Ms. Griggs appeared before the Council and gave an update on the progress with the organization. PEE DEE COALITION Denine Mitchell, Sexual Assault Program Director, Requests To Speak Before Council About Sexual Assault Awareness Month. Ms. Mitchell appeared and provided information to Council on the matter of sexual assaults and how the organization is making everyone aware. TARA VILLAGE NEIGHBORHOOD ASSOCIATION The Following Individuals Of The Tara Village Neighborhood Association Request To Appear Before Council To Ask For Support Of Council To Revitalize Tara Village By Addressing The Issues Outlined In The 2020 Tara Village Revitalization Report. Ms. Marilee Jackson, Mr. B. Page, Ms. M. Moultrie, and Ms. Emmie Smith appeared before Council to express concerns on safety, flood issues, potholes, drainage, speeding, sidewalks, and cleaning debris from the ditches. COMMITTEE REPORTS: Justice & Public Safety Councilman Springs gave an update. Last month, the Committee met to receive updates on the EMS staffing, and response study, the fire study, the hiring of a fire chief (hopefully to have someone in the position by July 151), and reviewed the Unified Fire District budget request for the year. City-County Conference Chairman Schofield gave an update. The City-County Conference Committee met on April 10th at Burch' s Mill. The topics discussed were water, street lighting, and a potential project in the downtown of the City of Florence. A motion was made to have the meetings quarterly, 1st and 3rd quarters will be the City, and 2nd and 4th quarters will be the County. iii Florence County Council Agenda April 17, 2025 PN - RESOLUTIONSPROCLAMATIONS: PROCLAMATION- NATIONAL PUBLIC SAFETY TELECOMMUNICATIONS WEEK The Clerk published the proclamation in its entirety. RESOLUTIONS: RESOLUTION NO. 36-2024/25 (Deferral) A Resolution Authorizing The Cessation Of Maintenance On An Abandonment And/Or Closure Of Existing Palmer Road, Located Near Cartersville, S.C. In County Council District 4. RESOLUTION NO. 43-2024/25 The Clerk published the title of the resolution. A Resolution Designating The Month Of April As Sexual Assault Awareness Month. Councilman Dorriety made the motion, and Councilman Springs seconded. Mr. Yokim stated that sexual assault is a widespread and devastating crime that affects millions of individuals of all genders, ages, races, and backgrounds in communities across the nation. Florence County has statistically had a high rate per capita of sexual assault reported and had the highest rate per capita in the recent report provided by SLED in 2023 of 8.69 per 10,000 people. Florence County has seen an increase in reports of sexual violence to law enforcement between 2022 and 203 per SLED reports. Raising awareness about the prevalence of sexual assault and the importance of prevention is crucial in combating this societal issue and creating safer environments for all. Designating the month of April for awareness encourages individuals, communities, and organizations to come together to advocate for those impacted by sexual assault, foster understanding, and promote support systems for survivors of sexual violence. The motion was approved unanimously by all the members present. A Resolution Designating Specific Individual Projects To Be Funded From CPST III Excess Pursuant to Section 2.02 Of Ordinance 16-2023/24. Councilman Dorriety made the motion, and Councilman Moore seconded. Mr. Yokim stated Florence County adopted Ordinance 16-2023/24 on November 16, 2023. Section 2.02 of Ordinance 16-2023/24 is for the designation of specific projects and within the project categories set forth in Section 2.01(a)-(g), Council shall by resolution from time to time designate the specific individual projects to be funded from CPSTIII Excess. This resolution approves three new projects totaling $261,941, where there is a slight increase to one project. This resolution also decreases one road project where bids came in lower than estimated for a cost savings of$164,015. The motion was approved unanimously by all the members present. An Ordinance Authorizing The Enlargement Of The Joint County Industrial Park Between Florence County, South Carolina, And Williamsburg County, South Carolina; And Other Matters Related Thereto. Vice- Chairman Yarborough made the motion, and Councilman Caudle seconded. Mr. Yokim stated pursuant to Article VIII, Section 13 