The tract could potentially have multiple users and buildings with intended uses such as data centers, e- commerce, and other related logistics uses. The purpose of the CP Brothers Planned Development District is to augment the current Agricultural Open and Single-Family Residential zoning districts by: 1) Assuming the Lanport Overlay, Business Park Sub-District regulations; 2) Adding Data Center as a defined permitted use; 3) Increasing the maximum allowable building height to 110 feet from the current 3-stories, as outlined in the Lanport Overlay; and 4) Providing a parking ratio consistent with a Data Center's working population. Pursuant to Section 14.1101 of the Lancaster Development Code (LDC), when reviewing a zoning change request for a planned development, there are nine (9) considerations that must be made when deciding on a planned development application. The following is an analysis of these considerations based upon the presented PD Concept Plan: Consistency with the City's Comprehensive Plan The City's Future Land Use Map of the Comprehensive Plan identifies this site as Private Open Space. The Private Open Space use category is not defined. However, private open spaces are usually owned and controlled by private entities such as homeowners associations (HOAs) or individual property owners. The primary purpose of private open space is to provide recreational, aesthetic, and functional benefits to the residents of a development or neighborhood. This can include areas like backyard gardens, courtyards, playgrounds, and other recreational amenities. This ownership gives them the authority to regulate access, use, and maintenance of the space. The intended industrial and data center uses are not consistent with the future land use. The applicant has requested a Plan Amendment (M25-17) to the Comprehensive Plan to change the land use designation to Logistics/Distribution. Proposed Uses, Development Densities, Intensities, and Development Regulations are Generally Consistent. The concept plan and uses are not in compliance with the Agricultural Open and Single-Family Residential regulations. The Agricultural Open base zoning district is used as a placeholder to reserve land in which the future growth of the City might occur. It is the intent of this district that agricultural land be held in its natural state until practical and reasonable growth occurs. AO only allows for a single-family dwelling on a minimum of 5 acres, and agricultural type uses. Additionally, SF-6 only allows for the development of a single-family dwelling. It should be noted, the proposed uses, building height, and parking ratio are consistent with the adjacent Planned Development, CP Belt Line North and CP Sisters The applicant proposes a maximum allowable building height of 110- feet. The Business Park Sub-district allows for 45-feet or 3-stories. The Planned Development request is compatible with developments that have recently been approved (CP Belt Line North, CP Belt Line South, CP, Sisters, QTS, and Bueller). The proximity to single-family uses are mitigated by strategically placing the building in the far east corner of the site, approximately 400- feet from the west property line along Lancaster Hutchins Road. A large open space area has been provided on the site to provide for a large buffer area between the residences and the proposed data center. Conform to the City's Thoroughfare Plan Lancaster Hutchins Road is a proposed four-lane Major Arterial Type B, requiring 100-feet of rights- of-way (ROW), and Greene Road is a four-lane Minor Arterial Type B, requiring 100-feet of ROW. At the time of platting, all applicable improvements will be dentified. Proposed Open Space Per section 14.101(b)(2)(A) of the Lancaster Development Code, "AI minimum of twenty percent (20%) of the gross land area within the entire PD District shall be devoted to open space". - At the time of site plan submittal, 20% open space will be required. Publicly Accessible Open Space Open space will be accounted for at the time of site plan submittal. Open space will be required to be accessible. Amenities A 10-to-12-foot trail has been identified along North Lancaster Hutchins Road as part of the City's Master Trail Plan, and called out in the conceptual plan. During the site plan phase, other amenities such as parks, gardens, bike paths, seating, trash receptacles, decorative ground pavers, and public art should be considered. In addition, a large open space area has been incorporated to provide for adequate buffering between the proposed data center and the existing homes. The change in land use designation would allow the zoning change to occur, and the 32.211 acre site would then be able to develop with data centers as proposed in the PD concept plan. Consistency with Area Development Patterns: The proposed land use designation is consistent with recent Planned Development approvals and the Lanport Overlay District located to the east of the subject site. These areas are intended for industrial, logistics, and distrbution-related uses, and the subject site serves as an extension of this development pattern. 2. Alignment with Adjacent Land Use Designations: The adjacent Aviation land use category supports flex industrialloffice, retail, civic and institutional uses, and parks. The proposed Logistics/Distribution designation complements and supports these uses, ensuring cohesive and compatible development in the area. 3. Land Use Transition and Buffering: The proposed development includes a large open space buffer between the planned data center and existing residential properties. This design consideration helps to mitigate land use conflicts and preserves some elements of open space consistent with the existing designation. 4. The attached ordinance increases the strength of force in the fire department from seventy-six (76) firefighters to eighty-five (85) firefighters in the fire department. There are no recommended changes to the current classification for the Police Department since adoption effective October 1, 2024. At the FY 2021-2022 strategic planning meeting, City Council recognized the tremendous growth that the south-eastern part of the city experienced. A priority of the City Council is to cultivate a healthy and safe community and ensure sound infrastructure. City Council incorporated the goal of planning for Fire Station No. 4 site selection and funding. This additional fire station will enable staff to better serve residents and respond to emergencies. In addition, it will serve the residents on the southeastern side of the railroad tracks. On August 12, 2024 City Council authorized the purchase of 601 E. Beltine as the future site for Fire Station No. 4. At the June 24, 2024 council meeting, the City Council approved the award of Bid RFP 2023-21 to Komatsu Architects for architectural and design services for Fire Station No. 4. It is anticipated the design phase will be completed, and the project will transition to construction by the first quarter of Fiscal Year 2026 with a completion date on or about the 4th quarter of Fiscal Year 2027. The additional nine (9) firefighters are part of the multi-year staffing plan for Fire Station No. 4 currently under design.
