Duluth NOTES OF THE WORK SESSION MAYOR AND COUNCIL CITY OF DULUTH, GA APRIL 28, 2025 PRESENT: Mayor Whitlock, Council members Harkness, Thomas, Doss, Graeder, and Holloway, City Manager, Asst. City Managers, Department Directors, City Attorney I. PUBLIC COMMENTS No public comments submitted. II. DISCUSSION TEMS/PRESESENTATIONS/UPDATES 1. UNIFIED DEVELOPMENT CODE AMENDMENT - WORKSHOP I Staff has been working on reviewing, editing, updating, and correcting items within the City's Unified Development Code since mid-2023. To date, this effort has resulted in several text amendments being implemented and has uncovered the need to revise the overall document to be more consistent from Article to Article and to be more user friendly. Staff distributed copies of the draft UDC to Mayor and Council and covered the highlights of the changes to each Article SO Mayor and Council can review the content over the coming months and offer feedback to staff for inclusion in the version that will be adopted in the fall. 2. ALCOHOL AMENDMENTS- BACKGROUND CHECKS As a result of an audit conducted by the GBI, the City of Duluth Business Office can no longer process "background checks" on individuals applying for alcohol handling permits. Therefore, staff and the City Attorney have prepared amendments to amend the language in sections 3-228 and 3-240 which deal specifically with procedural requirements of processing background checks for employees of alcohol establishments. Amending Section 3-204 will add the language specifically required by the GBI for procedural processes for fingerprinting owners, managers, and stockholders. AD VALOREM TAX INSOLVENT REPORT Per Chapter 2, Article 1, Sec 2- 4 of the Duluth Code, approval of this item grants insolvency status to property tax accounts determined to be uncollectible for years up through 2024. Accounts are considered insolvent only after every effort to collect them has been exhausted, which includes processing late notices, returned mail investigation, calls, e-mail, cross checks with the Gwinnett County' S Tax Assessors' real and personal property tax files, City and County Occupational Tax records, including on-site visits by the License/Code Compliance officer. Staff was authorized to place on the May 72th Consent agenda. 4. CITY HALL HVAC REPLACEMENT & AV INSTALLATION The City's 2017 Facilities Assessment identified the HVAC systems serving City Hall as nearing end of life oetween 2022 and 2027. Since 2017, the Second Floor and Council Chambers Units have been replaced. Staff is now recommending the First Floor unit be replaced as it is original to the building. This expenditure is approximately $100,000. Staff has also investigated an audio visual system upgrade for the City Hall Community Room. The upgrade would reorient the room toward the portrait wall with the inclusion of a new laser projector and screen. This expenditure would be approximately $20,000. Funds for the above projects can come from SPLOST 23 Administrative Facilities Category, which will require a budget amendment. Staff was authorized to place on the May 72th Consent agenda. 5. PARKING ORDINANCE AMENDMENT The Police Department has requested some additional language be included under Chapter 8 Article III Section 8-68 "Citywide regulations" relating to parking on roadway shoulders. Staff is recommending language be added to note 12 to provide better clarity on prohibitions to parking on roadway shoulders. Staff to contact Gwinnett County to work on a plan for the auxiliary lane on Bunten. 6. TRANSFER OF UNUSED R-O-W (KNOT STREET) Rainbow Village has requested the Council consider a transfer of unused right-of-way (Knot Street) adjoining their property to allow a safe path for emergency vehicles to access their proposed site expansion. MATTERS FROM MAYOR & COUNCIL Councimember Harkness asked about the possibility of replacing the sod on the town green to artificial turf. Staff to research and report back. IV.