of the South Carolina constitution and Title 4, Section 1, Code of Laws of South Carolina, 1976 as amended Florence County is authorized to jointly develop multicounty parks with counties having contiguous borders with the County and, in the County's discretion, include property within the boundaries of such multicounty parks. Under the MCIP Act, the County has created a multicounty park with Williamsburg County. Ten Governors Solar, LLC has obtained certain land in Florence County and is presently recruiting for a project. An agreement dated December 1, 1998, was approved for ajoint county industrial/business: park between Florence County and Williamsburg County. The County desires to expand the boundaries of the park and amend the agreement to include the project. Mr. Yokim stated pursuant to the FILOT Act, and in order to induce investment in the County, on February 20, 2025 County Council adopted an inducement resolution (Resolution No. 38-2024/25) in which it identified certain proposed investments by Ten Governors Solar, LLC. The company has represented that the project will involve an investment of approximately $122,200,000, but not less than $2,500,000, in the county, all within the investment period. The county has determined on the basis of the information supplied to it by the company that the project would be a "project" as such term is defined in the FILOT Act, and that the project would serve the purposes of the FILOT Act. Mr. Yokim stated that two bonds were issued a few months ago, and the $14 million bond will build an evidence building for the Sheriff's Department and an EMS station on the east side of town. In consultation with the architect designing both projects, the County may save a few million dollars on the bond; therefore, we asked the county bond counsel to draft this ordinance, which would allow the County to use the excess proceeds for these purposes. Mr. Yokim stated that the City of Johnsonville has a desire to sell its city hall building, and School District 5 is in need of the building. School District 5 does not have the mechanism to issue debt. The district will use the revenue from its share of the battery plant fee-in-lieu of tax. Council passed the revenue sharing ordinance months ago; however, the revenue has not started coming in yet, SO the County will purchase the building from City Hall from the City, lease it to the School District 5 and the County will pay themselves back when the revenue starts to come in from the battery plant. PEE DEE COMMUNITY ACTION PARTNERSHIP BOARD Council Is Requested To Approve The Appointment Of Beverly Alford To Serve On The Pee Dee Community Action Partnership Board, Representing Seat 1, With The Appropriate Expiration Term. Councilman Springs made the motion, and Councilman Caudle seconded. The motion was approved unanimously by all the members present. REPORTS TO COUNCIL: Mr. Yokim provided updates on projects. CPST III: District 1 - The contract for Miles, Red, Joy, Gracelyn, and Donald roads was approved in February. Construction is scheduled to start in May. District 2 - All District 2 CPST III projects are complete. District 3 = Bid 04-24/25 for Brookgreen Neighborhood resurfacing (Brookgreen Dr., Whittier Cir., New Hope Dr., Tobin Dr., White Ave., McNeil Dr., Adair Dr., and Gibbs Ave.) is under construction and should be completed in May. District 4 - DeGroat Road is complete pending punch list items (driveways). Bid 63-23/24 consisting ofl Bob White Trail, Pheasant Rd., Whippoorwill Rd., Quail Ln., and Old Middle Road is complete. Discus Lane is complete. The Deer Road water line extension Bid 25- ix Florence County Council Agenda April 17, 2025 ns 24/25 will be presented to Council for approval at the April 17th meeting. Bids have come in under budget. District 5 - Davis & Floyd is developing a future bid package for dirt to pave roads. District 6 - The remaining two roads are being planned for future bid. S. S. District 7 - Dorado, E. Rico, E. Suena, E. Tierra, Heard, N. Ives, Marlow, 3rd, Fairview, S. Robeson, Charlotte, S. Ballard, McFarland, Oak, Walnut, Clyde, E. Evans, Jarrott, Day, and Divine Streets were included in Bid 40-24/25 and approved on March 20th. District 8 - Projects are being scheduled for future delivery. The contract was issued for Briggs, Scriven, and Indian Roads. Construction is anticipated to begin by the end of April. Davis & Floyd received SCDOT encroachment permit for paving only. District 9 - Davis & Floyd is developing a future bid package for road resurfacing. According to CPST III Engineer Todd Warren, 207 of289 Road District projects have been completed. CPST III-A: District 1 -N. Floyd & Hagan were bid in January, approved in February, and construction is estimated to begin late spring once the contractor completes some open Florence County projects. in and District 2 = Franklin & Meritt Drive were bid in January, approved February, construction is estimated to begin once the contractor completes some open Florence County projects. District 4 -Sparks Road will be bid in the spring and will be packaged with Timmonsville resurfacing projects with CPSTIII. District 5 - E. Groom & Fowler Road will be bid in the near future. District 7 - Tara Village drainage improvements are being reviewed by engineers. McMillan Road will start late spring. E. Siesta Drive's scope may be reduced since piping and a portion of paving have occurred. The engineers are clarifying the new scope. E. Shenandoah Lane & parking is out for bid. District 8 - PO issued for Camelia & Congaree was approved on September 24th, and construction will begin once a current contract is complete. Montclair Way: SCDOT will require a signal; therefore, Alliance is creating the design and will resubmit to SCDOT for their approval. Municipal projects for Johnsonville, Coward, & Pamplico are currently being reimbursed as invoices are received. Parks & Recreation projects are underway. Departments: Engineering: O Took part in a meeting with the designers and builders of a proposed shopping plaza, which will include a Publix store and a Parker's Kitchen store. X Florence County Council Agenda April 17, 2025 Op Public Works Staffremoved the old "DuPont" sign on Hwy. 76 and moved it to storage at the Florence Industrial Park East at the request of Economic Development. Public Works staff coordinated with the Darla Moore Foundation, Lake City Police, and SCDOT to determine a temporary truck route plan to be implemented during the ArtFields festival in Lake City. EMD: Communications: Along with MCA, we visited each fire department throughout March. We flashed the existing APX portable radios, programmed the new APX mobile radios, and reprogrammed the existing APX mobile radios. MCA programmed and reprogrammed APX portable radios. In total, we touched approximately 930 radios. Planning & Zoning: FLATS: Hwy 327 & I-95 Interchange - SCDOT and FHWA approved the contract on April 3. A copy was delivered to Malloy McEachin for review and approval. Information Technology: Email: The florencecountyse.gov domain migration has begun and will be rolling out as department users have time. 14 departments have been completed. Parks & Recreation: ol DeWitt's BluffLanding Seawall (Landing closed 4/7/25, Project Start 4/8/25). ol Lions Park Multipurpose Building (Scheduled for completion in April 2025). Councilman Dorriety made the motion, and Councilman Moore seconded. Mr. Yokim stated Florence County, South Carolina is a body politic and corporate and a political subdivision of the State of South Carolina. The large chemical and "food" corporations have been addicting children for decades using techniques pioneered by tobacco companies. These hyperpalatable chemical compounds have led to innumerable, avoidable health problems for the employees, citizens, and residents of the county and harmed the social and economic welfare of the county. The County Council has determined that it is in the best interests of the residents, citizens, and visitors to retain attorneys for the purpose of seeking recovery on behalf of Florence County against, as determined by County Council > Kraft Heinz Company, Inc., Mondelez International, Inc., Post Holdings, Inc., The Coca-Cola Company, PepsiCo, Inc., General Mills, Inc., Nestle USA, Inc., Kellanova, WK Kellogg Co., Mars Incorporated, Inc., ConAgra Brands, Inc., Orangeburg Coca-Cola Bottling Co., Blenheim Bottlers, Inc., and/or any additional xi Florence County Council Agenda April 17, 2025 w parties approved by County Council believed to be responsible for improperly manufacturing, marketing, and/or distributing ultra processed foods. The County Council has determined that use of outside counsel is cost-effective, in the public interest, and necessary to pursue claims against the Defendants