sims stated he thinks it'sa good plan. Mayor Banks said the next order of business was to approve Resolution No. R2022-0019 to authorize the transfer of property from Akins Real Estate Properties, LLC to the City of Barnesville. Mayor Banks noted the City will get all of the property. Councilmembers Hightower and Sims indicated they still had questions and concerns and asked about the soil test results. Mayor Banks reported in the Phase I Environmental Study, the engineers said there is nothing on the property that poses a hazard, the property is clean, and there is no problem with the land. Councilmember Hightower expressed he hadn't had an opportunity to look at the report and discuss the vision for the project. He asked ifit was feasible to have further discussion. Mayor Banks said yes, but explained Bruce Akins wanted to give it to us and get a tax deduction for this year. He encouraged the Council to go ahead and accept the property because there was nothing wrong withi it. On motion by Councilmember Sims and seconded by Councilmember Hightower, Council unanimously tabled the resolution until everyone has had an opportunity to review the report. City Manager Turner announced there would be a Special Called Meeting on next Wednesday, December 14, 2022, at 5:30 p.m. to approve the resolution. Council discussed the reappointment to the Lamar County Board of Elections and Registration. Councilmember Hightower questioned why the Council's normal process of reappointment was not being followed and why this item on the agenda looked different from the other reappointments. Mayor Banks noted it was because one councilman had said he was going to oppose the reappointment. Councilmember McDaniel explained this was the first time we have had two people to choose from. He added he never said he didn't want Mrs. Williams, but one of his constituents was interested in the position. Mayor Pro Tem Shropshire stated Mrs. Williams has been on the board for a while. He asked for a comment from the Board. Chairman Bill Christopher, who's appointed by the City of Milner, stated Mrs. Williams has been on the Board for 10 years where she has served 8 years of her own appointment and 2 years to finish Mrs. Georgia Fletcher's term. Mr. Christopher said in her 10 years of service, Mrs. Williams has proven herselfe exemplary. He commented Mr. Jackson had served on the board where he resigned and he is no longer used as aj poll worker because his heart is not in it like Elaine. Mr. Scott Cone, a Board Appointee, also noted it is a pleasure to work with someone with a fair and nonpartisan approach. Mr. Christopher noted there are no other persons of color on the Board. On motion by Councilmember Hightower and seconded by Mayor Pro Tem Shropshire, Council unanimously reappointed Mrs. Elaine Williams for a four year term beginning January 1, 2023 and ending December 31, 2026 to the Lamar County Board of Elections and Registration. On motion by Councilmember Claxton and seconded by Councilmember McDaniel, Council unanimously reappointed Mr. Red Sammons to the Baresville-Lamar County Industrial Development Authority Board for a four year term beginning January 1, 2023 and expiring December 31, 2026. On motion by Councilmember Claxton and seconded by Councilmember Sims, Council unanimously reappointed Mr. Dan Rainey to the Bamesville-Lamar County Industrial Development Authority Board for a four year term beginning January 1, 2023 and expiring December 31, 2026. On motion by Councilmember Sims and seconded by Councilmember Hightower, Council unanimously appointed Ms. Sylvia Myers as Resident Commissioner to the Barnesville Housing Authority Board for a one year term beginning January 1, 2023 and ending December 31, 2023. Mr. Sohel Batliwala, the owner of Hot Shot, addressed the Council and stated he's wanted to connect to the City sewer system and lift station for three years. He said his engineer was here to explain. Mr. Joey Scanlon, a Griffin Civil Engineer, said they had come up with the best and economical solution to the problem in February of 2020 when David Rose was with the City to pump Hot Shot's wastewater just north of the new Farm Supply. He discussed the proposed plan with the Council for the City to fill out a gut application to go into the Georgia Department of Transportation's right of way and they discussed other alternatives. City Manager Turner noted the City is under an Environmental Protection Division advisement and it cannot take anymore sewer from anybody and there's nothing else he or the City engineers can do to help. Mr. Scanlon requested telemetry for the lift station. City Manager Turner reported we do have Scada and Mr. Scanlon can put in aj proposal to our engineers. Mr. Rudy Giadrosich addressed the Council to discuss the inconsistency in the picking up of limbs and leaves. He noted they are being picked up every 2 to 3 months. Mr. Giadrosich said he came to find out what the problem is and what can be done to solve it. City Manager Turner reported both oft the limb trucks have been down and we have had to wait on parts to repair them. He said a new truck has been ordered and is set to come in March. Mr. Turner noted they are working on weekends to get caught up. Mr. Giadrosich suggested putting preventative maintenance on the trucks. The Director of Utilities and Public Works Richard Vereen explained the City does have preventative maintenance and the trucks are serviced monthly by EFG, but the hydraulic pumps overheat and melt the lever control. He noted the problem with them is because of all the stopping and going and the lifespan for them is fives years and we have a 2009 and 2019. Mr. Giadrosich said he knows we can get these trucks fixed. He: said we pay a lot of money for the service and we have got to do something in this town to get things picked up. City Manager Turner said he will get with Mr. Vereen at 8:00 in the morning to discuss. Mayor Banks called for Ms. Mary Rooks to address the Council. He: noted she was not here. Mr. Al Hosford and Mr. Newton Galloway with HFG Development addressed the Council and discussed and answered questions regarding their two proposed projects on Johnstonville Road and Roberts Road and at the National Guard Armory at 408 Highway 41 South. Building and Zoning Administrator Mike Aiken noted they are just talking about rezoning and annexing their properties now. He said the plans have not been approved and will be addressed at a later date. Mr. Aiken recommended the rezoning and annexation be approved. Councilmember McDaniel commented on the need for traffic, education, and impact studies to be done. Councilmember Hightower inquired about the impact on the proposed plans ift they're not annexed. Mr. Hosford responded they'd have to work with the County to do a denser plan, but it's more of a City development than County. Mr. Galloway noted it would still have to be rezoned. On motion by Mayor Pro Tem Shropshire and seconded by Councilmember McDaniel, Council unanimously voted to enter into executive session to discuss real estate at 6:06 p.m. On motion by Councilmember McDaniel and seconded by Councilmember Sims, Council unanimously voted to reconvene into regular session at 6:38 p.m. City Manager Turner read Resolution No. R2022-0021.