as there does not exist sufficient and appropriate legal and financial resources within the County Attorney's office to handle the Matter, and the time and labor required may necessitate the use of outside counsel. The County Council has determined that the Attorneys have the combination of skill, experience, resources, and competency necessary to represent the County. PRESENTATION OF FY2024 ANNUAL AUDIT Council Is Requested To Approve The Annual Comprehensive Financial Report (ACFR) For The Fiscal Year Ended June 30, 2024. Councilman Dorriety made the motion, and Councilman Bradley seconded. Mr. Yokim stated that the audit for the period ending June 30, 2024, has been performed by the firm of Mauldin and Jenkins. Grant Davis, partner with the firm, will present the audit to the Council. Grant Davis made the presentation to the Council on the audit. The motion was approved unanimously by all the members present. RECLASSIFICATION/SALARY ADJUSTMENTS Council Is Asked To Approve The Reclassification Of A Currently Occupied Legal Records Clerk IV (Hourly) Position Grade 11 To An Account Management (Hourly) Position Grade 16, A Legal Records Clerk IV (Hourly) Position Grade 11, To A Filing Management (Hourly) Position Grade 16. Councilman Caudle made the motion, and Councilman Dorriety seconded. Mr. Yokim stated this is a budget-neutral request. Our department has significant savings from the elimination ofa slot to accommodate this fiscal year. This would satisfy a huge department need in Family Court. Reclassifying this position will bring leadership to our Family Court Accounting Clerks and the Filing Clerks Division to the high standards we expect. No additional funding will be required; these salary adjustments will be funded from the current year's salary savings from the elimination of the slot. These changes are being made for additional work in the duties of the positions. These employees bring leadership to the Clerk of Court as they maintain the highest standards that we expect, coming from their experience. Significant salary savings will be realized from the elimination of the slot position. There is a savings of $9,395.74. Ashley Davison and Tenae Reaves support the reclassification of the positions and salary adjustments. The proposed change is budget-neutral and has been reviewed and approved by the Finance Director and Human Resources Director. The motion was approved unanimously by all the members present. BID NO. 25-24/25 Council Is Requested To Award Bid No. 25-24/25, District #4 Deer Road Water Main Extension Project To B&B Construction Company Inc. Of Sumter, In The Amount Of xii Florence County Council Agenda April 17, 2025 ny $1,549,483.34 (The Primary Bid Amount Of $1,501,871.86 And The Alternate #1 Bid Amount of $47,611.48) To Be Funded From SCIIP Grant #A-23-C071 Funds. (9 Bids Received). Vice-Chairman Yarborough made the motion, and Councilman Dorriety seconded. Mr. Yokim stated the bid was advertised in the South Carolina Business Opportunities (SCBO) Newsletter on February 17, 2025. The bid opening was held on March 20, 20254. Nine (9) bids were received and compliant; B&B Construction Company of Davis & Inc. was the lowest bidder. Todd Warren, CPST III, Program Manager Floyd, and Steve Allen, Public Works Director, recommend awarding B&B Construction Company Inc. The bid expires on June 20, 2025. The motion was approved unanimously by all the members present. OTHER BUSINESS: SOUTH BLUESTONE DRIVE- INFRASTRUCTURE Council Is Requested To Approve The Expenditure Of Not To Exceed $10,000.00 From Council District 4 Infrastructure Allocation Funds To Place 250 Tons Of MBC Stone On South Bluestone Drive. WATER TOWER- INFRASTRUCTURE Council Is Requested To Approve The Expenditure Of Not To Exceed $10,000 From Council District 2 Infrastructure Allocation Funds For Maintenance And Upkeep Of The Hyman Water Tank On Highway 51. Councilman Rodgers made the motion, and Councilman Dorriety seconded. The motion was approved by all the members present. DOWNS ROAD & TIMMONSVILLE HIGHWAY- INFRASTRUCTURE Council Is Requested To Approve The Expenditure Of Not To Exceed $2,700.00 From Council District 4 Allocations From The Infrastructure Fund. These Funds Were Needed To Replace A Storm Drain Culvert That Was Collapsing At The Intersection OfDowns Road And Timmonsville Highway. The Culvert Repair Was A Necessary Part Of The Roadwork.
